East Riding of Yorkshire Council’s part of the council tax bill has increased by 3.99% for 2016-17 – the first such increase made by the Council for six years.

The Government is making further cuts to public spending and, as a result, the funding it provides to councils will continue to fall significantly. The main grant that East Riding of Yorkshire Council receives from Government to support service delivery is set to be cut by a further 87% over the next four years.

The Government is no longer funding a council tax freeze and its cuts to council funding going forward assume that councils will increase their council tax to help maintain services.

The Council has already made base budget savings of £118 million over the last six years and estimates that a further £60 million of base budget savings will need to be made by 2019-20, in addition to increases to council tax. These savings and council tax increases are required as a result of future reductions in grants from Government, increasing costs of service delivery, and increasing demand for services, in particular adult social care.

In recognition of the significant financial pressures facing adult social care services, the Government has allowed councils which deliver these services to increase council tax by up to 4 per cent. Increases over 2 per cent must be spent on adult social care. Therefore, this year’s council tax bill includes a new charge to help meet the costs of adult social care services and this is equivalent to a 2% increase in the Council’s charge. However, this charge only meets 55% of the estimated increases in adult social care costs.

The Council’s financial strategy continues to focus on business transformation, income maximisation, cost reduction and asset rationalisation to manage budget reductions together with the strategic use of earmarked reserves.

Within the 2016-17 budget, savings of £22.3 million have been identified, a significant part of which will be delivered through the Council’s Business Transformation Programme which aims to redesign services using technology wherever possible to reduce costs. All residents can help by using the Council’s website to book, pay, contact and transact with the Council.

The significant financial challenges mean that we need to develop new models of service delivery. Consultations on reshaping library and transport services to achieve savings are currently underway.

During the autumn, the Council held three budget events and conducted an on-line survey to understand the priorities of both residents and businesses in the East Riding. The two top priorities were:

Highways repairs and maintenance

The Council continues to invest significantly in improvements and maintenance to highways infrastructure, with a planned investment programme of £81 million over the next four years.

Flood prevention work affecting residents and businesses

The Council carries out work, over and above statutory duties, to maintain drainage and flood infrastructure, develop flood protection schemes and give advice to residents and businesses. This has led to the development of a £106 million investment programme in flood mitigation schemes, funded by central government and European funding, which the Council is currently in the process of delivering.

PAYING YOUR COUNCIL TAX

Online

You can pay the following bills via the internet: • council tax;

• business rates;

• council house and garage rents; • sundry debtor accounts; • overpayment of housing benefit.

Payments may be made free using debit cards or with credit cards for which an administration fee will be payable. To make a payment log on to East Riding of Yorkshire Council’s website at: www.eastriding.gov.uk and click on ‘How can I pay my council tax bill’, this will take you to a page that explains how you can pay.

PayPoint outlets

You can pay your bill free of charge at any outlet displaying the “PayPoint” sign. Please take along with you your barcoded bill, and remember to keep you receipt as proof of payment.

PayPoint outlets only accept cash payments and you should allow four working days for the payment to reach your account.

You can also pay free of charge at any Post Office with your barcoded bill. Payment can be made by cash, cheque or debt card. You should allow four working days for the payment to reach your account. Please keep your receipt as proof of payment.

Payments may be made free using debit cards or with credit cards, for which an administration fee will be payable, using our 24 hour payment line.

Payments by post should be sent to: East Riding of Yorkshire Council, PO Box No. 83, Beverley HU17 9YR.

Cheques should be made payable to East Riding of Yorkshire Council. Please quote the council tax or business rates account number and your name and address on the reverse of the cheque. Post dated cheques are not acceptable.

Cash payments by post should be registered. The council will not accept any responsibility for cash sent by ordinary post.

Direct Debit

Pay your council tax, rent or business rates by direct debit

Direct debit is the easiest and safest way to pay, and offers a choice of dates each month. You can choose either 10 or 12 monthly instalments. Why not join the 110,000 council tax and business rate payers who already use direct debit?

Please remember to pay your instalments on time

Council tax is due each month, and the details of the amounts

due and when to pay are shown on your bill.

You may pay over 10 or 12 monthly instalments from April 2016. If you would prefer to pay over 12 months and are not already on this plan, please contact us and we will change it for you.

If you do not pay an instalment by the due date a reminder will be sent to you. There are Government rules restricting the number of reminders that can be issued for late or

non-Failure to pay on time can result in a summons being issued to you for the full years charge, together with additional costs. The best way to avoid this is to pay by direct debit; you can sign up at www.eastriding.gov.uk/ctdd

Council Tax Discounts

Single person discount

A 25% discount is applicable where there is only one adult resident Empty property discount

A 100% discount is applicable for a maximum of two months where no-one lives in a property, and it is substantially unfurnished

Council tax support

A discount of up to 75% is available to low income households of working age. Unlike other discounts, this is means tested so eligibility depends on income and financial assets available to the household.

