1.

I N T R O D U C T I O N

The Hera Mine site (Mine) is located approximately 100km southeast of Cobar and approximately 4km south of the village of Nymagee (Figure 1). The Mine is an underground mine with an expected operational life of nine years.

This Traffic Management Plan (TMP) has been prepared to comply with Condition 3(38) of Project Approval 10_0191 which was granted on 31 July 2012 by the Director-General of the Department of Planning and Infrastructure in accordance with the Environmental Planning and Assessment Act 1979. The TMP describes the following.

• Consultation undertaken during preparation of this TMP. • Legal requirements, objectives and outcomes.

• Competence and awareness training.

• Implementation of traffic management measures. • Monitoring and evaluation of compliance. • Complaints handling.

• Corrective and preventative measures. • Incident reporting and review of the TMP.

2.

A P P R O V E D A C T I V I T I E S

Hera Resources is to establish an underground mine, processing plant, run-of-mine (ROM) pad, temporary waste rock emplacement, tailings storage facility, mine camp, site offices and ancillary infrastructure for mining and related activities.

The operational life of the mine is expected to total nine years, comprising 1.5 years of site establishment activities, 5.5 years of mining and processing operations and 2 years of rehabilitation operations.

The following activities have approval under the Project Approval (Figure 2).

• Extraction of a maximum of 355 000t per annum of ore using an underground sublevel open stope mining method.

• Construction and use of a surface facilities area that would incorporate a range of approved infrastructure including expanded Hera Resources and contractors’ site offices, ablutions facilities, vehicle parking, power station, fuel storage, refuelling area, workshop and laydown areas.

• Construction and use of a processing plant within the surface facilities area comprising crushing and grinding, gravity, separation, flotation, leach and gold recovery circuits and ancillary infrastructure.

• Construction and use of a tailings storage facility.

• Construction of a mine camp to house up to 80 personnel.

• Construction and use of a surface water harvesting system, including expansion of an existing dam (Pete's Tank) to 20ML capacity and construction of a new 90ML capacity dam (Back Tank East). • Construction of a water reticulation system that would connect the surface water storage dams and

existing production bores with the raw water dam and the mine camp.

• Construction and use of the mine site access road and the associated intersection to allow site access from Burthong Road.

• Transportation of bulk concentrate from the Mine site to customers using the surrounding public road network.

• Construction and use of ancillary infrastructure, including soil stockpiles, core storage yards, internal roads and tracks, and sediment and erosion management structures not already approved.

In addition, YTC Resources holds approval under Exploration Licence 6162 to construct a range of infrastructure, including an exploration decline and ancillary infrastructure (the Part 5 Approval). Those works are fully described in the Review of Environmental Factors (REF) titled “Exploration Decline at the Hera Deposit within Exploration Licence 6162, via Nymagee” dated December 2006 and approved by the Department of Primary Industries on 2 April 2007. That document includes a range of approved management plans that are to apply to all work undertaken under the Part 5 Approval.

Condition 13 (1) of the Project Approval states the following:

“Until they are replaced by an equivalent strategy, plan or program approved under this approval, the Proponent shall implement the existing strategies, plans or programs for the site that have been approved under the approved exploration activities described in Review of Environmental Factors (REF) entitled “Exploration Decline at the Hera Deposit within Exploration Licence 6162”.

This TMP replaces the existing traffic management strategies documented in the REF and approved under the Part 5 Approval.

3.

C O N S U LTAT I O N

Condition 3 (38)(c) of Project Approval requires this TMP to be prepared in consultation with the Cobar Shire Council (Council) prior to being submitted to the Director-General of the Department of Planning and Infrastructure (DP&I) for approval.

An initial draft of this TMP was provided to Council for their comment and review on 2 August 2012. Council made a range of comments in relation to the initial draft TMP and requested further opportunity to review the final draft TMP prior to submission to the Director-General for approval.

