Please confirm that construction manager is not required to provide a “bond”. CORRECT, CONSTRUCTION MANAGERS ARE NOT REQUIRED TO PROVIDE A BOND. PAGE 15 (PAGE 14 ITEMS FOR INCLUSION IN PROPOSAL)

I confirm that the requirement to describe various delivery methods is not applicable. Confirm the delivery method for this RFQ is “multiple-prime”

THE DISTRICT HAS NOT NECESSARILY SELECTED A DELIVERY METHOD YET. PLEASE COMPLY WITH THE REQUEST FOR PROVIDING INFORMATION REGARDING VARIOUS DELIVERY METHODS. PAGE 12-14 APPENDIX II PART 200………

Confirm that required provisions A-J apply to bid and agreements with “multiple-prime” contractors and not the construction manager.

“The construction manager will provide the proposed contract for each bidder.” Please confirm that the “scope” of each multiple-prime bid/agreement is to be provided by construction manager, but the “template” of the agreement for each multiple-prime contract with federal and district for boiler-plate. Requirements (example: items A-J pages 2-4 provided by district. Alternately construction manager shall prepare an agreement form for review/approval by district and/or district counsel.

What are the districts criteria for acceptable certificates of insurance and bonds?

ONCE A PROPOSAL IS SELECTED AND AN AGREEMENT IS CIRCULATED FURTHER INFORMATION WILL BE PROVIDED.

Please inform which standard prevails – “state prevailing wage” or “Davis – Bacon.”

BOTH STANDARDS ARE APPLICABLE. IF THERE IS A CONFLICT THEN THE FEDERAL STANDARD (DAVIS BACON) WILL PREVAIL.

Please confirm that the monitoring of certified payroll can be performed by either “In-House” personnel or a specialty consultant.

Please specify that the cost of this effort is either to be included within construction management agreement or not included and involved separately.

CURRENT DIR REPORTING REQUIREMENTS WILL BE REQUIRED FOR DISTRICT PROJECTS. COSTS FOR THE CONSTRUCTION MANAGER’S REVIEW OF DIR REGISTRATION REQUIREMENTS (TO THE EXTENT REQUIRED) MAY BE INCLUDED IN THE FINAL AGREEMENT TO BE NEGOTIATED WITH THE SELECTED FIRM.

Please confirm the district’s agreement with “….. district’s” inspector will include all duties, typically required of DSA approved inspection.

APPLICABLE DSA INSPECTION REQUIRMENTS WILL BE ADHERED TO FOR DISTRICT PROJECTS. PAGE 26-27 INDEMNIFICATION

Sub paragraphs a, b, and c clearly define the limitation to construction manager’s liability for damages. Please confirm that sub paragraphs a, b, and c also apply to the last paragraph page 27.

THE INDEMNITY PROVISIONS IN LINE WITH THE SUBPARAGRAPHS CITED WILL BE SPELLED OUT IN THE FINAL CONSTRUCTION MANAGER AGREEMENT.

APPROPRIATE MEANS THAT THE BOND COMPLIES WITH APPLICABLE LEGAL REQUIREMENTS. PAGE 27 INSURANCE

Subparagraph @ “construction manager shall provide.” Many firms that serve the industry as program and/or construction managers do not perform, even though properly licensed as a general contractor, in an “at-risk” manner & therefore do not have a relationship with a bonding company.

Is it the intention of the district to restrict the pool of respondents to only those that perform in an “at-risk” manner and can provide bonds?

NO, IT IS NOT THE DISTRICT’S INTENT TO RESTRICT THE POOL OF RESPONDENTS AS CITED. PAGE 27 INSURANCE

Subparagraph @ “bonds”

In the event of insolvency of a multiple-prime contractor and the entity that provided the bonds for that company, what entity is required to pay the cost of any incomplete work or warranty work and/or obtain a substitute bond for such costs?

THE BONDING COMPANY WOULD BE RESPONSIBLE FOR COMPLETING THE PROJECT. PAGE 28 INSURANCE

Subparagraph @ “builders risk insurance ”Page 24 “construction cost and project budget” states that the cost of construction management is a district responsibility and preferably not chargeable to the federal grant.

Please confirm. CONFIRMED.
