SPECIFICATIONS, TERMS AND CONDITIONS FOR PAVING PROJECT

Sealed Bids

DUE DATE: Tuesday, June 21, 2016 3:00 pm

INSTRUCTIONS TO BIDDERS

Sealed bids will be received by the Shamokin Ares School District for the proposed paving project located at the Shamokin Area School District Facility. Sealed bids, which should be plainly marked, “Sealed Bid: Paving Project” will be received until 3:00 PM (prevailing time) on Tuesday, June 21, 2016, at the Business Office of the District, 2000 West State Street, Coal Township, PA 17866. All properly received bids will be publicly opened and read aloud the same day, June 21st at 3:15 pm in the district board room. The bid is scheduled to be awarded at the June, 2016 board meeting (tentatively scheduled for June 21,2016). Documents for the bid may be obtained from the District Business Office at the address described above between the hours of 8:00 and 3:30 p.m. Monday through Friday, excluding holidays, or via website www.indians.k12.pa.us or via email: dpetrovich@indians.k12.pa.us Technical questions on the project should be directed to Dave Petrovich, Facilities and Maintenance Manager, 570-259-1609.

SHAMOKIN AREA SCHOOL DISTRICT MISCELLANEOUS PROVISIONS FOR PAVING PROJECT SPECIFICATIONS

 All specifications shall be in compliance with current Pennsylvania and Federal requirements and standards for safety, if applicable.

 All bidders must complete the attached specifications. Each line requires a response stating the specifications proposed by the bidder. In the event that the specifications proposed by the bidder are exactly identical to specifications established by the School District, including brand name if given, the bidder may response with the phrase “No Exceptions”. In all other cases, and for all other brand name items, the bidder is required to provide written specification exceptions. Additional pages may be used if necessary.

 The terms, “No structural difference” or “We are equal to your proposed specifications” is not acceptable. It is the responsibility of the School District and their representative to determine if an exception is equal. Therefore, the bidder must provide detailed specification exceptions so that the District can make the necessary comparisons to reach the proper decision. Failure to comply will render the bid invalid for material non-compliance to our published specifications.  In the final determination made by the school board, it may be necessary for the bidder to

provide a sample for our inspection.

 Bidder will complete this project between the dates of July 1, 2016 and August 28, 2016.  All contractors must provide the appropriate clearances, including FBI for all workers who will

be on the premises.

 By law, tobacco use is prohibited on all district property, buildings and vehicles. Any individual who violates this law is subject to a $100.00 fine for each infraction.

 Any disputes arising under this contract shall be adjudicated in the Court of Common Pleas of Northumberland County, Pennsylvania.

 Predetermined Minimum Wage Rates

The following predetermined minimum wage rates shall be applicable to all work performed under this Contract:

Pennsylvania Prevailing Wage Rates secured from Department of Labor and Industry.

The Contractor and his Subcontractor (if applicable) shall be responsible for filing the weekly payroll certification. The form for this certificate follows the wage rates. The section entitled “Duties of Awarding Agencies Under Pennsylvania Prevailing Wage Act” is included under this section and can be found following the wage rates and the weekly certification form. The requirements of the Contractor (and his Subcontractor, if applicable) under this section are hereby incorporated into and made a requirement under this Contract.

 Insurance

The Contractor shall procure and maintain during the life of the Contract (until final payment has been issued) all of the insurances with the coverage’s and amounts as shown below and shall be responsible for procuring or having his subcontractors procure the required insurances of subcontractors in the same coverage’s and amounts as his own insurances, from an insurance company or companies properly licensed and satisfactory to the Owner.

a) Workmen’s Compensation and Employer’s Liability Insurance (1) Statutory:

Amounts and coverage as required by law. (2) Employer’s Liability: $500,000.00

b) Comprehensive General Liability Insurance including coverage for direct operations, sublet work, demolition and wrecking, elevators, and contractual liability with the limits not less than stated below:

(1) Bodily Injury Liability Including Personal Injuries: $1,000,000.00 each occurrence.

(2) Property Damage Insurance: $500,000.00 each occurrence $1,000,000.00 aggregate Delete exclusions.

c) Automobile Liability Insurance including coverage of owned, non-owned, and hired vehicles with limits not less than stated below.

(1) Bodily Injury Liability: $250,000.00 each person $500,000.00 each occurrence (2) Property Damage Liability: $100,000.00 each occurrence

d) Each Contractor shall secure and maintain Builder’s Risk Insurance in the amount of their Contract throughout the project until final acceptance by the Owner.

All insurances provided shall list the Owner and the Engineer as additional insured’s.

Disputes

Any disputes arising under this contract shall be adjudicated in the Court of Common Pleas of Northumberland County, Pennsylvania.

ELEMENTARY PAVING PROJECT GENERAL BID INFORMATION

The Board of School Directors of the Shamokin Area School District, 2000 West State Street, Coal Township PA 17866 are , requests sealed bids subject to the following conditions:

1. DUE DATE

All bids must be in the administration office of the Shamokin Area School District, on or before 3:00 pm prevailing time, on June 21, 2016.

A. Sealed bids will be opened in the Shamokin Area School District on June 21, 2016 at 3:15 p.m. Bid will be awarded (or rejected) at the regular scheduled meeting of the Board of Directors on June 21, 2016. If due to unforeseen circumstances, the meeting is rescheduled, the bids will be awarded at that next meeting.

