ranchburg, NJ (June 27, 2011) – The Associa-tion of New Jersey Chiropractors announced today that its claims challenging the post-pay-ment auditing and overpaypost-pay-ment recovery practices of Aetna were upheld on June 20, 2011, by Judge Joel A. Pisano of the United Stated District Court in Trenton, NJ, in Association of New Jersey Chiropractors, et al. v. Aetna, Inc., et al., Case No.3:09-cv-03761.

The case, which was filed in July 2009 by Pomer-antz Haudek Grossman & Gross LLP, one of the na-tion’s preeminent class action law firms, and Buttaci & Leardi, LLC, a Princeton-based law firm that repre-sents healthcare providers, including chiropractors,

in overpayment disputes throughout the country, challenges Aetna’s abusive practices in using post-payment audits, repost-payment demands, and “pre-pay-ment review” to recover substantial sums that have previously been paid as health benefits for services provided to Aetna in violation of the Employee Retire-ment Income Security Act of 1974 (ERISA).

In the action, the plaintiffs allege that Aetna im-properly recouped monies from healthcare pro-viders (including chiropractors) that had previ-ously been paid on behalf of its members, based on retroactive determinations that

as it the graceful yet defi-ant actions of a mature African American woman refusing to sit at the back of the bus, or was it ballads like those of a Jewish guitar and harmonica play-ing kid who said “The Times They Are A-Changin” that set in motion the social changes of the sixties? Or do we trace it even further back to members of an underground railroad who led their fellow man into the un-known and a freer life?

Was it the scope of practice that changed chiropractic in New Jersey or was it that the scope had changed because the consciousness of chiropractors had changed? Have the public and the political powers accepted chiropractic as a legiti-mate, mature, distinct healing art with a proven track record because chiropractors do?

By now our members have received the news that one of our members, Dr. Armond Forcella, did not let the discouragement of hitting the brick wall dissuade him from doing the right thing for one of his patients. Dr. Forcella made a determination that his patient was permanently disabled, and persisted in making his point clear: that chiropractors are physi-cians and are qualified to make such a determination. The ANJC helped by providing him with support, documen-tation and a historic perspective to fight this fight.

We can certainly look to our cur-rent scope of practice, which states

that chiropractors are physicians and can “Sign or certify temporary or per-manent impairments and other certifi-cations consistent with a chiropractic practice such as pre-employment screenings. A chiropractic physician may use recognized references in making his determination.”

We can also look a little further back in our history to 1985 when Dr. Kevin Emery received an answer to his inquiry to the Board of Medical Examiners regarding whether or not chiropractors are physicians. The then Executive Secretary, Charles Janousek, stated that “a chiroprac-tor is considered a physician in this state, as long as he is referred to as a chiropractic physician.”

While Dr. Emery’s inquiry may have seemed like a small thing, it is the cumulative actions of many small things by many committed doctors that have brought the collective con-sciousness of chiropractic in New Jersey to this point. It can be said that you know not how far-reaching your actions, or the things you say today, may have on an individual or on the course of history in our global community.

I am proud to say that I belong to an association of committed doc-tors of chiropractic who are doing the things necessary to advance chiropractic to its rightful place. The future of chiropractic in New Jersey and in the world is looking brighter every day!

A

fter choosing a location for your practice, at some point the issue of when to hire staff and how many to hire comes up. This is probably the most complicated practice issue that a new doctor runs into. I’ll try to make this easy, and simple, but really it tends to be more art than science.

First, in general terms, you should hire a Chiropractic Assistant (CA) as soon as you can afford one. Sim-ply having someone to answer the phone and schedule appointments for you pays for itself when you’re seeing 10-12 visits per day. Most pa-tients aren’t going to be impressed with you if you’re answering your own phone. Remember that future practice growth comes from many sources, but primarily the patient has to feel that you’re someone that they want to refer their friends and family to.