The final draft TMP was provided to Council on 16 August 2012 with a request to provide final comments by 23 August 2012. Comments were received on 28 August 2012 and the TMP was updated to address the comments and resubmitted to the Cobar Council on 31 August 2012.

Comments received on 28 August were provided by Mr. Paul O’Brein (Manager Planning and Environmental Services). Mr O’Brein main comments were as follows

• Incorrect labelling of one of the roads in Figure 3.

• Figure 3 not showing the whole route to the Endeavour Mine.

• Include

• In Section 6.3 to include ‘the complainant shall be advised of the outcome of any investigation’

On 20 September Mr Stephen Taylor (Director Engineering Services) responded via email, stating that he was satisfied with the TMP, apart from one small adjustment, being changing the speed limit on Mulya Road to 100km/hr. This change was made and the final version of the TMP was sent to the Cobar Council and to the Department of Planning and Infrastructure.

4.

E N V I R O N M E N TA L M A N A G E M E N T

This section describes the legal requirements, objectives and outcomes, the Hera Resources personnel roles and responsibilities and the necessary training and awareness required to ensure the management of traffic for the Mine.

4.1

LEGAL AND OTHER REQUIREMENTS

The Project Approval stipulates the required criteria that the construction and operational activities of the Mine must comply with and sets out the core requirements of this TMP. Relevant conditions associated with this approval are reproduced in (Table 1).

Dangerous Goods Section

3(33) Transportation of all dangerous goods to or from the site shall be undertaken in strict accordance with Australian Code for the Transport of Dangerous Goods by Road and Rail.

5.4.4

Road Upgrades

3(34) Within 6 months of the date of this approval, the Proponent shall:

(a) commission a suitably qualified independent expert, whose appointment has been approved by the Director-General, to undertake a design and pavement condition review for the intersection of Burthong Road and Priory Tank Road, which:

(i) identifies any deficiencies in the design or pavement condition of the intersection;

(ii) recommends appropriate design upgrades and pavement repairs taking into consideration the type, volume and direction of traffic generated by the mine; and

(iii) ensures the recommended design is in accordance with the applicable AUSTROADS standards.

Undertake intersection design and pavement upgrades in accordance with the recommendations of the review in (a), in consultation with Council, and to the satisfaction of Council.

5.3.1

3(35) Within 6 months of the date of this approval, the Proponent shall:

(a) commission a suitably qualified independent expert, whose appointment has been approved by the Director-General, to undertake a review of the existing traffic control devices on Burthong Road and Priory Tank Road, which: (iv) reviews all existing traffic devices, including traffic signs, traffic signals,

pavement markings, guide posts, delineators and safety barriers, and identifies any deficiencies; and

(v) recommends appropriate upgrades in accordance with the applicable AUSTROADS standards;

(b) install traffic control devices in accordance with the recommendations of the review in (a), to the satisfaction of Council.

5.3.1.

Access Road Construction

3(36) The Proponent shall construct the site access road and the intersection of the access road and Burthong Road prior to the commencement of construction of the process plant. The intersection shall be designed and constructed to meet the relevant requirements of the Council and in accordance with the applicable AUSTROADS standards.

5.3.3

Monitoring of Concentrate Transport 3(37) The Proponent shall:

(a) Keep accurate records of the:

(i) Amount of lead and zinc concentrate transported from the site (on a monthly basis); and

(ii) The date and time of loaded truck movements from the site; and

(b) Provide the Director-General with a summary of these truck movements in the Annual Review.

5.4.3, 6.1.1

Traffic Management Plan

3(38) The Proponent shall prepare and implement a Traffic Management Plan to the satisfaction of the Director-General. The plan shall:

(a) focus on traffic management along Burthong Road and Priory Tank Road, particularly in the vicinity of the village of Nymagee;

(b) describe the measures to minimise conflicts between road users and ensure that trucks from the mine do not travel through surrounding local roads; and (c) be developed in consultation with Council and submitted for the approval of

the Director-General prior to carrying out any development on the site under this approval.

