Althoughthe
responsibilityfor
requestinga
reasonable accommodation rests primarilywith the
applicantor
participant,the
ADA Coordinator is available as aresource
in
the
preparation, explanation,
and
dissemination
of
reasonableaccommodation information and in providing technical assistance.

Pleaseinclude
the

with the
request
for
reasonableaccommodation:
a)
Name, address,and telephone
numberof the
person requesting the accommodation.b)
The
specific
limitation (valid
under
the
ADA)
and
the
type
of
accommodation requested,
with
an explanationof
how the accommodationwill
assistin
the
application/hiring processor
participation
in a
service,program, or activity.
c)
Verification of the disabilitybythe
requester's healthcare provider may berequired.
4. The completed Request
for
Reasonable Accommodationform
shall be submittedto
the ADA Coordinator as soon as possible but no later than ten (10) business daysbefore a scheduled
event.
Requests received later thanten
(10) business days willonly be
consideredand
granted
when
possible,as
determined
by
the
ADACoordinator and General Manager.
5.
The ADA Coordinator,working
in
coordinationwith the
General Manager orhis/herdesignee,
reviews
the
completed Request
for
Reasonable Accommodationform
to
determine whether
the
request
can
be
reasonablyaccommodated by
the
requesteddate.
The General Manageror
his/her designee approves or denies all accommodationrequests.
The ADA Coordinator notifies the requesterof
the
General Manager's decisionto
approveor
denythe
request bycontacting
the
requester inthe
manner requested and by sending awritten
Noticeof Accommodation.
6.
The Noticeof
Accommodation indicatesthe type
of
accommodationthat
wasapproved and who
to
contactto
receivethe
accommodation.lf the
requestfor
anaccommodation was not approved, the notice explains why and the appeal process.
7. lf the
request is denied,the
requester may appealthe
decision. The requestermay submit
the
appealto
the ADA Coordinator in writing or verbally. Appeals must be received within five (5) business days after the request was denied.8.
Followingreceipt
of
an
appeal,the
ADA
Coordinator contactsthe
Generalm¡ght be
available.
The ADA Coordinator contactsthe
requesterwithin ten
(L0) business days after receipt of the appealto
inform the requester of the final decision regarding the accommodation request.GRIEVANCE PROCEDURE
Benton
PUD hasadopted
a
grievance procedure providingfor
prompt and
equitable resolutionof
complaints alleging any action prohibited bythe
ADAor
statelaw.
Benton PUD prohibits retaliation for making complaints or participating in an investigation.The
Benton PUD Administration DirectiveNo.
L6, Maintoininga
Respectful Workforce, governs,employee-related complaintsof
disability
discrimination.All
other
complaints should be addressed to the ADA Coordinator, using the following procedure:L
A complaint shall be filed verbally or in writing, containthe
name and addressof
the person filing the complaint, and briefly describe the alleged violation.
2.
A complaint shall befiled within
ten
(10) business days afterthe
complainantbecomes aware of the alleged violation.
3.
An
investigationfollows
the
filing
of
a
complaint, when appropriate
and necessary as determined bythe
ADA Coordinator and General Manager. The ADACoordinator, working in coordination with the General Manager or his/her designee, conducts
the
investigations.The
investigationis
informal
or
formal as
needed, thorough, and affordsall
interested persons andtheir
representatives,if
any, anoppor:tunity to submit evidence relevant to the complaint.
4. The
ADA Coordinator,working
in
coordinationwith
the
General Manager or his/her designee, issues awritten
evaluation asto
the validity and resolution of the complaint and forwards a copyto the
complainantwithin thirty
(30) business daysafter the filing of the
complaint.
Suchtime
period may be extended bythe
ADACoordinator
and/or
the
General Manager
as
necessaryto
ensure
adequateinvestigation of the complaint.
5. The ADA Coordinator maintains
the
files and recordsof
Benton PUD relatingto
any and all ADA complaints that are filed.6.
lf the
grievance impactsthe
budget, the ADA Coordinatorwill
keepthe
Boardof
Commissioners
informed as
to
the
nature
of the
grievance,and
the
Boardof
Commissioners may be involved in its resolution.7. Prompt and equitable resolution of a complaint filed hereunder is not impaired by
the
person's pursuitof other
remedies, such as the filingof
an ADA complaint with the responsible federal or state department or agency.DETNT