2. BID IDENTIFICATION

Bids must be submitted in a sealed envelope that is properly marked “Sealed Bid: PAVING PROJECT”

3. STANDARD OF QUALITY

The description of items or reference to a manufacturer’s brand is furnished to define the quality desired. Items equal to or varying from those specified will be considered in all cases except where NO SUBSTITUTION is indicated. Hot mix asphalt Pavement design guide created by PAPA is provided.

4. BIDDING BLANK

All bids must be submitted on the bidding blanks provided with the unit price stated as requested. DO NOT CHANGE THE ARTICLE AND DESCRIPTION, THE UNIT OF MEASURE OR THE QUANTITY ON THE BIDDING.

Alternative bids must be made on a separate sheet similar to the one provided and attached to the regular bid blank.

5. SIGNATURE

Each bid must be signed in ink by the bidder. A duplicate set of specifications is enclosed for your file.

Bidders will be responsible for the accuracy of their bids including the extension of unit pricing to the total column. Amounts listed will be accepted as a firm bid and no subsequent

corrections on the part of the bidder will be accepted.

7. PRICE

Prices quoted herein shall not be withdrawn for ninety (90) days from the date of bid. Paving project is not to exceed $24,000.

8. BID BOND OR CERTIFIED CHECK

A bid bond or certified check for not less than 5% of the total bid is required. Unsuccessful bidders will have their bonds or checks returned immediately after bids are awarded.

Successful bidders shall have their bond or certified check returned after delivery of equipment has been completed. Project is not to exceed $24,000.

9. SCHOOL DISTRICT RIGHTS

The Board of Directors of the Shamokin Area School District reserves the right to reject any or all bids or any part of the bid which the Shamokin Area School District Board of Directors may decide to be in the best interest of the Shamokin Area School District.

10. BILLING

Invoices must correspond with Purchase Orders and MUST INCLUDE THE COMPLETE PURCHASE ORDER NUMBER.

SCOPE OF PAYMENT

Payment for the work done under this contract will be made at the unit prices bid, which prices shall include furnishing of all mob & demob, labor, tools, equipment, and materials required to

acceptably construct the various units, including but not limited to milling, saw cutting, excavation, backfilling, tamping aggregate, clean up, removing surplus materials, aggregate base course, temporary resurfacing, removal of existing pavement, restoring lawns, etc.

TACK COAT

A. Bituminous bonding material; Emulsified Asphalt, Class AE-T, or others as specified in PennDOT Pub. 408, PENNDOT’s Pavement Policy Manual (Publication 242)

JOINT SEAL COAT

A. Asphalt Cement, Class AC-20 Flexi-Fill #9075-R as per PennDOT Pub. 408, PENNDOT’s Pavement Policy Manual (Publication 242)

PREPARATION

A. Broom Clean all surfaces prior to the start of work.

B. Prior to the placement of the wearing course overlay the existing bituminous pavement shall be inspected for variation in grade and cracks.

C. All loose and scaling bituminous concrete, color surfacing material, dirt, oily materials, chemical residues, vegetable matter and miscellaneous debris of any matter shall be scraped and swept from the existing surface and cracks of the existing surface.

D. All cracks shall be scraped and swept clean with jet of compressed air into the opening and blowing all debris away. If vegetation is present, the existing cracks shall be treated with an approved herbicide. Wider cracks shall be cleaned by plowing out the dirt and other materials by use of tools.

JOINT SEALING

A. Upon completion of the paving operation, a bituminous seal coat application shall be sprayed or pour-applied to all points of jointure of existing and new paving so as to seal that joint. The width of such application shall be four inches (4") at joints and twelve inches (12") at curb lines. Seal coat material shall be spray-applied at the rate of 0.20 to 0.50 gallons per square yard.

A. In-place compacted bituminous paving will not be acceptable in exceeding the following Tolerances:

1. Thickness of Wearing Course: Not more than one-eighth inch (1/8”), plus or minus. 2. Thickness of Base Course: Not more than one-quarter inch (1/4”), plus or minus. 3. Wearing Course: Permissible variation from specified grade, not more than one eight Inch (⅛”) variation when measured with a ten-foot straightedge.

4. Base Course: Permissible variation from specified grade, not more than one-quarter Inch (¼”) variation when measured with a ten-foot (10’) straightedge.

ADDENDUM

The following Addendum, to be completed in full compliance with the instructions contained in the specifications set forth, shall constitute the sole exceptions to which the undersigned bidder has taken to the specifications of this bid. In every other respect the proposal submitted is made in full

conformity with the published specifications.

NOTARY PUBLIC MY COMMISSION EXPIRES INSTRUCTIONS FOR NON-COLLUSION AFFIDAVIT

1. This Non-collusion Affidavit is material to any contract awarded pursuant to this bid.

According the Pennsylvania Antibid-Rigging Act 73P.S. 1611 et.seq., governmental agencies may require Non-Collusion Affidavits to be submitted together with bids.

2. The member, officer or employee of the bidder who makes the final decision on prices must execute this Non-Collusion Affidavit and the amount quoted on the bid.

3. Bid rigging and other efforts to restrain competition, and the making of false sworn statements in connection with the submission of bids are unlawful and may be subject to criminal

prosecution. The person who signs the Affidavit should examine it carefully before signing and assure himself/herself that each statement is true and accurate, making diligent inquiry, as necessary, of all other persons employed by or associated with the bidder with responsibilities for the preparation, approval or submission of the bid.

4. In the case of a bid submitted by a joint venture, each party to the venture must be identified in the bid documents, and an Affidavit must be submitted separately on behalf of each party. 5. The term “complementary bid” as used in the Affidavit has the meaning commonly associated
