Terms of Reference (TOR) for hiring the services of a HR Agency for Uttar Pradesh Skill Development Mission
Back ground
The Government of Uttar Pradesh has approved Uttar Pradesh Skill Development Policy prepared by Vocational Education and Skill Development department. The objective of the policy is to integrate efforts of various departments of the State and Central Government organizations engaged in providing skill development training and make available employment oriented and placement linked training in vocational skills to 45 lakh youth in the age group of 14 to 35 years by 2016-17, and even at a greater pace thereafter, by partnering with government and private training providers, while ensuring equitable access to the most disadvantaged, including women; and strive for placement of preferably at least 70% of the trained youth in gainful wage and self-employment to enable them to contribute to the economic development of the State.
The Government of Uttar Pradesh has set up an autonomous society i.e. Uttar Pradesh Skill Development Society (UPSDS), under the aegis of Vocational Education Department, registered under the Societies Registration Act, 1860. The program is to be implemented in the state through a dedicated mission called Uttar Pradesh Skill Development Mission (UPSDM) controlled by Uttar Pradesh Skill Development Society (UPSDS). The mission will conduct trainings through six different centrally funded schemes namely NRLM, SJSRY, MSDP, SCA to SCSP, SDI, BADP, one fund under central act BOCW Cess Fund and state funded State Skill Development Fund.
The program will be implemented throughout the state of Uttar Pradesh, where dedicated state level and district level structure are required to be deployed to implement the program.
The terms and conditions for selection of staff has been described in the Rules/Regulations of UPSDS.
As UPSDM lays emphasis on promotion of ‘professionally competent and dedicated implementation structures’ at the state and district level for managing and supporting all Mission activities, the competent authority of the society has approved a set of 05 professional staff, whose services need to be hired immediately. The detailed job profile of these positions is given in Annexure 1.
The proposed professionals are expected to act as part of the SPMU to manage and
implement the skill development programme in the State. This could be possible only when
quality individuals are hired through a fair, transparent and meticulously designed
recruitment and selection process. In the backdrop of this, the Society needs the services of a HR Agency for recruitment of professionals in UPSDM.
Objectives of the assignment
Deployment of manpower for 10 positions at two levels, as per the Annexure 1.
Scope of Work
a) The primary role and responsibility of HR Agency will be the Screening, Recruiting and deployment of skilled human resource to UPSDM as per the defined parameters to serve the Mission purpose. For carrying this out, the Applicant will be deploying suitable qualified human resource based on the profiles mentioned in Annexure 1.
b) The human resource deployed by the HR Agency will be on the payrolls of the HR Agency and will be responsible for all the statuary compliances as per applicable law.
Agency will also be responsible to manage all staff related issues and oversee their performance, there will be no direct contracting obligations with UPSDM but for all operational purposes the human resource provided by the agency will be available on fulltime basis. Performance of human resource deployed by HR Agency shall be evaluated by UPSDM on a regular basis.
c) The HR Agency will ensure selection of only those candidates who fulfil the eligibility criteria prescribed for the task to be performed.
d) The search and selection process should continue till suitable manpower is found to the satisfaction of UPSDM. Under no circumstance will the selection requirements be diluted, since that will affect adversely the quality of the manpower to be placed.
e) All governance, monitoring and reporting aspect of human resource deployed under the assignment will be under the control and superintendence of the UPSDM.
f) Once the Staff is selected by UPSDM, the HR Agency would ensure that the staff reports for duty at UPSDM office within fifteen days.
g) The HR Agency shall ensure that all salaries and other benefits (if any) are paid to the staff on time as per Annexure 1. The Applicant shall also ensure that all statutory requirements of engaging the staff are met as per the law.
h) Replacement: In the rare case of a deployed staff leaving the HR Agency for any reason, the HR Agency shall be responsible to provide a suitable replacement (meeting all the eligibility criteria prescribed for the position) for any candidate leaving within 1 month from the date on which the deployed staff resigns. The replacement may be made either from the waitlisted pool or through conducting another round of selection process.
Addition or deletion in number of position may be possible as per the actual requirements
during the assignment period. This will be worked out mutually between the UPSDM and
the selected HR Agency.

The total duration of the Agreement will be for one year from the date of signing of contract.
However, it can be extended twice, one year at a time. In case, there is a direction otherwise from Government of India/State Government of Uttar Pradesh, the contract may be terminated before the stipulated agreement period.
Terms of Payment
1. The contract price shall include the monthly salary of the 10 no. of staff (i.e. INR 425,000) in addition to the monthly charge that the Applicant shall charge the UPSDM towards rendering the services contained hereinabove.
2. Payments shall be made on a monthly basis against the invoice submitted subject to the outsourced manpower (10 numbers as mentioned in Annexure 1) regularly attending office, discharging their routine and assigned functions and following the office decorum and discipline. The same has to be certified by the Mission Director.
3. In case, the outsourced manpower avails leaves beyond the permissible limits, the same shall be deducted at the following rates:
a. For Manager @ INR 3,000 per day
b. For Assistant Manager @ INR 2,000 per day

The Manpower Agency would also consolidate all the TA/DA expenses incurred by deployed staff and present an invoice for the same along with the invoice for the contractprice.The Manpower Agency would raise both these invoices by the 1st of every month for service provided by the deployed staff in the previous month. This would be approved and cleared by UPSDM within seven days (by 7th of every month), to enable the Manpower Agency to pay salaries (and reimburse their DA expenses) to deputed staff by the 10th of every month.
Earnest Money Deposit (EMD)
The Bidder shall furnish an interest free EMD of Rs. 20000 (Rupees Twenty Thousand only)
at the time of submitting the proposal in the form of a Demand Draft issued by one of the
Nationalized/ Scheduled Banks in India in favour of the “Uttar Pradesh Skill Development
Society” payable at Lucknow.