For households of pension age, a discount of up to 100% is available. This is also means tested in the same way as the working age scheme.

Council tax discretionary discount

The Council will consider applications for a discount from any council tax payer resident in the East Riding of Yorkshire who is having difficulty in meeting their council tax payments.

There is no statutory right for the Council to award a discount under this scheme, and no predetermined criteria for an award to be made, although a household’s income and expenditure would be an important factor in reaching a decision. All applications for discretionary help are treated individually to ensure that each applicant receives equal and fair treatment. Disabled reduction

A reduction is available if you or someone (adult or child) who lives in your home is substantially and permanently disabled and one of the following conditions is met:

• There is an additional bathroom or kitchen which is needed by the disabled person

• There is a room (other than a bathroom, kitchen or toilet) needed by and mainly used by the disabled person • There is enough space for a wheelchair which is used indoors

This reduction results in your council tax bill being reduced to the amount payable for a property in the valuation band below the applicable band for your property. Properties in the lowest valuation band, Band A, receive a reduction equal to one sixth of the bill.

Other council tax discounts

Other council tax discounts are available in certain circumstances:

• Some residents are disregarded for council tax purposes when calculating the amount payable. Examples of those who are disregarded are full-time students, people who are severely mentally impaired, and patients permanently residing in a care home. A full list of disregards can be found at www.eastriding.gov.uk/counciltax

• A 50% discount may be applicable to an annexe of a property that is lived in by a family member, or is used by a resident of the main dwelling. The annexe must have been separately banded and be classed as a separate dwelling. If a non-family member occupies the annexe, the discount will not apply

• A 50% discount may be applicable to a property in the course of construction and for which a completion notice has been served and which is part occupied. The discount will be for a maximum period of 12 months, or until the property is substantially complete.

• There are special rules for tied accommodation or that provided by the MOD and you are advised to contact the Council if this might apply to you.

INFORMATION ABOUT COUNCIL TAX

What is Council Tax and who has to pay?

Council tax is an annual charge based on the property band that your home is in. Only people aged 18 or over are liable to pay council tax and payment is the responsibility of the owner occupier, tenant, owner or resident. Council tax is payable on occupied and unoccupied properties in many cases.

REDUCTIONS IN COUNCIL TAX

Exemptions

Some properties are exempt from council tax. These exemptions are defined in legislation and the Council cannot change these. If your property is in receipt of an exemption, the details will be shown on your council tax bill.

Classes of exemption

B Unoccupied property owned and previously used by a body established for charitable purposes (exemption lasts for six months).

D Unoccupied property which is the home of someone who has gone to prison.

E Unoccupied property which was the home of someone who has gone into a residential home or hospital to receive residential care.

F Unoccupied property which is waiting for letters of administration/probate to be granted (exemption lasts until probate is granted and for six months after this).

G Property which is unoccupied because occupation is forbidden by law.

H Unoccupied property which is waiting to be occupied by a minister of religion.

I Unoccupied property which was the home of someone who has moved into another residence (not a residential home or hospital) to receive personal care.

J Property left unoccupied by someone who has moved away to provide personal care for another person.

K Unoccupied property which was the home of one or more students who have moved away to study.

L Unoccupied property which has been repossessed.

M Student halls of residence.

N Property occupied only by students.

O Armed forces accommodation owned by MOD.

P Property occupied by visiting forces.

Q Unoccupied property which is the responsibility of a bankrupt’s trustee.

R A pitch or mooring which is not occupied by a caravan or a boat.

S Property occupied only by persons under 18.

T Unoccupied annexe/property that cannot be let separately.

U Property occupied only by persons who are severely mentally impaired.

V Property occupied by a diplomat.

W An annexe occupied by a dependant relative over 65, or severely mentally impaired or disabled.

Your council tax bill has been calculated on the assumption that any exemption for which you may qualify will continue to 31 March 2017. However, if it is a time limited exemption, a new bill will be issued to you two weeks before the end of the exemption.

Long Term Empty Properties

Properties that have been unoccupied and unfurnished for two years or more will be subject to an additional premium of 50% of the council tax for the relevant council tax band, meaning that a 150% council tax charge will be payable. The only circumstances where the premium cannot be charged are:

• Empty properties of service personnel who are living in MOD accommodation due to their employment • Empty annexes which form part of a single property which includes at least one other property

Benefit and Money Advice Service

The Council’s benefit and money advice team are available to provide help to customers who having difficulties meeting their council tax and/or rent payments. The team will work with customers to help set affordable repayment amounts and can help with budgeting in general. The team will also carry out checks to ensure that all benefits are being received and income maximised.

