TERMS AND CONDITIONS IN RESPECT OF K11 Art Mall WHY SO MEME Lucky Draw
(23 July 2021 – 1 August 2021)
1 Applicable Activity
By participating in the activity organized by K11 Loyalty Program Limited (“KLUB 11”) as set out in paragraph 2 below (the “Activity”), a participant is deemed to have read, understood and agreed to the terms and conditions applicable to the Activity.
2 The Details of Activity
Activity: K11 Art Mall WHY SO MEME Lucky Draw
Activity Period: 23 July 2021 – 1 August 2021 (both days inclusive) (the “Activity Period”)
Prize Collection Period: 23 July 2021 to 5 September 2021 (both days inclusive) (the “Prize Collection Period”)
Redemption Hours: Monday to Sunday from 10:00am to 10:00pm during the Activity Period (the
“Redemption Hours”)
Redemption Location: Lucky Draw booth on G/F of K11 Art Mall (the “Redemption Location”)
Prize Collection Booth Opening Hours: Monday to Sunday from 10:00am – 10:00pm during the Activity Period (the “Prize Collection Hours”)
Prize Collection Booth Location: G/F, K11 Koncierge, K11 Art Mall (the “Prize Collection Booth”)
During the Activity Period, KLUB 11 Members (“Members”) whose same-day spending at K11 Art Mall reaches the following designated amount (“Designated Spending”) may redeem a lucky draw token (“Lucky Draw Token”) on the same date of the Eligible Transaction (as defined under paragraph 5.1.2 below). Members must insert the Lucky Draw Token into the capsule machine for the Lucky Draw (“Capsule Machine”) on the date of purchase and the Capsule Machine will randomly dispense a Gashapon capsule. The Gashapon capsules contain a slip bearing the description of the Lucky Draw Prize (“Prize Slip”), and Members can collect designated Lucky Draw Prizes as set out under Appendix 1 (“Lucky Draw Prize(s)”) during the Prize Collection Period, subject to these Terms and Conditions.
Same-day spending is calculated based on a maximum of four (4) Eligible Receipts (as defined in paragraph 5.1.1 below) from at least 2 different Participating Merchants (as defined in the KLUB 11 Loyalty Programme Terms and Conditions) in K11 Art Mall, excluding any spending by K Dollar(s) and/or K11 gift voucher(s).
Members must register their Eligible Transaction(s) with the relevant Eligible Receipt(s) together with the corresponding Electronic Payment slip(s) in person at the Redemption Location in order to redeem the Lucky Draw Token during the Redemption Hours on the date of the relevant Eligible Transaction(s).

3 Lucky Draw Token Redemption Restriction
3.1 During the Activity Period, each Member is only entitled to redeem a maximum of 3 Lucky Draw Tokens per day.
3.2 The redeemed Lucky Draw Token(s) are non-refundable, non-returnable, non-transferable and will not be re-issued, exchanged or honoured if found defaced, damaged, replicated, or lost/stolen.
4 Results of the Activity and Collection of Lucky Draw Prize(s)
4.1 Each Member must collect the Lucky Draw Prize(s) in person by presenting the Gashapon capsule(s) and the Prize Slip together with a valid KLUB 11 membership card as shown on his/her “K11 HK” Mobile App (“K11 App”) to our staff at the Prize Collection Booth on the day of purchase. Any uncollected Lucky Draw Prize(s) will be deemed as forfeited after expiry of the Prize Collection Period, i.e. 5 September2021.
4.2 Use of the Lucky Draw Token(s) shall be subject to these Terms and Conditions. EachGashapon capsule and the corresponding Prize Slip can only be used for redemption once and will be collected by our staff upon collection of the Lucky Draw Prize(s).
4.3 The Lucky Draw Prize(s) of the Activity are in forms of K Dollars or physical gift(s) as set out in Appendix 1 of these Terms and Conditions. For Lucky Draw Prize(s) that is in form of K Dollars, it will be awarded in the form of KLUB Points in accordance with the Member’s membership tier at the time of registration of the relevant Eligible Transaction.
4.4 The Lucky Draw Prize(s) in form of KLUB Points will be credited to each Member’s e-Wallet within the K11 App on the date of collection of the Lucky Draw Prize and such KLUB Points will expire on 31 December 2021.
KLUB 11 is not responsible for any loss of value due to possible change of the KLUB 11 membership tier at the time of actual usage of K Dollar(s) under the Lucky Draw Prize. Lucky Draw Prize(s) in form of physical gift(s) shall be collected in accordance with paragraph 4.1. If the Lucky Draw Prize is not collected within the Prize Collection Period, such Member shall be deemed to have disclaimed his/her entitlement to the same and no compensation shall be made by KLUB 11.
4.5 Event end notice will be announced in Sing Tao Daily and The Standard on 9 August 2021. By participating in this Activity, participating Members agree and consent to KLUB 11 announcing the participating Members’
names publicly as aforesaid.
