1. CALL TO ORDER

10:00 AM meeting was called to order by Chairman Daniel J Cronin at 10:04 AM.

MOTION TO CONDUCT MEETING

Member Krajewski moved and Member Chaplin seconded a motion to allow the members of the County Board to conduct the meeting via teleconference/remotely. The motion was approved on roll call, all "ayes."

5. CHAIRMAN'S REPORT

There is, perhaps, no more fitting time to frame the events of the past few days and weeks than today, as we consider the life and contributions of Martin Luther King Jr.

On Wednesday, we were all horrified by the actions of a mob who descended on our nation’s capital, defiling that building, a physical symbol of our democracy. Far worse, five lives were lost as a result of the melee.

That afternoon, I issued a statement, decrying and denouncing these actions. It is clear, President Trump is responsible for inciting the actions of those who desecrated our capitol with the

intention of causing harm and damage.

I share the outrage expressed by my fellow Republicans and by Democrats and all law-abiding citizens, at the careless, craven attempt to overturn our election process. The President’s actions have hurt America and the American ideal. We will all have to work harder, rededicate ourselves to bipartisanship, compromise, civility and collaboration so that our citizens’ faith may be

restored in the rule of law, our democratic ideals and institutions. We can be and we are the example of this in DuPage County.

As we consider this damage to our Capitol, perhaps we should pull back, take a long view and remember a quote from Dr. King, who said, “A riot is the language of the unheard.” As I consider that, I conclude no amount of anger or frustration is reason for endangering lives or destroying property. Not now, not ever. But as we resolve to move forward as one nation, one democracy, perhaps we are well advised to remember Dr. King’s words and dedicate ourselves to a path of non-violence, mutual respect and thoughtful listening . This approach will move our county and our nation to a better, kinder place.

A. Dr. Martin Luther King, Jr. Day 2021 Proclamation

Today we celebrate the birthday of the Reverend Dr. Martin Luther King Junior, ahead of the official federal holiday on January 18th. This is a day set aside to not only recall Dr. King’s remarkable life and accomplishments, but to reflect on our progress in DuPage County, as together, we strive to achieve our shared goals of racial equality and fostering a community welcoming to all. As you know, last year we partnered with the College of DuPage for a year of activities designed to provide education and thoughtful discussion around topics of race. My colleague at COD, Dr. Nathania Montes, student representatives Samiha Syed, Alviana Crosley and NAACP President Michael Childress join us today to accept our annual proclamation. So please allow me to read through it. Then I will ask our Dr. Montes and our COD students to share some information about upcoming events and the Chaps Unite Against Racism initiative and I’ll ask Michael Childress to share his thoughts as President of the NAACP.

WHEREAS, 50 ILCS 750/15.4 provides that the corporate authorities of the County shall establish an Emergency Telephone System Board (“ETSB”) and shall provide for the manner of appointment and the number of members of the ETSB; and

WHEREAS, the DuPage County Board at the June 13, 1989, meeting created the Emergency Telephone System Board for 9-1-1 and on June 25, 2013 in Ordinance OEX-003B-89 amended Section 40-20 of the DuPage County Code pertaining to the ETSB providing for the appointment of two members representing the DuPage County Board who are not also members of any other constituency represented on the ETSB; and

WHEREAS, Daniel J. Cronin has submitted to the County Board his nomination of Greg Schwarze as a Member (County Board Representative) and Chairman of the Emergency Telephone System Board for a term expiring December 1, 2023

WHEREAS, Greg Schwarze is not a member of any other entity otherwise represented on the ETSB.

WHEREAS, the DuPage County Board at the June 13, 1989, meeting created the Emergency Telephone System Board for 9-1-1 and on June 25, 2013 in Ordinance OEX-003B-89 amended Section 40-20 of the DuPage County Code pertaining to the ETSB providing for the appointment of one member representing the DuPage County Fire Chiefs that is not employed by a governmental entity serviced by DU-COMM; and

WHEREAS, Daniel J. Cronin has submitted to the County Board his nomination of Erik Kramer as a Member (Fire Chiefs Representative) of the Emergency Telephone System Board for term expiring December 1, 2023; and

WHEREAS, Erik Kramer is not employed by a governmental entity serviced by DU-COMM.

NOW, THEREFORE BE IT RESOLVED by the DuPage County Board that the County Board, pursuant to the nomination of the Chairman, does hereby appoint Erik Kramer as a Member of the Emergency Telephone System Board representing the DuPage County Fire Chiefs for a term expiring December 1, 2023; and

BE IT FURTHER RESOLVED that the attached “Notice of Nomination” be attached hereto and made a part hereof; and

NOW, THEREFORE BE IT RESOLVED by the DuPage County Board that the County Board, pursuant to the nomination of the Chairman, does hereby appoint David Schar as a Member of the Emergency Telephone System Board representing the DuPage Chiefs of Police Association for a term expiring December 1, 2023; and

BE IT FURTHER RESOLVED that the attached “Notice of Nomination” be attached hereto and made a part hereof; and

Motion to Combine Items

Member Chaplin moved and Member Renehan seconded a motion to combine items A through C. The motion was approved on roll call, all "ayes."