With an unemployment rate that is at it’s highest in 30 years, I would recommend that you first try asking people if they know someone who is looking for a job. This way, you’ll have a recommendation rather than inter-viewing a hundred or more applicants

that you do not know. You can also consider a part-time person, say af-ternoons only, until your practice gets busier.

The next step is to find someone nice, who is able to smile. You can teach them just about everything else, but being nice comes naturally. Then you can begin to train them to answer the phone and make appoint-ments. Once they are able to take a new patient phone call and schedule appointments, then everything else comes second.

At some point in your practice, you will have grown to a point when you consider adding additional staff. The general rule of thumb is that if you run an efficient practice, then one staff person should be able to handle 35 to 50 visits per day during a normal 6-8 hour practice schedule. When you are consistently over 35 visits per day, then you can consider adding a second CA. But like I said, this is much more art than science.

W

hen that sweet little old patient comes in to see you for the first time this year, don’t automatically assume that her Medicare coverage is still in effect. More and more seniors are taking advantage of the option in coverage that moves them over to Medicare Part C. If you’ve already experienced the joy of billing Medicare for a pa-tient who no longer has traditional Medicare, then you know the hassle that Medicare Part C, also known as a Medicare Advantage Plan, can be to your billing and collections process.

What is a Medicare Advantage Plan?

According to www.Medicare.gov, a Medicare Advantage Plan (like an HMO or PPO) is another Medicare health plan choice qualified beneficia-ries may have as part of Medicare. Medicare Advantage Plans, some-times called “Part C” or “MA Plans,”

are offered by private companies ap-proved by Medicare. If your patient joins a Medicare Advantage Plan, the plan will provide all Part A (Hospital Insurance) and Part B (Medical Insur-ance) coverage. Medicare Advantage Plans may offer extra coverage, such as vision, hearing, dental, and/or health and wellness programs. Most include Medicare prescription drug coverage (Part D).

Medicare pays a fixed amount for your patient’s care every month to the companies offering Medicare Advan-tage Plans. These companies must follow rules set by Medicare. However, each Medicare Advantage Plan can charge different out-of-pocket costs and have different rules for how these patients get services (i.e., whether a referral is needed to see a specialist, like chiropractors, or if they have to go to only doctors, facilities, or suppliers that belong to the plan for

nonemer-gency or non-urgent care). These rules can change each year.

Am I Allowed to Treat Medicare Part C Patients?

The best thing to do is to verify each and every Medicare patient’s benefits, for all insurance cards they have in their possession. This means that you can discern whether they have traditional Medicare coverage with a red, white, and blue card, or have decided to choose a Medicare Part C plan. If so, you must know whether or not you participate in this plan, and whether they have out of network benefits if you don’t. Watch out for ID cards that say, “PFF,” which stands for Private Fee for Ser-vice. If you treat and submit bills for services on one of these patients, you are automatically in the network while treating that patient, and sub-ject to all the fee restrictions and

appeals processes of this plan. It’s also known as making you a deemed provider. If you don’t want to accept these benefits, and you are not par-ticipating in their network, then let the patient know you are not submit-ting to the PFF carrier, and then you may treat that patient as a cash pay-ing patient, and not be restricted to the fee schedule of that carrier.

Factoids You Must Know for Medicare Part C

• ABN forms do not apply to Part C. • Verify the insurance benefits just

like you would for regular health insurance. While making that call, you would ask for both in and out of network benefits, and confirm which your office is subject to. • Should you need to appeal

deni-als, realize that the appeals pro-cess is different from traditional Medicare. Each plan has its own appeals process that you must be aware of.

• The AT modifier will usually not apply in this environment. Check with each plan to be sure. • Plans can choose to eliminate

DCs as they only need to provide the service, and can designate a DO or MD to do so. Don’t assume there is chiropractic coverage automatically.

• DCs are usually included on “point of service” options.

