OIL MARKEÎ AND lHE REFINING INDUSÎRY
Following an examination
of
the
Commission communication on recent developmentsand prospects
of
the
oil
market andthe
reflnlng
lndustry
in
the
Community, the Council adoptedthe fotlowing
conclusions:tilhe
Council:welcomes
the
CommisslonrsIndustry;
endorses
the
Commisslonts GuIfCrisis
and notes themaintalning supply;
communication on
the
Oil
Market andthe
Refiningview
that
markets workedefflciently
during the successof
the
Europeanoil
industry in
recognizes
that
the
existenceof
a
competitive Europeanrefining
industrycontributes
to
the
stability of
the marketsof
refined
products,to
thesecurity
of oil
supplyin
the
community andto its
energy independence;reaffirms the
importanceof
protection
of
the
environment, and endorses theCommissionts vlew
that
environmental issueswill
continueto
place a heavyburden on
the
o11lndustry.

Counciltherefore
invites
the Commission toconsult
fully
the industry
at
anearly
stagein
the
development ofenvironmental measures,
particularly
onthe cost implications
for
producers and consumers;agrees

objectivesof

energylmpllcations
of
the proposedintroduction
of
a
carbon dloxlde/energy tax.this
Communltystrategy
is
intendedto
stabilize
carbon dloxide emissions attheir
1990level
bythe
year 2000,in
orderto
counterthe
greenhouseeffect,
and consists
of
the followlng
four

the

marketin electricity

the following

Confirmedthe
importanceit
attachesto
the
completionof
the
Internal EnergyMarket.
Energyis
avital
componentin
the
economyof
the
Community andthe
energy sectorin aII of its
aspects must becomepart
of
the
SingleMarket.
It ls
thereforeessentlal
to
work towards more open, transparent,efficient
and competitiveelectricity
and gas markets,while
bearingin
mindthe
specificities
of electricity
andnatural
gas andthe
different
situatlons
in
Member States and white respecting theprinciptes
mentionedin
paragraphs 3 and 4;2.
Notedthat
the
directives
onelectricity
and gastransit
and pricetransparency are
a
§tep torÿardsthe
creationof
anInternal
Energy Marketbut
that
other
obstacles needto
be removed;3.
Agreedthat further
progress toh,ardsthe
completionof
the Internal
Marketshould respect
the following principles:
(a)
Securityof
supply: hasto
remain the basicobjective
of
energypolicy.
Member States shouldretain
the
ability to
safeguardsecurity
ofsupply,
lncluding the
abitity
(i) to
affect
the
choiceof
primaryfuels
for electricity
generation;(li) to
ensuresufficient
long-term investment sothat
adequatecapacity
is
available
to
meet demand, bearingin
mindthe
longread times
for
brlnging
on some typesof
new generation andtransmission
facilities ;
and(iii.)
to
maintainthe safety
andintegrity of
transmission anddlstribution
systemswhile
ensuring optimal dispatching ofgenerating plants;
(b)
Environmentalprotection:
should be maintainedat
ahigh
level.
Inparticular,
the
progressive harmonizationof
environmental standards inthe
energy sector shouldcontinue.
The compretionof
the
InternalMarket should be compatible
wlth
encouragementto
the
development of

the protection
of
small consumers: should be ensured andcross-subsidies
in
favourof
larger
customers prevented, whllemaintalning
public
serviceobligations

Member Statesto

parallel with
the
progressof
the
internal
market,ln
theelectricity
and gas markets;(e)
Implementatlon: the wide differences between andwithin
Member Statesexisting
energy systems should berecognized.
Member States shouldcontinue
to
choosethe structure
and instrumentsbest suited
to
their
own circumstances. Any new Communitylegislation
should be capable ofbeing implemented,
taking
accountof
the
speclfic situatlons In
MemberStates,
with
a minimumof
regulation;(f)
Transitional
arrangements: should besufflciently
longto
allow
for
eareful
planning and anorderly
adaptationwill
be required;4.
Notedthat
account should be takenof
significant
differeneesin
the
gas sector as comparedto
the
electriclty
sector,

particular:

significant part

Communityrs gas demandis

Notedthe
encouraging progress which has been madein
negotiatinga
Basic Agreement designedto put
the
commitments andprinciples
in
the
European EnergyCharter,
slgnedin
the
Hague on 17 December 1991,into a
legally
binding form;

Reaffirmed the highpriority
attached bythe
Lisbon European Councilto
thedeveropment
of
crose co-operationin
the
energy sector as avitar
contribution
to facilitating
and acceleratingthe
transition
of
the

central role
played by the Community and the Member States inthe

may need time
to
implementfully
