General Terms of Service of Bet3000 Casino General
These Terms of Service govern the customer's rights to access and use the Bet3000 Online Casino website, which is operated by IBA Entertainment Ltd, a company incorporated and based in Malta (company registration no C 47819). The Casino is regulated by the Lotteries and Gaming Authority of Malta and is subject to Maltese laws.
Please read these General Terms of Service carefully before using the Bet3000 Online Casino website or downloading any Software made available on the Bet3000 Online Casino website. By entering Bet 3000's Casino website the customer confirms to have read and agree to be bound by the following terms.
These Terms of Service together with any other additional rules, terms and conditions that appear on the Bet3000 website or that specifically relate to and govern any particular event, game, Software or tournament, constitute a legally binding agreement between Bet3000 and the customer.
These Terms of Service, including the documents specifically incorporated by reference, represent the complete, final and exclusive agreement between the customer and Bet3000 Casino with respect to the Bet3000 Casino Services. They replace and merge all prior agreements, representations and understandings between the customer and Bet3000 Casino. The customer acknowledges and agrees to that they are not relying on any representation, agreement, term or condition that is not set out herein.
Bet3000 has the right to terminate Bet3000 Casino Services or suspend the customer's account if it believes the customer are in breach of these Terms of Service.
These Terms of Service are governed by the laws of Malta. The customer hereby irrevocably consents to submit to the jurisdiction of the Courts of Malta.
The customer agrees that no joint venture, partnership, employment, or agency relationship exists between the customer and Bet3000 (or its licensors) arising from this agreement or the customer's use of the Site, services and/or Software.
Bet3000 may at any time assign this agreement in whole or in part. The customer hereby acknowledges and agrees that Bet3000's licensors are third-party beneficiaries under this agreement.
Bet3000's failure to enforce at any time any of the provisions of these Terms of Service or related License Agreements shall in no way be construed to be a present or future waiver of such provisions, nor in any way affect the right of any party to enforce each and every such
Notwithstanding anything else in this agreement, no default, delay or failure to perform on the part of Bet3000 shall be considered a breach of this agreement if such default, delay or failure to perform is shown to be due to causes beyond the reasonable control of Bet3000. No indulgence granted by the Bet3000 Casino to the customer shall be construed as a waiver of any of Bet3000 Casino's rights in respect of these Terms of Service.
Unless specifically stated otherwise, nothing in these Terms of Service shall create or confer any rights on any persons not party to this agreement.
Bet3000 reserves the right to modify and update these Terms of Service at any time with or without notice to its customers, who are responsible for regularly reviewing these Terms of Service. The most current version of the Terms of Service can be reviewed by clicking on the 'Terms and Conditions' hypertext link located on the bottom of the Bet3000 Sites. The
customer's continued use of the Site after a change or update has been made to the Terms of Service will constitute the customer's acceptance of such change or update.
These Terms of Service may be published in various languages for information purposes and to facilitate access. It is only the English version that is the legal basis of the relationship between the Customer and the Bet300 Casino. In case of any discrepancy between a non-English version and the non-English version of these Terms of Services, the non-English version shall be prevalent.
1. Services of the Bet3000 Casino Website
1.1 Bet3000 may provide the customer with access to its services. The services, including any updates, enhancements, new features, and/or the addition of any new sites, are subject to these Terms of Service and any license agreements, codes of conduct or posted rules, instructions or guidelines regarding a particular service and any related Software and materials (as applicable, the 'License Agreement'). If there is any conflict between these Terms of Service and the applicable License Agreement for a particular Service, Bet3000 (or its licensors) shall resolve the conflict at its sole discretion.
1.2 All content of the Bet3000 website is for non-commercial, personal use only. The
customer is only permitted to enter the Bet3000 Casino for their own personal entertainment and non-professional use. Any other entrance, access, use or reuse of the Casino or the Casino Website is strictly prohibited. No purchase is necessary or required to play on the Casino site and the customer may participate without betting money if the customer so wishes. Playing for money is at the customer's sole discretion and risk.
2. Customer account
2.1 The customer is solely responsible for verifying that their registration with Bet3000 is legal in the jurisdiction in which the customer is located regarding the the laws of use of the Internet gaming. Bet 3000 Casino or any of the Casino's employees, licensees, distributors, wholesalers, affiliates, subsidiaries, advertising, promotion or other agencies, media partners, agents give no representations or warranties, implicit or explicit, as to the customer's legal right to play at the Casino.
2.2 The customer must be at least 18 years of age to use the Services or place bets on the Site. Providing false information relating to age, name and address may constitute a violation of the law. Bet3000 reserves the right to report any person supplying false information on the Site to the relevant authorities.
2.3 If any of the Services the customer uses require an account, before using the Service the customer must open an account by completing the required registration process. This will include providingBet3000 with current, complete and accurate information, including, without limitation, the customer's email address.
