AN ORDINANCE REGULATING TRAFFIC WITHIN THE CORPORATE LIMITS OF THE CITY OF MISSION WOODS, KANSAS; INCORPORATING BY REFERENCE THE “STANDARD TRAFFIC ORDINANCE FOR KANSAS CITIES,” EDITION OF 2021, WITH CERTAIN AMENDMENTS AND ADDITIONS; AMENDING AND REPEALING EXISTING SECTION 11-101 THE CODE OF THE CITY OF MISSION WOODS, KANSAS.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF ROELAND PARK, KANSAS:
SECTION 1. Section 11-101 of the Code of the City of Mission Woods, Kansas, is hereby amended to read as follows:
11-101. INCORPORATING STANDARD TRAFFIC ORDINANCE. There is hereby incorporated by reference for the purpose of regulating traffic within the corporate limits of the City of Mission Woods, Kansas, that certain standard traffic ordinance known as the “Standard Traffic Ordinance for Kansas Cities,” Edition of 2021, prepared and published in book form by the League of Kansas Municipalities, Topeka, Kansas, save and except such sections as are hereafter modified or changed, such incorporation being authorized by K.S.A. 123009 through 12-3012, inclusive, as amended. At least one copy of said Standard Traffic Ordinance shall be marked or stamped “Official Copy as Adopted by Ordinance No. ____,” with all sections or portions thereof intended to be changed clearly marked to show any such change, and to which shall be attached a copy of this ordinance, and filed with the City Clerk to be open to inspection and available to the public at all reasonable hours.
The police department, municipal judge and all administrative departments of the City charged with enforcement of the ordinance shall be supplied, at the cost of the City, such number of official copies of such Standard Traffic Ordinance similarly marked, as may be deemed expedient.

NOTICE OF PUBLIC HEARING ISSUANCE OF INDUSTRIAL REVENUE BONDSFOR
Public notice is hereby given that the City Council of the City of De Soto, Kansas (the “City”), will conduct a public hearing on Thursday, October 21, 2021, at 7:00 p.m., or as soon thereafter as may be heard, at De Soto City Hall, 32905 West 84th Street, De Soto, Kansas, in regard to the proposed issuance by the City of its industrial revenue bonds in an approximate principal amount of $1,600,000 (the “Bonds”) and in regard to an exemption from ad valor- em taxation for property constructed or purchased with the proceeds of such Bonds.
The Bonds are proposed to be issued under authority of K.S.A. 121740 et seq., as amended, to provide funds for acquiring, purchasing, constructing, installing and equipping an approximately 8,800 square foot commercial mul- tifamily facility to be approximately located at the southwest corner of 82nd Street and Shawnee Street in De Soto, Kansas. The City intends to base lease the facility and further intends to lease the facility to Original Town De Soto Properties, LLC, a Kansas limited liability company, or its successors and assigns.
The applicant has requested a 10-year, 100% property tax abatement for the property constructed or purchased with the proceeds.
A copy of this Notice, together with a copy of the resolution of intent of the City to be considered for adoption, indicating the intent of the governing body of the City to issue such Bonds, and a report analyzing the costs and benefits of such property tax exemption, are on file in the office of the City Clerk and available for public inspection during normal business hours.
All persons having an interest in this matter will be given an opportunity to be heard at the time and place above specified.

