Amendments made to the University’s academic regulations for academic session 2009-10
Introduction
1 The purpose of this paper is to provide a list of the amendments that have been made to the University’s academic regulations for academic session 2009-10. A concise list of all amendments made to each section of the regulatory framework is attached at Appendix 1.
2 The Regulations Committee is accountable to Quality Committee for ensuring that the University’s academic regulations remain valid, reliable and up-to-date, and that they are consistently applied across the University. Academic Development is the professional service area with responsibility for the overall maintenance of the University's academic regulations. Quality Committee approved in November 2007 the following professional service areas as being responsible for maintaining the following sections of the University's academic regulations:
a) Section A: General Regulations, Quality Enhancement Services (now Academic Development).
b) Section B: Undergraduate Regulations, Quality Enhancement Services (now Academic Development).
c) Section C: Taught Master’s Regulations, Quality Enhancement Services (now Academic Development).
d) Section D: Research Degree Regulations, Graduate School.
e) Mitigating Circumstances and Academic Appeals Regulations, Registry Services (now Student Affairs).
f) Student Disciplinary Regulations, Secretariat Services (now Student Affairs). 3 The above sections of the University's academic regulations applicable for session

4 To ensure that the current edition of each section of the University’s academic regulations is being used, the system of version control introduced in 2004-05 has been continued. The out-going and in-coming edition identifiers for each section are included within this paper for ease of reference.
Approving University academic regulations for 2010-11
5 Quality Committee will be asked to formally approve the University’s academic regulations for academic session 2010-11 at its meeting on 28 May 2010. The Regulations Committee will therefore receive proposals to amend specific

6 Regulation A5.5 enables module and programme leaders to apply in exceptional circumstances for an exemption to specific regulations. The 20-Credit Handbook (page 31, paragraph 24) indicates that all programmes will operate the standard University regulations for the appropriate award and that exemptions to University regulations will be approved in the very few situations where a case is made and accepted (for example, to meet professional body requirements).
7 Module or programme leaders wishing to seek an exemption to a University
academic regulation are required to submit a rationale and the proposed variation to the regulation to their Faculty Quality Committee for endorsement and authorised submission to the Regulations Committee for formal approval. Proposals which have not been approved by a Faculty Quality Committee will not be accepted by the Clerk to the Regulations Committee. Proposals should be received by the Clerk for
consideration by the Committee by the dates listed in paragraph 5.

Section A: General Regulations.
1. Service area responsible for this section: Academic Development.

a) The University title has been amended throughout Section A to read Edinburgh Napier University.

Suspended study. A period of suspended study may be requested by a student and agreed through discussion with their programme leader. The maximum period of time that a student is permitted to suspend their studies is two years. In discussing a period of suspended study the student and
programme leader will agree the point within the delivery of a module that study can be suspended and the point within the academic year that studies may be resumed. During a period of suspended study a student remains as a

If an external examiner is unable to attend a meeting of a Board of Examiners their views must be communicated to the Convenor of the Board prior to the meeting and such views will inform the meeting appropriately. The formal written minute of a Board of Examiners must record the views submitted by the approved external examiner and the means by which appropriate account has been given to such views. In the event that an external examiner declines or is unable to submit their views prior to the meeting this must be recorded in the formal written minute.
i) Renumber existing Regulations A9.7 and A9.8 accordingly.
j) Delete Regulation A10.2.7 and renumber existing Regulations A10.2.8 to A10.2.15 accordingly.
k) Amend existing Regulation A10.2.9c)i) (renumbered Regulation A10.2.8c)i)) to read:

