EXPLANATORY MEMORANDUM

1. In the first quater of this year the Commission, with the assistance of the

Economic Tariff Problems Group, examined all the requests submitted by the

Member States for temporary suspension of common customs tariff duties,

in-cluding requests for the prolongation of suspensions currently in force.

2. The proposal Tor aT Regulation for the suspension of autonomous common

customs tariff duties on agricultural products has already been forwarded

to the Council. The attached proposal covers products for use in the

con-struction, maintenance and repair of aircraft. The proposal concerning

other industrial products is being drawn up. It will shortly be sent to

the Council.

3. As in the case of agricultural products, the principle followed, when

examining the requests for suspension relating to aircraft, was to grant

total suspension where Community production of the product in question is

minimal or non-existent, and partial suspension where Community production

only partially caters for Community requirements. For the latter, the rate

of suspension varies according to the supply possibilities open to users

within the Community.

In this way, the Commission seeks to keep a balance between the interests

of producers, users and consumers.

Moreover, the need to safeguard jobs within the Community has been

con-stantly borne in mind.

4. Given the criteria listed above, the Commission feels that suspension of

duty is justified only for those products listed in the Annex to the

attached draft Regulation. In this specific case, is sought a pure and

simple prolongation of the suspensions currently in force.

5. As stated in Article 1 of the draft Regulation, the proposal will be valid

for a period of 12 months.

THE COUNCIL OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community, and in particular Article 28 thereof,

Having regard to the'proposal from the Commission,

Whereas production of the products referred to in this Regulation is at present inadequate or non-existent within the Community and producers are thus unable to meet the needs of user industries in the Community;

Where ;s it is in the Community's interest to suspend the autonomous Common Customs Tariff duties for these products completely;

suspension measures should be taken only temporarily, by fixing their period of validity by reference to the interests of Community production.

HAS ADOPTED THIS REGULATION:

Article 1

From 1 January to 31 December 1 9 9 0 the autonomous Common Customs Tariff duties for the products listed in the Annex shall be totally suspended, provided that the said products are intended, on conditions to be determined by the competent authorities, for the construction, maintenance and repair of aircraft.

Whereas, taking account of the difficulties involved in accurately assessing the development of the economic situation in the sectors concerned in the near future, these

This Regulation shall be binding in its entirety and directly applicable in all Member States.

1. The subject of the annexed draft proposal for a Regulation is the suspension

of the autonomous Common Customs Tariff duties for certain products intended

for the construction, maintenance and repair of aircraft as requested by

certain Member States.

2. In this manner, the needs of the user industries, including small and

medium-sized companies, will be met.
