Consultation prior to procurement (CPP)
About the CPP process
This Consultation Prior to Procurement (CPP) aims to give MÄLAB and its owners, who are responsible for regional public transport, knowledge ahead of future procurement of regional rail services on certain lines in the Stockholm – Mälar region.
The CPP is primarily directed to market participants that are or will be engaged in activities coupled to regional rail services, both commercial services and services on behalf of MÄLAB based on decisions on public services. In addition to traffic services, other activities linked to services such as vehicle maintenance, sales/ticket distribution, station services, etc., are also referred to.
Responses to this CPP should be sent 27 January 2013 at the latest per e-mail to
[email protected] or normal post to SIU Regional tågrafik 2017, MÄLAB, c/o AB SL, SE10573 Stockholm, Sweden. Responses shall be written in Swedish or English.
During the period of CPP, i.e. until the last day for response, any supplementary information or revisions will be published on the MÄLAB website, www.malab.se/siu. The website will also include background information regarding the traffic assignment.
In addition to written responses to the CPP, appointments can also be made for bilateral meetings. MÄLAB has allocated time for bilateral meetings in Stockholm as shown below. Appointments can be made per e-mail to [email protected] by 19 December at the latest. We would like to receive a preliminary response regarding the published CPP questions or other issues you wish to discuss ahead of the meeting.

After the CPP, MÄLAB will draw up a PM that will give a comprehensive report of market reactions to the published issues.
MÄLAB does not intend to publish or distribute received written responses or notes made from bilateral meetings but will regard them as working materials.
Definitions
The regional public transport operators
The previous transport authorities, the current regional public transport authorities and their subsidiaries
TiM Collaboration with regard to planning, marketing and sales between SJ AB and the regional public transport authorities in the Stockholm - Mälar region.

trains/Commuter rail services
Regional rail services intended for passengers travelling short distances, usually dense services (15-30 minute intervals) and which are fully integrated with connecting bus and rail services. In the MÄLAB area, SL's Pendelåget, Upptåget and
Östgötapendeln are defined as commuter rail services.
Regional rail Regional rail services that are not commuter rail services, i.e. rail service for more long distance and/or in rural areas and which usually only stop at municipal capitals.
Regional rail service Rail service that is regional as defined by the Public Transport Act and takes place in a county or is intended to satisfy the needs of commuter passengers or any other daily passengers and
which, with reference to the actual use, also satisfies such a need. Major regional core
network
A network of regional rail services jointly defined for the counties with regional trains whose services meet a number of functional requirements on stability, frequency, integration with other public transport services, etc. Described in MÄLAB's planning document Traffic Plan 2017 for the years following 2017.
Background
Travel across county boundaries has increased significantly during the last 15 years and these borders have become less relevant for work and everyday travel. This development has meant passengers and society in general have become increasingly dependent on regional rail
services and the counties have become increasingly interdependent, a mixed blessing. The scope of the regional rail services, but also increasingly the quality and ability of stability over time, has become a critical factor for the development of the counties and the region.
Regional rail services in the Stockholm – Mälar region are conducted in different rail systems. On a number of lines, the services are run by SJ AB under the SJ Regional brand. These services form part of a collaboration between the regional public transport authorities called TiM. Four of these lines are operated wholly or partially by SJ on assignment of the regional public transport authorities via MÄLAB, while other services are operated commercially. Traffic assignment
MÄLAB's overall assignment is to deal with matters of common interest regarding regional rail services in the region, which is based on the needs and goals of regional public transport as set out by the regional public transport authorities in their traffic provision program.
The regional public transport authorities in Stockholm, Södermanland, Uppsala, Västmanland, Östergötland and Örebro counties entered into a joint declaration of intent in November 2012 to work for establishing a major regional core network based on regional rail service with planned implementation once the City line under Stockholm is taken into service in 2017.

The design of the rail system's overall functions has been based on county requirements and joint regional goals for the transport system in the Stockholm – Mälar region.
The basic planning principle for the core network is that services on the lines shall be
operated with one departure per hour on weekdays 06-23, with additional services during rush hour and a two-hourly service on weekends. Certain deviations can be made from this for both lack of capacity (mainly single-track lines in rush hour) and lack of passenger numbers.

Time schedule and continued process
MÄLAB's time schedule relates to services in the major regional core network being
established once the City line has been taken into service in 2017 with a gradual build-up of traffic over several years.
In order to make this time schedule possible to attain, it is considered as necessary to make a decision regarding its implementation during 2013 and a decision thereafter being taken regarding procurement call-off of vehicles and start of the procurement project.
The distribution of roles between MÄLAB and the regional public transport authorities are outlined in the declaration of intent entered into by the counties.
• The regional public transport authorities define the need for services and decide on public services. They will subsequently also finance both any deficits of the services and the acquisition of vehicles for the same.
• MÄLAB is responsible for the owners' assignment of implementation and thereafter the management and ongoing development of the transport system. This includes conducting the procurement and in the next step entering into agreements.
Questions
Below are the questions that this CPP is intended to illuminate. These questions can certainly be perceived as of different relevance to the parties in various sectors and it is not compulsory to answer all of them.
1) Service scope
The region's planning for future provision of services on a larger regional scale in Traffic Plan 2017. In addition to the provisions for the major regional core network, the traffic plan also describes assumptions of rail services that are regional public transport, both those that are operated commercially and those that are agreed upon based on the need for general public services.
a) How well does the total provision of regional rail services meet with your view of the development of regional rail services in the years following the opening of the City line?
b) Are you prepared to provide all or part of the services as described in Traffic Plan 2017 on a commercial basis, i.e. that within the framework of an agreed undertaking (general public services) operate services with your own vehicles without
reimbursement from MÄLAB? What would the conditions be for this?
c) Do MÄLAB's demands in relation to the benefits make the services unnecessarily expensive?
2) Form of agreement
MÄLAB's present service agreement is a service concession where the service provider operates with its own vehicles and is independently responsible for marketing and determining products and pricing.
a) Which one of the production, incentive or service concession forms of agreement do you consider best contributes to meeting society's goals and undertakings for services, while keeping short and long-term expenditure low?
b) Which of these forms of agreement suits you best and conversely, is there a form of agreement that does not suit you?
c) What are the opportunities and risks you see with the forms of agreement, both for you and for MÄLAB as a purchaser?
d) For incentive and service concession agreements, what are the risks in the form of incentive/freedoms should you as an operator have and what risks would you find difficult to handle?
f) Should the services in the major regional core network be acquired in one or more areas of agreement? If several, which grouping is suitable?
g) How long preparation time should be given from the decision of allocation to the start of services?
3) Vehicle provision
MÄLAB and/or RPTA prepares an acquisition of vehicles for services in the major regional core network on call off for framework agreements via Transitio.
a) How should the procurement of services, vehicles, maintenance and depot be combined or should each individual acquisition be made separately?
b) How should the acquisition/introduction of vehicles be planned as regards time in relation to the procurement/introduction of service operator?
c) In case of delays in vehicle delivery, what possibility do you have to provide reserve vehicles for service during a transitional period?