a) Delete Regulation B2.1f) and replace with:
Stage. As defined in Regulation A3.1t) a stage of study is a grouping of modules studied by a student at any given time.
i) A programme of study leading to the award of a certificate of higher education has one stage of study containing 120 credits. The award regulation for a certificate of higher education is defined in Regulation B3.4.
ii) A programme of study leading to the award of a diploma of higher
education has two stages of study with each stage containing 120 credits. The award regulation for a diploma of higher education is defined in Regulation B3.6.
iii) A programme of study leading to the award of a Foundation Degree has three stages of study with the first and second stages each containing 120 credits and the third containing 60 credits. The award regulation for a Foundation Degree is defined in Regulation B3.8.
iv) A programme of study leading to the award of a bachelor’s degree has three stages of study with each stage containing 120 credits. The award regulation for a bachelor’s degree is defined in Regulation B3.9.
v) A programme of study leading to the award of a graduate certificate has one stage of study containing a minimum of 60 credits. The award regulation for a graduate certificate is defined in Regulation B3.11. vi) A programme of study leading to the award of a graduate diploma has
one stage of study containing 120 credits. The award regulation for a graduate diploma is defined in Regulation B3.13.
b) Insert new Regulation B3.8 and renumber existing Regulations B3.9 to B3.14 accordingly:
A Foundation Degree will be awarded to a student who has satisfied all programme specific requirements and gained a minimum of 300 credits of which:
a) a minimum of 120 credits are at SCQF level 8 or above, and b) a minimum of 120 credits are at SCQF level 7 or above.
c) Amend existing Regulation B3.10 (renumbered Regulation B3.11) to read: A graduate certificate will be awarded to a student who has satisfied the requirements of Regulation B4.4, all programme specific requirements and gained a minimum of 60 credits at SCQF level 9 or above.
d) Amend existing Regulation B3.12 (renumbered Regulation B3.13) to read: A graduate diploma will be awarded to a student who has satisfied the requirements of Regulation B4.4, all programme specific requirements and gained a minimum of 120 credits at SCQF level 9 or above.
e) Insert new Regulation B3.16 and renumber existing Regulations B3.15 to B3.18 accordingly):
A bachelor’s degree with honours will be awarded to a student progressing from an Edinburgh Napier University Foundation Degree who has satisfied all programme specific requirements and gained a minimum of 180 credits of which:
a) a minimum of 100 credits are at SCQF level 10, of which a minimum of 40 credits are derived from a dissertation or final year project, and;
b) a minimum of 80 credits are at SCQF level 9 or above.
f) Amend existing Regulation B3.15 (renumbered Regulation B3.17) to read: The calculation of the classification of honours will be based on 180 credits, to include a minimum of 100 credits at SCQF level 10, of which a minimum of 40 credits are derived from a dissertation or final year project, plus all remaining SCQF level 10 credit and the best SCQF level 9 credit achieved to gain a total of 180 credits.
g) Amend existing Regulation B3.18 (renumbered Regulation B3.20) to read: The minimum number and level of credit to be achieved by a student whilst registered as a student of Edinburgh Napier University having entered a programme of study with recognised prior learning and before being presented for an award of the University listed in Regulation A4.1a), b) and e) is as follows: a) A certificate of higher education will be awarded to a student who has
met the requirements of Regulation B3.4, satisfied all programme specific requirements and achieved a minimum of 60 credits at SCQF level 7 or above.
c) A diploma of higher education will be awarded to a student who has met the requirements of Regulation B3.6, satisfied all programme specific requirements and achieved a minimum of 60 credits at SCQF level 8 or above.
d) A diploma of higher education with distinction will be awarded to a student who has met the requirements of Regulation B3.7, satisfied all programme specific requirements and achieved a minimum overall average of at least 65 per cent across all of the 60 credits. If more than the minimum of 60 credits has been achieved, the distinction calculation will be based on an overall average of at least 65 per cent in the best 60 credits achieved at SCQF level 8 or above.
e) A bachelor’s degree will be awarded to a student who has met the requirements of Regulation B3.9, satisfied all programme specific requirements and achieved a minimum of 60 credits at SCQF level 9 or above.