WHEREAS, pursuant to Resolution No. 4620 of the City adopted on June 1, 2020, as amended by Resolution No. 4620, A of the City adopted on May 3, 2021, the Issuer declared its intent to issue its federally taxable private activity revenue bonds for the benefit of Overland One, LLC, a Kansas limited liability company (“Overland One”), in the principal amount not to exceed $35,500,000 for the purpose of financing the costs of the acquisition, construction and equipping of a commercial facility generally located at the northeast corner of West 110th Street & Nall Avenue within the City (the “Project Site”), and buildings and improvements (collectively, the “Project Improvements” and together with the Project Site, the “Project”); and
WHEREAS, Overland One is the sole member of 110th Street Development, LLC, a Kansas limited liability company (the “Company”), and Overland One conveyed the Project Site to the Company; and
WHEREAS, the Issuer has found and does find and determine that it is desirable in order to promote, stimulate and develop the general economic welfare and prosperity of the Issuer and the State of Kansas that the Issuer issue its Federally Taxable Private Activity Revenue Bonds, Series 2021 (Overland One – Building 3 Project), in the principal amount not to exceed $35,500,000 (the “Bonds”), for the purpose of financing the costs of the acquisition, construction and equipping of the Project, and authorizing the Issuer to lease the Project to the Company, and consenting to the sublease of a portion of the Project to Berkley Insurance Co., a Delaware corporation, Creative Planning, LLC, a Missouri limited liability company, and affiliates of Creative Planning, LLC (the “Subtenants”); and
WHEREAS, the Issuer further finds and determines that it is necessary and desirable in connection with the issuance of the Bonds to execute and deliver (i) a Trust Indenture (the “Indenture”), with Security Bank of Kansas City, Kansas City, Kansas, as Trustee (the “Trustee”), prescribing the terms and conditions of issuing and securing the Bonds; (ii) a Lease (the “Lease”), between the Issuer and the Company, pursuant to which the Issuer will lease the Project to the Company in consideration of rentals which are intended to be sufficient to provide for the payment of the principal of, premium, if any, and interest on the Bonds as the same become due;
(iii) a Payment in Lieu of Taxes Agreement providing for a property tax exemption for the Project among the Issuer and the Company and (iv) a Bond Purchase Agreement providing for the sale of the Bonds by the Issuer to the Company, as the purchaser (collectively, the “Bond Documents”);
NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF OVER- LAND PARK, KANSAS, AS FOLLOWS:
Section 1. Authority to Cause the Project to be Acquired, Constructed and Equipped. The Issuer is hereby authorized to cause the Project to be acquired, constructed and equipped all in the manner and as more particularly described in the Indenture and the Lease herein authorized.
Section 2. Authorization of and Security for the Bonds. The Issuer is hereby authorized and directed to issue the Bonds, to be designated “City of Overland Park, Kansas, Federally Taxable Private Ac- tivity Revenue Bonds, Series 2021 (Overland One – Building 3 Project)” in the principal amount not to exceed
$35,500,000 (the “Bonds”), for the purpose of providing funds to pay the costs of acquiring, constructing and equipping the Project. The Bonds shall be dated and bear interest, shall mature and be payable at such times, shall be in such forms, shall be subject to redemption and payment prior to the maturity thereof, and shall be issued in the manner prescribed and subject to the provisions, covenants and agreements set forth in the Inden- ture. The Bonds shall be special limited obligations of the Issuer payable solely from the trust estate established under the Indenture, including revenues from the lease of the Project to the Company. The Bonds shall not be general obligations of the Issuer, nor constitute a pledge of the full faith and credit of the Issuer and shall not be payable in any manner by taxation.
Section 3. Execution of Bonds and Bond Documents. The Mayor of the Issuer is hereby autho- rized and directed to execute the Bonds and deliver them to the Trustee for authentication on behalf of, and as the act and deed of the Issuer, in the manner provided in the Indenture. The Mayor is further authorized and directed to execute and deliver the Bond Documents on behalf of, and as the act and deed of the Issuer, in substantially the forms on file in the office of the City Clerk, with such corrections or amendments thereto as the Mayor may approve, which approval shall be evidenced by execution thereof, and to execute such other docu- ments, certificates and instruments as may be necessary or desirable to carry out and comply with the purposes and intent of this Ordinance and the Bond Documents. The City Clerk of the Issuer is hereby authorized and directed to attest the execution of the Bonds, the Bond Documents and such other documents, certificates and instruments as may be necessary or desirable to carry out the intent of this Ordinance under the Issuer’s official seal.
Section 4. Pledge of the Project and Net Earnings. The Issuer hereby pledges the Project and the net earnings generated under the Lease to the payment of the Bonds in accordance with K.S.A. 121744. The lien created by such pledge shall be discharged when all of the Bonds shall be deemed to have been paid within the meaning of the Indenture.
Section 5. Further Authority. The officials, officers, agents and employees of the Issuer are hereby authorized and directed to take such action, expend such funds and execute such other documents, certificates and instruments as may be necessary or desirable to carry out the provisions of this Ordinance and to carry out and perform the duties of the Issuer with respect to the Bonds and the Bond Documents as necessary to give effect to the transactions contemplated in this Ordinance and in the Bond Documents.
Section 6. Effective Date. This Ordinance shall take effect from and after its final passage by the Governing Body of the Issuer, signature by the Mayor and publication once in the official newspaper of the Issuer.

