MASSAGE AND BODYWORK PERMIT

APPLICATION AND INSTRUCTIONS

CITY OF MANHATTAN BEACH

COMMUNITY DEVELOPMENT DEPARTMENT CHAPTER 4.36 MBMC

OVERVIEW

Massage/bodywork services includes any method of pressure on or friction against the body, with or without the aid of any mechanical or electrical apparatus or appliances or with or without supplementary aids such as rubbing alcohol, oils, powders, lotions, etc. A Massage/bodywork Practitioner provides massage/bodywork services to patrons in permitted locations.

Business owners- Every person, including self-employed persons, conducting, owning,

operating, or managing a massage/bodywork business, except as exempted below, is required to obtain a Massage/bodywork Permit through the Community Development Department. Once approved, the permit is valid for two calendar years. Renewal of a permit requires a new application, fees, updated photos, fingerprinting and any other supplemental information as deemed necessary by the Planning Division staff or the Police Department. A City business license from the Finance Department is also required.

Exemptions- (All still require a City business license)

1. Cosmetologists- State licensed cosmetologists providing services defined in the Business and Professions Code Section 7321. (4.36.010)

2. Healing Arts- Any treatment in the practice of any healing arts or under the supervision of any person licensed to practice any such art or profession under the provision of the Business and Professions Code of the State of California or any other stature of the State. (4.36.160)

3. Modalities- If approved by Community Development and the modality involves

minimal touching, the client remains fully clothed, practitioners undergo a training program consisting of at least 500 hours of instruction, and the modality is governed by a professional organization responsible for certification of practitioners and for the enforcement of professional and ethical standards. (4.36.160)

4. Ancillary massage/bodywork services- If performed by a State Certified Massage Therapist (CMT) with a certificate per the Business and Professions Code Section 4600 et seq. And if performed in a health club or beauty salon where twenty-five percent (25%) or less of the overall business operation is related to the provision of massage/bodywork services as measured by the percentage of gross sales or floor area devoted to the provision of massage/bodyworks, whichever is greater. (4.36.170) If exempt as an Ancillary massage/bodywork service, submit the appropriate materials to verify exemption and complete Section I and Section IV of this application.

Massage/bodywork Practitioners are only required to obtain a Massage and Bodywork

Permit if they also conduct, own, operate, or manage a massage/bodywork business.

All Massage/bodywork Practitioners, including self-employed, must obtain a City

business license from the Finance Department. Community Development staff will review and approve the business license prior to issuance by the Finance Department. All Practitioners must show Community Development staff a current original identification card as a Certified Massage Therapist (CMT) with a photograph issued by the California Massage Therapy Council (CAMTC), in accordance with Business and Professions Code Sections 4600 et seq. (4.36.030)

MASSAGE /BODYWORK PERMIT PROCEDURE

1. Complete all sections of the attached application.

2. Provide two 2” x 2” color photos taken within the last 60 days. Black and white photos will not be accepted.

3. Present an original Certificate of Completion in a course of study in massage/bodywork at a school or institution approved pursuant to the California Education Code with a State approved massage/bodywork curriculum of not less than 100 hours. This document may be in the form of an official transcript or diploma with an original seal. Planning will make a copy of the original for the permit file at the time the application is submitted.

4. Provide written consent from the property owner approving the operation of the business or a copy of the lease for the premises executed by the owner evidencing such consent.

5. Submit completed application, photos, original Certificate of Completion, written consent or lease and all other information deemed necessary by the Planning Staff to the Community Development Department.

6. Fees are due at time of submission. A total of $490.00 is due (fee calculation on last page). Checks are to be made payable to the City of Manhattan Beach.

7. Go to the City of Manhattan Beach Police Department or an alternate location for fingerprinting. If an alternative location is selected obtain a Request for Live Scan application form from the Planning Division. If using the City of Manhattan Beach Police Department they will provide the Request for Live Scan application form. Be sure to show proof of payment and have Request for Live Scan application completed. 8. After the Live Scan is completed provide a copy to the application form to Planning for verification that the Live Scan process has been initiated.

9. While fingerprinting is being analyzed by the Police Department, Planning Staff will schedule an appointment for inspection at the proposed business site. If the site is not ready for inspection, then the Massage Permit will not be issued until an inspection can be performed.

10. The Police Department will notify Planning Staff when clearance is provided. Planning Staff will then notify applicant of clearance. The permit and approval letter will be issued at this time.

MICELLANEOUS INFORMATION

The Manhattan Beach Police Department is located at 420 15th Street Manhattan Beach,

CA 90266. Call (310) 802-5140 for fingerprinting hours prior to coming in. A list of alternate fingerprinting locations is available at the Community Development Department. Please note that locations outside of Manhattan Beach will charge additional fees.

New applications take 60 - 90 days to process (renewals 2-4 weeks). Once reviewed, the applicant will be contacted by Planning Staff to complete processing.

All persons providing massage/bodywork services are also required to obtain a City Business License from the Finance Department.

As the holder of a massage/bodywork business permit, the applicant shall not hire or employ any individual to perform as a massage/bodywork practitioner unless that person possesses a valid permit as required by the Massage/Bodyworks Ordinance (Ord. 1946 & amend. by Ord. 1953).

Whenever any change occurs relating to the written information specified in this application, including changes in the physical layout of the business, changes in employees or operations, the applicant shall report said change(s) to the Permit Administrator prior to the change taking effect.

The holder of a massage/bodywork business permit shall notify the Permit Administrator of the name and address of each person to be employed as massage/bodywork practitioner, acupressurist, or any person engaged in performing massage/bodywork activities prior to that person being employed.

Prior to issuance of a permit, an inspection shall be required to confirm the facility requirements. Review the following list and check the appropriate compliance box. Explain all “no” answers below.

No massage/bodywork activity shall be conducted with any cubicle, room, booth or other area which may be locked (unless otherwise exempted by Ordinance 1946).

A recognizable and readable sign shall be posted at the main entrance, identifying the establishment, subject to compliance with the Sign Code. Equipment for disinfecting and sterilizing instruments used in massage/bodywork shall be provided.

Hot and cold running water, soap or detergent, and sanitary towels or air dryer shall be provided at all times.

Separate closed receptacles shall be provided for the storage of clean and soiled linen.

All wall ceilings, floors, pools, showers, bathtubs, steam rooms, equipment and all other physical facilitates shall be sanitary and in good repair.

Wet and dry heat rooms, steam or vapor rooms, steam and vapor cabinets, shower compartments shall be thoroughly cleaned after each use and toilet facilities shall be kept in a clean and sanitary condition. Clean and sanitary towels and linens shall be provided for each patron. No common use of towels or linens shall be permitted.

Standard or portable massage/bodywork tables or a mat suitable for shiatsu or acupressure shall be used. Foam pads more than four inches thick or with a width of more than four feet may not be used. Beds, mattresses, and water beds may not be used.

FEE CALCULATION

A fee of $32 for the DOJ, $24 for FBI and $23 for fingerprinting, and background investigation is required. Business owners/operators each pay a fee of $411 every two years in addition to the fingerprinting, FBI, and DOJ fees.
