Technical specifications – Online

Required File Format: We can only process JPG files (only simple file compres-sion) or animated GIF files (file size should not exceed 60 KB) (no swf or flash formats).

Delivery Date: Please send us your advertising material and your destination URL (NO tags) five working days before the start of the advertising campaign.

Advertising theme or subject: We do not offer ad rotation services. We can only present one advertisement in the time period (calendar month) re-quested by the customer.

Destination URL: Please send only ONE destination URL per advertisement.

We only accept delivery of the advertisement and destination URL – no tags.

Reporting System – Banners: Once the advertising campaign has concluded, Callwey will provide reports on clicks, page impressions and click-through rates for the entire advertising period. For campaigns stretching over several months we are happy to provide interim reports. We do not provide weekly reports.

Please note that only ONE URL can be attached per banner. This means that

we cannot provide page impressions and click statistics for diverse URLs. We cannot implement javascript tracking or iframes. Due to security reasons, we do not offer tracking services conducted by customers or agencies themselves.

Reporting System – Newsletters: When the newsletter has been sent out, Callwey will send you a screenshot of the newsletter containing your banner / advertisement. In addition, we will provide you with a report on the number of subscribers who have received the newsletter (newsletter sent by e-mail) as well as statistics on open rates and the number of newsletters opened. This does not include reports on the number of times your advertisment has been clicked. Please ensure that a maximum of ONE URL is consigned to each banner / advertisement. This means that it is not possible to generate click or page impression statistics for more than one URL.

Reporting System – Advertorials: Following the publication of your avertorial, Callwey will provide you with a screenshot of the blog post which is linked via the slider. Once the advertising campaign is over, Callwey will deliver a report on the number of times your blog entry has been clicked during this period. We will also provide you with a screenshot of the newsletter showing your banner / advertising text, as well as statistics on the numbers of subscribers who have received your newsletter (newsletter sent via e-mail) and the open rate and the

number of opened newsletters. This does not include reports on how many times your advertisement in the newsletter have been clicked. Please en-sure that a maximum of ONE URL is consigned to each banner / advertisement.

This means that it is not possible to generate click or page impression sta-tistics for more than one URL. For more information on the reporting system for XXL super banners, please consult the website for reports on banners.

Miscellaneous

Before submitting ad copy, please fax your insertion to +49 (0)89 / 43 61 161 complete with colour details (b/w, 2c, 3c or 4c), the

software format (incl. version no.) and a hard copy of the advertisement.

Please also state whether the file will be supplied on CD, DVD, as an email attachment (no larger than 5 MB) or uploaded to our

FTP site (transfer.callwey.de; our user ID and password can be obtained on request). Virus-infected files will be deleted.

Please convert spot colours (such as HKS, Pantone) as well as RGB and indexed colours into

CMYK (Euroscale)

process colours.

Images in the ad copy should be positioned 1:1 as far as possible and supplied at a resolution of 300 dpi (1200 dpi in the case of

The Publisher will not be liable for any error in a published advertisement supplied in an open format. A colour proof must be

provided simultaneously with colour advertisements supplied by digital means; non-compliance excludes the right to claim for

compensation on the grounds of colour deviations in the printed advertisement. A colour proof can be produced with costs by the

publisher on request. Should supplied data not fulfil the above criteria, services having to be furnished on our part in this

connec-tion are charged for at cost; this also applies to resetting or composing an advertisement at the customer‘s instrucconnec-tion.

General Terms and Conditions of Business for advertisements and inserts

1. In the sense of the following General Terms and Conditions of Business an “advertisement order” is the agreement about the publication of one or several advertisements of an advertising agency or other advertiser (called client in the following) in magazines published by the Publishing House or the agreement about inserts in such publications for the purpose of circulation.

2. The advertising order includes all the advertise-ments published within 12 months. The period of validity of the advertisement order starts with the publication of the first advertisement.

3. Advertisements for definite positions are accep-ted only if the Publishing House in each case con-firms these special positions in writing.

4. Orders for advertisements and inserts, which declaredly shall be published exclusively in definite numbers or at definite positions in the magazine, must reach the Publishing House in such good time that the client can be informed before the closing date if the order cannot be executed in this manner.

5. Cancellations of advertisement orders must be made by the closing date for advertisements. The Publishing House can charge the client for the set-ting and production costs. No right of cancellation applies for advertisements for special positions.

6. If an advertisement order is not completely executed, the client will refund appropriately the Publishing House the difference between the granted discount and the discount corresponding to the actual quantity. If non-execution is due to circumstances within the control of the publishing house, no obligation to refund will apply.

7. The Publishing House is entitled to refuse ad-vertisement orders and individual orders in the scope of an existing agreement due to their con-tents, their origin or their technical manner on the basis of uniform objectively justified principles. This will apply namely when the contents infrin-ge on statutory regulations or official decrees or are unacceptable for the Publishing House. The Publishing House will inform the client about the refusal without delay.

8. Orders for inserts are not binding for the Pu-blishing House until a sample of the insert has been presented and approved. Inserts will not be accepted, which give the impression to readers – through their format or layout – of an integral part

of the newspaper or magazine or which contain third party advertisements.