4.6 By participating in this Activity, participating Members are deemed to agree and consent to KLUB 11:
4.6.1 using their personal information for purposes relating to this Activity; and
4.6.2 disclosing their personal information to relevant merchant(s)/ provider(s) for Lucky Draw Prize(s) redemption purposes and on a need-to-know basis only.
5 Special Terms and Conditions applicable to the Activity 5.1 Terms Used
5.1.1 “Eligible Receipt” means an original machine-printed receipt issued by a Participating Merchant at K11 Art Mall on the date of an Eligible Transaction. KLUB 11 does not accept any photocopies or hand- written receipts and reserves the right not to accept any receipts that KLUB 11 suspects to be invalid, forged or issued not for genuine transactions or on other grounds without any need for explanation.
5.1.2 “Eligible Transaction” means a consumer transaction made by Electronic Payment between a Member and a Participating Merchant at K11 Art Mall but excludes:
(a) Any spending paid by cash;
(b) Any single spending below HK$50;
(c) Purchase of any kinds of membership(s);
(d) Purchase of pre-paid items, cash vouchers, gift cards or coupons, stored value cards or pre- paid cards
(e) Purchase of show/event/exhibition tickets;
(f) Payments using K Dollars and/or K11 physical or electronic gift vouchers;
(g) Adding value to Octopus cards, stored value cards or pre-paid cards;
(h) Currency exchange;
(i) Any transactions at Hyatt Regency Hotel, K11 ARTUS, K11 Atelier (including Victoria Dockside &
King’s Road) and Rosewood Hong Kong;
(j) Any transactions at Victoria Playpark, D Mind & the Prince and Yan Toh Heen;
(k) Any online transactions with Participating Merchants;
(l) Any bank transactions;
(m) Charity donations;
(n) Any bill payment (including but not limited to payment of telecommunication or utility bills);
and
(o) Any other transaction between the Member and any Participating Merchants of K11 Art Mall as specified by KLUB 11 from time to time (with or without prior notice);
(p) Any course or event provided or hosted by K11 Kulture Academy; and
(q) Any transactions on K11 ESHOP, Food Ordering via ‘K11 HK’ Mobile App or any online platform
of any merchants of K11 Art Mall.
5.1.3 “Electronic Payment” means transaction by credit cards, debit cards, Android Pay, Apple Pay, EPS, Samsung Pay, WeChat Pay, Tap & Go, Alipay payment slip, Quick Pass and Octopus cards.
5.1.4 Other terms not defined in these Terms and Conditions shall have the same meanings as defined in the KLUB 11 Loyalty Programme Terms and Conditions.
5.2 Copying Eligible Receipts
KLUB 11 has the right to make an electronic copy of each Eligible Receipt presented to KLUB 11 in the course of redemption and keep the electronic copies for auditing purposes.
5.3 Marking on Eligible Receipts
KLUB 11 has the right to make any marks on each Eligible Receipt presented to KLUB 11 in the course of redemption. The Eligible Receipt marked by KLUB 11 cannot be used again for redeeming gifts or offers from other promotions.
5.4 Verification of Identity
Member shall present his or her valid membership card for inspection at the time of redemption.
5.5 No Exchange
The Lucky Draw Token(s), Gashapon capsule(s), the Prize Slip(s) and/or the Lucky Draw Prize(s) cannot be exchanged for cash, goods, other prizes or services in kind. The Lucky Draw Prize(s) are subject to applicable terms and conditions of the relevant merchant(s)/ provider(s).
5.6 No Warranty
KLUB 11 is not the provider of the products and/or services to be redeemed under the Activity (except K Dollars) and makes no representation or warranty in relation to the same. KLUB 11 shall not be liable for any loss or damage whatsoever or for personal injury which is suffered or sustained, as a result of taking or using any such services or products, except for any liability which cannot be excluded by law.
5.7 No Liability
KLUB 11 does not warrant that the Lucky Draw Prize(s) are of any merchantable quality or fit for any purpose, KLUB 11 disclaims all liability in relation to the Lucky Draw Prizes (except K Dollars). The participants in the Activity shall waive all his/her rights and interest, if any, of any nature to pursue against KLUB 11.
5.8 Exclusion of the Employees of Merchants and K11
To ensure fairness, the employees of K11 and the staff of the Participating Merchants in K11 Art Mall who are wearing company uniform or wearing their staff card at the material time cannot participate in the Activity.
6 General Terms and Conditions applicable to the Activity 6.1 Privacy Policy

6.2 Interpretation
KLUB 11 has the right to interpret these terms and conditions. In case of disputes, the decision of KLUB 11 will be final and binding on all parties concerned.
6.3 English Version Prevails
The Chinese version of these terms and conditions are for reference only. In case of discrepancies between the provisions of the English version and the Chinese version, the English version will prevail.
