Theadiustments envisaged
to
achievethis
are basedto
avery
large extent on thesolutions
adoptedfor
the Directive
onpublic
service contracts.In
particular,
the Directive
becomesfully
applicableto
services which are regarded astaking
priority
(e.g.
maintenance andrepair
services,
computerservices, advertising services,
certain finaneial
andfinancial
intermediationservices,
certain
R&Dservices,
architectural
and engineering services andcertain transport
and telecommunicationsservices),
since they are morelikely
to bethe
subiectof
transfrontier operations.
Non-priority
services(e.g.
hotelservices,
legal
services,
education and vocational educationservices,
socialservices,
etc.)
are subiectto
minimum retrospective transparency requirements.It
should be stressedthat
the opening-upof
Community service contractsin
the excluded sectorsto
persons providing services andto
tenders fromthird
countries
i.s accompanied by aprovision
allowing the Commi.ssionto
propose thatthe Council,

Council expressedits
satisfaction
at
the
considerable progress which hadbeen made
in
the
last
six
monthswith
the
amended proposalsfor
a
Regulation aÉdDirective
onthe Statute
for
a
European Company (SE).The Council noted
that
the greatmajority
of
delegations had adopted favourablepositions
on the basisof
the compromise proposals submitted by the Portuguese Presidencyfor
a numberof
key questions.Following
the
discussion, the Council concludedthat
the paceof
work could bekept up under the next Presidency
with
a viewto
adoptionof
a
commonposition
in
the near future
COPYRIGHT AND RELATED RIGHTS
The Council adopted
its
commonposition
with
a vierr,to
adoptionof
the Directiveon
rental
right
and lendingright
and oncertain
rights
related
to
copyright inthe
field of
intellectual
property.The
Directive
providesfor
an exclusiveright
enabling authors, performingartists,
producersof
phonograms and producersof
films to
authorizeor
prohibit
the
rental
and lendingof their
works, performances, phonograms andfilms;
MemberStates
will
be ableto
derogate fromthe
exclusive lendingright
under certain conditionslaid
downin
the
Directive.-6-The
Directive also
involves approximationof the
lawsof
the Member Statesconcerning
certain rights related to
copyright bydefining rights of fixation,
reproduction,distribution,
broadcasting and communicationto
thepublic for
the aforementioned categoriesof
person holdingrelated rights.
FUTURE SYSTEM FOR THE FREE MOVEMENT OF MEDICINAL PRODUCTS

Councillaid

guidelinesfor establishing the
futuresystem
of
authorizationof
medicinal productsin
the Community,including
aEuropean Agency which

be responsiblefor assisting

a Member State.Following the discussion, the Council noted considerable agreement on these proposals,
with the
exceptionof Article 8 of the Directive,

deadlines
for return,

wasnot
possiblefor
delegationsto

will

part

a
series
of
measures aimedat

every Communitynational
can havequalifications

another Member State recognrzed bythe
host MemberState.
Recognitionis
based on theprinciple
of mutualtrust,
without anyprior
co-ordinationof
the
typesof
training
for
the various professions concerned.The scope
of the Directive in principle
covers twolevels of
education ortraining,
namely higheror
post-secondary diplomas obtainedafter
a period ofless
than three years and secondary education diplomas, andalso

medicinal products.The Regulation
is
intendedto
improvelegal protection of
those medicinalproducts covered by a patent b,hose period
of
protecti.onis in practice
reduced bythe current
systemof
authorizationsfor
placing, on themarket.
That systemreduces the
protection actually
provided by the patentto
a period which rsinadequate
for
the purposeof
amortizationof
investmentsin
research, owing tothe
lengthof
time which elapses between the depositof
anapplication for
apatent
for
a new medicinal product and authorizationto
place such a product onthe market.
Through
the introduction of a
supplementarycertificate
whichwill
takeeffect
the momentthe
patentexpires, the
pharmaceuticalindustry in
the Member Stateswill
be placedin a similar position to that in certain third
