STATEMENT OF PROBABLE CAUSE   The Complainant states that the following facts establish probable cause:   On or about January 18, 2017 at approximately 5:30 a.m., Deputy Mac Malecha received a phone call from B.H. regarding allegations of multiple violations of an Order for Protection in which B.H. is the protected party. B.H. lives at 7539 230 Street West in Morristown, which is in Rice County, Minnesota. B.H. shares the residence with her two young children. Jeremiah James Bauer, dob 11/26/1980, herein the defendant, is the father of these children, and B.H. and the defendant were previously in a relationship for approximately 10 years.  B.H. told Deputy Malecha that on January 17, 2017 at approximately 5:45 p.m., the defendant began texting and calling her and was "blowing up" her phone all night. B.H. stated that the defendant was calling her but not leaving her voicemails. B.H. reported that the defendant tried calling her 31 times and sent more than 50 text messages since 5:45 p.m. the night before. B.H. described the content of some of the text messages in which the defendant was stating that he wanted to come and see her and the children, wanted to bring hay over for the horse, and stated that he was going to shower and would be coming over. B.H. repeatedly told the defendant to stop contacting her and that he was not welcome. The defendant also sent messages in which he asked what makes B.H. better than him and why she gets to see the kids all of the time; he also said that he is not over her and never will be, asked her to "hang out" with him and questioning why she refuses to do so, and accused her of illegally kicking him out of the house without giving him a 30-day notice. B.H. described the defendant as abusive toward her when they were together. B.H. told Deputy Malecha that when she woke up for work, she saw tracks in the snow to go behind the barn and into the shed, but B.H. did not follow the tracks to search for the defendant as she is afraid of him. The defendant sleeps in his 2007 Chevy truck and also stays on occasion with his parents in the nearby area. B.H. stated that she has spent numerous sleepless nights watching out her windows for the defendant as he can see her house clearly from the road. Faribault Police Officers Shuda and Alexander responded to B.H.'s address with Deputy Malecha, where they checked around the property and into the field. The snow was wet and slushy, and they were able to observe vehicle tracks that came up to the horse barn and some foot prints that went around the barn, up behind the garage and near the house door. The vehicle tracks went into the field to the north and west of the property. Deputy Malecha photographed the tire marks, which he found consistent with that of a pickup truck because of the terrain and condition of where the tracks went. Deputy Malecha attempted to locate the defendant and/or his truck but was not successful at the time.

Deputy Malecha was also able to locate a Domestic Abuse No Contact Order ("DANCO) issued in Rice County Case Number 66-CR-16-2719 arising from an incident in which the defendant was charged with Violation of a Protection Order as a gross misdemeanor for a second offense. The DANCO also prohibits the defendant from having any contact with B.H. or going to her residence. The DANCO was modified on approximately January 5, 2017 to allow the defendant to have telephone contact with B.H. solely for the purpose of arranging parenting time. The defendant's request's to B.H. to "hang out," statements that he was coming to the residence against the victim's wishes, and most of the other text messages did not address arranging parenting time. The defendant is presently on probation in Rice County Case Number 66-CR-14-2721 for Second Degree Assault which occurred on November 14, 2014. B.H. and her children were the victims. In that case, the defendant physically assaulted B.H. and the children, prevented them from leaving the residence, threw B.H.'s cell phone in the bathtub to prevent her from calling 911, and then holding a gun on B.H. and threatened to end all of their lives. B.H. was able to flee with the children after the defendant fell asleep. The defendant was sentenced on July 1, 2015 for Second Degree Assault and placed on probation for five years with local jail time.