2.4 The customer may also be asked to choose a user name and a password. The customer's user name must be unique and cannot be vulgar or otherwise offensive (as determined by Bet3000 at its sole discretion), nor should it infringe any trade mark or other proprietary rights of a third party. The customer's user/account name can only be used in accordance with these Terms of Service and/or applicable License Agreements.
2.5 The customer's membership or subscription is personal to the customer and the
customer may not transfer or make available the customer's account name and password to others and the customer may not use anyone else's account at any time.
2.6 The customer is entirely responsible for maintaining the confidentiality of their account number and password and the customer has sole responsibility for any and all activities that occur under their account. The customer remains liable for losses incurred by themselves or a third party on their Bet3000 account.
2.7 The customer hereby warrants that all and any information that they submit to Bet3000 is and will be true and accurate (including, without limitation, the customer's billing information such as credit card number and its expiry date), and the customer gives his consent to pay all fees the customer incurs using the Bet3000 Casino Services, plus all applicable taxes,. The customer agrees to notify Bet3000 immediately, if any of the information supplied has changed.
2.8 The customer must notify Bet3000 immediately of any unauthorized use or theft of their account or any other breach of security. If requested, the customer agrees to provide Bet3000 with evidence of such theft or unauthorized use. Bet3000 will not be liable for any loss that the customer may incur as a result of a third party using their password or account, either with or without the customer's knowledge.
2.9 Bet3000 reserves the right to cancel the customer's account without refund if it becomes aware that the customer have disclosed their account details and password to a third party. 2.10 The customer agrees to indemnify and hold harmless Bet3000 from any claim, demand, damage, or loss including reasonable attorneys' fees, asserted by any third party due to or arising out of their use of the Services or use by any third party accessing the Services using the customer's account.
2.11Employees of the Casino, its licensees, distributors, affiliates, subsidiaries, advertising, promotion or other agencies, media partners, retailers and members of the immediate families of each are not eligible to play on the Bet3000Casino website.
2.12. Bet3000 Casino reserves the right to refuse to open a customer account or to cancel a customer's account for any reason whatsoever at any time without notice to the customer. Any balance in the customer's account at the time of such cancellation will be refunded to the customer using the method of payment as determined by the Bet3000 Casino. However, Bet3000 Casino reserves the right to void any winnings and appropriate any balance in the customer's Casino account in its sole discretion in any of the following circumstances:
2.12.1. if the customer resides in a jurisdiction where playing at the Bet3000 Internet Casino is prohibited by law
2.12.2. if the customer provides incorrect or misleading registration information 2.12.3. if the customer has charged back any of the purchases made with the
customer's credit card or other applicable purchase method on the customer's Bet3000 Casino account
2.12.4. if the customer is not of legal age
2.12.5. if the customer is found cheating or if it is determined by Bet 3000 Casino that the customer made use of a system (including machines, computers, software or other automated systems) specifically designed to defeat the Casino
2.12.6. if the customer has not played at the Casino on an individual basis for personal entertainment only (that is, the customer have played in a
professional sense or in concert with other player(s) as part of a club, group, etc.);
2.12.7. if the customer has more than one active account at the Bet3000 Casino
2.12.8. if the name on the customer's Casino account does not match the name linked to the payment method used to make purchases on the customer's Bet3000 Casino account
2.12.9. if the customer has granted (intentionally or unintentionally) someone else to play on the customer's Bet3000 Casino account
2.12.10. if the customer takes part in a Casino promotion and cash-in before fulfilling the requirements of that particular promotion
2.12.11. if the Casino should become aware that the customer has used the services of any other Online Casino under any of the unlawful circumstances stipulated above.
3. Deposits and Withdrawals/Winnings
3.1 Internet gambling may be illegal in the jurisdiction in which the customer is located. If so, the customer is not authorized to use their payment card to complete any transactions on the Sites.
3.2 The customer can only place bets on Bet 3000's service using the credit held in their account. The customer can also credit their account using one of Bet3000’s other authorized payment methods.
3.3 Under the anti-money laundering laws of Malta Bet3000 are obliged to report suspicious transactions to the authorities. Examples of such activities include: use of funds suspected to be derived from illegal activities; any suspected intention to conceal or disguise funds derived from illegal activities; or suspicion that the involvement of the Casino is in any manner intended to facilitate criminal activity.
3.4 Winnings are subject to Bet3000’s verification procedures before payment is made. Bet3000 may charge a fee for handling payments by cheque or by bank transfer.
3.5 The maximum payout for any one 24-hour period for any one customer is EUR100,000.- in the casino. The daily maximum payout in the casino excludes winnings onBet3000’s progressive casino games, payouts of which are governed by the Jackpot amount.