Sealed bids for TWELVE (12) 2021 TREADMILLS will be received by the City of Overland Park, Kansas, at the office of the City Clerk, City Hall, 8500 Santa Fe Drive, Overland Park, Kansas 66212 until 2:00 p.m. local time on November 2, 2021. At that time all sealed bids will be transferred to the City Council Chamber, City Hall, where they will be publicly opened and read aloud. All bids shall be submitted in sealed envelopes addressed to the City Clerk of Overland Park, Kansas, and marked "BID FOR: TWELVE (12) 2021 TREADMILLS." Bids shall be made upon the form provided in ink or typewritten. No oral, facsimile or telephonic bids or alterations will be considered.

In the event the successful bidder is unable to execute the contract, for whatever reason, City may exercise its legal prerogatives, including, but not limited to, enforcement of its rights as to the bid security.
The City reserves the right to accept or reject any and all bids and to waive any technicalities or irregularities therein. Bids may be modified or withdrawn by written request of the bidder received in the office of the City Clerk, prior to the time and date for bid opening; provided, however, that no bidder may withdraw its bid for a period of thirty (30) days from the date set for the opening thereof.
ALL BIDDERS AGREE THAT REJECTION SHALL CREATE NO LIABILITY ON THE PART OF THE CITY BECAUSE OF SUCH REJECTION. Community Notification
The City of Overland Park, Kansas, Planning & Development Services Department, in accordance with National Flood Insurance Program regulation 65.7(b)(1), hereby gives notice of its intent to revise the flood hazard information, generally located near the intersection of W. 101st Street and Connell Drive. The flood hazard revisions are being proposed as part of Conditional Letter of Map Revision (CLOMR) Case No. 21-07-0777R for a proposed project along Indian Creek Tributary 5. The City of Overland Park is proposing to construct channel widening and deepening improvements as part of improving stormwater capacity within the project limits.
Once the project has been completed, a Letter of Map Revision (LOMR) request should be submitted that will, in part, revise the following flood hazards along Indian Creek Tributary 5.

c. Prior to the issuance of a building permit, the property shall be preliminary and final platted.

d. Prior to the submittal of a building permit, the Planning Commission shall approve final development plans.
e. Prior to the issuance of a Certificate of Occupancy, all rooftop and ground mounted mechanical equipment shall be screened from view with an architectural treatment that is compatible with the building architecture.
f. At the time of final development plan, the applicant shall provide detailed plans of the proposed amenity areas.
g. A density bonus of 3.4% is approved with this application.
h. The final plan shall meet the requirements of the Site Design Standards and Architectural Design Standards.
i. The number, location, and geometrics of all driveways and parking areas are subject to review and approval by the Planning and Development Services Department.
j. Concurrent with the submittal of construction plans for a public improvement, site development, or building permit, whichever comes first, the developer’s engineer shall provide a Final Stormwater Management Study that addresses any outstanding items from the Preliminary Stormwater Management Study and includes any design changes. The study shall be approved prior to the issuance of a permit.
k. Prior to the issuance of a building permit, the public improvements shall be built and accepted for maintenance by the Engineering Services Division.
l. Prior to the issuance of a public improvement permit, a landscape architect registered in the State of Kansas shall provide a landscape plan for any seeding or planting associated with the designated stormwater treatment facilities.
m. Prior to the issuance of a public improvement or site development permit, whichever comes first, the owner/developer shall submit a stormwater treatment maintenance agreement for review and approval by the Engineering Services Division. The stormwater treatment maintenance agreement shall be submitted to the Engineering Services Division for recording at the Johnson County Department of Records and Tax Administration with the recording fee paid by the owner/developer.