5(2) The Proponent shall ensure that the management plans required under this approval are prepared in accordance with any relevant guidelines, and include:

(a) detailed baseline data; (b) a description of:

• the relevant statutory requirements (including any relevant approval, licence or lease conditions);

• any relevant limits or performance measures/criteria;

• the specific performance indicators that are proposed to be used to judge the performance of, or guide the implementation of, the project or any management measures;

(c) a description of the measures that would be implemented to comply with the relevant statutory requirements, limits, or performance measures/criteria; (d) a program to monitor and report on the:

• impacts and environmental performance of the project; • effectiveness of any management measures (see c above);

(e) a contingency plan to manage any unpredicted impacts and their consequences; (f) a program to investigate and implement ways to improve the environmental

performance of the project over time; (g) a protocol for managing and reporting any:

• incidents; • complaints;

• non-compliances with statutory requirements; and

• exceedances of the impact assessment criteria and/or performance criteria; and (h) a protocol for periodic review of the plan.

Note: The Director-General may waive some of these requirements if they are unnecessary or unwarranted for particular management plans.

4.2

OBJECTIVES AND OUTCOMES

Table 2 lists the objectives and outcomes for the TMP.

4.3

ROLES AND RESPONSIBILITIES

Table 3 lists the roles and responsibilities for the TMP.

4.4

COMPETENCE AND AWARENESS TRAINING

All personnel shall undergo traffic awareness training. Traffic awareness training shall be a component of the competency based site induction program. The following areas shall be covered in the induction.

• Driver’s Code of Conduct (heavy vehicle driver’s). • Operating hours for all vehicles.

• Approved routes for heavy vehicle site access. • Speed limits on public and mine site roads. • Parking requirements.

• Incident response and reporting procedures in the event of a traffic accident or near miss. • Expectations of behaviour on public roads.

• Drive cautiously and to conditions if travelling on the dirt roads around Nymagee • Contact phone number in the event of a complaint or accident.

The Environmental Officer shall be responsible for ensuring the appropriate Traffic Awareness training is included in the induction.

5.

I M P L E M E N TAT I O N O F T R A F F I C M A N A G E M E N T

M E A S U R E S

5.1

INTRODUCTION

Traffic and transport impacts are expected to be minimal as the current traffic volume and the proposed construction traffic volumes are low. The possible impacts which traffic and transport may result in include:

• Additional number of vehicles using Burthong Road, Priority Tank Road and Kidman Way (Figure 3) due to movement of the workforce and contractors or heavy vehicle movements for product transportation. This may result in:

– elevated risk of accident/incident on local roads; and

– road pavement deterioration.

• Dust and gravel being tracked onto Burthong Road.

This section presents the traffic management measures that will be implemented during the life of the Mine to ensure that the requirements of Conditions 3(34) to (38) and the objectives of this TMP are achieved. These measures include the following.

• Assessment of the condition of the Burthong Road and Priory Tank Road intersection. • Construction of the Burthong Road and site access intersection.

• Construction of the main site access road.

• Monitoring of numbers, dates and times of departure of concentrate-loaded trucks. • General measures identified in the Statement of Commitments.

• Driver’s Code of Conduct. • Enforcement of speed limits.

5.2

BACKGROUND TO EXISTING EXTERNAL ROAD AND CONDITIONS

The following provides an overview of the existing roads and conditions in the vicinity of the Mine site (Figure 3). The Environmental Officer will be responsible to ensure all drivers are aware of the speed limits and parking requirements.

5.2.1

Burthong Road

Burthong Road is a two-way, sealed road with no centre line and a 100km/h speed limit in the vicinity of the Mine site and 50km/h through Nymagee. The existing peak hour traffic along Nymagee – Burthong Road is less than five movements per hour.

