We, the Members of your Committee of the Whole beg leave to report Section “A” as information and Section “B” as follows:

“A” 1 Provincial Hospital Funding for Major Core Capital Equipment

“B” 1 THAT the Council of the Corporation of the Township of Drummond/North Elmsley

supports the Town of Perth’s resolution to Premier Doug Ford requesting the province be financially responsible for the replacement costs associated with all major capital

equipment in hospitals.

“A” 2. Unopened Road Allowance between Lots 20 & 21, Concession 2 Drummond

“B” 2. THAT the Council of the Corporation of the Township of Drummond/North Elmsley

supports, in principle and subject to the results of a survey, the road closure over a limited portion of the road allowance lying between lots 20 and 21 Concession 2, Drummond if required;

AND FURTHERMORE THAT the staff be authorized to work with the applicant to process

THE CORPORATION OF THE TOWNSHIP OF DRUMMOND/NORTH ELMSLEY

BY-LAW NUMBER 2021-027 STOP SIGN BY-LAW

BEING A BY-LAW TO PROVIDE FOR

THE ERECTION OF STOP SIGNS AT VARIOUS INTERSECTIONS

WHEREAS section 11 of the Municipal Act, 2001 authorizes municipalities to enact

by-laws respecting matters within the sphere of jurisdiction of “highways, including parking and traffic on highways”, in conjunction with the provisions of the Highway Traffic Act.

NOW THEREFORE the Council of the Corporation of the Township of Drummond North

Elmsley enacts as follows:

1. THAT the intersections on highways set out in Appendix A are designated as intersections where stop signs have been erected.

2. THAT the penalties provided in the Highway Traffic Act shall apply to offences against this by-law.

3. THAT this By-law has full force and effect from the date of approval and that new stop signs will have full force and effect on the day of installation.

4. THAT By-law 2012-069 is and shall hereby be repealed.

THE CORPORATION OF THE TOWNSHIP

OF DRUMMOND/NORTH ELMSLEY

BY-LAW NO. 2021-028

STOP UP, CLOSE AND CONVEY A PORTION OF A ROAD – SHAW STREET

BEING a by-law to stop up, close and convey a portion of the Shaw Street Road Allowance

described as Part 1 on 27R-11662.

WHEREAS pursuant to Section 34 of the Municipal Act, 2001, S.O. 2001 c. 25, and amendments

thereto, a municipality has the power to close a highway by carrying out the prescribed procedures;

AND WHEREAS the lands were declared surplus on November 24, 2021 by Resolution #130 to

the needs of the Corporation in accordance with By-Law 2014-027;

AND WHEREAS notice to the public of the proposed closure has been given by an ad in the local

paper; notice on the Corporation’s Website Page and a notice posted on the property for 14 days prior to the passing of this by-law;

AND WHEREAS on June 8, 2021, the Council of the Corporation of the Township of

Drummond/North Elmsley has heard in person or by his counsel, solicitor or agent all persons claiming that his/her land will be prejudicially affected by this By-Law and who applied to be heard and no objections were received;

AND WHEREAS it is deemed expedient in the interest of the Corporation of the Township of

Drummond/North Elmsley that part of the Township highway more particularly described in Schedule “A” (the lands) be closed and stopped up and the lands transferred to Ronald Joseph Jackson and Julie Ann Jackson (the “Abutting Owner”);

NOW THEREFORE BE IT RESOLVED THAT, the Council of the Corporation of the Township of

Drummond/North Elmsley enacts as follows:

1. That the lands more particularly described in Schedule “A” to this By-Law are hereby closed and stopped up.

2. That the Reeve and the Clerk of the Corporation of the Township of Drummond/North Elmsley are hereby authorized to sign and execute such deeds and other documents as may be necessary to effect the conveyance of the lands which have been stopped, closed and conveyed to the Abutting Owner.

3. That Schedule “A” forms part of this By-Law.

4. That this By-Law will come into effect upon registration in the proper land registry office. Read a first, second and third time, and finally passed and enacted this 22nd day of June, 2021.

BY-LAW NO. 2021-029

DOG POUND AGREEMENT – BIG SKY RANCH

BEING a by-law to enter into an agreement with Big Sky Ranch (Andrew Parent) for

the provision of pound services;

WHEREAS the Council of the Corporation of the Township of Drummond/North

Elmsley deems it necessary and desirable to enter into an agreement for the basic care and shelter for dogs impounded by the municipality;

NOW THEREFORE, the Council of the Corporation of the Township of

Drummond/North Elmsley enacts as follows:

1. That the Reeve and Clerk Administrator are authorized to enter into an agreement with Big Sky Ranch (Andrew Parent) on behalf of the Corporation of the Township of Drummond/North Elmsley, attached as Schedule “A” and forming part of this by-law.