6.4 Governing Laws
These Terms and Conditions shall be governed by the laws of Hong Kong Special Administrative Region.

4.1 Each Member must collect the Lucky Draw Prize(s) in person by presenting the Gashapon capsule(s) and the Prize Slip together with a valid KLUB 11 membership card as shown on his/her “K11 HK” Mobile App (“K11 App”) to our staff at the Prize Collection Booth on the day of purchase. Any uncollected Lucky Draw Prize(s) will be deemed as forfeited after expiry of the Prize Collection Period, i.e. 5 September2021.
4.2 Use of the Lucky Draw Token(s) shall be subject to these Terms and Conditions. EachGashapon capsule and the corresponding Prize Slip can only be used for redemption once and will be collected by our staff upon collection of the Lucky Draw Prize(s).
4.3 The Lucky Draw Prize(s) of the Activity are in forms of K Dollars or physical gift(s) as set out in Appendix 1 of these Terms and Conditions. For Lucky Draw Prize(s) that is in form of K Dollars, it will be awarded in the form of KLUB Points in accordance with the Member’s membership tier at the time of registration of the relevant Eligible Transaction.
4.4 The Lucky Draw Prize(s) in form of KLUB Points will be credited to each Member’s e-Wallet within the K11 App on the date of collection of the Lucky Draw Prize and such KLUB Points will expire on 31 December 2021.
KLUB 11 is not responsible for any loss of value due to possible change of the KLUB 11 membership tier at the time of actual usage of K Dollar(s) under the Lucky Draw Prize. Lucky Draw Prize(s) in form of physical gift(s) shall be collected in accordance with paragraph 4.1. If the Lucky Draw Prize is not collected within the Prize Collection Period, such Member shall be deemed to have disclaimed his/her entitlement to the same and no compensation shall be made by KLUB 11.
4.5 Event end notice will be announced in Sing Tao Daily and The Standard on 23 August 2021. By participating in this Activity, participating Members agree and consent to KLUB 11 announcing the participating Members’
names publicly as aforesaid.
4.6 By participating in this Activity, participating Members are deemed to agree and consent to KLUB 11:
4.6.1 using their personal information for purposes relating to this Activity; and
4.6.2 disclosing their personal information to relevant merchant(s)/ provider(s) for Lucky Draw Prize(s) redemption purposes and on a need-to-know basis only.
11 Special Terms and Conditions applicable to the Activity 5.1 Terms Used
11.1.1 “Eligible Receipt” means an original machine-printed receipt issued by a Participating Merchant at K11 Art Mall on the date of an Eligible Transaction. KLUB 11 does not accept any photocopies or hand- written receipts and reserves the right not to accept any receipts that KLUB 11 suspects to be invalid, forged or issued not for genuine transactions or on other grounds without any need for explanation.
11.1.2 “Eligible Transaction” means a consumer transaction made by Electronic Payment between a Member and a Participating Merchant at K11 Art Mall but excludes:
(a) Any spending paid by cash;
(b) Any single spending below HK$50;
(c) Purchase of any kinds of membership(s);
(d) Purchase of pre-paid items, cash vouchers, gift cards or coupons, stored value cards or pre- paid cards
(e) Purchase of show/event/exhibition tickets;
(f) Payments using K Dollars and/or K11 physical or electronic gift vouchers;
(g) Adding value to Octopus cards, stored value cards or pre-paid cards;
(h) Currency exchange;
(i) Any transactions at Hyatt Regency Hotel, K11 ARTUS, K11 Atelier (including Victoria Dockside &
King’s Road) and Rosewood Hong Kong;
(j) Any transactions at Victoria Playpark, D Mind & the Prince and Yan Toh Heen;
(k) Any online transactions with Participating Merchants;
(l) Any bank transactions;
(m) Charity donations;
(n) Any bill payment (including but not limited to payment of telecommunication or utility bills);
and
(o) Any other transaction between the Member and any Participating Merchants of K11 Art Mall as specified by KLUB 11 from time to time (with or without prior notice);
(p) Any course or event provided or hosted by K11 Kulture Academy; and
(q) Any transactions on K11 ESHOP, Food Ordering via ‘K11 HK’ Mobile App or any online platform
of any merchants of K11 Art Mall.
11.1.3 “Electronic Payment” means transaction by credit cards, debit cards, Android Pay, Apple Pay, EPS, Samsung Pay, WeChat Pay, Tap & Go, Alipay payment slip, Quick Pass and Octopus cards.
11.1.4 Other terms not defined in these Terms and Conditions shall have the same meanings as defined in the KLUB 11 Loyalty Programme Terms and Conditions.
5.2 Copying Eligible Receipts
KLUB 11 has the right to make an electronic copy of each Eligible Receipt presented to KLUB 11 in the course of redemption and keep the electronic copies for auditing purposes.