There are no restrictions on parking on Burthong Road in the vicinity of the Mine site. The existing site entrance easily exceeds the Australian Standard requirements AS 2890.1 and 2 Parking Facilities for the posted speed limit along Burthong Road.

5.2.2

Priory Tank Road

Priory Tank Road is sealed with 100km/h speed limit.

5.2.3

Kidman Way

Kidman Way is sealed with 100km/h speed limit. During peak hour traffic flows along the road, south of Cobar are less than 50 vehicles per hour.

5.2.4

Mulya Road (formally Louth Road)

The Mulya Road (formally known as Louth Road) is sealed with a 100km/h speed limit. Through the town of Cobar it is 50km/hr.

5.2.5

Heavy Vehicle Transportation Route

All intersections along the approved heavy vehicle transportation route (Figure 4) operate at a very good level of service with no delays. These intersections are sealed with one lane in each direction and no sealed shoulders.

Finally, the heavy vehicle transport route is an approved road train route.

5.3

TRAFFIC MANAGEMENT MEASURES

5.3.1

Assessment of Burthong Road and Priory Tank Road

Conditions 3(34) and (35) of Project Approval requirean independent assessment of the design and pavement condition of the intersection of Burthong Road and Priory Tank Road intersection and the traffic devices on both

roads. The purpose of that assessment is to determine deficiencies in design or pavement condition of the intersection or traffic devices along both roads, taking into account the type, volume and direction of Mine-related traffic. The assessment is to include recommendations to ensure that the roads and intersection comply with applicable AUSTROADS standards. The following will be implemented within 6 months of Project Approval, namely by 30 January 2013, to satisfy these conditions.

• Review by an independent expert of the design and pavement condition for the intersection of Burthong Road and Priorty Tank Road.

• Review by an independent expert of all existing traffic devices, including traffic signs, traffic signals, pavement markings, guide post, delineators and safety barriers of Burthong Road and Priorty Tank Road.

• Implementation of appropriate recommendations from the review and in accordance with AUSTROADS standards.

5.3.2

External Site Access and Maintenance of Local Roads

Vehicular access to the Mine site will include the following (Figure 2). • Heavy vehicle (main site) access.

• Light vehicle access.

The construction of the light vehicle access road to the Mine site is an approved activity under the Part 5 Approval. Once the Main Site Access Road is constructed, the light vehicle access road will be used primarily for light vehicle access to the mine camp. A sign indicating that this road is only a light vehicle access road will be erected at the entrance to the road from Burthong Road.

5.3.3

Main Site Access Road Intersection

Condition 3(36) of the Project Approval requires the intersection of Burthong Road and the main site access road to be designed and constructed to the satisfaction of Council and in accordance with the applicable AUSTROADS standards. The following will be undertaken to satisfy this condition.

The intersection of the main site access road and Burthong Road will be constructed to RTA Standards for a Basic Rural intersection incorporating basic right turn (BAR) and left turn (BAL) treatments (Figure 4). The BAL and BAR treatments for the left and right turning vehicles at the intersection are based on the RTA’s warrants for Rural Turn Lanes (as defined by the RTA AUSTROADS standard) and the Traffic volumes that will use the intersection. The intersection will be able to accommodate articulated vehicles turning left into and right out of the Mine site. The intersection will be able to accommodate articulated vehicles, including 36m Road Trains, turning left into and right out of the Mine site. The General Manager will be responsible to ensure the construction of the site access road and the intersection are undertaken to the specified standards.

Officer or delegate will be responsible to ensure that regular clearing of vegetation found on the vicinity of the intersection is undertaken to make sure the SISD is maintained.

Construction works would be undertaken following consultation with Council. Hera Resources will obtain the appropriate approvals from the Cobar Shire Council in relation to all activities within the Burthong Road reserve. The General Manager will be responsible to ensure that the necessary permits are obtained.

