On the basls of lnformatlon provlded by the Presldency and the Commlssion, the Councll held an exchange of vlews on the toplcs whlch could be dlscussed at the meetlng of the European Councll on
27 and, 28 June 19BB ln Hanover.

B/14.vr.88SETTING UP OF A COURT OF FIRST INSTANCE
hlith the Presldent of the Court of Justlce, Lord MACKENZIE STEV{ART,
attending, the Councll examlned the questlons stl11 arislng with regard to the establ-ishment of a Count of Flrst Instance, the aim of which would be, on the one hand, to llghten the workload of the Court of Justice and, on the other hand, to make access to Justlce
easier by speeding up procedures. The questlons unresolved concerned,
in particular, the scope of that Courtrs Jurlsdlctlon.
In concludlng the dlscusslon, the Councll lnstructed the Permanent
Representatives Commlttee to contlnue 1ts work on the subJect, also 1n
the l1ght of the Oplnlons ar^raited from the European Parllament and
the Commlssion, with a view to reachlng a concluslon as soon as
possible.
APPOINTMENT OF JUDGES AND ADVOCATES-GENERAL AT THE COURT OF JUSTICE
The Conference of the Representatlves of the Governments of the
Member States dealt wlth certaln questlons arlslng 1n connection
wlth the appointment of 1O members of the Court of Justlce (7 Judges
and 3 Advocates-General), slnce the terms of offlce of the present incumbents explre on 6 October, and expressed lts determlnatlon to
reach a declsion on thls matter as soon as posslble.

B/T4.VI.BBCMEA - SIGNING OF THE JOINT DECLARATION
The Councll approved the substance of the Jolnt Declaratlon on the establlshment of offlclal relatlons between the EEC and the Councll
for Mutual Economic Asslstance and declded to proceed wlth lts signlng. The slgnlng ceremony wlll take place 1n Luxembourg on
25 June 1988.
On thls occaslon, the Councll was lnformed by the Commisslon that
certaln CMEA countrles had requested that offlclal relatlons be
established with the Communlty. It was agreed that the Communlty
procedure for thls purpose would be completed as soon as posslbIe.
NEGOTIATIONS ÿJ]TH HUNGARY
The Counel1 held an exchange of vlews on the progress of the
negotiatlons wlth Hungary on an Agreement on trade and commerclal. and economlc co-operatlon.
It defined certaln guldelines whlch should enable these negotlatlons
to reach an early and successful concluslon.

In the context of the preparatlon of the forthcomlng meetlng of EFTA Ministers and the Commlsslon to be held ln Tampere on
t5 June 1988, the Councll agreed to two Declslons, one of whlch concerns the negotlatlon of agreements wlth the EFTA countries
concernlng the establlshment of an exchange of informatlon ln the
field of technlcal regulatlons, and the other amends Protocol No 3
concerning the definitlon of the concept of rroriglnating productsrl and methods of admlnlstratlve co-operatlon 1n order to slmpllfy the
rules on cumulatlon.
RELATIONS ÿüITH THE GULF STATES
The Council decided to proceed wlth the slgnlng, subJect to its
concluslon, of the Co-operatlon Agreement between the EEC, on the one
hand, and the countrles partles to the Charter of the Co-operation
Council for the Arab States of the GuIf (the Unlted Arab Emlrates,
Bahrain, Saudl Arabia, Oman, Qatar and Kuwalt), on the other hand.
Thls Agreement will be slgned at Mlnlsterial leveI at 11.30 on ÿüednesday 15 June 1988 at the Klrchberg European Centre 1n
Luxembourg.