5.3 Marking on Eligible Receipts
KLUB 11 has the right to make any marks on each Eligible Receipt presented to KLUB 11 in the course of redemption. The Eligible Receipt marked by KLUB 11 cannot be used again for redeeming gifts or offers from other promotions.
5.4 Verification of Identity
Member shall present his or her valid membership card for inspection at the time of redemption.
5.5 No Exchange
The Lucky Draw Token(s), Gashapon capsule(s), the Prize Slip(s) and/or the Lucky Draw Prize(s) cannot be exchanged for cash, goods, other prizes or services in kind. The Lucky Draw Prize(s) are subject to applicable terms and conditions of the relevant merchant(s)/ provider(s).
5.6 No Warranty
KLUB 11 is not the provider of the products and/or services to be redeemed under the Activity (except K Dollars) and makes no representation or warranty in relation to the same. KLUB 11 shall not be liable for any loss or damage whatsoever or for personal injury which is suffered or sustained, as a result of taking or using any such services or products, except for any liability which cannot be excluded by law.
5.7 No Liability
KLUB 11 does not warrant that the Lucky Draw Prize(s) are of any merchantable quality or fit for any purpose, KLUB 11 disclaims all liability in relation to the Lucky Draw Prizes (except K Dollars). The participants in the Activity shall waive all his/her rights and interest, if any, of any nature to pursue against KLUB 11.
5.8 Exclusion of the Employees of Merchants and K11
To ensure fairness, the employees of K11 and the staff of the Participating Merchants in K11 Art Mall who are wearing company uniform or wearing their staff card at the material time cannot participate in the Activity.
12 General Terms and Conditions applicable to the Activity 6.1 Privacy Policy

6.2 Interpretation
KLUB 11 has the right to interpret these terms and conditions. In case of disputes, the decision of KLUB 11 will be final and binding on all parties concerned.
6.3 English Version Prevails
The Chinese version of these terms and conditions are for reference only. In case of discrepancies between the provisions of the English version and the Chinese version, the English version will prevail.
6.4 Governing Laws
These Terms and Conditions shall be governed by the laws of Hong Kong Special Administrative Region.

1 適用活動
每位參與 K11 Loyalty Program Limited（「KLUB 11」）舉辦下述第 2 條的活動（「活動」）的參與者將被視為 已閱讀、理解及同意適用於活動的條款及細則。

活動期: 2021 年 7 月 23 日至 2021 年 8 月 1 日(包括首尾兩天) ( 「活動期」)
禮品換領日期: 2021 年 7 月 23 日至 2021 年 9 月 5 日(包括首尾兩天) (「禮品換領日期」) 換領時間: 活動期內星期一至日上午 10 時至下午 10 時( 「換領時間」)
換領地點: K11 Art Mall 地下之抽獎攤位 ( 「換領地點」)