3.6 If while playing at Bet3000 the customer wins a sum regarded byBet3000 as worthy of publicity then the customer hereby agrees to be available for any event arranged byBet3000 in relation to the win.
3.7 The customer is solely responsible for any applicable taxes on any prizes and/or winnings that the customer collects from the Casino.
3.8 If the customer has any dispute with regard to any outcome of the Casino, the customer must submit their complaint to the Casino in writing within fourteen (14) days. In the event of a discrepancy between the result showing on the customer's Casino software and the
Casino's gaming server software, the result showing on the Casino's gaming server software shall be the official and governing result of Play.
3.9 If any complaint to the Casino is not resolved to the customer's satisfaction, they have the right to refer such complaint to the Lotteries and Gaming Authority of Malta by sending an email to complaints@lga.org.mt.
4. Closing of a customer account
4.1. The customer has the right to cancel their account or a particular subscription at any time. the customer understand and agree that, except as specifically provided by law, the cancellation of the customer's account or a particular subscription is the customer's sole right and remedy with respect to any dispute with Bet3000 or its licensors. Bet3000 reserves the right to collect fees, surcharges or costs incurred before the customer cancel the customer's account or a particular subscription. In the event that the customer's account or a particular subscription is terminated, suspended or cancelled, no refund will be granted, no other credits (e.g. points or tokens) will be credited to the customer or converted to cash or other form of reimbursement, and the customer will have no further access to the customer's account or anything associated with it (such as points, tokens). If the customer's account is terminated or suspended by Bet3000, Bet3000 shall have the right to terminate or suspend any of the customer's other accounts.
4.2. If no activity is registered on the customer's account for a period of thirty (30) months the customer's account shall be deemed to be a dormant account under Malta's Remote Gaming Regulations (LN 176 of 2004). Thereafter we will make every effort to reimburse the
customer the balances in the customer's account and failing that balances in the customer's account will be remitted to the Lotteries and Gaming Authority of Malta.
5. Customer communication
5.1 Bet3000’s representatives may monitor the customer's communications on the Sites. Bet3000 specifically excludes, to the maximum extent permitted by law, liability for any third party content on the Bet3000 Casino Sites.
5.2 With reference to any materials, in whatever format or media, a customer may post or otherwise provide to the Site (a "posting"), the customer hereby grants Bet3000 a non-exclusive, worldwide, royalty-free, perpetual and irrevocable license to use, copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, modify, translate and reformat their posting. The customer specifically acknowledges that Bet3000 will not pay them for their posting. Bet3000 may remove a customer's posting from the Site at any time. For each posting, the customer warrants that they have all the rights necessary for them to grant the license contained in this paragraph.
6. Responsible Gaming
Bet3000 is committed to assisting its customers in gambling responsibly and as such has provided the following features on its site: self-exclusion tools, links to GamCare, self help and awareness information, and tools to protect underage access. Players may at any time request to be excluded from Bet3000’s services.
7. Software License
7.1 Copyright in any Software relating to the Bet3000 Casino Services that is made available from the Site ('Software') is owned by Bet3000 and/or its licensors. Use of the Software is governed by the terms of the applicable License Agreement. A customer may not install or use any Software, unless they agree to the applicable License Agreement terms. If there are any inconsistencies between the relevant License Agreement and these Terms of Service, Bet3000 will determine which terms shall apply or take priority at its sole discretion.
7.2 The Software is made available solely for use by Bet3000 Casino customers in accordance with the License Agreement and these Terms of Service. Customers are specifically prohibited from reproducing or redistributing the Software except in accordance with the License Agreement. Bet3000 and its licensors reserve their rights to take legal action against any user found to be in breach of any License Agreement.
7.3 Copying or reproducing the Software is specifically prohibited, unless such reproduction or redistribution is specifically permitted by the relevant License Agreement.
7.4 The customer obtains no rights to the Bet3000 Casino's trade name, nor any other names, graphics, text, concepts or methodologies by using the Casino Website and the material contained therein. The customer is merely granted a revocable, exclusive, non-transferable right to use the Casino software for the purposes of entertainment. All copyright, trademarks and all other intellectual property rights in all material and content supplied as part of the websites and software remain lodged in the Bet3000 Casino. The customer is permitted to use this material only as specifically authorized by Bet3000 Casino.
7.5. Bet3000 reserves the right to modify the sites, services and software and/or change the system specification requirements necessary to access and use the services at any time and without prior notice.
7.6 Contingent on any express warranties in the relevant License Agreement, Bet3000 hereby disclaims all warranties and conditions with respect to the Software. This includes all warranties and conditions of merchantability, whether express, implied or statutory, fitness for a particular purpose, title, non-infringement, and those arising from a course of dealing or usage of trade.