Medicare Part C can be a valuable help to seniors on a fixed income, since the plan mirrors traditional managed care, and can help to keep costs down. Choose wisely before automatically joining these networks, and make sure you never fail to verify

all Medicare coverage for maximum efficiency and coverage. After all, these plans may pay for otherwise statutorily non-covered services, like exams and therapies. Find the per-fect blend of these plans in your fee system and contracted plans in your office to maximize coverage and ben-efits for your senior patients.

JUDGE AFFIRMS ANJC’S STANDING TO PURSUE ERISA CLAIMS IN AETNA LAWSUIT

under the members’ healthcare plans. Frequently, Aetna determined after the fact that the services were excluded from coverage because they were “ex-perimental and investigational” and therefore demanded that the provid-ers return the funds. If the providprovid-ers did not agree, Aetna placed them into pre-payment review, which in reality meant that Aetna simply withheld pay-ment as a means to punish the pro-vider and save money through undis-closed denials. The entire process, as alleged in the complaint, was in viola-tion of ERISA because Aetna made its retroactive adverse benefit determina-tions that served as the basis of its repayment demands without providing a full and fair review of its decision, as required under the law.

“This decision is very important,” says D. Brian Hufford of Pomerantz, “as now we will be able to proceed to full-scale discovery where we an-ticipate finding substantial evidence supporting our claims that ERISA

has, indeed, been violated as a re-sult of Aetna’s widespread actions.” The case parallels a similar action brought by Pomerantz and its co-counsel, Buttaci & Leardi, on behalf of ANJC and other plaintiffs, which is proceeding against a number of Blue Cross Blue Shield licensees in the Northern District of Illinois before the Honorable Matthew E. Kennelly, as well as a recently filed action against United HealthCare in the District of New Jersey before the Honorable Faith Hochberg, both of which allege violations of ERISA for improper re-payment demands and recoupments of prior benefit payments.

In addition to the ERISA claims, Judge Pisano also upheld the stand-ing of the association plaintiffs to pursue claims for injunctive relief on behalf of their members, including the International Chiropractors As-sociation, the Association of New Jersey Chiropractors, the New York Chiropractors Council, and the Illinois

Chiropractic Society. Co-counsel and ANJC Special Counsel John W. Leardi notes that “We are very pleased that the associations will be able to con-tinue advocating on behalf of their members in this case, as they play an important role in defending the rights of providers and subscribers against managed care abuse.”

“The ANJC is and will continue to be aggressive in fighting for the rights of our members, and their patients,” notes Dr. Sig Miller, Execu-tive Director of the ANJC. “And one area where we believe many of our members’ rights have been ignored is post-payment audits,” Miller added, “which is why our Board of Directors voted to be involved in this lawsuit in the first place.”

ANJC President Dr. Steve Clarke stresses the importance of a fair process moving forward for post-payment audits: “We recognize that rooting out fraud and abuse should be a common goal for both providers

and payers, but the manner in which insurers audit previously paid claims and demand repayment has to be fair, particularly because the vast majority of these audits involve coverage or documentation issues as opposed to fraudulent billing.”

The ANJC, who is joined by three other chiropractic associations and six individual healthcare providers, including five chiropractors, in bring-ing the lawsuit, is assertbring-ing its right, through representational standing, to obtain appropriate equitable relief to address the numerous abuses at issue on behalf of its members and, more importantly, their patients.

D

iabetes continues to increase rapidly across all regions and demographic groups. Chiro-practors should be very concerned, since the effects of diabetes inter-fere with spinal and lower extremity health and can significantly increase physical disability. Diabetes can be associated with serious complica-tions and premature death, but with professional healthcare counseling, persons with diabetes can take mea-sures to reduce the likelihood of such occurrences.

Chiropractic care has much to offer patients who have diabetes. Because of circulatory concerns, these patients often develop extrem-ity problems and symptoms, most commonly of the feet (1,2). As the diabetic process continues, neu-ropathy can lead to sensory difficul-ties, which often allows poor shoe fit, excessive pressure and friction, and even injuries to go undetected (3,4). The eventual result is skin ulcerations, infections that do not heal readily, and even amputation in some cases (5,6).