5.3.4

Main Site Access Road

The main site access road to be used by both light and heavy vehicles would be constructed approximately 500m south of the light vehicle access road (Figure 2). The access to this road will be from Burthong Road. The main site access road will intersect with the light vehicle access road approximately 1 100m from the intersection of Burthong Road. From that intersection, the principal access for all vehicles to the surface facilities area will be via the main site access road.

An approximately 100m section of the main site access road, at the entrance from Burthong Road, will be sealed to prevent tracking of mud and other material onto Burthong Road. The remainder will be an unsealed two-lane road suitable for use by light and heavy vehicles and sufficiently wide that two loaded semi-trailer trucks can pass safely.

The main site access road will be designed, constructed and/or maintained in accordance with the following. • The road surface will be sheeted with suitable materials in order to maintain all weather access. • The road will be routinely maintained and watered to suppress the generation of dust, including

through the use of chemical suppressants.

• The road will be constructed to avoid excessive erosion during rain events.

• Appropriate road side drainage will be installed adjacent to all roads in accordance with the requirements of “Managing Urban Stormwater - Volume2C Unsealed Roads” published by the then department of Environment and Climate Change in January 2008.

5.4

Traffic Levels, Transportation Hours and Routes

Condition 3(38) (a) & (b) of the Project Approval requires this TMP to describe the traffic management along Burthong Road and Priory Tank Road, and in the vicinity of the village of Nymagee to minimise the potential for conflicts between road users and to ensure that travel through surrounding local roads is not conducted.

This section has been prepared to address these requirements and describes the measures to be implemented including the description of vehicle types, transportation routes and hours of operation.

5.4.1

Type of Vehicles

The following are the vehicles that have been approved for the associated activities with the Mine. • Light vehicles – including passenger vehicles and light trucks and buses.

Heavy vehicles – including rigid trucks, semi-trailers, 36m Road Trains and B-Doubles delivering consumables and supplies to the Mine site and transporting concentrate to Hera Resources’ customers.

Oversize and overweight vehicles – delivering components of the processing plant and mobile fleet, primarily during construction operations. Hera Resources would ensure that all oversize and overweight vehicles would have the appropriate permits and approvals and will be appropriately escorted, when required.

All vehicles transporting bulk concentrate will be loaded and transported in sealed containers to allow for easier handling and reduce the risk of spills though transport.

5.4.2

Transport Route and Traffic Levels

It is noted that limited numbers of light vehicles would be required to transport Mine-related employees as the majority would be accommodated within the mine camp. Employees not living within the mine camp will most likely be commuting from Cobar. This is also the proposed route for the heavy vehicles transporting associated products for the Mine (Figure 3).

The Environmental Officer will be responsible for the providing awareness for the approved routes and to ensure impacts on the village of Nymagee are minimised.

5.4.3

Transportation Hours

Condition 3(7) of Project Approval requires that the dispatch of lead and zinc concentrate and gold doré from the site is limited to between the hours of 7:00am and 10:00pm on any day.

The Environmental Officer will be responsible to ensure awareness and documentation of the dispatch hours of concentrate and doré to transporters of these materials.

5.4.4

Dangerous Goods

Condition 3(33) of Project Approval requires that the transportation of all dangerous goods to or from the Mine site be undertaken in accordance with Australian Code for the Transport of Dangerous Goods by Road and Rail. Refer to the Hazardous Material Management Plan for further information on the transport of dangerous goods.

The Environmental Officer will be responsible to ensure all contractors transporting dangerous goods for Mine related activities are aware of the requirements to operate in accordance with the Code.

5.5

Statement of Commitments

Table 4 presents the traffic-related commitments made by Hera Resources and embodied in Appendix 6 of Project Approval. Hera Resources Environmental Officer will ensure that each of these commitments is implemented.

The following sections provide additional measures to address those issues committed to in the Statement of Commitments (Table 4) that have not been previously documented within this TMP.