9. The client will indemnify the Publishing House against all claims by third parties from infringe-ments by the advertiseinfringe-ments or inserts of legal provisions, in particular the law on competition and copyright.

10. Advertisements, which are not recognisable as such due to their editorial layout, will be clearly identified by the word „Advertisement“.

11. The client must ensure the punctual supply of the advertisement text and faultless printing copy or of the inserts. The costs for drafts, drawings and similar shall not be included in the advertise-ment prices. As the client does not provide the printing copy, he will defray the costs for their procurement.

12. Proofs will be supplied only on explicit request. The client will be responsible for the correctness of the returned proofs. The Publishing House will take into conpageration the error corrections by the specified date, which is brought to its notice on returning the proofs. The client will defray the costs for alterations he desires or alterations for which he is responsible of the originally agreed realisation.

13. If no particular sizes are specified, the price will be based, depending on the kind of advertise-ment, on the usual actual printing height.

14. The Publishing House will ensure the customa-ry printing quality for the titles order in the scope of the feasibilities resulting from the printing copy.

15. On request the Publishing House will enclose a copy of the advertisement with the invoice. Depending on kind and scope of the advertise-ment order advertiseadvertise-ment cuttings or complete reference numbers will be supplied. If an original document cannot be procured, it will be replaced by a legally binding certificate of the Publishing House about the publication of the advertisement.

16. Printing copy will be returned to the customer only on separate demand. The Publishing House will file the printing copy up to three months at the latest after execution of the order.

17. In the event of wholly or partially illegible, incorrect or incomplete printing of the advertise-ment the client is entitled to rebate on the account or a faultless replacement advertisement but only in such degree as the purpose of the

advertise-ment was impaired. If the Publishing House allows a reasonable deadline to elapse, which was set it, or if the replacement advertisement also is not faultless, the client has the right to a reduction in payment or cancellation of the order.

18. Claims for damages are precluded from a po-sitive breach of obligation, negligence on conclu-sion of the agreement and inadmissible actions, also when the order is placed by telephone. The Publishing House is liable for mistakes of any kind from telephone messages only on intention or gross negligence.

19. Claims for damages from the impossibility of execution and delay are restricted to the replace-ment of the predictable damage and to the charge payable for the advertisement or insert. This does not apply for the intention and gross negligence of the publishing house, its legal representative and its vicarious agent. The liability of the Publishing House for damages due to errors of promised pro-perties remains unaffected.

20. In addition the Publishing House will not be liable in commercial business transactions for the gross negligence of ordinary servants. In the other cases the scope of the liability vis-à-vis business-men is restricted to the predictable damage up to the amount of the relevant advertisement charge.

21. If advertisement copy is submitted to the Pub-lishing House incorporeal, i.e. digital, liability of the Publishing House is excluded for the whole or par-tially illegible, incorrect or incomplete reproduction of the advertisements concerned.

22. Except for not apparent faults claims must be submitted within four weeks after receipt of the invoice and sample.

23. If the customer does not pay in advance, the invoice will be submitted before publication of the advertisement but for the due data of publication of the advertisement as far as possible. The in-voice shall be paid within the period indicated in the price list after receipt of the invoice insofar as a different term of payment or payment in advance has not been agreed.

24. In the event of delay in payment or prolongation of payment interest as well as collection expenses will be charged. On delay in payment the Publishing House can postpone the further execution of the current order until payment and demand payment in advance for the remaining advertisements.

25. On the existence of justifiable doubts about the solvency of the client the Publishing House is entitled, also during the term of an advertisement order, to make the publication of further advertise-ments dependent on the advance payment of the amount and payment of outstanding invoices irre-spective of the originally agreed term of payment.

26. Advertisers and advertising agents are obliged to adhere to the price list of the Publishing House in their quotations, agreements and invoices. The inter-mediary fee granted by the Publishing House must not be wholly or partially passed on to the client.

27. In the case of keyed advertisements the Pub-lishing House will pay the attention of a conscien-tious businessman to the storage and punctual on-ward transmission of the offers. Registered letters and express letters in response to keyed adver-tisements will be forwarded by normal mail. The letters in response to keyed advertisements will be kept for four weeks. Answers, which are not collected during this period, will be destroyed. The Publishing House will return valuable documents even though not obliged to do so. In the interests and for the protection of its clients the Publishing House reserves the right to open to control purpo-ses the incoming offers to preclude misuse of the key advertisement service. The Publishing House is not obliged to transmit onward business com-mendations and mediation offers.

28. The registered main office of the Publishing House is the place of performance. In business transactions with businessmen, corporate bodies in public law or in special assets under public law, the registered main office of the Publishing House is legal venue for legal proceedings. Insofar as claims of the Publishing House are not asserted in a collection procedure, the legal venue of nontra-ders will be their place of domicile.

29. If the place of domicile or usual repagence of the customer, including non-traders, is unknown at the time of institution of legal proceedings or if the customer has moved his place of domicile or usual repagence outpage the area of validity of the law, the registered main office of the Publishing House is agreed as legal venue.

30. If individual items of these terms and condi-tions of business should become wholly or parti-ally invalid, the legal validity of the other terms and conditions is not affected.