2. That By-law 2019-025 shall be and is hereby repealed. 3. That this by-law comes into force on July 1, 2021.

2021.

SCHEDULE “A” BY-LAW 2021-029

DOG POUND AGREEMENT – BIG SKY RANCH

THIS AGREEMENT made in duplicate this day of 2021.

BETWEEN:

THE CORPORATION OF THE TOWNSHIP OF DRUMMOND/NORTH ELMSLEY Hereinafter called the “Township” of the FIRST PART

- and -

ANDREW PARENT

Hereinafter called “Andrew Parent” of the SECOND PART

WHEREAS Andrew Parent has the facilities and is prepared to act and provide Pound Services to the Township;

NOW THEREFORE this Agreement witnesseth for and in consideration of the mutual covenants hereinafter contained, the parties hereto agree each with the other as follows:

1. The Township agrees:

1.1 to appoint and does hereby appoint Andrew Parent as Pound Keeper for the Township with the duties of such Pound Keeper to be exercised by Andrew Parent to impound canines (dogs) in accordance with the provisions of Township By-law 2021-xxx; 1.2 to pay Andrew Parent as remuneration for his services as such Pound Keeper

effective the date of signing this agreement: (a) A Pound Fee of $100.00 (flat rate) per dog,

(b) A Board Fee of $10.00 (per day rate, to a maximum of (5 days) per dog,

(c) A flat monthly rate (retainer) of $250.00 per month; for the term of the contract,

payable monthly;

1.3 in the event a dog(s) is claimed by its owner(s), the owner(s) will assume full responsibility and pay full costs for veterinarian fees, the impound and boarding fees and will be paid directly to Andrew Parent. In such circumstances which a dog(s) is claimed by its owner(s), the Township will not be charged pound or boarding fees;

1.4 should the dog(s) remain unclaimed at the end of the five (5) day period, the Township will be responsible and full payment of the veterinarian fee, pound fee and boarding fee to a maximum of five (5) days;

1.5 to grant to Andrew Parent the right to foster by the Sanctuary all dogs lawfully impounded and remain safe and cared for until the dog is placed in a new loving home. A copy of the fostering document detailing the transfer of responsibility for the animal from the Township to the Sanctuary will be provided in the monthly report, in this event.

1.6 to promptly transport injured dog(s) to a veterinarian, if the owner of the dog(s) in unknown or cannot be located in a timely fashion. The Township will be responsible for the payment of all veterinary fees. Once the animal has been treated and released from the veterinary clinic, the Township may transport the dog(s) to Andrew Parent;

1.7 to reimburse Andrew Parent the full cost of any medical care given to a dog within the five (5) day boarding period. A copy of all medical care expenses will be approved in advance and provided to the Township in the monthly report.

1.8 The contract does not cover cats, wildlife, roadkill, deadstock or deceased dogs. 2 Andrew Parent agrees:

2.1 to provide a facility capable of providing adequate accommodation for all dogs

impounded in the Township and designed to meet the standards of this type of building in accordance with the Animals for Research Act, RSO 1990, c A 22 and its regulations; 2.2 to install in the facility all equipment necessary for the proper operation of the facility; 2.3 to receive, impound and hold for claiming by the owner(s), any dog delivered to

Andrew Parent’s animal facility by the Township; 2.4 to charge and collect such fees as described herein;

2.5 to keep the facility open and in operation to ensure that the owner(s) of an impounded dog(s) have reasonable opportunity to reclaim such animal(s), and to advise the Township of any change of hours of operation;

2.6 to indemnify and save harmless the Township and will pay for any damages suffered by, imposed upon, or asserted against the Township as a result of, in respect of, connected with or arising out of, under pursuant to any breach of the Agreement and the operation of the facility;

2.7 the Township will be provided with the entry code to permit access to the facility 24 hours per day and located at:

2.8 to keep Andrew Parent, the facility and the Township property insured in respect to public liability and property damage, including claims in respect to injury and loss and/or death of any animal in the following amounts:

(a) Public Liability $2,000,000.00

(b) Property Damage $25,000.00

And to provide the Township with a copy of the insurance policy to execution of this Agreement, and annually on the anniversary date of this Agreement.

3 Both Parties agree:

3.1 This agreement will commence on July 1, 2021 and shall continue in full force and effect until July 1, 2023, with a two-year extension if both parties are in agreement until July 1, 2025. However, it is further agreed that this agreement may be terminated by either for any reason party upon sixty (60) days written notice.