5.5.1

Internal Road Speed Limits and Dust Control

The maximum speed limit within the Mine site would be 40km/h.

Internal roads will be treated with chemical suppressants, where appropriate, to minimise dust generation.

5.5.2

Security and Safety

To effectively restrict non-mine traffic accessing the Mine site, a security gate and fencing will be erected in the vicinity of the Hera Resources site office. Access to the active sections of the Mine site is will be restricted to approved vehicles and driver’s.

All non-mine traffic will be required to report to the Hera Resources office and register before proceeding to the active section of the Mine site. Non-approved vehicles or driver’s requiring access to the Mine site will be escorted by Hera Resources personnel or persons approved by Hera Resources. Where required, wide loads or special vehicles will be accompanied by an escort within the site.

5.6

DRIVER’S CODE OF CONDUCT

Hera Resources has developed a Driver’s Code of Conduct which aims to minimise the impacts of traffic associated with the Mine on local residents and mine employees by reducing noise and limiting traffic, resulting in a safer traffic environment. Heavy vehicle driver’s regularly accessing the Mine site will be required to review and sign the Driver’s Code of Conduct as part of their induction and will be required to be re-inducted and re-sign the code annually.

The Driver’s Code of Conduct stipulates the allowable travel times, recording of breaches, information on the external road network and a list of requirements which are listed below:

Driver’s MUST NOT:

• Exceed the maximum speed limits posted by the Roads and Maritime Service on any roads. • Exceed 40 km/hr while driving within the Mine site.

• Enter or leave the Mine site between the hours of 10:00pm and 7:00am (concentrate laden vehicles only).

• Overtake other vehicles in an unsafe or inappropriate manner or where vision is limited. • Throw rubbish / cigarette butts out of your vehicle.

• Refuse to follow or fail to carry out the reasonable instructions of a Supervisor.

• Coming to work under the influence of alcohol or any drug, or bringing alcoholic beverages or drugs on to company property. A Blood Alcohol concentration of 0.00% is required for all machinery operators.

• Operate an unroadworthy vehicle or vehicle that has an identified defect. Driver’s MUST:

• Only access the Mine site via the approved heavy vehicle transport route. • Stop at all designated stop signs.

• Hold a current and valid driver’s licence for the class of vehicle that you operate. • Adjust driving to the road conditions (slowdown in wet conditions and on narrow roads). • Demonstrate driver courtesy.

• Drive in a manner that minimises vehicle noise.

• Limit the use of compression braking in built-up areas (except where it is not safe to do so). • Comply with the road rules pertaining to the vehicle, including use of mobile phones. • Comply with site parking, speed limits and traffic management requirements.

• Ensure that loads are properly secured and covered and no loose items can be dislodged or blow from the vehicle.

• Wear a seatbelt at any time that a vehicle is in motion. • Drive at a safe speed at all times.

• Complete a vehicle pre-start checklist and report any defects.

• Practise caution around the local school bus and children getting off the bus (Monday to Friday, mornings 7:15am to to 9am and afternoons 3.00pm to 4.45pm

The following procedure will be implemented to enforce the Driver’s Code of Conduct.

• A copy of the Driver’s Code of Conduct will be made available on the Project website. • A copy of the Driver’s Code of Conduct will be provided during inductions.

• A procedure for members of the public to report alleged unsafe driving or breaches of the Driver’s Code of Conduct will be established and advertised with the Driver’s Code of Conduct. This will utilise the Project’s community consultation line 6837 3689.

• In the event that a complaint is received, an investigation will be initiated as described in Section 6.5. If the investigation confirms the alleged activity and identifies that the driver and vehicle in question are Project-related, then appropriate action will be taken depending on the circumstances. Appropriate actions may include:

– counselling of the driver in relation to the requirements of the Driver’s Code of Conduct;

– issuing of a formal warning to the driver;

– exclusion of the driver from the Project Site; or

– exclusion of the transport contractor from the Project Site.