When treating a diabetic patient, it is the chiropractor’s duty to evaluate the circulatory status in the extremi-ties, and provide advice to help pre-vent the development of foot ulcers. In most people the foot is seldom symptomatic, and this is particularly true in the case of patients with a his-tory of or tendency to diabetes.

Areas of Clinical Concern

Nutrition: Dietary modifications and vigilance over food intakes are required when dealing with a diabetic condition. Supplementation with vi-tamins, minerals, and other products can be very useful, depending on each patient’s condition and food habits.

Circulation: Circulatory status must be maintained at all costs through

proper nutrition, regular exercise, and protection from injury. Lower extrem-ity exercise is critical: just regular walking can stimulate the pumping of blood and fluids through the system and prevent pooling and stasis. Gen-tle massage along with elevation of the legs and compression stockings— when necessary—are useful adjuncts.

Shoe fit: Proper shoe selection can be critical in avoiding excessive frictional stresses to sensitive foot tissues (7). The sole the shoe is built on must match the shape and length of the foot. The vamp and the heel counter need to provide support with-out being too restrictive and irritating. The size and shape of the toe box are critical, and prominent seams or stitching can rub and chafe, with di-sastrous results. Adjustable closures, such as full laces, can adapt to the changes in foot size and shape that occur during the day, and Velcro®-type tabs are very helpful for patients who have difficulty lacing and tying knots. Slip-on styles are usually not recom-mended for patients with diabetes, due to the lack of adjustability and the need for a tight fit.

Shock absorption: An important consideration is preventing damage to the heel pads and absorbing the stresses of walking. The diabetic foot is particularly sensitive to the 3-5 g-force it must endure with every footstep. Normal shocks and stresses can result in damage and injury to sensitive diabetic feet. The sole of the shoe (insole, midsole, and outsole) must be made of comfortable, durable, and shock-absorbing materials.

Breakdown prevention: Individually designed, stabilizing foot orthotics are valuable, and should be considered early in the treatment of a patient with diabetes. In the initial stages of the condition, an orthotic that is sup-portive of normal foot biomechanics is

useful, as long as a special, shock-ab-sorbing material is provided. Effective orthotics encourage efficient foot and lower extremity biomechanics, while at the same time diffusing pressure stresses and preventing tissue break-down. The ideal orthotic should be designed to be very comfortable and shock absorbing, while still providing full corrective support for foot align-ment and dynamics. Such an orthotic will allow your patient to continue to be active and to exercise regularly.

In the final stages of diabetic foot problems, a purely accommodative orthotic is all that can be tolerated. This type of compromise orthotic will absorb shock and prevent pressure sores, but it does not support the arches and biomechanics of the foot. In this case, cut-outs and divots must be incorporated to allow the broken-down foot to function without exces-sive pressure on individual areas. It is much better to intervene early in this process and to prevent or at least slow down the development of this late stage.

The Value of Orthotic Support

The importance of proper shock absorption and shoe fit for the dia-betic patient cannot be overstressed. Chiropractors who treat patients with diabetes must consider their need for comfortable, flexible foot orthotics that will provide support and fore-stall future biomechanical and tissue breakdown (8).

utrition is a vast and dense subject; many chiropractors find the idea of introducing nutrition into their practice a daunting task. I personally keep nutritional advice and supplementation in my practice as simple as possible. I believe that good nutritional advice and supplementation should support the body and allow it to heal itself, just like a chiropractic adjust-ment. When study after study shows that the average American eats less then 25% of the fruits and vegetables they need to thrive there is no wonder remarkable results can be achieved with simple changes. I decided to ask some of the board members of the ANJC’s new Nutrition Education Council what one basic nutritional product or change they would make to improve the health of their patients. If you are new to nutrition try choosing one of these doctor’s sugges-tions and concentrate on implementing that step into your practice—your pa-tients and your practice will both benefit.

