Recommendation

Adopt Ordinance No. 19-02 entitled:

Background and Discussion

At the March 13, 2019, City Council regular meeting, the City Council introduced for first reading, read by title only, and waived further reading of Ordinance No. 19-02 (4-0-1-0; Mayor Holloway Abstained). Ordinance No. 19-02 will amend and restate the Rancho Santa Margarita Municipal Code Section 12.01.090 (Speed Limits) of Chapter 12.01 (General and Administrative Provisions) to Title 12 (Vehicles and Traffic) Pertaining to Updating Speed Limits based on Engineering and Traffic Survey (E& TS).

It is now in order for the City Council to adopt Ordinance No. 19-02.

Alternatives

1) The City Council could choose to deny the adoption of Ordinance No. 19-02 to amend and restate the Rancho Santa Margarita Municipal Code Section 12.01.090 (Speed Limits) of Chapter 12.01 (General and Administrative Provisions) to Title 12 (Vehicles and Traffic) Pertaining to Updating Speed Limits based on Engineering and Traffic Survey (E& TS).

2) To otherwise modify the code and provide direction to staff.

Fiscal Impact

There is no fiscal impact associated with the adoption of Ordinance No. 19-02. The revisions will be updated during the regular municipal code update process done through and budgeted within the City Clerk's department.

Background

Section 40802(a)-(c)(2)(b) of the California Vehicle Code (CVC) requires the City to perform Engineering and Traffic Survey (E& TS). updates every five to seven years in order to use radar or laser to enforce speed limits. The Orange County Sheriff's Department (OCSD) is unable to knowingly enforce speeds with the use of radar or laser without a valid E&TS that has been prepared in accordance with State laws and adopted, by ordinance, into the City's Municipal Code. The current E&TS were last updated in June 2012 and are set to be updated within seven years, or by June 2019. The City's Ordinance must be approved no later than seven years after the previously adopted Ordinance, which is set to expire in November 2019. Recognizing that the E&TS have a

limited seven-year shelf life with the currently posted speeds limits set to expire later this

year, staff is recommending a comprehensive update to the City's speed limit ordinance. Discussion

To assess the vehicle speeds it is helpful to first review the basic speed law. In California.,

the Vehicle Code (CVC 22350) defines the basic speed law as:

"No person shall drive

a

vehicle upon

a

highway at

a

speed greater than is reasonable or prudent having due regard for weather, visibility( the traffic on, and the surface and width of the highway, and in no event at a speed Which endangers the safety of persons or property.''

This law recognizes that driving conditions vary widely from time-to-time and place-to-place, and therefore, no set or fixed driving rules will adequately address all conditions.

Motorists will constantly adjust their driving behavior to fit the conditions encountered and

must learn to do this with a minimum of assistance from the police. The Basic Speed

Law is founded on the belief that most motorists can modify their driving behavior properly, provided they are aware of the conditions around them.

State Law requires that the City establish speed limits at or below the closest five-mile

per hour increment of the 85th percentile speed as determined by the E& TS. The 85th

percentile speed is the vehicle speed, at or below, which 85 percent of free-flowing traffic is travelling on a particular roadway segment. In cases in which the speed limit needs to be rounded up to the nearest five miles per hour increment of the 851h-percentile speed,

CVC Section 21400 permits the City to instead round down the speed limit to the lower five miles per hour increment. By way of example, .jf an engineering and traffic survey shows an 85th percentile speed of 37.6 mph, the posted speed limit may be rounded up

to 40 mph (the nearest five miles per hour increment); alternatively, the City could decide to round down to 35 mph. Staff has made every effort to round the speed limits down where possible.

Analysis

As shown in Attachment A, a review of the E&TS indicates that 28 of the 64 roadway segments require speed limit updates to continue enforcement using radar or laser.

Changes to the speed limits on the 28 roadway segments must be adopted by ordinance

by the City Council. The detailed E&TS worksheets for the 28 roadway segments

requiring a speed limit change are provided in Attachment B. The E&TS worksheets present the roadway segment limits, the existing posted speed limit, the 85th percentile speed, the average daily traffic volumes, accident history and summary of recommended

changes to the posted speed limits.

Changes to the posted speed limits are summarized on the following three tables. Table

1 lists the two roadway segments where the recommended (proposed) speed limit will be reduced by five miles per hour (mph).

Only one segment is proposed to increase by more than five mph. The proposed speed limit on Buena Suerte from Avenida de Las Flores to Santa Margarita Parkway is proposed to increase by 10 mph. A review of the detailed E& TS worksheet (Attachment B) for Buena Suerte (18) shows that this segment was previously posted at 35 mph from 2002 to 2010. Subsequently, the speed limit was reduced to 25 mph due to conditions present for the speed survey at the time.

-Environmental Impact

The recommended action is categorically exempt from the California Environmental Quality Act pursuant to the Class 1, Existing Facilities, exemption (14 Cal. Code Regs.

§

15301 ). This exemption applies to the operation of public facilities, including streets and highways, that involve no or negligible expansion of such facilities. In this case, the City is merely adjusting the speed limits on existing streets within the City. The City is not contemplating any actual physical improvements to widen or otherwise increase the capacity of these facilities.