3.2 It is understood that Andrew Parent is an independent contractor and not an employee of the Township.

Property Standards By-law

BEING a by-law to provide standards for the maintenance and occupancy of property

within the Township of Drummond/North Elmsley.

WHEREAS under Section 15.1(3) of The Building Code Act, S.O. 1992 c.23 as

amended, municipalities may pass a by-law to:

1. Prescribing standards for the maintenance and occupancy of property within the municipality or within any defined area or areas and for prohibiting the occupancy or use of such property that does not conform with the standards.

2. Requiring property that does not conform with the standards to be repaired and maintained to conform with the standards or the site to be cleared of all buildings, structures, debris or refuse and left in graded and levelled condition.

AND WHEREAS pursuant to Section 15.6 of the Building Code, S.O. 1997 c.24, as

amended, a by-law passed under section 15.1 shall provide for the establishment of a Property Standards Committee;

AND WHEREAS the Official Plan in effect in the Township of Drummond/North Elmsley

includes a provision relating to property conditions;

AND WHEREAS under the Tenant Protection Act, S.O. 1997 c.24, as amended, the

Council of a local municipality may pass by-laws requiring landlords to provide adequate and suitable vital services to each of the landlord’s rental units;

NOW THEREFORE the Council of the Corporation of the Township of Drummond/North

Elmsley hereby enacts as follows:

PART I DEFINITIONS

In this By-law,

1.1 “Clerk” means the person appointed by the Municipality as the Clerk.

1.2 "Committee" means the Property Standards Committee of the Township of Drummond/North Elmsley, members of which are appointed by Council.

1.3 “Chief Building Official” means the person appointed by Municipality as the

Chief Building Official.

1.4 “Derelict vehicle” means any car, trailer, boat, machinery, recreational vehicle or

objects or parts thereof that are not operative, unused, non-restorable, discarded, in disrepair or unlicensed.

1.5 "Maintenance" means the preservation and keeping in repair of a property. 1.6 "Municipality" means the Corporation of the Township of Drummond/North

Elmsley.

1.7 "Noxious Weed" means any weeds classed as noxious by the Weed Control Act, R.S.O. 1990, c.W.5.

1.8 "Officer" means a property standards officer who has been assigned the responsibility of administering and enforcing this by-law.

1.9 “Occupant” means any person or persons over the age of 18 years in possession

of the property; 1.10 “Owner" includes:

a) the person for the time being managing or receiving the rent of the land or premises in connection with which the word is used, whether on the person’s own account or as agent or trustee of any other person, or who would receive the rent if the land and premises were let, and

b) lessee or occupant of the property who, under terms of a lease, is required to repair and maintain the property in accordance with the standards for the maintenance and occupancy of the property.

1.11 "Person" means an individual, firm, corporation, association or partnership.

1.12 "Property" means a building or structure or part of a building or structure and includes the lands and premises appurtenant thereto and all mobile homes, mobile buildings, mobile structures, outbuildings, accessory buildings, fences and erections thereon whether heretofore and hereafter erected, and includes vacant property.

1.13 "Unsafe Condition" means the physical state of a property, structure, barrier, fence and/ or building(s), whether vacant or occupied, that in the opinion of the Property Standard Officer is a hazard to the public regarding fire, accident, health or safety.

1.14 "Vehicle" includes an automobile, truck, motorcycle, motorized snow vehicle, bus, trailer, traction engine, road-building machine and any vehicle drawn, propelled or driven by any kind or power, including muscular power, but does not include vehicles running only upon rails or vehicles used in farm operations.

1.15 "Yard” means

a) In urban areas - For lands around or adjoining to the whole or any part of a residential, commercial, industrial or institutional property and used or capable of being used in connection with the property; and for estate lots, it generally refers to the lawn portion of a property situated within the Hamlets whose boundaries are identified in the Municipality’s Official Plan and properties situated within registered plans of subdivision.

b) In rural areas – For lands around or adjoining to the whole or any part of a residential, commercial, industrial or institutional property and used or capable of being used in connection with the property; and for estate lots, it generally refers to the lawn portion of a property and excludes barnyards and land under farm operations and applies to lands situated outside the Hamlets whose boundaries are identified in the Municipality’s Official Plan and outside all areas of registered plans of subdivision.

1.12 Any word or term not defined in this by-law shall have the meaning ascribed to it in the Building Act or the Ontario Building Code.

PART II GENERAL 2.0 CONDITIONS OF LANDS

2.1 No owner or occupant of any property shall cause, allow or permit any building,

yard, lot or grounds to be or remain in a condition contrary to the requirements of this by-law.