Data protection

In line with advice received from the Information Commissioner’s Office, the Council may use personal data from council tax records to assist it in the exercise of its other functions. The Council is committed to using secondary personal data only for the better performance of its functions and will not permit the use of the data to make decisions about individuals in any way which is unfairly detrimental or causes unwarranted harm or distress.

East Riding of Yorkshire Council will use your information in accordance with relevant legislation including the Data Protection Act 1998. The Council has a duty to protect the public funds that it administers and may use the information you have provided, or provide when requesting a service, for the prevention and detection of fraud and any other lawful purpose. The Council will also share your information where we have any other legal obligation to do so. We will not disclose your personal information to third parties for marketing purposes.

Fraud investigation team

The Council has a team dedicated to the prevention and detection of council tax support fraud. If you suspect someone of committing fraud, you can report your suspicions in complete confidence on the Fraud Hotline by calling (01482) 394949 or by completing a fraud referral form on the Council’s website at www.eastriding.gov.uk

Please remember that when you make a claim for council tax support, you may need to provide us with some supporting evidence. You must also inform us of any change in circumstances of you or any member of your household. Failure to inform us of any changes that might affect your claim could lead to prosecution.

Council Tax Increases

If Local Authorities increase their council tax above a percentage level set by Government each year they are required to hold a local referendum. Parish and Town Councils are excluded from this requirement.

The Secretary of State for Communities and Local Government has made an offer to adult social care authorities. (“Adult social care authorities” are local authorities who have functions under Part 1 of the Care Act 2014, namely county councils in England, district councils for an area in England for which there is no county council, London borough councils, the Common Council of the City of London and the Council of the Isles of Scilly.)

The offer is the option of an adult social care authority being able to charge a “precept” of up to 2% on its council tax for the financial year beginning in 2016 without holding a referendum, to assist the authority in meeting expenditure on adult social care. Subject to the annual approval of the House of Commons, the Secretary of State intends to offer the option of charging this “precept” in relation to each financial year up to and including the financial year 2019-20.

In relation to the financial year beginning in 2016 the Secretary of State has determined (and the House of Commons has approved) a referendum principle of 4% (comprising 2% for expenditure on adult social care and 2% for other expenditure), for adult social care authorities. These authorities may therefore set council tax up to this percentage in 2016 without holding a referendum.

East Riding of Yorkshire Council has increased its part of the council tax bill by a total of 3.99%. This increase is the first such increase in six years and includes a 2% adult social care precept to be used to fund pressures in the adult social care budget. The cost of adult social care is estimated to increase by £20million over the next four years creating significant budget pressures. These pressures, coupled with larger than expected Government funding cuts, and other cost pressures such as inflation have made freezing council tax for a sixth year an unviable option.

The new adult social care precept will only meet 55% of the expected increase in demand and costs for adult social care over the next four years, and even with the 3.99% increases to council tax proposed in each of the next four years, the council’s financial plan forecasts £60.5million of base budget savings need to be made by 2019/20. Proposed savings identified total £43.7million, leaving a shortfall of £16.8million to be found. Alongside savings generated through business transformation projects, the proposed increases to council tax will ensure financial stability and protect priority services

CALCULATING YOUR COUNCIL TAX

Calculating your council tax

The amount of council tax you pay depends on which property band your home is in. However, your final bill will be less if you qualify for council tax support or other reductions. This table shows the amount of council tax for East Riding of Yorkshire Council, Office of the Police and Crime Commissioner for Humberside and Humberside Fire and Rescue Service for each property band. Your council tax bill states which band your dwelling has been placed in. The valuation bands are A-H and are based on April 1, 1991 market values.

Besides the Council, police and fire authority charges, most residents pay an additional amount for the parish or town Council and/or special expenses.

Precepts and special expenses

What are town and parish precepts?

A precept is an order from a town or parish council to East Riding of Yorkshire Council to collect money from the council tax. This money is then paid over to the town or parish council. The precept is shown as a separate item on the council tax bills of those living in the town or parish council’s area - this is for services in addition to those provided by East Riding of Yorkshire Council. The level of service provided varies from area to area and it is the responsibility of each individual town or parish council to set a precept to cover its expenditure. If you want to know where the money is being spent, please contact your town/parish clerk.

What are special expenses?

Special expenses are charges for Council services that East Riding of Yorkshire Council provides which, in some parts of the East Riding, are provided by town or parish councils (e.g. maintenance of parks, open spaces and closed churchyards). The costs are separately identified as “special expenses” on council tax bills in areas receiving these services from East Riding of Yorkshire Council. The cost of services provided by the parish or town council is also separately identified on the bill.

