Lemoyne Borough Council Work Session Meeting Minutes—February 4, 2021

The Work Session Meeting of Lemoyne Borough Council was called to order at 6:37 p.m. on Thursday, February 4, 2021. Present were Council members Rebecca Coleman, Joe Gargiulo, Kasha Griva, Gene Koontz, Jesse Monoski, Suzanne Yenchko. Council President Gale Gallo was absent. Also present were Mayor David G. Beasley, Borough Manager Cindy L. Foster, Executive Assistant Jenn Erickson, Assistant Treasurer Amanda Seibert, Code Enforcement Officer Trisha Rafferty, Maintenance Department Superintendent Cliff Karlsen, Wastewater Treatment Plant Superintendent Bob Oakes, West Shore Regional Police Department Chief Michael Hope, Lieutenant John Friel, Borough Engineer Mike Knouse and Borough Solicitor Anna Marie Sossong.

Special Presentation –

1. Monarch Development Group – Brandon Johnson VP of Development for Monarch Development Group, provided an overview and proposed timeline for Riverton Woods, an affordable housing senior living project on 12th Street below Artis Senior Living. Brandon is seeking an opinion from the Zoning Officer that would allow a reduction in the parking requirement as per the Municipalities Planning Code 916.2. Mr. Johnson and Ms. Rafferty fielded questions from Council. After much discussion, Mr. Monoski requested an agenda revision be added under Ordinance & Zoning.

Agenda Revisions—

1. At Mr. Monoski’s request, a motion to authorize drafting a letter by Ms. Rafferty to Monarch Development Group regarding the request for a parking waiver be added under Ordinance &

Zoning.

2. Mr. Gargiulo requested an open discussion be added under Streets Committee report regarding residents’ comments concerning snow response.

3. At Mr. Gargiulo’s request, an update regarding the access road located at Walton Street and Susquehanna Court is to be added under Streets Committee.

Public Comment –

1. Jim Fox, 760A State Street, brought forth concerns regarding the snow removal on sidewalks throughout the Borough. Borough manager, Ms. Foster, acknowledged Mr. Fox’s concern and assured him the Code Enforcement Officer is actively addressing this matter.

2. Councilmember Mr. Koontz, 813 Michigan Avenue, Mr. Koontz first thanked Mr. Fox for voicing a concern he too shared. Mr. Koontz then raised the question if there would be a Community Clean Up Day this year, as he has noticed multiple troublesome areas becoming inundated with trash. Mayor Beasley stated that the community clean up event usually takes place in April and if the event can safely occur with enough volunteers, details will be in the spring newsletter.

Intermunicipal Reports

1. Council of Governments – Ms. Yenchko provided an update from the January 18th meeting:

a. Presentation from Polco National Research Center regarding community surveys b. Covid-19 response in Cumberland County

c. No property tax increase d. Claremont Sale update

2. Cumberland County Municipal Advisory Board – No meeting

3. Cumberland County Tax Collection Committee – Mr. Monoski noted he was unable to attend the last meeting however Mr. Gargiulo was able to attend in his place. Mr. Gargiulo noted:

a. A request for proposal (RFP) was discussed regarding the search for a new auditor.

b. Elected officers were announced.

c. Mr. Monoski gave a brief review of the EIT /LST comparison report.

4. Cumberland County Redevelopment Authority – Ms. Yearick provided an update on businesses and properties in the Borough.

5. Franklin-Cumberland County Boroughs’ Association – No meeting 6. Lemoyne Municipal Authority – Mr. Koontz provided an update:

a. Re-organization meeting results were announced.

b. Moving toward the conversion to ultraviolet radiation replacing the chlorination.

7. West Shore Recreation Commission (WSRC)– Mr. Leverentz noted there was no meeting as the next meeting will be held next week.

8. West Shore Bureau of Fire Commission –Ms. Griva noted:

a. Moving forward with necessary IT upgrades i.e., 5G compatibility and 911 updates b. Reminded residents that the fundraiser mailer has been sent out.

c. Continuing efforts to make changes in protocols to manage the spread of Covid -19, ensuring the safety of the residents and firefighters.

Officials/Staff Reports

1. Council President Gallo— Ms. Yenchko reported although Council President Gallo was absent, she wanted to be on record noting her concern with the consistency of declaring a snow emergency.

2. Mayor Beasley— Mayor Beasley noted Grace Church is not for sale and is potentially to become a community outreach program location. Two local Pastors are seeking suggestions as to what the community is in need of and how they can comply.

3. Borough Manager—Ms. Foster reported:

a. The newsletter is rapidly approaching, and March 1, 2021 is the deadline for all articles to be submitted.

b. Audit season is officially upon us. We are in the midst of our first audit and the liquid fuels audit will soon follow.

c. Comprehensive Recreation, Parks & Open Space Plan committee’s next meeting will be held February 18, 2021 at 5:00 p.m. and will be open to the public.

4. Code Enforcement Official—Ms. Rafferty reported:

a. Updates on recent code violations that have been cited or corrected.

b. R.S. Mowery and Sons have contacted the Borough and will be submitting a building application for the former Middle School in the upcoming week.

c. To ensure pedestrian safety, in response to citizen complaints concerning lack of snow and ice removal from sidewalks, steps are being taken to ensure property owners are reminded of their responsibility for timely snow removal.