n. Prior to the issuance of a public improvement or site development permit, whichever comes first, a performance surety for the stormwater treatment facilities shall be provided by the owner/developer in accordance with Section 16.210.080.C of the O.P.M.C.
o. Prior to the release of the performance surety for any stormwater treatment facilities and prior to the issuance of any building permits, the owner/developer shall provide a certificate of completion and compliance for all constructed stormwater treatment facilities. The owner/developer shall submit a maintenance certification one year after construction is completed, and every two years thereafter. The certification shall be on a form as approved by the Engineering Services Division and shall be performed by a professional engineer licensed in the state of Kansas unless the Director approves other qualified individuals to perform the certification.
p. Prior to the release of the performance surety for any deferred stormwater treatment facilities and prior to the issuance of any building permits for non- deferred stormwater treatment facilities, a maintenance surety shall be provided by the owner/developer for the stormwater treatment facilities in accordance with Section 16.210.080.E of the O.P.M.C.
q. Concurrent with the submittal for construction plans, the applicant shall provide an evaluation of the existing vegetation being utilized as a stormwater treatment facility. If it is determined that the area requires restoration, a landscape architect registered in the State of Kansas shall provide a sealed landscape plan for the native vegetation plantings being utilized as a stormwater treatment facility.
r. Prior to the issuance of a certificate of occupancy, all sidewalk ramps in the public right-of-way adjacent to the property shall be constructed or reconstructed to conform with current public sidewalk ramp requirements, including the installation of truncated domes where applicable.
s. Prior to the issuance of a certificate of occupancy, any existing public sidewalk adjacent to this property that does not substantially meet current City standards or is in poor condition shall be reconstructed to current City standards. The limits of the repair shall be approved by the Engineering Services Division prior to the issuance of a building or site development permit. An alternate route for pedestrian traffic shall be maintained in compliance with Section 13.10.070 of the Municipal Code. In no case shall public sidewalks be closed to pedestrian traffic for a period exceeding 30 days without prior approval from the City.

Section 3. The Zoning District Map for the City of Overland Park, Kansas, is hereby amended by this ordinance, Ordinance No. Z-4162, said amendment being incorporated by reference pursuant to Section 18.150.020 which is amended to read as follows:
18.150.020 Zoning District Map
The boundaries of the zoning districts enumerated in Section 18.150.010 and in Article 7 of the Johnson County, Kansas, Zoning & Subdivision Regulations adopted herein shall be shown on a map officially designated as the Zoning District Map, which map is hereby incorporated by reference. Such "Zoning District Map" shall be marked "official copy of zoning district map incorporated into the zoning regulations by adoption of a zoning ordinance by the Governing Body of the City on the 4th day of October, 2021," and shall be filed in the office of the Director of Planning and Development Services of the City of Overland Park, Kansas, to be open to inspection and available to the public at all reasonable business hours. Ordinances amending the boundaries of zoning districts shall order the
"Zoning District Map" to be changed to reflect such amendment, shall amend this Section 18.150.020, and shall reincorporate such "Zoning District Map" as amended.
Section 4. All zoning ordinances or provisions of the City of Overland Park, Kansas, otherwise limiting the use of the above described real property and inconsistent with this ordinance are hereby repealed. Further, Overland Park Municipal Code, Section 18.150.020, is hereby repealed to allow for amendment to the Zoning District Map as set forth hereinabove.
Section 5. Take Effect. This ordinance shall take effect and be in force as of the date of its passage, approval and publication as provided by law.

AN ORDINANCE RELATING TO ZONING: AMENDING CERTAIN ZONING REGULATIONS SHOWN ON SHEET NO. 075 OF THE ZONING DISTRICT MAP INCORPORATED BY REFERENCE BY OVERLAND PARK MUNICIPAL CODE SECTION 18.150.020; AMENDING OVERLAND PARK MUNICIPAL CODE SECTION 18.150.020, AND REPEALING THE SAME.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF OVERLAND PARK, KANSAS:
Section 1. Amendment of Zoning District Map. The zoning district boundaries set forth on the Zoning District Map, Sheet No. 075, of the City of Overland Park, Kansas, incorporated by refer- ence in the Overland Park Municipal Code, Section 18.150.020, are hereby amended with respect to the following described real property, to-wit:
Legal Description:
The East 165 Feet Of The West 1/2 Of The Southwest 1/4 Of The Southeast 1/4 Of Section 24, Township 14, Range 24, Except Any Part Thereof In Roads, All Lying In Overland Park, Johnson County, Kansas.
The real property hereinabove described shall hereafter be deemed zoned and classified as R-1, Single-Family Residential District.
The Zoning District Map, Sheet No. 075 is hereby ordered to be changed to reflect such amendment.
Section 2. Stipulations and Conditions. The rezoning granted in Section 1 of this ordinance is hereby made contingent upon the performance and observance of the following regulations, stipulations, conditions, and restrictions, to-wit:
a. Prior to the issuance of a building permit, the property shall be preliminary and final platted.
b. Access to 175th Street may be modified or restricted by the City Engineer to meet City Ordinance and adopted Access Management Standards in place at the time when 175th Street is improved.