7.7 As a condition of the customer's use of the Bet3000 Services, the customer will not use the Bet3000 Casino Services for any purpose that is illicit or disallowed by the terms, conditions, and notices included in these Terms of Service or any relevant License Agreement. Furthermore, the customer may not use the Bet3000 Casino Services in any manner that could damage, disable, overburden, or impede any Bet3000 server, or the network(s) connected to any such server, or interfere with any other party's use and enjoyment of any Bet3000 Casino Services. The customer may not endeavour to gain unauthorized access through hacking, password mining or any other means to any Bet3000 Casino Services, other accounts, computer systems or networks connected to any Bet3000 server or to any of the Bet3000 Casino Services. The customer may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services. The customer may not reverse engineer, decompile or disassemble any Software, including any proprietary communications protocol used by such Software.
8. Third party content
8.1. The Sites may contain advertising and sponsorship and other material from third parties which are beyond Bet3000's control. Those third parties are responsible for ensuring that material submitted for inclusion on the Site complies with all relevant laws and regulations. Bet3000 will not be responsible for any error or inaccuracy in any third party material, nor does the Company endorse any third parties whose material appears on the Site.
8.2. The Site may contain links to other Sites which are also outside Bet3000's control and are not covered by these Terms of Service. Bet3000 will not be liable for the content of any third party websites or the actions or omissions of their proprietors nor for the contents of third party advertisements and sponsorship on those Sites. Bet3000 does not endorse any third party Sites which have links from the Site. If the customer access those third party Sites, the customer do so entirely at the customer's own risk.
8.4. Any charges or obligations the customer incur in the customer's dealings with third parties are the customer's sole responsibility.
9. Limitation of Liability
9.1. The customer's use of the Sites, Services and Software, and the Internet is at the customer's sole risk. The customer acknowledges and accepts that the customer's sole and exclusive remedy for any dispute with Bet3000 is to stop using the Service, and to cancel the customer's account.
9.2. The Sites, Services and Software, and any other third-party Services and products, are provided on an 'as available' basis for the customer's use exclusive of warranties of any kind, either express or implied, unless such warranties are legally incapable of exclusion. Bet3000 provides the Casino Services on a commercially viable basis and does not guarantee that the customer will be able to access or use the Services at times or locations of the
customer's choice, or that Bet3000 will have adequate capacity for the Services as a whole or in any specific geographic area.
9.3. Bet3000 shall not be liable in contract, tort, negligence or otherwise, for any loss or damage whatsoever arising from or in any way connected with the customer's use of the Bet3000 Casino Services or Site, whether direct or indirect, including, without limitation, damage for loss of business, loss of profits, business interruption, loss of business information, or any other pecuniary or consequential loss (even where Bet300 has been notified by the customer of the possibility of such loss or damage).
9.4. Bet3000 Casino shall not be liable for computer malfunction, failure of
telecommunications service, Internet connections or attempts by the customer to play by methods, means or ways not intended by the Casino.
9.5. Bet3000 Casino cannot and does not guarantee that its software and files are free from computer viruses. The customer is solely responsible to protect their systems and to reinstall any data or programs lost due to a virus.
9.6. Bet3000 Casino may temporarily suspend the whole or part of the services it provides for any reason at its sole discretion. The Bet3000 Casino may, but shall not be obliged to, give the customer as much notice as reasonably practicable of such suspension. The Bet3000 Casino will restore all services as soon as reasonably practicable after such delay. 9.7 Some jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages. In such jurisdictions, the liability of Bet3000 shall be limited to the fullest extent permitted by law. Nothing in these Terms of Service shall exclude or limit our liability for death or personal injury resulting from our negligence or that of Bet3000's employees or agents.
10. Severability Clause
If any part of this agreement is determined to be invalid or unenforceable according to applicable law including then the invalid or unenforceable stipulation will be deemed substituted by a valid, enforceable stipulation that most closely matches the intent of the original provision. This includes, but is not limited to, the warranty disclaimers and liability limitations set forth above. All other stipulations of this Agreement shall continue to be valid and binding.
11. Privacy Policy
11.1. The customer hereby acknowledges and gives his consent to that it is necessary for Bet3000 Casino to collect and otherwise store the customer's personal data that the customer provides during the registration process in order to allow the customer to use the service of the Bet3000 Casino. This information shall be kept for as long as the customer's account remains active. All information gathered will be protected against misuse or unauthorized access in accordance with the Data Protection Laws of Malta.
11.2. The customer has the right to access personal data held by Bet3000 Casino about the customer and if such information is inaccurate, the customer has the right to rectify such information.
11.3. If the customer has any queries or complaints regarding the customer's personal data held by Bet300 Casino, the customer may contact the Casino at info@bet3000.com. See the Bet3000 Privacy Policy relating to the collection and use of the customer's personal information. The Bet3000 Privacy Policy forms part of these Terms of Service.