Planning Commission Recommendation

Consistent with the duties, and responsibilities of the Planning Commission that include

review of traffic and transportation related issues, the Plannin~ Commission

recommended by a 4-0 vote that the City Council adopt the ordinance updating the speed limits. The Planning Commission communicated a general desire to maintain lower speed limits. However, a review of the 85th percentile speeds included in Attachment 8 shows that the recommend speed limits on these segments have already been rounded down to the lower five mph increment, and according to the CVC, the City "shall not

reduce the speed limit any further for any reason".

While the Planning Commission expressed concerns with the recommended speed limit increases on several segments, they specifically requested that staff explore potential

traffic calming measures on Avenida de Las Fundadores (Segment 13) near the Beach

Club. Based on this feedback from the Planning Commtssion, staff will explore potential

traffic calming measures such as intersection bulbouts at the all-way stop intersection of

Avenida de Las Fundadores and Via Recardo that may be included as part of a future

Capital Improvement Project (CIP).

Alternatives

The City Council may choose to:

1, Delay the adoption of the Ordinance updating speed limits based on the E&TS and

collect additional vehicle surveys at selected roadway segments to validate the recommended E& TS findings. Such delay would still require an Ordinance be considered and adopted no later than November 2019. This alternative is not recommended because State law requires that the City perform periodic speed surveys to continue to use radar or laser to enforce speed limits. Accordingly, the timely adoption of the attached Ordinance allows the Orange County Sheriff's Department to enforce speed limits on these roadway segments ih the City using

radar or laser. Furthermore, limited additional surveys have been conducted which

validate the recommendations.

2. Reject adoption of the Ordinance updating speed limits based on the E&TS. This alternative is not recommended because it would effectively negate any enforcement ability of posted speed limits throughout the City.

Conclusion

The E&TS typically have a shelf life of five to seven years; the current E&TS adopted by the City Council in 2012 are set to expire in June of this year, and the current Ordinance is set to expire in November 2019. While staff has made every effort to maintain lower speed limits, the posted speed limits are largely a function of state law for which the City

of Rancho Santa Margarita has little or no discretion. Staff recommends that the City

Council review and forward a recommendation to the City Council for adoption of the proposed Ordinance (Attachment C), updating speed limits established in the Rancho Santa Margarita Municipal Code pursuant to State law.

Fiscal Impact

The recommended action will require changes to approximately 60 speed limit signs. While many of these signs can be repurposed, staff estimates that as many as 30 new speed limit signs may be needed. In addition, the 35 mph pavement legends will need to

be removed on Esperanza from Avenida Empresa to Avenida de Las Banderas. It is

expected that this work effort will be performed under the existing PV maintenance contract with an estimated cost of approximately $3,500,

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO SANTA MARGARITA, CALIFORNIA, AMENDING AND RESTATING SECTION 12.01.090 (SPEED LIMITS) OF CHAPTER 12.01 (GENERAL AND ADMINISTRATIVE PROVISIONS) OF TITLE 12 (VEHICLES AND TRAFFIC) OF THE CITY OF RANCHO SANTA MARGARITA MUNICIPAL

CODE REGARDING SPEED LIMITS, INCLUDING AN EXEMPTION FROM THE CALIFORNIA ENVIRONMENTAL

QUALITY ACT (CEQA) PER CEQA GUIDELINES SECTION

THE CITY COUNCIL OF THE CITY OF RANCHO SANTA MARGARITA,

CALl FORNIA. DOES HEREBY ORDAIN AS FOLLOWS:

SECTION 1. The City Council of the City of Rancho Santa Margarita hereby finds, determines, and declares as follows:

California Vehicle Code Section 40803(b) provides, in pertinent part,

as follows:

"In any prosecution under this Code of a charge involving the speed of a vehicle where enforcement involves the use of radar or other electronic devices which measure the speed of moving objects the prosecution shall establish, as part of its prima-facie case, that evidence or testimony presented is not based upon a speed trap as defined in subdivision (b) of Section 40802."

B. Pursuant to California Vehicle Code Section 40802 vehicle speed limit enforcement involving the use of radar or other electronic device is

permissible and does not constitute a "speed trap" where the prima facie

speed limit is justified by an engineering and traffic survey conducted within five to seven years prior to the date of the alleged violation.

C. The City desires to continue to use radar and other electronic devises to measure the speed of moving objects to protect the lives and property of motorists traveling on City streets and to improve the enforcement of speed limits within the City of Rancho Santa Margarita.

D. The City has caused an Engineering and Traffic Survey for Speed Limits to be prepared in compliance with California Vehicle Code§ 40802 establishing and justifying prima-facie speed limits on certain City streets within the City of Rancho Santa Margarita, which is incorporated herein by reference.

E. Amendments to Rancho Santa Margarita Municipal Code Section 12.01.090 (Speed Limits) are necessary to ensure continued enforcement of vehicle speed limits in accordance with the California Vehicle Code.
