USA PATRIOT Act
Important Information About Procedures for Opening a New Account:
On October 26, 2001, the Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism Act was signed into law, commonly known as the USA PATRIOT Act. To help the government fight the funding of terrorism and money laundering activities, the Act requires all financial institutions to obtain, verify, and record information which identifies each person who opens an account. What this means for you: when you open an account, we will ask for your name, address, date of birth, and other information which will allow us to identify you. We may also ask to see your driver’s license or other identifying documents.
As a financial institution, we are required to do our part to protect the country from terrorists and other types of criminal activity. St. Martin Bank cannot and will not waive these requirements.
Please help us to protect our country.
Our Relationship with You
Maintaining a good relationship with our customers is very important to us. Please contact us if you have a problem with any account or service.

At times, unanticipated expenses or unforeseen circumstances can leave you short on cash. St. Martin Bank offers overdraft solutions when needed.
Our Customer Overdraft Policy
An insufficient balance could result in several ways, such as (1) the payment of checks, electronic funds transfers or other withdrawal requests; (2) payments authorized by you; (3) the return of unpaid items deposited by you; ( 4) the imposition of bank fees and/or charges; or (5) the deposit of items which are held and not yet available
according to our funds availability policy. We are not obligated to pay any items if your account does not contain sufficient funds; however, if you maintain your account in good standing which is defined as making regular deposits and generally keeping a positive balance, you are not in default on any loan or other obligation to the Bank and there are no legal orders, liens or levies outstanding, we will have the discretion to pay the overdraft, subject to the limit of your overdraft privilege and the amount of the overdraft fees. The paying of your overdraft is considered our standard overdraft practices known as Overdraft Privilege and is not a line of credit.*
We also offer overdraft protection plans, such as a link to a savings account or signing up for a line of credit, which may be less expensive than our standard overdraft practices. To learn more, ask us about these plans.
What are the standard overdraft privilege practices that come with my account?
We may authorize and pay overdrafts for checks and other transactions made using your checking account number as well as automatic bill payments.
We do not authorize and pay overdrafts for ATM transactions and everyday debit card transactions, unless you tell us to do so.** If we do not authorize and pay an overdraft, your ATM and everyday debit card transactions may be declined.
Avoiding Overdrafts on Your Account
Overdraft Privilege should not be viewed as encouragement to overdraw your account. We encourage you to manage your finances responsibly.
What if I want St. Martin Bank to authorize and pay overdrafts on my ATM and everyday debit card transactions?
If you want us to authorize and pay overdrafts on ATM and everyday debit card transactions, you must tell us to do so. If you do not authorize us to pay overdrafts on these types of transactions, the transaction may be declined.
What if I authorize St. Martin Bank to pay overdrafts on my ATM and everyday debit card transactions then change my mind?
If you change your mind, contact us at 1-888-234-4994 or visit our website at www.stmartinbank.com then click on the Reg E Opt In link shown at the bottom of our homepage.
We pay overdrafts at our discretion, which means we do not guarantee that we will always authorize and pay any type of transaction.
We will charge you a fee of $28 each time we pay an item causing an overdraft or each time an item is returned unpaid as nonsufficient (NSF). The total fees we will charge you for overdrawing your account if using our standard overdraft privilege practice is (6) overdraft fees per business day.** There is no limit to the number of NSF fees (for returned items) charged, but each NSF item will be charged an NSF fee.
Linked Accounts for Overdraft Protection
You can cover your overdraft on your personal checking account by transferring funds from another St. Martin Bank account. Ask us how to set this up. This will be an automated transfer from another checking, savings or money market account***. A fee will be assessed for each overdraft transfer that occurs.
Overdraft Protection—Line of Credit
An unsecured Line of Credit used as an overdraft protection for qualified applicants is available. Credit terms and conditions apply. Please see one of our representatives for more details and fees associated with this service. Please see our schedule of fees for detailed information on NSF and overdraft fees.
*St. Martin Bank & Trust Company is not obligated to pay any item presented for payment if your account does not contain sufficient available funds. Any discretionary payment (or other negotiation or processing) by St. Martin Bank & Trust Company of any non-sufficient funds check or other item does not obligate or create an agreement or course of dealing for St. Martin Bank & Trust Company to pay any additional non-sufficient funds check or item or to provide prior notice of its decision to refuse to pay any additional non-sufficient funds check or item.
St. Martin Bank & Trust Company will have the discretion to pay overdrafts within the overdraft privilege limits, but payment by St. Martin Bank & Trust Company is a discretionary courtesy and not a right of the account holder or an obligation of St. Martin Bank & Trust Company. **For personal accounts only. ***Maximum of six transfers per month as per account limitation guidelines.

Deposit Reclassification
The Bank may make a change in your Checking Account which will not affect your available balance, interest earnings, FDIC insurance, or bank statement. This Account will consist of a checking sub-account and a savings sub account. The Bank may periodically transfer funds between these two sub-accounts. If your Account is a Plan on which interest is paid, your interest calculation will remain the same. Otherwise, the savings sub- account will be non-interest bearing. The savings sub- account will be governed by the rules governing our other savings accounts.
Individual Retirement Accounts
SMB Individual Retirement Accounts are long range savings plans which can contribute to one’s financial security at retirement. SMB offers a traditional IRA and a Roth IRA.
Traditional IRA
The traditional IRA is an account which allows the investor to defer taxes on earnings until funds are withdrawn. Also, certain contributions are tax deductible in the year they are made. If the investor is under age 70 1/2 for the entire tax year and has earned income, he or she is eligible to establish a traditional IRA. A transfer fee of $50.00 will be imposed on an IRA transferred out of the Bank.
ROTH IRA
The Roth IRA is a non-deductible account featuring tax-free withdrawals for certain distribution reasons after a five year holding period. Since Roth IRA contributions are non-deductible and taxed in the year they are earned, investors expecting to be in higher tax brackets when they retire may benefit more from this account than from a traditional IRA. Basically, there are two requirements for eligibility to contribute to a Roth IRA: the investor must have earned income (or his/her spouse must have earned income) and the investor’s modified adjusted gross income cannot exceed certain limits. A transfer fee of $50.00 will be imposed on an IRA transferred out of the Bank.
HSA Accounts
Are available to eligible individuals with a high deductible health plan as described by IRS in Publication 969. This account is a NOW Checking Account. Monthly service fee is $2.50 per statement cycle. There is no minimum balance required to maintain the account.
Time Deposits
Time Certificates of Deposit offered with terms varying from 7 days to 36 months. Specials may be offered with additional terms. Rates may change on a weekly basis set by SMB. Interest can be paid to the certificate holder monthly, quarterly, or at term or can be compounded by adding to the certificate balance quarterly or at term.
Christmas and Vacation Clubs
SMB offers Christmas and Vacation Club Savings Accounts which earn interest based on a variable interest rate set by SMB. Minimum balance to open a club account is $2.00. Deposits can be made weekly for 50 consecutive weeks. No withdrawals are allowed from Christmas and Vacation Club Savings Accounts; however ,if an exception is made, a $2 handling fee will be assessed. Annually, the Bank will issue a check for the entire balance of the account including principal and interest. The check will be mailed to you directly or can be automatically deposited to a checking or savings account with the Bank.
Deposit Account Closing
If a deposit account remains at a zero balance for more than five business days, it will automatically close.
