Regulation (EEC) No 3584/73 of the Council, of 28 December 1973,

on the t~riff tre.:-~.tm10mt of certain products intended for use in

the construction, maintenance and repair of Rircraft (1), with,

in addition, Regulation (EEC) No 1522/74 of the Council, of 17 June 1974, on the tariff tree>.tm·:mt of certain products intended for use in the maint€nance and repair of aeroplanes of the types Mercure

and Airbus during 1974 (2), provided for either the total or the

partial suspension of the duties laid down in the Common ~ustoms

Tariff for a certain number of products which are intended ;

either to be incorporated in the construction of ~cro~lanes of

~n unl~den weight exceeding 15.000 kg of types whose manufacturing

-pro:grnmme had on 1 January 1973 pe.ssed the ini tie.l test flight st9.ge,

- or intended to be used for the maintenance. or repair of

aero-planes of an unladen weight ex~eeding 15.000 kg, or of aeroplanes

or helicopters of an unl8den weight exceeding 2.000 kg but not

e:x:oeeding 15.000 kg.. . .

These .suspension measures expire on 31 D3c.ember 1~74, and it becomes necessc..ry to de.fine, taking in particular into account

the new technic'al capabilities consequent on the enlargement of

the Qo~munity, the tariff treatment to be applied with effect from

that date. to products imported from third countries, both for the

construction of aircraft as well as for their maintenance and

repedr.

This then is the purpose of this draft Regulation which may be

summarised as follows

1. With l'e·gard· t'o the construction of aeroplanes of an unladen weight exceeding 15.000 kg, a new list has been prepared of

prod~cts eligible for duty-free admission. This list takes into

account the capabilities of the Community industry and the special

requirements of each type of aeroplene currently constructed in

-the Community. In consequence, duty-free admission is henceforth

limit~d so~ely to products necessary for the construction

ot

each particular type of aeroplane (Annex I).

This manner of pr~ng safeguards to the maximum the interests · of Oommunity producers of airor~ft materials and equipment for aeroplanes.

2. The same principles are followed in the preparation of the li~t

of products eligible for duty-free admission w~ich are intended to be

for tne maintenance or repair of aeroplanes of an un.

various above~mentioned tariff measures.to keep pace with such progress, e,nd take into account the technioa~ capa.bili ties of 'thi·s industry.

To this ·end, this draft Regulation serves to limit to.a relatively short period (one year) the application of the measures tor dU~Y-.. , free admission which it lays down.

Whereas the whole of these suspension measures will expire on

31

December

1974;

Whereas, having regard to the technical requirements associated

with the concept itself of aeroplanes currently constructed in

the Community, the suspension measures to be grQnted, counting

from l January

1975;

in respect of products intended for the

construction of aeroplanes of an unladen weight exceeding 15.~

kg,

require dtl!erentiation to be made according to the type to which the aeroplanes under consideration b~long, in order to take

account of, in each case, the cap~bilities of the Community

indu~try;

Whereas, in order to give full effect to the principles laid down

for suspension of common customs tariff duties in respect of

certain products intended tor the construction of aeroplanes of

an unladen weight exceeding

15.000

kg, it is equally necessary to

follow them to estnblish a·list of products admissible to suspension

of customs duties for the maintenance or the repair of aeroplanes

of the kind currently constructed in the Community; whereas

subject to account being taken of the current capacities of the

Community industry, it is moreover necessary that the arrangements

·be continued whereby users of aircraft of an unladen weight

exceeding l5POOO' kg constructed in third countrit>s or of which

the subse·quen~ construction in the Community has required a

considerable qua~ti~y of. products imported from third countries,

may obtain· supplies of products necessary for their maintenance

or their repair und~r suspension of common customs tariff duties;

Article 5 .

This Regulation shall enter into force on 1 January 1975 and

sh~ll ap:!_)ly until 31 December 1~75.

This Regulation shall be binding in its entirety and

directly applicable in all Member Sta·tes.·
