Pool Enclosure Permit Application Process

To make an application for a swimming pool enclosure permit, please provide By-law Services with the following:

☐ A completed Pool Enclosure Permit Application.

☐ A detailed drawing showing the pool enclosure fencing.

☐ Payment in the amount of $450.00 made payable to the Town of Whitby for the cost of the permit.

(In case of permit application cancellation by the applicant, only 40% of the permit fee will be refunded)

☐ Any required deposits (to be determined when application is submitted to Clerk).

• Should your property back on to or reside near a greenspace, additional approvals from Central Lake Ontario Conservation Authority (CLOCA) may be required.

Confirmation that zoning would permit a pool on your property without a minor variance will need to be obtain and provided to CLOCA. Zoning information can be obtained by contacting our planning department at [email protected]

• If your subdivision is not assumed by the Town, an approval letter as well as proof that deposits are collected from the developer must be provided with your pool enclosure permit submission. If you have questions on whether your subdivision has been assumed by the Town, please contact our office.

• Deposits are mandatory when the above listed elements are present on the property

• Additional deposits will also be collected should you request access through a Town park or easement.

• Deposit fees are cashed by the Town when submitted.

• A pre-construction inspection will take place by an Enforcement Officer to evaluate the current state of Town items such as curb, sidewalk, boulevard and fence.

• Inspections will not take place until a ‘Permission to Construct’ notice has been issued.

(Instructions are provided on the front page of the notice on how to arrange for these inspections.)

• When construction of your pool is nearing completion, a post-construction inspection will take place prior to releasing deposits assuming no damages have occurred.

• Property owners are encouraged to take their own photographs, which are to be dated and time stamped, prior to construction beginning as well as afterwards in the event that damage has occurred.

Additional Information:

• It is recommended that applications be submitted no less than two weeks prior to construction start date.

• Should you require access through a Town easement or park, please communicate this with our office well in advance of construction start date. This may require additional approvals and insurances to be collected which can take time to collect. Please note that approval for

accessing through a Town easement or park is not always granted. It is recommended to plan alternate routes for construction access in the event that these permissions are not granted.

• A Road Occupancy Permit may be required if accessing off of a side street. Please contact the Town of Whitby’s Public Works Department for more information at 905.668.3437.

Using the area below as a guideline, please indicate the location of the driveway on the property, the house and the proposed swimming pool. Please indicate the distances from the water’s edge of the pool to the fence (in all directions). The minimum setback between the water’s edge and the fence is 1 metre. Also, please be sure to indicate the location of any gate(s) and the type of fence (e.g. chain link, board fencing, wrought iron) on each side of the pool enclosure.

Please review the requirements below for complete permit submission:

• The minimum setback between the water’s edge and the property line and nearest building is 1 metre.

• In the event a shared divisional fence is forming a part of the pool enclosure, the

external/neighbouring side of the fence needs to comply with the Town of Whitby’s pool enclosure fence requirements.

• Pool Enclosures must be a minimum of 1.2 metres in height.

• Pool Enclosures may be of chain link or vertical board construction.

• All fences must be setback a minimum distance of 1.0 metre from the edge of the swimming pool.

• The structure of the pool enclosure, including all gates, must not contain any climbable objects or horizontal fencing supports.

• For West Whitby properties only: A set back of 0.6 meters from a rear yard, Interior side yard, exterior side yard lot line is required for pool equipment such as heaters, swimming pool, pumps, treatment, and filters.

Page 12 of 13 Pool Enclosure Final Checklist

This checklist is to be used to guide the owner of the property through the provisions of the by-law that correspond to the enclosure they have constructed around their pool. Please ensure each box is checked off prior to an officer inspecting the enclosure. If a box is left unchecked, the enclosure will not be inspected because it would not be approved when the officer arrives. If you require guidance from an officer, please contact the officer assigned to your file.

General: Fencing

☐ The enclosure is at least 4 feet in height

☐ From the bottom of the fence/gate to the ground there is less than 4 inches

☐ There are no openings anywhere that are greater than 4 inches

General: Gates

☐ The gate is at least 4 feet in height

☐ The gate(s) has self-closing, self-latching devices at the top and on the inside of the gate

☐ The enclosure is kept closed and locked at all times when a responsible person is not present and supervising the swimming pool

Specific to: Vertical Board Construction

Note. Only fill this out if it applies to your enclosure.

☐ The enclosure is at least 4 feet in height