2.2 Every yard, including vacant lots, shall be kept free from:

(1) rubbish, garbage, waste, debris, and other objects that create, or may create a health, fire or accident hazard;

(2) long grass, discarded brush and clippings, excessive weed growth, or any

other condition that may promote or be susceptible to fire or infestation by weeds, rodents and other noxious conditions;

(3) timber, lumber, building materials or any other type of product or materials

stored or kept under conditions that may promote or be susceptible to infestation by rodents and vermin.

(4) derelict vehicles, scrap and junk material including without limiting its

generality, wrecked, dismantled, unused, or non-restorable, machinery, tools, appliances, equipment or any part thereof, except in an establishment licensed or permitted to conduct and operate such a business;

(5) buildings, fences, scaffolding, retaining walls or any other erection that, by reason of its ruinous or dilapidated state, faulty construction or otherwise, is in an unsafe condition as regards danger from fire or risk of accident;

(6) dead, decayed or damaged trees that pose a safety hazard.

PART IV EXEMPTED LANDS

3.0 FARM LANDS/COMMERCIAL & INDUSTRIAL OPERATIONS

3.1 Lands that are being actively farmed and commercial industrial operations are

exempt from the provisions of the by-law to the extent that no health and safety risks are present.

PART V

RESIDENTIAL TENANCIES ACT 4.0 RESIDENTIAL TENANCIES ACT

4.1 The maintenance standards for residential tenants shall be in accordance with the

O Reg. 517/06 Maintenance Standards of the Residential Tenancies Act, 2006, S.O. 2006 c.17.

PART VI ENFORCEMENT 5.0 OFFICERS AND INSPECTORS

5.1 The enforcement of this bylaw shall be complaint driven.

5.2 Every person who contravenes any provision of this bylaw is guilty of an offence

and upon conviction is liable to a fine as provided for by the Provincial Offences

Act, R.S.O. 1990, Chapter P.33, as amended.

5.3 The person(s) appointed as Property Standards Officer(s) for the Corporation of

the Township of Drummond/North Elmsley shall be responsible for the administration and enforcement of this By-law.

5.4 Upon receipt of a written complaint to the Municipality’s Chief Building Official by an identifiable individual, the Officer will investigate to determine if a violation of this Bylaw exists.

5.5 An officer who finds that a property does not conform with any of the standards

prescribed in this by-law will work with the property owner to achieve compliance prior to an order being issued. The Officer may serve written notice upon the owner of the property directing that the violation be remedied within a specific period and specifying what needs to be done. Said Notice in the form of Appendix A shall be sent by registered mail to the last known address as shown on the most current assessment roll or delivered personally to the registered owner or person responsible for the property.

5.6 If the matter cannot be resolved through voluntary compliance, the Officer may

make an order in the form of Appendix B:

a) stating the municipal address or the legal description of the property;

b) giving reasonable particulars of the repairs to be made or stating that the site is to be cleared of all buildings, structures, debris or refuse and left in a graded and levelled condition;

c) indicating the time for complying with the terms and conditions of the order and giving notice that, if the repair or clearance is not carried out within that time, the municipality may carry out the repair or clearance at the owner’s expense; and

d) indicating the final date for giving notice of appeal from the order.

5.6 The order shall be served on the owner of the property and such other persons

affected by it as the officer determines and a copy of the order may be posted on the property in a location visible to the public.

6.0 PROPERTY STANDARDS COMMITTEE

6.1 A Property Standards Committee shall be established and consist of members of

Council.

6.2 The members of the Committee shall appoint one of themselves as Chair, and

when the Chair is absent, the Committee may appoint another member to act as Chair pro tempore and any member of the Committee may administer oaths.

6.3 The Secretary shall keep on file minutes and records of all applications and the

decisions thereon and of all other official business of the Committee and Section 74 of the Municipal Act applies mutatis mutandis to such documents. The Secretary shall be comprised of a Municipal Staff member appointed by the Committee.

6.4 A majority of the Committee constitutes a quorum and the Committee may adopt

its own rules of procedure but before hearing an appeal it shall give notice or direct that notice be given of such hearing to such persons as the Committee considers should receive notice.