73/74.vr. 88RELATIONS hIITH THE ACP STATES: GUIDELINES FOR THE RENEhIAL OF THE ACP.EEC CONVENTION - CONCLUSIONS OF THE PRESTDENCY
The Council held an exchange of vlews on the guldellnes whlch the
Commlssi-on had proposed for the renewal of the Conventlon in 1ts
communciation of 25 March 1988, which was considered an excellent basis for the Councilrs proceedlngs on the subJect.
At the close of this exehange of views the Presldency drew the
following concluslons :
1. The Councll had a frank and frultfuL exchange of views on the
future ACP-EEC Convention. At the same tlme the Councll agaln acknowledged the paramount importance of the trend-setting
co-operation 1n the form of a partnershlp with these States wlthln the framework of the Lomé Conventions and conflrmed lts wil-l- to
continue thls co-operation. The Councll emphaslzes the lmportance
of human rlghts, wlthout respect for which the alms of the
Convention cannot be achleved.
It endorses the Commlssion I s view that the establlshed baslc
prlnclples, methods and mechanlsms of thls co-operation should be
maintained and, if necessary, consolidated.
At the same tlme the EEC and ACP States must look together for fresh anshrers to problems which have arisen or become more acute
since the Thlrd Conventlon was concluded. Thts means that there muSt be further dynamlc development of lmportant areas covered by the Conventlon.
Envlronmental- protectlon and demographlc development should also
be lncluded in 1t as new areas of co-operatlon.

/vr .BB2. The Councll discussed various indlvidual aspects of the new
Convention on the basis of the Commissj-on?s guidelines of
21 March 1988. Ï'Ihile some questlons sti1l have to be
considered in greater detail, a large measure of agreement
emerged on some lmportant points. Thls 1s partlcularly true as regards the need for greater support for the structural
adjustment measures of the ACP States in which the Communlty
must also particlpate 1n the future ln close co-ordination
wlth other donors, in particular the Bretton Vüoods organizatlons.
At the same tlme the characteristics of Community aid must be
maintalned. Thls al-so takes account of the difflcult lndebtedness
situation of many ACP States.
The Council referred ln thls connectlon to the recently adopted
special Community programme to aid heavily lndebted low-lncome
countries in Africa whlch have taken structural adjustment measures, and to its basic attltude, as set out in the Resol-ution of 31 May 1988, towards such measures.
3. The Council 1s ahrare that trade and export possiblllties are
of particul-ar lmportance for the economlc development of
the ACP States.
In view of the concern of the ACP States regardlng the mu1tilateral
trade negotlations in the framework of GATT, it reaffirms its
conviction that further l-iberalizaLj-on of world trade also
benefits the national economies of the ACP States. In the
negotiations the Communlty will heed the legitimate interests of its privileged partners and make every effort to ensure that other markets are al-so opened up to them to a greater extent.
The CounclL polnts again to the opportunltles which wl11 arise also for the ACP States from the completlon of the European
Internal Market durlng the period of validlty of the new
Convention.

4. The Councll welcomes the Commlsslonrs proposal for the prlvate
sector to be lnvolved to a larger extent 1n thls co-operatiorr and also shares the vlew that reglonal co-operatlon must be
improved in order to achieve greater reglonal economlc lntegratlon.
5. Both the Council and the Commiss j-on are of the oplnion that rro
approprlate declslons on the volume of financlng and the detail-ed arrangements for future ald can be taken until a very late stage 1n the negotiations.
6. The Councll would be prepared to consider a longer perlod of validity for these contractual relatlons if the ACP States so
desire.
The Council has noted wlth satisfactlon that the Commisslon lntends, ifl view of the dlscusslons hltherto wlth regard to the opening of the negotlatlons planned for the month of October 1988, to submit to it ln good tlme a proposal for the negotlatlng
directlves for dlscussion.
The Council- shares the Commlssionrs vlew that the European
Parliament should be closely assoclated wlth this process in
an approprlate manner.

The Councll completed the work of emiïodylng
conclusions of the European Council meetlng 12 February 1n Brussels.

thls meetlng concerning:
the system of the Communityts own resources;
budgetary diselpllne;
the reform of the Structural Funds. (1)
The consensus also extended to the fo11owlng texts:
the draft Regulation amendlng Regulatlon No l.8æ/78 on the general
rules for the financing of operations by the EAGGF Guarantee Sec t ion;
the draft Regulation amending Regulatton No 729/70 on the
flnanclng of the CAP;
the draft Dtrective on the harmonlzatlon of the definltions
of GNP at market prices;
the draft Regulatlon amendlng Flnanclat Regulation of
2l December 7977;
the draft Regulation on financlal support for Portugal for a
speciflc lndustrial development programme (PEDIP);
the draft Regulatlon on the granting of flnanclal compensatlon to Spain and Portugar rn vrew of urty r.iepr'ricrar,rorl crf ucr'uarll §t/ocKs of agrleul-t,rrraI products. on which the Council had already
reached consensus at its meetlng on 24 May 1ÿ88.
