COOPERATIVE LIBRARY AGREEMENT

Laredo Community College

Texas A&M International University

Laredo Community College and Texas A&M International University, adopting a common goal to promote and facilitate access to information, communication, and research available in their respective libraries, will extend free reciprocal borrowing privileges to each other's faculty, students, and staff, so they may have direct, personal access to library materials that are not available at the home institution. The covenants below are intended to accomplish this goal. Generally, this agreement for on-site use and direct circulation of materials will preclude

interlibrary loan service between the college and the university. However, the library directors or their designees may make exceptions in special cases to fax material or arrange interlibrary loan of items. This agreement will become effective on the date of signature of the officials of the covenanting institutions.

A preliminary point should be emphasized before the covenants of this agreement are set forth: This agreement should in no way be interpreted as conferring rights on any borrower. The agreement is for privileges that may be revoked at any time by the borrower's home library or withheld by the lending library.

THE AGREEMENT

1.

SCOPE

The libraries to which this agreement

applies are the libraries of Laredo

Community College and Texas A&M International University.

and staff of Laredo Community College and Texas A&M International

University.

The tenDs faculty, student and staff refer to individuals identified and/or defined as such by their home institutions.

PRIVILEGES

Any eligible faculty, students

and staff of Laredo Community College and Texas

A&M International University may use the collections of the counterpart

institution, and upon proper identification (college or university ill card), borrow

materials that they may take away with them. The circulation policy of the

lending library, not the patron's home library, will be applied to these transactions

including circulation periods, fine policies, replacement

policies, and restrictions

or charges for damages

or replacement

of items at his/her home library or the

lending library may be denied participation in this program.

3.

RESPONSIBILITIES OF BORROWERS

A.

Present appropriate identification as required by this agreement. Items must be physically checked out in person by the ill cardholder at the lending library.

B.

Return items physically, directly to the lending library within the loan period

prescribed by the lending library. I

c.

Observe

the regulations

of the lending library.

D.

Return materials immediately and directly to the lending library if recalled by the lending library.

E.

Pay fines or any other charges assessed by the lending library including charges incurred as the result of late return, damage or loss of materials.

RESPONSIBILITIES OF LIBRARIES

A.

Each library will maintain at the circulation desk and distribute to patrons

handouts detailing its major circulation policies which apply to transactions under this agreement. The handouts should outline privileges, but also note if there are any restrictions on the use of collections or types of materials or services.

B.

Each library will inform the other if any significant changes in circulation policy such as circulation periods or fine policies are being considered.

c.

The lending library will take available and appropriate

actions to recover payment

from delinquent

borrowers. The lending library will collect overdue and lost item

charges,

according

to its fme policies, on return of the overdue item(s) or

notification of the loss of the item. The lending library will bar patrons with

outstanding

charges

from circulating items at the lending library until the fine is

paid.

D.

Each library will prepare

a report at the end of each semester

(by an agreed-upon

date) of the charges

owed it by the other library's patrons. After this report has

been sent, the patrons' home libraries will be responsible for collecting

outstanding

charges. The patrons' home libraries will place holds on delinquent

patrons until the fines are paid.

Overdue monies will accrue to the library which collects the fine. Replacement charges referred to the home library and collected there will be remitted by the home library to the lending library.

LIAISON AND PROBLEM RESOLUTION

Each library will appoint a liaison for this cooperative library program. Duties of the liaison include promoting the program locally, providing information on the program and insuring that the policy handouts are available, administering the program at the library, and resolving individual problems. Problems or iss1,les of a broader scope should be resolved between the library directors or their designees.

REVIEW AND ASSESSMENT

A.

The details of this agreement may be amended by agreement between the two institutions. At the end of three months from the effective date of the agreement, a joint committee from the two libraries will review the agreement to determine if any amendments are advisable. Thereafter the agreement will be reviewed at least once annually.

B.

It is understood that this agreement may be terminated at the end of anyone-year period (calculated September I-August 31) at the option of the participating libraries. Notice of intent to terminate participation must be made in writing to the library director of the other library not later than 60 days preceding the date of intended termination.