6.5 An owner or occupant who has been served with an order made under subsection 4.2 and who is not satisfied with the terms or conditions of the order may appeal to the committee by sending a notice of appeal to the Municipality’s Clerk within 14 days after being served with the order

6.6 An order that is not appealed within the time referred to in subsection 4.5 shall be deemed to be confirmed.

6.7 The committee shall hear the appeal.

6.8 On an appeal, the committee has all the powers and functions of the officer who

made the order and the committee may do any of the following things if, in the committee’s opinion, doing so would maintain the general intent and purpose of the by-law and of the official plan or policy statement:

1. Confirm, modify or rescind the order to demolish or repair. 2. Extend the time for complying with the order.

7.0 POWER OF MUNICIPALITY TO REPAIR OR DEMOLISH

7.1 Where an owner or occupant of the property fails to take such steps as may be

necessary to bring the property into compliance with this By-law, the Municipality, or a person acting on its behalf, shall:

c) have the right to enter upon the property to affect such repairs, clean-up, demolition or other remedial steps as may be required to bring the property into compliance with the standards herein and neither the Municipality, nor anyone acting on its behalf shall be liable to compensate the owner, occupant or any other persons by reasons of anything done by or on behalf of the Municipality in reasonable exercise of these powers and

d) shall have a lien on the property for the amount spend by, or on behalf of the Municipality in accordance with this By-law, together with an administration fee of 10% of the amount spent, and the total amount shall have priority lien status as described in section 1 of the Municipal Act, 2001, S.O. 2001, c. 25 as

amended.

PART II ADMINISTRATION 8.0 ADMINISTRATION

8.1 Should any part, section, subsection or portion of this by-law be repealed or declared by a court of competent jurisdiction to be illegal, the same shall not affect the validity of the by-law as a whole or in part thereof, except for that which was declared to be invalid.

8.2 Where a provision of this By-law conflicts with the provisions of another By-law in force in the Municipality, the provisions that establish the higher standards to protect the health, safety and welfare of the general public prevails.

8.3 This By-law shall come into force and take effect upon its passing.

8.4 That By-law 2019-052 and any other by-law inconsistent with the provisions contained herein are hereby repealed in their entirety.

SHORT TITLE

8.5 This By-law shall be sited as the “Property Standards By-law.”

WHEREAS Section 39.1(1) of the Planning Act, R.S.O., 1990, Chapter P.13, authorizes

Council to pass by-laws to regulate the use of lands and the character, location and use of buildings and structures within the Township of Drummond/North Elmsley;

AND WHEREAS the Council of the Corporation of the Township of Drummond/North

Elmsley deems it advisable to amend Zoning By-law No. 2012-060, as amended, as hereinafter set forth;

NOW THEREFORE the Council of the Corporation of the Township of Drummond/North

Elmsley enacts as follows:

1. The lands affected by this By-law are shown on Schedule “A” which is attached hereto and forms part of this By-law.

2. Zoning By-law No. 2012-060, as amended, is hereby further amended by adding the following new subsection at the end of Section 7.4 (Exception zones):

RU-101: Part of Lot 12, Concession 2 Drummond (2021-031)

Notwithstanding any provisions of this By-law to the contrary, on the lands zoned RU-X, the following provision shall apply:

1. A Residential dwelling shall be prohibited

3. Schedule “A1” of By-law No. 2012-060 is hereby amended by changing the zoning of the lands affected by this By-law from “RU” to “RU-101”

BY-LAW NO. 2021-032

BEING A BY-LAW TO CONFIRM THE PROCEEDINGS OF THE COUNCIL.

WHEREAS pursuant to Section 5 of the Municipal Act 2001 S.O. 2001 c.25, the powers

of a municipal corporation are to be exercised by its Council through the passage of a

by-law;

AND WHEREAS Subsection 2 of Section 11 of the Municipal Act, 2001, S.O. 2001, c. 25,

the powers of every Council are to be exercised by By-law;

AND WHEREAS it is deemed expedient that the proceedings of the Council of the

Corporation of the Township of Drummond/North Elmsley at this meeting be confirmed and adopted by By-law;

NOW THEREFORE the Council of the Corporation of the Township of Drummond/North

Elmsley enacts as follows:

1. The action of the Council of the Corporation of the Township of Drummond/North Elmsley at its meeting held on June 22, 2021 in respect of each recommendation contained in each motion and resolution passed and other action taken by the Council of the Corporation of the Township of Drummond/North Elmsley at its meeting is hereby adopted and confirmed as if all such proceedings were expressly embodied in this By-law.

2. The Reeve and proper officials of the Corporation of the Township of Drummond/North Elmsley are hereby authorized and directed to do all things necessary to give effect to the action of the Council of the Corporation of the Township of Drummond/North Elmsley referred to in the preceding section hereof. 3. The Reeve and the Clerk are authorized and directed to execute all documents necessary to that behalf and to affix thereto the seal of the Corporation of the Township of Drummond/North Elmsley.
