A RESOLUTION APPROVING TWENTY-SIX (26) FORFEITURE FUND PROGRAM/PROJECTS AW ARD ED AS A PART OF THE 2020 LAW ENFORCEMENT TRUST FUND GRANT AW ARD PROGRAM; AUTHORIZING THE MAYOR OR HIS DESIGNEE TO EXECUTE AGREEMENTS AND ALL DOCUMENTS NECESSARY TO EFFECTUATE THESE

AW ARDS; APPROVING A SUPPLEMENTAL

APPROPRIATION IN THE AMOUNT OF $31,603 FROM THE UNAPPROPRIATED BALANCE OF THE LOCAL LAW ENFORCEMENT STATE TRUST FUND (1601) TO THE POLICE DEPARTMENT, LOCAL LAW ENFORCEMENT STATE TRUST FORFEITURE DIVISION (140-2857) TO FULLY FUND THE AWARDS; AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, the City of St. Petersburg Police Department ("Department") is required by Florida Statute 932.7055 to expend at least 25% of the total fiscal year deposits into its forfeiture trust fund for crime prevention, neighborhood safety, drug abuse education, drug prevention or school resource officer program(s); and

WHEREAS, the Department has developed a Law Enforcement Fund Grant A ward Program ("Program") in which neighborhood groups, organizations, other City departments or associations may apply for a portion of said funds; and

WHEREAS, the Department solicited applications and the Funding Approval Committee ("Committee") approved twenty-six (26) programs/projects for full or partial funding for a total of

WHEREAS, one of the programs/projects is the Chiefs program to be used by the Chief of Police to fund programs/projects meeting the criteria ofF.S. 932.7055; and

WHEREAS, the Chief of Police has approved the recommendations of the Committee.

NOW THEREFORE, BE IT RESOLVED by the City Council ofthe City of St. Petersburg, Florida, that twenty-six (26) forfeiture fund programs/projects awarded as a part of the 2020 Law Enforcement Trust Fund Grant A ward Program are hereby approved and the Mayor or his designee is authorized to execute agreements and all documents necessary to effectuate these awards; and

BE IT FURTHER RESOLVED that there is hereby approved from the unappropriated balance of the Local Law Enforcement State Trust Fund (1601), the following supplemental appropriation for FY21:

SUBJECT: A resolution approving twenty-six (26) Forfeiture Fund Program/Projects awarded as a part of the 2020 Law Enforcement Trust Fund Grant A ward Program; authorizing the Mayor or his designee to execute agreements and all documents necessary to effectuate these awards;

approving a supplemental appropriation in the amount of $31,603 from the unappropriated balance of the Local Law Enforcement State Trust Fund ( 160 l) to the Police Department, Local Law Enforcement State Trust Forfeiture Division (140-2857) to fully fund the awards; and providing an effective date.

EXPLANATION: Pursuant to Section 932.7055, Florida Statutes, the St. Petersburg Police Deparlmenl is required to expend al least 25% of the proceeds realized through the seizure and forfeiture of property used in violation of the Florida Contraband Forfeiture Act for the support or operation of eligible programs in the following categories: Crime Prevention, Neighborhood Safety, Drug Abuse Education and Prevention Programs, and School Resource Officer Program(s).

Based on the statutory formula (25%), a minimum of $31,603 is to be available and approved for distribution in the 2020 award program.

The Funding Approval Committee met on October 7, 2020. The Committee approved twenty-six (26) eligible programs which includes Chief of Police programs/projects for full or partial funding in the amount of $31 ,603. The Chief of Police has approved the recommendations of the Committee.

For each applicant awarded funding, the administration will enter into an agreement with the applicant. The agreement will outline the requirements for completion of the project to include the expenditure documentation process, the disbursement of the awards, and the time line for completion of the funded projects.

RECOMMENDATION: The administration recommends that City Council adopt the attached resolution approving twenty-six (26) Forfeiture Fund Program/Projects awarded as a part of the 2020 Law Enforcement Trust Fund Grant Award Program; authorizing the Mayor or his designee to execute agreements and all documents necessary to effectuate these awards; authorizing a supplemental appropriation in the amount of$31,603 from the unappropriated balance of the Local Law Enforcement State Trust Fund ( 160 l) to the Police Department, Local Law Enforcement State Trust Forfeiture Division (140-2857) to fully fund the awards; and providing an effective date.

COST/FUNDING INFORMATION: Funds for the 2020 Law Enforcement Fund Grant Award Program will be available after approval of a supplemental appropriation in the amount of $31,603 from the unappropriated balance of the Local Law Enforcement State Trust Fund ( 160 l) to the Police Department, Local Law Enforcement State Trust Forfeiture Division (140-2857). The fund balance after this appr · n will be approximately $178,341.