5. Borough Engineer/Building Code Official Reports—Mr. Knouse reported:

a. Updates on the 2020 Sanitary Sewer Improvements Project.

i. Submittal of the application for Payment No.2 to Farhat Excavating LLC in the amount of $82,935.00 for approval at the February 18, 2021 business meeting.

b. Updates on proposed development of 3 lots on Indiana Avenue regarding the submitted stormwater plan.

c. Request for authorization to advertise bids in March for Annual Roadway Project will be on the agenda for the February 18, 2021 business meeting for Council’s

consideration.

6. Maintenance Department Superintendent—Mr. Karlsen reported:

a. Maintenance Department staff has been working on restoring playground equipment and picnic tables at Negley Park.

b. Maintenance staff shifted focus onto snow removal, as multiple storm systems came through the Borough.

7. MS4 Coordinator—Mr. Karlsen reported on behalf of the MS4 Coordinator:

a. Repairs were completed to the inlet located at 52R Market Street.

b. Completed multiple rounds of inlet topper cleanings.

c. Cleaned sediment bags at 9th Street and Hummel Avenue 8. WWTP Superintendent—Mr. Oakes reported:

a. Plant is running well and is now fully staffed.

b. Provided knowledge regarding the potential conversion to ultraviolet radiation noting it is safer for both employees and the environment.

c. Thanked Council for the authorization to hire Mr. Janney as he has been a great addition to the Wastewater Treatment Plant staff.

d. Mr. Janney and Mr. Wagoner will be moving forward to obtain their operator’s license by taking classes at HACC.

e. Upcoming Pennsylvania Department of Environmental Protection (DEP) routine visit will take place on February 9, 2021.

9. Police Chief— Chief Hope noted:

a. The written monthly call report.

b. Announced the Police Department has passed the assessment for accreditation and is set to be recommended for reaccreditation at the Police Commission meeting in March. This reaccreditation will last 3 years.

Committee Reports 1. Administration

a. Downtown Program Manager Services Agreement – Ms. Yenchko noted The

Cumberland County Housing & Redevelopment Authority is requesting the renewal of the Downtown Program Manager Services agreement for 2021. The terms and rate remain the same as in 2020--$7,000 as was approved as part of the 2021 budget process. The agreement will be added to the February 18th meeting agenda for consideration.

b. Shade Tree Commission Vacancy – Ms. Yenchko stated the Borough received a letter of interest and resume from Ms. Marsha Everton. Ms. Everton was in attendance to provide a brief statement expressing her interest in filling the existing vacancy on the Shade Tree Commission. Since there were no objections, Ms. Everton’s appointment will be added to the February 18th agenda for consideration.

2. Public Safety –

a. County Hazard Mitigation Plan Update – Ms. Coleman reported the Cumberland County Planning Department, forwarded a draft resolution relative to the County’s updated Hazard Mitigation Plan. The Disaster Mitigation Act of 2000 requires state and local governments to develop and adopt a plan that is a prerequisite to receiving post- disaster funding. Adopting this resolution in support of the revised plan will open the door for us to funding sources should we need them. Council will be asked to adopt the resolution adopting the plan as the official mitigation plan for the County at the February 18th meeting.

3. Streets

a. Proposed Curb & Sidewalk Inspection Program – Mr. Gargiulo opened discussion concerning the draft policy created by staff, for implementing a potential curb and sidewalk inspection program that would provide timely notification to residents when curb and sidewalk repairs are needed prior to our annual paving program. Discussion ensued. Staff will make appropriate changes as requested by Council and Mr. Knouse.

Motions to draft and advertise ordinance and to accept policy will be added to the agenda for consideration at the February 18th meeting.

b. Snow Emergency Response – Mr. Gargiulo opened discussion regarding the citizen complaints concerning the snow events in December and February. Mayor Beasley explained how his decision to declare a snow emergency is based on staff

recommendations including both the weather forecast and staffing. Mr. Karlsen also provided a statement regarding the logic and determining factors that are involved in the decision. Mr. Gargiulo recognized there is seemingly confusion regarding what a snow emergency entails and advised the Streets Committee, including the Chief of Police and the Chief of the Fire Department, will be reviewing the Snow Emergency Plan including streets listed as snow emergency routes and an explanation of why snow emergencies exist.

c. Walton Street and Susquehanna Court Access Point Update – Mr. Gargiulo provided an update regarding Mr. Stark’s previous complaint regarding the supposed use of the access point located on Walton Street. As Council President Gallo was absent this matter will be reported on at a subsequent meeting.

4. Ordinance & Zoning

a. Monarch Development Group: Letter of Opinion–

ACTION ITEM:

Motion by Mr. Monoski, second by Mr. Gargiulo, to authorize the drafting of a letter by the Zoning Officer, Trisha Rafferty, with the cooperation of the Borough Solicitor and Engineer, in response to a parking waiver requested by Monarch Development Group regarding Riverton Woods. Motion passed unanimously.

Public Comment – None

Councilmember Ms. Yenchko noted there will not be a Community Development/Parks & Recreation meeting in February.

Following a motion by Mr. Gargiulo, second by Mr. Monoski, the meeting was unanimously adjourned at 9:04 p.m.
