Public Facility Project. Any Applicant who elects to construct a Public Facility Project or dedicate land for a Public Facility Project or who makes a proportionate fair share

payment consistent with County regulations adopted pursuant to Section 163.3180(16), Florida Statutes maybe eligible for a Credit for such contribution against Fees otherwise due but not against the service charge. To be eligible to apply for a Credit, the Public Facility Project must:

1. Be identified in the Capital Improvement Program of the County; or

2. Be identified through a joint resolution or interlocal agreement between the County and a municipality and be included in the municipalities Capital Improvement Program;

3. Be a requirement of a land use approval or developer agreement by the Board or a tri-party agreement between the Board, a municipality and a developer or related to a County requirement, or a Municipal requirement in written consultation with the County, connected with the issuance of a final engineering approval or permit to construct an offsite Public Facility Project, including:

a. The construction of an offsite public Park Improvement such as a boat ramp, a boat/canoe or kayak launch, a beach access connection, playground equipment, or recreational fields; or

b. The construction or widening of an off-site bicycle and pedestrian facility that connects a gap in the existing system, or connects the development with an adjacent bicycle or pedestrian facility, park, school, place of assembly, employment or retail center; or

c. The construction of an off-site turn lane or off-site round-a-bout at the intersection of a functionally classified collector or arterial road, per the Comprehensive Plan, that is either unrelated to the impact from the development activity constructing the improvement; or

d. The construction of an off-site turn lane or of-site round-a-bout at the intersection of a functionally classified collector or arterial road, per the Comprehensive Plan, that creates additional capacity for use by other others above and beyond that needed to accommodate the impact of the development activity constructing the improvement; or

e. The construction of a new off-site collector road or the widening of an off-site functionally classified collector of arterial road, per the Comprehensive Plan, that creates additional capacity for use by other development activity beyond that needed to accommodate the impact of the development activity constructing the improvement; or

f. The construction of an off-site transit shelter of transit (bus) bay / pull-off; or g. The construction of an off-site Public Facility Project deemed to create

additional capacity unrelated to the development activity approved by the County Engineer, and

4. Be a requirement of a land use approval or developer agreement by the Board or a tri-party agreement between the Board, a municipality and a developer or related to a County requirement, or a Municipal requirement in written consultation with the County, connected with the issuance of a final engineering approval or permit to construct or dedicate land for an on-site Public Facility Project, including:

a. Dedication of land for a public Park, Library, Fire Station or Sherriff substation;

or

b. Construction of a public Park, Library, Fire Station or Sherriff substation; or c. The widening of an existing paved shoulder or bike lane, that is four (4) feet or

less in width, to a buffered bike lane at least six (6) feet in width, a protected bike lane / cycle track or the widening of an existing sidewalk, that is five (5) feet or less in width, to an eight (8) foot wide path or a ten (10) foot or wider trail; or d. Dedication of right-of-way for a future roadway shown on the Comprehensive Plan Thoroughfare Map or a future bicycle and pedestrian facility shown on the Bicycle Master Plan that are not proposed for use by the Development or a requirement through an enforceable development order; or

e. Construction of a future roadway shown on the Comprehensive Plan Thoroughfare Map or a future bicycle and pedestrian facility shown on the

Bicycle Master Plan that are not proposed for use by the Development or are not a requirement through an enforceable development order; or

f. The construction of a future roadway shown on the Comprehensive Plan Thoroughfare Map proposed for use by the Development or required through a development order shall only receive credit for construction of the third and fourth through lanes, and associated right-of-way for said lanes, to the extent the Development does not consume all the capacity of the initial two through lanes. Should the Development consume the capacity of the first two lane and consume capacity of the third and fourth lane, then the credit shall be reduced per the percentage of the capacity consumed on the third and fourth lanes.

D. Improvements. The following are examples of the types of off-site or on-site

improvements for which credit is not provided, expect as provided for in Section VII A.

4. of this manual:

1. Privately owned parks and recreational facilities, even if said facilities are available to the public; or

2. Site-related turn lanes, round-a-bouts, traffic signals, or operational and safety improvements; or

3. Off-site extension of turn lanes, construction of turn lanes or round-a-bouts, traffic signals, or operational and safety improvements directly related and attributable to the demand from the development; or

4. The construction or upgrade of an off-site local road to a functionally classified collector of arterial road necessitated by the impact of the development or as required through a development order;

5. The construction of on-site sidewalks, paths and trails within, adjacent or along the development,

6. The construction of on-site bicycle facilities, paved shoulders or bike racks or lockers within, adjacent or along the development,

7. The construction of on-site internal roadways within, adjacent or along the development,

8. The construction of on-site transit stops and transit (bus) pull-out bays, E. Credit Determination

Credit shall be based upon the additional capacity created above and beyond that needed to accommodate the utilization of the capacity by the development activity.

1. For dedication of land and construction of a Public Park, the development activity shall receive Credit for the additional capacity provided based upon established level of service standards established based upon the amount of park capacity needed by the development activity divided by the capacity created by the construction of a Public Park.

2. For off-site turn lane improvements, round-a-bouts, new roads or widened roads, the development activity shall receive Credit for the additional capacity created from construction of the turn lane based upon a detailed traffic impact analysis.

3. For off-site turn lane improvements, the development activity shall receive credit for extending a turn lane to provide a turn lane for an adjacent development or providing a continuous turn lane beyond that needed for the development, which may have a gore or chevron, to eliminate roadway transitions. The credit shall be based upon the percentage of additional asphalt added to accommodate the turn lane extension above and beyond that needed to serve the development per FDOT Index 301 and Index 526, or other design criteria approved by the County Engineer.

4. For on-site roads shown on the County Thoroughfare Plan or Mobility Plan and included in the Capital Improvements Program, the first two lanes of the road are needed to accommodate traffic from internal development activity and no Credit shall be provided, except as provided for below:

a. Where right-of-way is provided to accommodate a four (4) lane divided road and only two lanes are needed for the development activity, then Credit shall be provided for the additional land needed to accommodate a four (4) lane divided road versus a two (2) lane divided road; or

b. If the trips from the development activity does not utilize more than the capacity created from the first two lanes, then the development shall receive Credit for construction of the third and fourth lanes on a four (4) lane divided road; or c. If the trips from the development activity does utilizes all the capacity created

from the first two lanes, then the development shall only receive Credit for the additional capacity created through construction of the third and fourth lanes;

or

d. Should the development activity consume all the capacity for a four (4) lane divided road, then the development activity shall only receive Credit from construction of the fifth and sixth lanes on a six (6) lane divided road.

e. Credit for right-of-way dedication shall only be provided for the additional land needed to accommodate a third and fourth lane or a fifth and sixth lane based upon the trips generated from the development activity.

f. Should the development activity consume a portion of the third and fourth lane of capacity, then the amount of the Credit for construction and right-of-way dedication shall be proportionate to the additional capacity created. For example, if trips from the development activity consumes 50% of the capacity created from the third and fourth lane, then the Credit will amount to 50% of the cost and value of the land dedicated.