禮品換領處開放時間: 禮品換領日期內星期一至日上午 10 時至下午 10 時(「禮品換領時間」) 禮品換領處地點: K11 Art Mall 地下禮賓部 (「禮品換領處」)
KLUB 11 會員(「會員」)活動期內於 K11 Art Mall 同日消費滿以下指定金額（「指定消費金額」）可於合格 交易當日(定義見第 5.1.2 條款)換領指定抽獎代幣(「代幣」) 並必須於交易當日以代幣參與抽扭蛋乙次。扭 蛋機將隨機發放扭蛋乙個。扭蛋內附有中獎禮品的說明紙條（「該紙條」），會員須於禮品換領日期內領 取列於附件一的指定抽獎禮品(「抽獎禮品」) ，活動受條款及細則約束。
同日消費是根據由不多於 4 張合格收據(定義見第 5.1.1 條款)計算（當中至少由 2 間不同 K11 Art Mall 的參 與商戶(定義見 KLUB 11 會員獎賞計劃條款及條件)發出），以 K Dollar 及/或 K11 禮券作消費之金額除外。
會員須於有關合格交易當日親身攜同合格收據及相關電子貨幣付款存根於換領時間內到換領地點登記合 格交易，方可換領代幣。

3 代幣換領限制
3.1 活動期間，每位會員每天只可換領最多 3 個代幣。

4 換領抽獎禮品及抽獎結果公佈
4.1 會員必須於禮品換領日期內，親身於禮品換領處向我們的員工出示扭蛋及該紙條之正本及其「K11」
流動應用程式內之有效 KLUB 11 電子會員卡，方可領取抽獎禮品。禮品換領日期過後(即 2021 年 9 月
5 日)，任何沒有被領取之抽獎禮品會被視作無效。
4.2 代幣之使用受本條款及細則約束。每個扭蛋及該紙條只可以用作換領抽獎禮品一次，並於換領抽獎 禮品後被我們的員工收回。
4.3 列於附件

之抽獎禮品將以 K Dollars 或實體禮物的形式送出。若抽獎禮品為 K Dollars，K Dollars 將根 據會員於登記有關合格交易時之會藉等級送贈相應之 KLUB 積分數量。4.4 以 K Dollars 形式送出之抽獎禮品將會於領取抽獎禮品當日記入會員帳戶，而該些 K Dollars 將於 2021 年 12 月 31 日過期。KLUB 11 將不會為任何於換領或實質使用 K Dollar 抽獎禮品當時，因會籍等級轉 變而可能引致的損失負上任何責任。以實質禮品形式送出的抽獎禮品將根據第 4.1 條款之方式領取，
若抽獎禮品於禮品換領日期內沒被領取，該會員準備視作放棄其領獎資格，KLUB 11 將不作任何賠償。
4.5 活動完結通知將 2021 年 8 月 9 日於星島日報及英文虎報刊出。
4.6 每位參與活動的會員將被視為同意 KLUB 11:
4.6.1 使用其個人資料用作與活動相關之用途;及
4.6.2 按需知密原則披露其個人資料予有關商戶/提供商作換領抽獎禮品之用途。
5 適用於活動的特別條款及細則
5.1 定義
5.1.1 「合格收據」是指 K11 Art Mall 的參與商戶於合格交易當日發出的一張機印收據正本。KLUB 11 不接受任何影印或手寫的收據或支付憑據。KLUB 11 有權拒絕接受任何懷疑是無效的、偽造的 或虛假交易產生等原因的收據或支付憑據，且毋須作任何解釋。
5.1.2 「合格交易」是指任何會員與 K11 Art Mall 的參與商戶之以電子貨幣付款的交易，但不包括:
a) 以現金支付的交易；
b) 單筆支出低於港幣 50 元；
c) 購買任何種類的會籍;
d) 購買預付產品、現金券、禮品卡或優惠券、儲值卡或預付卡 ； e) 購買表演/活動/展覽入場券；
f) 使用 K Dollar 及/或 K11 電子或實體禮券進行支付；
g) 為八達通卡、儲值卡或預付卡增值；
h) 貨幣兌換；
i) 在凱悅酒店、K11 ARTUS 、K11 Atelier (包括 Victoria Dockside 及 King’s Road)和香港瑰麗酒店 進行的任何交易；
j) 在 Victoria Playpark、 D Mind & the Prince 和欣圖軒進行的任何交易；
k) 與參與商戶的任何網上交易；
l) 任何銀行交易；
m) 慈善捐款；
n) 任何帳單支付（包括但不限於電訊或公用事業帳單支付）；及
o) 會員與任何 K11 Art Mall 參與商戶之間的由 KLUB 11 不時指定的任何其他交易（不論事先通 知與否）；
p) 任何 K11 Kulture Academy 所提供或主辦的課程或活動；及
q) 在 K11 ESHOP、「K11 HK」流動應用程式內食品訂購及 K11 Art Mall 商戶的網上購物平台進
行的任何交易。
5.1.3 「電子貨幣」指信用卡、借記卡、Android Pay﹑Apple Pay﹑EPS﹑Samsung Pay﹑WeChat Pay﹑
拍住賞﹑支付寶﹑銀聯閃付的支付憑據及八達通卡簽賬。
5.1.4
其他沒有在本條款和條件中定義的條款與 KLUB 11 會員獎賞計劃條款及條件所作的定義具有相同的涵義。
5.2 複製合格收據
KLUB 11 有權將每張提交予 KLUB 11 作換領禮品的合格收據複製成電子版本，並保留該電子版本用 於審計目的。
5.3 於合格收據上做標記
KLUB 11 有權於每張提交予 KLUB 11 作換領禮品的合格收據上做標記。該等已標記的合格收據不可 再次用於其他推廣或換領任何其他禮品。
5.4 核實身份
KLUB 11 會員於換領禮品時，須出示其有效會員卡，以核實身份。
5.5 不可兌換
代幣，扭蛋，該紙條及/或抽獎禮品不可兌換現金、物品、其他禮品或服務。抽獎禮品受有關商戶/
提供商之條款及細則約束。
5.6 不作保證
活動換領的產品及/或服務並非由 KLUB 11 提供（K Dollars 除外），KLUB 11 不對該等產品及/或服務 作任何表述或保證。因享用該等產品及/或服務而造成的損失或破壞，或人身傷害，KLUB 11 概不負 責，法律規定之責任除外。
5.7 不承擔責任
KLUB 11 不對抽獎禮品為可銷售品質或適合任何目的以及作保證（K Dollars 除外）。KLUB 11 不對禮 品承擔任何責任，而活動的參加者須放棄其追究 KLUB 11 的所有權利及利益（如有）。
