ARESOLUTION BY COUNCILMEMBER YOLANDA ADREAW A RESOLUTION AUTHORIZING THE MAYOR OR HIS DESIGNEE ON BEHALF OF THE CITY OF ATLANTA TO ENTER INTO NEGOTIATIONS FOR AN AGREEMENT THAT PROVIDES FOR THE USE OF THE BOBBY JONES GOLF COURSE CLUBHOUSE FOR PUBLIC EVENTS, MEETING SPACE AND OTHER USES AS APPROVED BY THE COMMISSIONER OF THE DEPARTMENT OF PARKS AND RECREATION, IF THE COMMUNITY RAISES THE NEEDED RESOURCES FOR CAPITAL IMPROVEMENTS AND OPERATIONS FOR THE CLUBHOUSE; AND FOR OTHER PURPOSES.

WHEREAS, pursuant to City of Atlanta Ordinance 16-0-1282 as amended by Ordinance 16-0- 1485, the City of Atlanta ("City") conveyed the Bobby Jones Golf Course property ("Golf Course Property") to the Georgia Building Authority ("State") effective November 1, 2016; and WHEREAS, the City entered into a Ground Lease Agreement ("Ground Lease") with the State to lease back a portion of the Golf Course Property which includes the Bobby Jones Clubhouse ("Clubhouse') for a term of thirty (30) years (the "Term"); and

WHEREAS, the Term will commence on the earlier of (i) the date on which the Bobby Jones Golf Course Foundation, Inc., a Georgia non-profit corporation (the "Foundation") provides notice to the State under the terms of the lease between the Foundation and the State ("Golf Course Lease") that the Foundation elects to close the Bobby Jones Golf Course operations and to begin certain renovations to the Golf Course Property as contemplated by the Golf Course Lease or (ii) January 1, 2019; and

WHEREAS, the Ground Lease provides that the City may use the Clubhouse for operating and maintaining a public meeting facility and all related uses and that the City has the right to make improvements to the Clubhouse; and

WHEREAS, the community has expressed an interest in using the Clubhouse for public events, meeting space, musical events, social and educational activities and other purposes in the community ("Community Uses"); and

committed to capital improvements and operations for the Clubhouse;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ATLANTA, GEORGIA, that the City is committed to providing the community with the opportunity to use the Clubhouse for the Community Uses; and

BE IT FINALLY RESOLVED, that the Mayor or his designee is authorized to engage in negotiations for an agreement that provides for the Community Uses on the condition that the community raises at least One Million Dollars ($1,000,000) through fundraising efforts by early 2018 date certain.