An Alkaline Diet (suggested by Dr. Steve Zodkoy): The single most impor-tant nutritional change a patient can make is to improve their diet. The best nutritional supplements cannot make up for a poor diet or offer as well rounded of a supply of nutrients. While nutritional supplements may be able to supply some vitamins, minerals, protein, etc. they often do not supply trace minerals, oils, and fiber. I like to encourage my patients to adopt a new lifestyle grounded in a healthier diet. Patients who are willing to make dietary changes are usually more committed to make the changes needed for a healthier life.

I encourage all of my patients to go on a pH diet. A pH diet is one that focuses on foods that alkaline the body. I use pH paper and a saliva test to show my patients that they need to change their lifestyle and diet. This added visual cue really stimulates patients into action and excites them to improve their pH so that their saliva test improves. An alkaline body has been shown to have lower levels of inflammation, improved immune function and more energy; these are the exact opposites of your patients’ complaints. This diet is great for just about every patient and their complaints, which helps simplify implementing it into a practice. I also like the idea that there are dozens of books and internet web-sites that discuss the details of the diet, which means less of my time is needed explaining the details to the patient. My final selling point on the pH diet is that there are no special products to buy, patients just need to adjust their diet. The pH diet does it all: reduces patients’ symptoms, is easy to implement and costs nothing.

The basic rules for a pH diet are sim-ple. Foods that are good and alkaline the body are fruits, vegetables, and whole grains. Foods that are bad and acidify the body are processed foods, white flour, soda, coffee, artificial ingredients, preservatives, sugar and red meats. The pH diet is really all the rules we all know, but don’t follow. The pH diet also lends itself well to adding in nutritional supple-ments to improve the patents’ outcomes when needed. The pH diet is a great way to get your patients more involved in their health in a simple and familiar manner without the physician having to explain every detail. A Multi-Nutrient (suggested by Dr. Michael Wald): The single most impor-tant product to carry in any healthcare practice should be a multivitamin.

Re-search has proven that each individual in the United States would benefit from tak-ing a multivitamin in addition to a well-balanced diet, exercise and other healthy lifestyle choices. Women who are men-struating should take a multivitamin with iron. Those with proven iron deficiency should also take a multivitamin with iron. A multivitamin contains a complex of the B-vitamin family as well as minerals and sometimes additional accessory or supportive nutritional compounds. Lastly, a multivitamin will often contain levels of various nutrients higher than the Recommended Daily Values (RDV) or Recommended Daily Intakes (RDI). Some patients will be concerned about this, but they and the practitioner should keep in mind that the RDV and RDIs represent only statistical average needs for basic nutrition for survival and not optimal levels or individual needs. Many people, as a direct result of disease, stress and other factors, will require additional di-etary and/or nutritional supplementation even beyond a multivitamin.

Magnesium (suggested by Dr. Christopher Bump): My number one nutritional supplement to recommend would be magnesium. There are several key reasons to choose magnesium as the most important nutrient to recom-mend: magnesium is involved in over 300 enzymatic/metabolic processes, it is estimated that 9 out of 10 people in the western population are deficient in magnesium, and food sources do not provide adequate amounts. Magnesium is a key nutrient that is essential for en-ergy production, muscle relaxation and nerve transmission. Magnesium has been shown to be beneficial for hypertension, type II diabetes, osteoporosis, depres-sion, migraine headaches, CV disease and insomnia.

I recommend magnesium citrate for primary energy issues, magnesium citra-malate for muscle and soft tissue is-sues—huge in our profession—and mag-nesium glycerinate for those who cannot tolerate the other forms. The typical dose is 250 mg twice a day with food.

While the experts might disagree on the key nutritional method or product to start with, they all agree that good nutrition and nutritional supplements are key to your patients’ good health. Choose any one of the above ideas to introduce nutrition into your practice and you and your patients will be amazed at the results. You will be able to add ad-ditional nutritional products and services with ease once you have a handle on the basics.