f) A bachelor’s degree with distinction will be awarded to a student who has met the requirements of Regulation B3.10, satisfied all programme specific requirements and achieved a minimum overall average of at least 65 per cent across all of the 60 credits. If more than the minimum of 60 credits has been achieved, the distinction calculation will be based on an overall average of at least 65 per cent in the best 60 credits achieved at SCQF level 9 or above.
g) A bachelor’s degree with honours will be awarded to a student who has met the requirements of Regulation B3.15, satisfied all programme
specific requirements and achieved a minimum of 120 credits at SCQF levels 9 and 10, of which a minimum of 100 credits are at SCQF level 10, of which a minimum of 40 credits are derived from a dissertation or final year project. The calculation of the classification of honours will be based on 120 credits, to include a minimum of 100 credits at SCQF level 10, of which a minimum of 40 credits are derived from a dissertation or final year project, plus all remaining SCQF level 10 credit and the best SCQF level 9 credit achieved to gain a total of 120 credits.
h) Amend Regulation B7.1.2 to read:
Programmes of study leading to the award of an Integrated Master of
Engineering and the award of an Integrated Master in Science have five stages of study with each stage containing 120 credits. The award regulation for an Integrated Master of Engineering and an Integrated Master in Science is defined in Regulation B7.2.3.
i) Delete Regulation B7.5.5. j) Regulation B8.2.1c)i):
k) Insert new Regulation B8.2.1c)ii) and renumber existing Regulation B8.2.1c)ii) accordingly:
Midwifery Practice modules are designed to enable a student to achieve a level of performance as prescribed by NMC. Practice modules are delivered in an approved placement learning location under the supervision of an approved due regard NMC registrant. Practice modules are assessed using competence-based assessment, and / or portfolio and a student will be awarded a mark. l) Regulation B8.2.1d)iii):
Delete respectively from the last sentence. m) Regulation B8.2.1g):
Add new penultimate sentence: Students will be awarded either a pass or fail grade.
n) Regulation B8.2.1h):
Add and included in the programme specification at the end of the final sentence.
o) Regulation B8.3.3:
Delete reference to Diploma of Higher Education in Midwifery as this award is no longer offered.
p) Regulations B8.3.10 and B8.3.11:
Delete both regulations as there are no students prior to September 2006 wanting to study Diploma of Higher Education in Midwifery.
q) Renumber existing Regulation B8.3.12 to B8.3.15 accordingly. r) Delete Regulation B.8.3.16 as it is a repeat of Regulation B8.3.2.
s) Renumber existing Regulation B8.3.17 and B8.3.18 (renumbered Regulations B8.3.14 and B8.3.15) accordingly.
t) Insert new Regulation B8.4.3:
In accordance with NMC requirements, only students who are Registered Nurses (Adult) can be admitted with advanced standing into the shortened route programme of study leading to an award of a Bachelor of Midwifery. u) Amend existing Regulation B8.5.4 to become new Regulation B.8.5.3. v) Amend existing Regulations B8.5.3 (renumbered Regulation B8.5.4), B8.5.5
w) Insert new Regulation B8.5.6:
To pass a midwifery practice module at the first attempt, a student must achieve a module mark of 40 per cent or above. The module mark will be derived from the component or components of assessment.
a) If only one component is used a component mark of 40 per cent or above must be achieved.
b) If two components are used the module mark will be based on the weighted marks achieved for each component of assessment, and no individual mark for a component of assessment may fall below 40 per cent.
c) A mark of 40 per cent or above must be achieved for each individual element of any component of assessment.
x) Insert new Regulation B8.5.7:
A student will be awarded merit in a midwifery practice module by achieving a weighted average mark of at least 65 per cent in the module.
y) Renumber existing Regulations B8.5.6 to B8.5.8 as B8.5.8 to B8.5.10. z) Insert new Regulation B8.5.11:
To pass at reassessment, a student enrolled on a midwifery practice module must achieve a minimum overall module mark of 40 per cent.
a) If only one component of reassessment is used, a student must achieve a minimum mark of 40 per cent in that component.
b) If two components are used a student must achieve 40 per cent in each component.
c) A mark of 40 per cent or above must be achieved for each individual element of any component of assessment.
d) The overall mark for a reassessed module will be capped at 40 per cent. aa) Amend Regulation B9.3.12b) to read:
A minimum of 100 credits are from … Section C: Taught Master’s Regulations.