What are the Police and Fire and Rescue Authority precepts?

These are orders from the Office of the Police and Crime Commissioner for Humberside and Humberside Fire and Rescue Service to East Riding of Yorkshire Council to collect money from the council tax. This is then paid over to the police and fire authorities. The amount is shown separately on the council tax bill.

What does it mean to me?

The table “What you pay at a glance” shown on pages 11 - 12, show the town and parish precepts for each area and what is payable by a band D council taxpayer. The band A to H columns show the total council tax including East Riding of Yorkshire Council, special expenses and precepts.

CALCULATING YOUR COUNCIL TAX

Council tax base

The council tax base is a measure of the relative taxable capacity of different areas and calculated within prescribed rules. The figure represents the estimated full year equivalent number of chargeable dwellings in an area, taking account of changes in properties discounts, exemptions and circumstances which are likely to occur during the coming year. It is shown as an equivalent number of band D dwellings with two or more adults.

This figure also takes into account an estimated collection rate and is used in calculating the council tax set each year. The council tax base for 2016/17 is 111,185.3 band D equivalents.

Can I appeal if I think my bill is wrong?

You can appeal if you think there is a mistake in your bill, e.g. you might think you are not liable to pay the bill or feel that you are entitled to a discount or exemption. If you disagree with what you are being charged, please email or write to the billing and collection section. If you disagree with your valuation band, do not contact the Council, unless the banding is provisional. You can make a formal proposal against your council tax band by contacting the Valuation Office at Earle House, Colonial Street, Hull HU2 8JN or telephone on 03000 501 501 or by completing a proposal form online at: www.voa.gov.uk.

Making a formal proposal against your band or an appeal against your liability to pay does not allow you to withhold payment of your council tax instalments. You should continue to pay as normal until your formal proposal or appeal is resolved.

The Council’s 2016/17 budget includes £22.3 million of budget savings to meet both cost pressures and a £15

million reduction in government grant funding. Overall, the Council’s gross expenditure has increased compared

to the previous year due to cost pressures including a £6.6 million increase in gross expenditure on adult social

care. The council tax requirement has therefore increased compared to the previous year, enabled through an

increase of 1.99% to the Council’s general council tax charge, a new charge to fund cost pressures on adult social

care, and an increase to the council tax base. This additional council tax income reduces the impact of cuts to

government grants on the Council’s expenditure.

LEVIES

Levies

The Environment Agency, Hull and Goole Port Health Authority and Internal Drainage Boards are able to raise income by placing a levy on the Council. The levy is an amount of money for a specific financial year which the Council has to pay over to the levying body.

Levies form part of the council tax requirement and are not shown separately on the council tax bill. Details of the levies made against the Council for 2016/17 are detailed on pages 16 to 20.

Environment agency levies

The Yorkshire region of the Environment Agency has responsibility for flood defence along main rivers and sea defences in the Yorkshire region. The Midlands Trent region of the Environment Agency has responsibility for flood defence and the maintenance of the river system in the catchments of the River Severn and River Trent.

The levies on East Riding of Yorkshire Council in 2016/17 total £0.175m, compared to £0.163m in 2015/16. The gross expenditure and levies of the two regions are as follows:

North Eastern Inshore Fisheries and Conservation Authority (NEIFCA)

On 1 April 2011, North Eastern Inshore Fisheries and Conservation Authority (NEIFCA) replaced North Eastern Sea Fisheries Committee (NESFC), with wholly new duties and responsibilities for managing and conserving marine resources between the River Tyne and North East Lincolnshire.

NEIFCA have adopted the following National Vision:

“To lead, champion and manage a sustainable marine environment and inshore fisheries, by successfully securing the right balance between social, environmental and economic benefits to ensure healthy seas, sustainable fisheries and a viable industry”.

An internal drainage board (IDB) is a type of operating authority which is established in areas of special drainage need in England and Wales with permissive powers to undertake work to secure clean water drainage and water level management within drainage districts. The area of an IDB is not determined by county or council boundaries, but by water catchment areas within a given region.

Beverley & North Holderness and Foss IDBs

East Riding of Yorkshire Council’s levy is only part of the Boards funding stream. The other significant incomes are levies from other authorities and drainage rates. The Boards income raised year on year contributes to funds to make larger purchases such as machinery replacement for the Boards maintenance works, or to make larger investments. The gross expenditure varies year on year depending when larger purchases are made.

It is apparent that the previous Clerk and the Board have been setting negative budgets and therefore using commuted sums to fund normal activities. Estimated Revenue balance at 31 March 2016 is -£50,000. The 2016/17 budget addresses this situation and starts to replenish both Revenue and Commuted Sum accounts
