Customs Tariff for a certain number of products intended to be used for the maintenance or repair of aeroplanes of an unladen weight exceeding

th regard ·to the maintenance and repair of aeroplanes of this category which are constructed in the Corrmunity, the list of products admissible under this total or partial suspension is of greater importance when it concerns aeroplanes of types certified before 1 January

1974

(or of

versions of these types vrhich do not differ fUndamentally from the former) than when it concerns aeroplanes of types certified after this date.

During discussions which were held at Council level prior to the adoption

of the Regulation referred to above, it was apparant that aeroplanes of types 1\.ercure and Ail'bus1 for which the certification was made after

1 January

1974,

necessitated for their manufacture a certain number of

products imported from third countries which are not included in the list of producto admissible under suspension measures when thoy are intended for

maintenance or repair of aeroplanes of types certified after

1

January

1974•

This circumstance was covered in a statement written into the minutes of the meeting of the Council during which the Regulation in question was adopted.

This statement makes provision for "a supplementary list to be drawn up, at the earliest possible moment, of materials able to be imported under euspension of Cor.mon Customs Tariff duties when such products are intended for the maintenance and repair of aeroplanes of types constructed in the Community and certified after 1 January 1974".

This draft Regulation, which follows from the above mentioned statement,

completes the suspension measures laid down in Annex II., column 4 of

Regulation EEC n°

3584/73

for products intended to be used for the mainte-nance or repair of aeroplanes of types Eercure or Airbus. I

These measures, as those of Regulation ~ n°

3584/73

themselves, must terminate on 31 December

1974•

This draft Regulation, based on Article 28 of the EEC Treaty, does not

require the Opinion of the European Parliament 1 nor that of the Economic and Social Committee.

and, in particular, Article 28 thereof ;

Having regard to the draft Regulation submitted by the Commission,

ca-tegory manufactured in the Community, the 'list of products admissible

under this total or partial suspension is of greater importance when it

concerns aeroplanes of types certified before 1 January

1974

(or of

versions of these types which do not differ fundamentally from the former)

than when it concerns aeroplanes of types certified after thi~ date,

iJher~as it is laid down that aeroplanes of type Mercure and type Airbus

shall be certified during

1974;

whereas these aeroplanes currently require

in their construction a certain number of products imported from third

countries l'Thich do not appear in the list of suspensions relating to the

maintenance and repair of aeropl~es of t~~es certified after 1 January

1974;

wheroaa it thus seems possible to admit the said products under

total suspension if they are imported for the maintenance or repair of

the aeroplanes in question; whereas it is holiever necessary, in order to '-take account of the advances in the teclmical capabilities of the Communi t1 aircraft industry and Community aircraft equipment industries, to provide for the implemeniation of these measures only until

HAS IJX)PJ.'ED THIS REGULiiTION :

Article 1

1. The Common Customs Tariff duties on products listed in Annex to this Regulation shall, provided that such products arc intended to be used, under customs control, for maintenance or repair of aeroplanes of type Horcure or type Airbus, be suspended to the level indicated in column 3

of the said Annex.

2. The prov1s1ons of paragTaph 1 shall not preclude the gr~~ting, in respect of products listed in Annex II of Regulation {EEC) n°

3584/73

which are intended to be used under customs control for the maintenance or repair of aeropl~.nes of type !:ercure or type Airbus, of the suspension of Common Customs Tariff duties to the level indicated in column

4

of the said Annex, unless this level should be above that laid down in

column 3 of the Annex to this Re[~lation.

Article 2

This Regulation shall enter into force on