5.8 參與商户及 K11 員工不得參與
為確保公平，K11 員工及 K11 Art Mall 參與商戶之穿着制服或戴有員工證的員工均不能參與此活 動。
6 適用於活動的一般條款及細則
6.1 私隱政策

6.4 適用法律

7 適用活動
每位參與 K11 Loyalty Program Limited（「KLUB 11」）舉辦下述第 2 條的活動（「活動」）的參與者將被視為 已閱讀、理解及同意適用於活動的條款及細則。
8 活動詳情
活動: K11 Art Mall 「WHY SO MEME 」即抽即獎活動
活動期: 2021 年 8 月 9 日至 2021 年 8 月 15 日(包括首尾兩天) ( 「活動期」)
禮品換領日期: 2021 年 8 月 2 日至 2021 年 9 月 5 日(包括首尾兩天) (「禮品換領日期」) 換領時間: 活動期內星期一至日上午 10 時至下午 10 時( 「換領時間」)
換領地點: K11 Art Mall 地下之抽獎攤位 ( 「換領地點」)
禮品換領處開放時間: 禮品換領日期內星期一至日上午 10 時至下午 10 時(「禮品換領時間」) 禮品換領處地點: K11 Art Mall 地下禮賓部 (「禮品換領處」)
KLUB 11 會員(「會員」)活動期內於 K11 Art Mall 同日消費滿以下指定金額（「指定消費金額」）可於合格 交易當日(定義見第 5.1.2 條款)換領指定抽獎代幣(「代幣」) 並必須於交易當日以代幣參與抽扭蛋乙次。扭 蛋機將隨機發放扭蛋乙個。扭蛋內附有中獎禮品的說明紙條（「該紙條」），會員須於禮品換領日期內領 取列於附件一的指定抽獎禮品(「抽獎禮品」) ，活動受條款及細則約束。
同日消費是根據由不多於 4 張合格收據(定義見第 5.1.1 條款)計算（當中至少由 2 間不同 K11 Art Mall 的參 與商戶(定義見 KLUB 11 會員獎賞計劃條款及條件)發出），以 K Dollar 及/或 K11 禮券作消費之金額除外。
會員須於有關合格交易當日親身攜同合格收據及相關電子貨幣付款存根於換領時間內到換領地點登記合 格交易，方可換領代幣。

9 代幣換領限制
3.1 活動期間，每位會員每天只可換領最多 3 個代幣。
3.2 所有已換領之代幣均不可退款、不可退換及不可轉讓。如有任何污損、損壞、複製或遺失，代幣將 不被補發或交換並不獲受理。
10 換領抽獎禮品及抽獎結果公佈
4.1 會員必須於禮品換領日期內，親身於禮品換領處向我們的員工出示扭蛋及該紙條之正本及其「K11」
流動應用程式內之有效 KLUB 11 電子會員卡，方可領取抽獎禮品。禮品換領日期過後(即 2021 年 9 月
5 日)，任何沒有被領取之抽獎禮品會被視作無效。
4.2 代幣之使用受本條款及細則約束。每個扭蛋及該紙條只可以用作換領抽獎禮品一次，並於換領抽獎 禮品後被我們的員工收回。
4.3 列於附件
一
之抽獎禮品將以 K Dollars 或實體禮物的形式送出。若抽獎禮品為 K Dollars，K Dollars 將根 據會員於登記有關合格交易時之會藉等級送贈相應之 KLUB 積分數量。4.4 以 K Dollars 形式送出之抽獎禮品將會於領取抽獎禮品當日記入會員帳戶，而該些 K Dollars 將於 2021 年 12 月 31 日過期。KLUB 11 將不會為任何於換領或實質使用 K Dollar 抽獎禮品當時，因會籍等級轉 變而可能引致的損失負上任何責任。以實質禮品形式送出的抽獎禮品將根據第 4.1 條款之方式領取，
若抽獎禮品於禮品換領日期內沒被領取，該會員準備視作放棄其領獎資格，KLUB 11 將不作任何賠償。
4.5 活動完結通知將 2021 年 8 月 23 日於星島日報及英文虎報刊出。
4.6 每位參與活動的會員將被視為同意 KLUB 11:
4.6.1 使用其個人資料用作與活動相關之用途;及
4.6.2 按需知密原則披露其個人資料予有關商戶/提供商作換領抽獎禮品之用途。
11 適用於活動的特別條款及細則 11.1 定義
11.1.1 「合格收據」是指 K11 Art Mall 的參與商戶於合格交易當日發出的一張機印收據正本。KLUB 11 不接受任何影印或手寫的收據或支付憑據。KLUB 11 有權拒絕接受任何懷疑是無效的、偽造的 或虛假交易產生等原因的收據或支付憑據，且毋須作任何解釋。
11.1.2 「合格交易」是指任何會員與 K11 Art Mall 的參與商戶之以電子貨幣付款的交易，但不包括:
ii) 以現金支付的交易；
jj) 單筆支出低於港幣 50 元；
kk) 購買任何種類的會籍;
ll) 購買預付產品、現金券、禮品卡或優惠券、儲值卡或預付卡 ；
mm) 購買表演/活動/展覽入場券；
nn) 使用 K Dollar 及/或 K11 電子或實體禮券進行支付；
oo) 為八達通卡、儲值卡或預付卡增值；
pp) 貨幣兌換；
qq) 在凱悅酒店、K11 ARTUS 、K11 Atelier (包括 Victoria Dockside 及 King’s Road)和香港瑰麗酒店 進行的任何交易；
rr) 在 Victoria Playpark、 D Mind & the Prince 和欣圖軒進行的任何交易；
ss) 與參與商戶的任何網上交易；
tt) 任何銀行交易；
uu) 慈善捐款；
vv) 任何帳單支付（包括但不限於電訊或公用事業帳單支付）；及
ww) 會員與任何 K11 Art Mall 參與商戶之間的由 KLUB 11 不時指定的任何其他交易（不論事 先通知與否）；
xx) 任何 K11 Kulture Academy 所提供或主辦的課程或活動；及
yy) 在 K11 ESHOP、「K11 HK」流動應用程式內食品訂購及 K11 Art Mall 商戶的網上購物平台進
行的任何交易。
11.1.3 「電子貨幣」指信用卡、借記卡、Android Pay﹑Apple Pay﹑EPS﹑Samsung Pay﹑WeChat Pay﹑
拍住賞﹑支付寶﹑銀聯閃付的支付憑據及八達通卡簽賬。
11.1.4
其他沒有在本條款和條件中定義的條款與 KLUB 11 會員獎賞計劃條款及條件所作的定義具有相同的涵義。