6.

M O N I T O R A N D R E V I E W

This section describes the monitoring of concentrate transportation, the evaluation of compliance, complaints handling procedures, the corrective and preventative procedural measures, incident reporting and review.

6.1

MONITORING OF TRAFFIC

Condition 3(47) of the Project Approval reproduced in Table 1 identifies a range of requirements in relation to the keeping of accurate records of the loaded truck movements for transporting lead and zinc concentrate from the Mine site. In order to achieve compliance with these requirements, Hera Resources will implement the following.

• Maintain records of all concentrate and other heavy vehicles arriving and departing from the Mine site, including their classification and time of arrival/departure.

• Prepare a monthly summary of concentrate-related vehicle movements, including date, time and amount of concentrate transported. These reports will be provided quarterly to the Department of

• Ensure that concentrate-related heavy vehicles depart the Mine site between the hours of 7:00am to 10:00pm on any day.

• Erect signs, in consultation with Council, at an appropriate location near the intersection of Priory and Burthong Roads south of Nymagee identifying that Mine-related heavy vehicles travelling:

– west along Priory Road are to turn left on Burthong Road to the Mine site and are not permitted to turn left (north) and travel through Nymagee.

– north along Burthong Road are to turn left (west) at Priory Road to travel to Cobar.

• Consult with the Traffic Committee for Council at least quarterly to identify and address any Mine traffic-related issues.

6.2

EVAULATION OF COMPLIANCE

Hera Resources will conduct periodic evaluation of compliance with the following reported within the Annual Environmental Management Report.

• An overview of consultation with Council in relation to traffic-related matters and payments made under the planning agreement.

• On overview of road construction and maintenance operations undertaken during the reporting period.

• An overview of the number of drivers who have signed the Driver’s Code of Conduct.

• A summary of any traffic-related complaints and measures undertaken to investigate and resolve those complaints.

• All accidents, near misses and complaints will be reported in the Annual Environmental Management Report.

• Record keeping of concentrate transport and reporting to DP&I and Council.

6.3

COMPLAINTS AND HANDLING RESPONSE

A 24-hour Community Complaints Line (6837 3689) is in place for members of the public to make a complaint against any driver not complying with road rules, Driver’s Code of Conduct or driving recklessly. All complaints will be investigated and appropriate action will be taken as indicated in Section 5.6. All heavy vehicle drivers are required to comply with the Hera Resources Driver’s Code of Conduct. The complainant shall be advised of the outcome of any investigation.

An investigation will be initiated in the event of a traffic accident, reported near miss or complaint. The investigation will aim to determine:

• details of the incident; • root cause of the incident;

• whether appropriate controls were implemented to prevent the incident.

6.4

CORRECTIVE AND PREVENTATIVE MEASURES

Any breaches of this TMP by Hera Resources employees, contractor or sub-contractors will be treated in accordance with the Hera Resources disciplinary policies and procedures.

If corrective actions are required as a result of the investigation, they will be initiated a soon as practicable. If necessary the TMP and Driver’s Code of Conduct will be amended as recommended by the investigation.

6.5

INCIDENT REPORTING

All reports associated with accidents will be provided within 7 days to the Council and other agencies as required and will be retained for a minimum of four years.

All accidents, near misses and complaints will be reported in the Annual Environmental Management Report.

6.6

REVIEW

In accordance with Condition 5 (4) of Project Approval, this TMP will be reviewed and, if required, revised within 3 months of:

• the submission of an annual review under Condition 5(3); • the submission of an incident report under Condition 5(6);

• the submission of an independent audit report under Condition 5(7); and • any modification to the conditions of Project Approval.

This review will include the adequacy of strategies, plans and programs as required under the Project Approval. Recommendation for appropriate measures or action to improve the environmental performance of the Mine and or any assessment, plan or program will be incorporated into this TMP.