D2.1 Delete(e) and replace with:

D3.1 Remove sentence 2. (“Where the candidate holds an overseas
qualification, confirmation must be received from the Head of School at Napier (or their nominee) that it is equivalent to such an honours

D4.2 Delete last two sentences: “Substantial changes, involving changes to the programme of study, require the endorsement of the Faculty Higher Degrees Committee. All changes must be notified to the University Higher Degrees Committee.”
d) D5 Periods of Study
D5.1 Table, DBA, change minimum period from 30 to 36 months. D5.2 Delete final sentence: “In all other cases, students may not submit in
less than the minimum period. Insert new clause D5.3:
D5.3 In exceptional circumstances, part-time research students may be permitted to submit earlier than the minimum period specified.
Applications for approval of early submission must be made in writing to University HDC and must have the support of the student’s supervisory team.
Renumber existing D5.3 as D5.4 Insert four new clauses:
D5.5 Candidates may apply to change mode of study from full- to part-time, or vice versa.
D5.7 Once the target degree has been determined, a PhD candidate may transfer to MPhil within the normal period of registration, but not after this has elapsed.
D5.8 Once the target degree has been determined, an MPhil candidate may transfer to MA/MSc by Res within the normal period of registration of the higher award, but not after this has elapsed.
Renumber section D5 thereafter
D5.9 (Previously D5.4) Delete the word “maximum”.
D5.12 (Previously D5.8) Change “Graduate School” to “Research Office”. D5.13 (Previously D5.9) Sentences 2 and 3: amend to read: “Applications

e) D6 Supervisory Arrangements D6.1 First sentence: change “four” to “three”
Insert new clause:
D6.2 Members of staff who have not previously supervised students at Edinburgh Napier University must undertake the relevant research degree supervision training programme before being eligible to supervise. Existing supervisors are required to participate in refresher briefings, normally every two years. Renumber section D6 thereafter
f) D7 Determination of Target Degree and Progress Reviews Insert new clause:
D7.2 At each review the candidate must submit a written report detailing their research work since the previous review. The format of the report will depend on the particular review (determination of target degree or progress review).

D7.3 (Previously D7.2) Sentence 2, change “will take place” to “may take place”
D7.4 (Previously D7.3) Change “This review” to “The determination of target degree review”.

D8.1 Change to: “The Director of Studies should make an application for approval of examination arrangements at least 3 months before the viva is due to take place. Applications should be submitted for scrutiny by the relevant Faculty HDC before going forward to University HDC for approval.”
D8.4 Change to read: “Sufficient familiarity with the University’s Research Degree Regulations and procedures” is defined, normally, as:
a. two or more previous Edinburgh Napier University examinations at the level being examined;
or
b. having attended the University’s Research Degree training on procedures and examinations within the two years prior to the viva. D8.5 Add: “as defined in D8.3” at end of sentence 2 and replace sentence 3
with: “In order to fulfil this requirement it may be necessary to include two external examiners.”
D8.6 Replace existing clause with: “In addition to the examiners, the team should normally include a non-examining convener, who must have substantial experience of examining UK higher degrees and sufficient familiarity with the University’s research degree regulations and procedures.”
D8.8 (Previously D8.9) Add sentence: He or she must have sufficient familiarity with the University’s Research Degree Regulations and procedures as defined in D8.4.
D8.9 (Previously D8.10) Sentence 1: delete second “be”. Sentence 2: move the word “normally” to the start of the sentence.

18. This section of the regulatory framework combines two previous sections into one concise document. The sections being replaced are:
a) Student Disciplinary Regulations 2008-09 (December 2008). The out-going edition was approved by the Regulations Committee on 16 December 2008. This edition can be identified by APPROVED DECEMBER 2008 within the document header and Student Disciplinary Regulations 2008-09 (December 2008) within the footer of each page. This edition ceases to be valid at midnight on 6 September 2009.
b) Fitness to Practice Student Disciplinary Regulations. The out-going edition was approved by the Regulations Committee on 16 December 2008. This edition can be identified by APPROVED DECEMBER 2008 within the document header and Fitness to Practice Student Disciplinary Regulations 2008-09 within the footer of each page. This edition ceases to be valid at midnight on 6 September 2009.
19. The in-coming edition was approved by the Regulations Committee on 28 April 2009. This edition can be identified by APPROVED APRIL 2009 within the document header and Student Disciplinary and Fitness to Practise Regulations 2009-10 within the footer of each page. This edition comes into effect at midnight on 6 September 2009.
20. Changes to the incoming regulations to take effect from midnight on 6 September 2009, all of which have been approved by the Regulations Committee, are:
a) The former Student Disciplinary Regulations remain unchanged with the exception of the following:
i) Section 1.5: insert new penultimate sentence:
In such circumstances, the University will invoke the Fitness to Practise regulations in Appendix 3 of this document.
ii) Insert new Appendix 3:
Consideration of Fitness to Practise (Professional Courses).