11.2 複製合格收據
KLUB 11 有權將每張提交予 KLUB 11 作換領禮品的合格收據複製成電子版本，並保留該電子版本用 於審計目的。
11.3 於合格收據上做標記
KLUB 11 有權於每張提交予 KLUB 11 作換領禮品的合格收據上做標記。該等已標記的合格收據不可 再次用於其他推廣或換領任何其他禮品。
11.4 核實身份
KLUB 11 會員於換領禮品時，須出示其有效會員卡，以核實身份。
11.5 不可兌換
代幣，扭蛋，該紙條及/或抽獎禮品不可兌換現金、物品、其他禮品或服務。抽獎禮品受有關商戶/
提供商之條款及細則約束。
11.6 不作保證
活動換領的產品及/或服務並非由 KLUB 11 提供（K Dollars 除外），KLUB 11 不對該等產品及/或服務 作任何表述或保證。因享用該等產品及/或服務而造成的損失或破壞，或人身傷害，KLUB 11 概不負 責，法律規定之責任除外。
11.7 不承擔責任

TERMS AND CONDITIONS IN RESPECT OF K11 Art Mall WHY SO MEME Lucky Draw
(16 August 2021 – 22 August 2021)
13 Applicable Activity
By participating in the activity organized by K11 Loyalty Program Limited (“KLUB 11”) as set out in paragraph 2 below (the “Activity”), a participant is deemed to have read, understood and agreed to the terms and conditions applicable to the Activity.
14 The Details of Activity
Activity: K11 Art Mall WHY SO MEME Lucky Draw
Activity Period: 16 August 2021 – 22 August 2021 (both days inclusive) (the “Activity Period”)
Prize Collection Period: 2 August 2021 to 5 September 2021 (both days inclusive) (the “Prize Collection Period”)
Redemption Hours: Monday to Sunday from 10:00am to 10:00pm during the Activity Period (the
“Redemption Hours”)
Redemption Location: Lucky Draw booth on G/F of K11 Art Mall (the “Redemption Location”)
Prize Collection Booth Opening Hours: Monday to Sunday from 10:00am – 10:00pm during the Activity Period (the “Prize Collection Hours”)
Prize Collection Booth Location: G/F, K11 Koncierge, K11 Art Mall (the “Prize Collection Booth”)
During the Activity Period, KLUB 11 Members (“Members”) whose same-day spending at K11 Art Mall reaches the following designated amount (“Designated Spending”) may redeem a lucky draw token (“Lucky Draw Token”) on the same date of the Eligible Transaction (as defined under paragraph 5.1.2 below). Members must insert the Lucky Draw Token into the capsule machine for the Lucky Draw (“Capsule Machine”) on the date of purchase and the Capsule Machine will randomly dispense a Gashapon capsule. The Gashapon capsules contain a slip bearing the description of the Lucky Draw Prize (“Prize Slip”), and Members can collect designated Lucky Draw Prizes as set out under Appendix 1 (“Lucky Draw Prize(s)”) during the Prize Collection Period, subject to these Terms and Conditions.
Same-day spending is calculated based on a maximum of four (4) Eligible Receipts (as defined in paragraph 5.1.1 below) from at least 2 different Participating Merchants (as defined in the KLUB 11 Loyalty Programme Terms and Conditions) in K11 Art Mall, excluding any spending by K Dollar(s) and/or K11 gift voucher(s).
