A

s if we have not had enough changes to the IHSS care delivery over the last few years, the new Governor’s budget proposals for the 2011-2012 state budget promise more cuts, more changes and more reason to work together with our Unions and other advocates to make sure that whatever happens, we take care of those most vulner-able Californians that depend on IHSS for their safety and well being.

Elsewhere in this newsletter you will find information regarding the changes that have already taken place and how you can best deal with them. Here, I will briefly discuss cuts and changes that have been proposed to begin July 1, 2011 and how you can get involved to help fight against them. THE CUTS THAT HAVE BEEN PROPOSED TO BEGIN JULY 1, 2011 INCLUDE:

• An additional 8.4% across the board cut to consumer hours; this is in addition to the 3.6% cut that was applied February 1. • Loss of all domestic and related services hours for any consumer who lives with ANYONE. Only consumers who live alone will keep their domestic and related ser-vice hours; Domestic and related serser-vices include: meal preparation and clean-up, housekeeping, laundry, food, shopping, and errands.

• Elimination of ALL homecare services for IHSS consumers who are unable to obtain a physician’s written certifica-tion that personal care services are necessary to prevent him/her from entering out-of-home care; at the same time, the number of doctor visits that Medi-Cal will pay for will be limited to 10 a year and there will be new co-payments on physician, clinic, and emergency room services. This means IHSS consumers could have to use one of their limited physician appointments AND pay a co-payment to obtain physician certification.

• Under current law, each county must have an IHSS Advisory Committee that consists of a majority of consumers of personal care for which there is state funding to support; the governor proposes to eliminate the funding, and make these boards voluntary – which will result in many counties eliminating these committees and the loss of a valuable source of input from consumers and providers. The IHSS Advisory Committee in San Bernardino is very active and provides important feed back that assists the County and the PA in planning how best to deliver services. 2s have been mailed out. If you have not received yours, contact your local IHSS office. You will need to pick it up in person and must present your photo ID. Beginning January 1, 2011, providers who did not complete the new provider enrollment requirements were terminated by the state. If you did not receive timesheets for the pay periods in January or you were given timesheets that were “Not valid”, you will need to contact IHSS to complete the enrollment process. Either you need to attend orientation, get fingerprinted, or both. Once the process has been completed and your paperwork is cleared, you will get paid retroactively.

appy New Year! 2011 brings many changes to the Criminal Background Investigation Unit. As of January 1st all providers are considered new. If a provider did not complete the enrollment requirements prior to December 31, 2010, he/she has been termi-nated and will not receive pay. In order to be re-employed as an IHSS provider and be paid by the IHSS program, he/she must complete all the enrollment requirements and be determined eligible as a new provider.

The list of disqualifying crimes has been expanded by the 2010-11 State budget act which will go into effect February 1, 2011 and shall apply to all new provider applicants and any applicant who previously was denied enrollment as a provider on the basis of a criminal conviction and for whom

providers an opportunity to get on the PA registry, we are waiving the 6 months experience requirement for providers who attend the Public Authority 10 topic caregiver training program. the training is FrEE to all who would like to attend. Public Authority registry is conducting a targeted recruitment and is accepting provider applications oNly from applicants that are fluent in English, have at least 6 months of homecare Experience and/or complete the 10 topic training course and are able to pass a background check. Need income verification for a loan, or maybe employment verification for a government agency? Then come by the Public Authority which is currently servicing all of San Bernardino County IHSS Providers with Income and Employment verifications. Although we are not your employer, we are your employer of record. We can verify your start date, income, end dates, proof of termination and give you a print out of your earnings broken down by paycheck.

Come by our office and put in a request; or FAX your signed request in to 909-891-9130 and within 72 hours you will have the information you requested.

WORKERS COMpENSATION

Workman's compensation is the exclusive remedy for workers who sustain occupational injury or illness. Workman's comp benefits are fixed by law. Any injury or illness that results from performing one's job or conducting an employer's business is eligible for workman's compensation. Call the Public Authority for assistance with setting up the initial treatment for your work related injury.

Worker’s Compensation benefits for IHSS workers are provided by State Compensation Insurance Fund but the Public Authority can assist you with your claim.

All claims must be reported within a reasonable timeframe so that we can appoint you with an initial evaluation with a Worker’s Compensation doctor in your area. Our objective is to assist you with receiving proper medical treatment along with attaining maximum medical improvement after your injury has occurred.

HEALTH BENEfITS

In November of 2010, the Union (SEIU) gave notice to us that their health coverage through the Trust would no longer be available effective Jan 1, 2011. Subsequently, all providers that previously received health benefits through the Trust have been transferred to the Select Benefits Plan as of January 1st, 2011.

The plan provides coverage for doctor visits, hospital services, and prescriptions. In order to be eligible to apply, data records must show that you have been approved and paid to work a minimum of 80 hours per month for two consecutive months, prior to the enrollment period and are working at the time benefits begin. You will continue to be eligible as long as you continue to work at least 80 hours per month.

You are not eligible if you have MediCal, Healthy Families, Healthy Kids or other health insurance. Not everyone who is eligible for health benefits will be enrolled. County funding is available only for a

limited number of slots. Providers with the most hours for the longest period of time will be given the highest priority. Those not receiving benefits will be placed on a waiting list, and applicants with the most hours for the longest period of time will be given the highest priority. If you did not enroll when you first became eligible you must wait for an open enrollment period; we will have an open enrollment soon so stay tuned for the dates. TRAINING

The National Caregiver Training Program is back and off to a great start. The 10 topic caregiver course is designed to help IHSS caregivers acquire the care giving skills they need to provide safe home care. You will receive detailed instructions on Caring for Someone on Bed Rest, Medication Management,

Vital Signs, Personal Care, Infection Control and many other key topics. You will receive a certificate of completion at the end of the course. Providers can enroll in the entire 10 topic course that meets once a week or enroll in a class of interest.

an appeal of the denial decision is pending on February 1, 2011. A new provider applicant is defined as an individual who has not completed ALL of the provider enrollment requirements and has not been enrolled as a provider prior to February 1, 2011. If you received a clearance letter prior to February 1, 2011 and did not complete IHSS Orientation prior to 2/1/11, your clearance letter is no longer valid. You DO NOT have to re-fingerprint, but you DO need to be reviewed under the new criteria.

The changes include identifying two different categories of crimes. The state calls them Tier 1 and Tier 2. In order to pass the criminal background check, an individual must not have been convicted of, or incarcerated following a conviction for, a disqualifying crime within the last 10 years.

TIER 1 LIST:

1) Fraud against a governmental health care or supportive services program;

2) Violation of subdivision (a) of Section 273a of the PC; or

3) Violation of Section 368 of the PC (abuse of an elder or dependent adult).

TIER 2:

Expanded list There are 4 pages of additional crimes on this list; you can obtain a copy of all these crimes by visiting the Public Authority, or by going to our website.

There have also been changes in regards to expungements. For more information on expungements, or obtaining a waiver or general exception for a TIER II crime please contact the CBI Unit at 1-866-985-6322 option 1 and ask for a CBI clerk.

Authority are partnering with San Bernardino County Animal Care & Control to assist them with getting more pets adopted and informing pet owners of their services.

The mission of the San Bernardino County Animal Care & Control Program is to prevent rabies in humans and pets, to educate the public about responsible pet ownership, including the importance of spaying and neutering, to protect and serve the public and pets by enforcing all laws and ordinances pertaining to Animal Care & Control, to care for all animals domestic and wild, to reunite lost pets with their owners, to place unwanted pets into new homes, and to maintain a high quality of service.
