Monthly Environmental Regulatory Update

This report contains a monthly update of environmental regulatory activity that is of interest, to the Department of Energy. lt is Provided to DOE operations and contractor staff to assist and support environmental management programs by tracking regulatory developments. Any proposed regulation that raises significant issues for any DOE operation should be reported to the Office of Environmental Guidance (EH-23) as soon as possible so that the Department can make its concerns known to the appropriate regulatory agency. Items of particular interest to EH-23 are indicated by a shading of the RU#.

The Environmental Regulatory Update Table provides information on regulatory initiatives of interest to DOE operations and contractor staff with environmental management responsibilities. The table is updated each month with information from . the Federal Register and other sources, including direct contact with regulatory agencies.

Each table entry provides a chronological record of the rulemaking process for that initiative with an abstract and a projection of further action.

1. Hazardous Waste Management System: Amendments to Interim Status Standards for _gradient Ground-Water Monitoring Well Locations at Hazardous Waste

Facilities - lrmal Rule

Under the authority of the Resource Conservation and Recove,'y Act, EPA issues a final rule (NPRM: 1-18-91) amending ground-water monitoring requirements in

40 CFR 265.91 for interim status landfills, surface impoundments, and land treatment facilities. Current regulations mandate that owners and operators of these facilities install a ground-water monitoring system including at least three hydraulically

downgradient monitoring wells located at the limit of the waste management area. This final rule adds Section 265.91(a)(3) to allow alternate placement of monitoring wells in certain instances where existing ph_ical obstacles prevent installation at the hydraulically downgradient limit of the waste management area. For facilities seeking approval for alternative well placement, EPA will require a written demonstration certified by a qualified ground-water scientist (as defined in the rule). The demonstration must establish that: (1) an existing physical obstacle prevents the installation of a monitoring well at the hydraulically downgradient limit of the waste management area; (2) the

alternate location is as close as practical to the limit of the waste management area; and (3) the detection of any statistically significant amounts of hazardous waste or hazardous constituents that migrate to the uppermost aquifer is as early as possible, given the alternate location. EPA indicates that a "physical obstacle" can include factors affecting the safety of personnel (e.g., presence of overhead or underground electrical cables or wires) as well as geologic features, buildings, and roads. A_ternate locations for down gradient wells will not be allowed when obstacles at the limit of the waste management area may be avoided. Only those units existing on the effective date of this amendment or subsequently _ming under interim status will be eligil le for the use of alternate downgradient wel! placement. The rule will become effective on June 23, 1992.

2. Guidelines For Developmental Toxicity Risk Assessment - Final Guidelines

EPA has issued final amended guidelines, revising the 1986 "Guidelines for the Health Assessment of Suspect Developmental Toxicants," for assessing the risks for

developmental toxicity from exposure to environmental agents. Risk assessment is the process by which scientific judgments are made concerning the potential for toxicity to occur in humans. These guidelines outline principles and methods for evaluating data from animal and human studies, exposure data, and other information to characterize risk to human development, growth, survival, and function because of exposure prior to conception, prenatally, or to infants and children. Some environmental agents are

" established as causing developmental toxicity in humans (e.g., lead, PCBs, methylmercury, and ionizing radiation), while others are suspected of causing developmental toxicity in humans based on data from animal studies. In comparisons, agents causing human

developmental toxicity in most cases were found to produce adverse effects in

experimental animal studies and, in at least one species tested, types of effects similar to those in humans. The guidelines provide new guidance on the relationship between maternal and developmental toxicity, characterization of the health-related data base for developmental toxicity risk assessment, use of the reference dose or reference

concentration for developmental toxicity, and use of the benchmark dose approach. If animal data are considered sufficient for risk assessment, an oral or dermal reference dose for developmental toxicity (RfDtrr) or an inhalation reference concentration (RfCtn-) is derived for comparison with human exposure estimates. The RfDtrr is based on short- term exposure, to distinguish it from the reference dose (RfD), which is used for chronic exposure situations. The guidelines were effective December 5, 1991.

IRIS DATABASE UPDATE

A DOE EH-231 Memorandum entitled Integrated Risk Information System (IRIS) and Availability of Chemical Risk Assessment Guidance was distributed in June 1991 to DOE

Program Offices and Field Organizations. Attachment 1 to the

memorandum, an ORNL-F_SD report discussing access to and utilization of the IRIS online database, included "Fable 1.

IRIS Chemicals With Reference Doses and Carcinogen

Assessments." The IRIS database has been updated extensively since that table was generated. The following table is the monthly updated version of Table 1 including ali the chemicals listed in Table 1 along with additions/changes to the database as of December 31, 1991. Additions/changes are shaded for ease of identification. Future issues of the Environmental Regulatory Update Table 'NII include updates to the IRIS database during the previous month. Use only the most cunem version of the table..