Members must register their Eligible Transaction(s) with the relevant Eligible Receipt(s) together with the corresponding Electronic Payment slip(s) in person at the Redemption Location in order to redeem the Lucky Draw Token during the Redemption Hours on the date of the relevant Eligible Transaction(s).

15 Lucky Draw Token Redemption Restriction
3.1 During the Activity Period, each Member is only entitled to redeem a maximum of 3 Lucky Draw Tokens per day.
3.2 The redeemed Lucky Draw Token(s) are non-refundable, non-returnable, non-transferable and will not be re-issued, exchanged or honoured if found defaced, damaged, replicated, or lost/stolen.
16 Results of the Activity and Collection of Lucky Draw Prize(s)
4.1 Each Member must collect the Lucky Draw Prize(s) in person by presenting the Gashapon capsule(s) and the Prize Slip together with a valid KLUB 11 membership card as shown on his/her “K11 HK” Mobile App (“K11 App”) to our staff at the Prize Collection Booth on the day of purchase. Any uncollected Lucky Draw Prize(s) will be deemed as forfeited after expiry of the Prize Collection Period, i.e. 5 September2021.
4.2 Use of the Lucky Draw Token(s) shall be subject to these Terms and Conditions. EachGashapon capsule and the corresponding Prize Slip can only be used for redemption once and will be collected by our staff upon collection of the Lucky Draw Prize(s).
4.3 The Lucky Draw Prize(s) of the Activity are in forms of K Dollars or physical gift(s) as set out in Appendix 1 of these Terms and Conditions. For Lucky Draw Prize(s) that is in form of K Dollars, it will be awarded in the form of KLUB Points in accordance with the Member’s membership tier at the time of registration of the relevant Eligible Transaction.
4.4 The Lucky Draw Prize(s) in form of KLUB Points will be credited to each Member’s e-Wallet within the K11 App on the date of collection of the Lucky Draw Prize and such KLUB Points will expire on 31 December 2021.
KLUB 11 is not responsible for any loss of value due to possible change of the KLUB 11 membership tier at the time of actual usage of K Dollar(s) under the Lucky Draw Prize. Lucky Draw Prize(s) in form of physical gift(s) shall be collected in accordance with paragraph 4.1. If the Lucky Draw Prize is not collected within the Prize Collection Period, such Member shall be deemed to have disclaimed his/her entitlement to the same and no compensation shall be made by KLUB 11.
4.5 Event end notice will be announced in Sing Tao Daily and The Standard on 30 August 2021. By participating in this Activity, participating Members agree and consent to KLUB 11 announcing the participating Members’
names publicly as aforesaid.
4.6 By participating in this Activity, participating Members are deemed to agree and consent to KLUB 11:
4.6.1 using their personal information for purposes relating to this Activity; and
4.6.2 disclosing their personal information to relevant merchant(s)/ provider(s) for Lucky Draw Prize(s) redemption purposes and on a need-to-know basis only.
17 Special Terms and Conditions applicable to the Activity 5.1 Terms Used
17.1.1 “Eligible Receipt” means an original machine-printed receipt issued by a Participating Merchant at K11 Art Mall on the date of an Eligible Transaction. KLUB 11 does not accept any photocopies or hand- written receipts and reserves the right not to accept any receipts that KLUB 11 suspects to be invalid, forged or issued not for genuine transactions or on other grounds without any need for explanation.
17.1.2 “Eligible Transaction” means a consumer transaction made by Electronic Payment between a Member and a Participating Merchant at K11 Art Mall but excludes:
(a) Any spending paid by cash;
(b) Any single spending below HK$50;
(c) Purchase of any kinds of membership(s);
(d) Purchase of pre-paid items, cash vouchers, gift cards or coupons, stored value cards or pre- paid cards
(e) Purchase of show/event/exhibition tickets;
(f) Payments using K Dollars and/or K11 physical or electronic gift vouchers;
(g) Adding value to Octopus cards, stored value cards or pre-paid cards;
(h) Currency exchange;
(i) Any transactions at Hyatt Regency Hotel, K11 ARTUS, K11 Atelier (including Victoria Dockside &
King’s Road) and Rosewood Hong Kong;
(j) Any transactions at Victoria Playpark, D Mind & the Prince and Yan Toh Heen;
(k) Any online transactions with Participating Merchants;
(l) Any bank transactions;
(m) Charity donations;
(n) Any bill payment (including but not limited to payment of telecommunication or utility bills);
and
(o) Any other transaction between the Member and any Participating Merchants of K11 Art Mall as specified by KLUB 11 from time to time (with or without prior notice);
(p) Any course or event provided or hosted by K11 Kulture Academy; and
(q) Any transactions on K11 ESHOP, Food Ordering via ‘K11 HK’ Mobile App or any online platform