A. FI-R-0055-21 RESOLUTION -- Acceptance and Appropriation of Additional Funding and Extension of Time for the Nicor Gas Energy Saver Kits Project Grant, Company 5000 - Accounting Unit 1550, Community Services, $3,000.

WHEREAS, the County of DuPage, through the Department of Community Services, heretofore accepted and appropriated the Nicor Gas Energy Saver Kits Project Grant, Company 5000, Accounting Unit 1550 pursuant to Resolution FI-R-0025-19 for the period October 1, 2018 through December 31, 2019, as amended; and

WHEREAS, the County of DuPage has been notified by Resource Innovations, on behalf of Nicor Gas, through the Agency Participation Agreement (Attachment II), that additional grant funds in the amount of $3,000 (THREE THOUSAND AND NO/100 DOLLARS) are available to be used in helping distribute Nicor Gas Energy Saver Kits to Nicor Gas clients; and

WHEREAS, the County of DuPage has been notified by Resource Innovations, on behalf of Nicor Gas, that the participation agreement may be extended until otherwise notified by Resource Innovations or Nicor Gas; and

WHEREAS, no additional County funds are required to receive this funding; and WHEREAS, acceptance of this additional funding does not add any additional subsidy from the County; and

WHEREAS, the County of DuPage finds that the need to appropriate said additional funds creates an emergency within the meaning of the Counties Act, Budget Division, (55, ILCS 5/6-1003).

NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that the Agency Participation Agreement (Attachment II) between DuPage County and Resource Innovations is hereby accepted; and

BE IT FURTHER RESOLVED by the DuPage County Board that the additional appropriation on the attached sheet (Attachment I) in the amount of $3,000 (THREE THOUSAND AND NO/100 DOLLARS) be made and added to the Nicor Gas Energy Saver Kits Project Grant, Company 5000, Accounting Unit 1550 and that the program continue as originally approved in all other respects; and

BE IT FURTHER RESOLVED by the DuPage County Board that the expiration date of this grant be extended indefinitely; and

BE IT FURTHER RESOLVED that should local funding cease for this grant, the Health and Human Services Committee shall review the need for continuing the specified program; and

BE IT FURTHER RESOLVED that should the Health and Human Services Committee determine the need for other funding is appropriate, it may recommend action to the County Board by Resolution.

B. FI-R-0056-21 RESOLUTION -- Acceptance and Appropriation of the Income Eligible Retrofits Program FY21, Company 5000 - Accounting Unit 1555, Community Services, $286,200.

WHEREAS, the County of DuPage, through the Department of Community Services, has been notified by Resource Innovations, on behalf of the northern Illinois utilities, ComEd, Nicor Gas, North Shore Gas and Peoples Gas that incentive funding is available to be used to supplement the Illinois Home Weatherization Assistance Program to increase the availability of energy saving improvements to residents of DuPage County; and

WHEREAS, to receive said funds, the County of DuPage, through the Department of Community Services, must enter into a Participation Agreement with Resource Innovations, a copy of which is attached to and incorporated as a part of this resolution by reference (Attachment II); and

WHEREAS, the period of the Participation Agreement is from January 1, 2021 through December 31, 2021; and

WHEREAS, no additional County funds are required to receive this funding; and WHEREAS, acceptance of this additional funding does not add any additional subsidy from the County; and

WHEREAS, the County of DuPage finds that the need to appropriate said additional funds creates an emergency within the meaning of the Counties Act, Budget Division, (55, ILCS 5/6-1003).

NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that the Participation Agreement (Attachment II) between DuPage County and Resource Innovations is hereby accepted; and

BE IT FURTHER RESOLVED by the DuPage County Board that the additional appropriation on the attached sheet (Attachment I) in the amount of $286,200 (TWO HUNDRED EIGHTY-SIX THOUSAND, TWO HUNDRED AND NO/100 DOLLARS) be made to establish the Income Eligible Retrofits Program Grant FY21, Company 5000 - Accounting Unit 1555, for the period of January 1, 2021 through December 31, 2021; and

BE IT FURTHER RESOLVED by the DuPage County Board that the Director of Community Services is approved as the County’s Authorized Representative; and

BE IT FURTHER RESOLVED that should state and/or federal funding cease for this program, the Health and Human Services Committee shall review the need for continuing the specified program; and

BE IT FURTHER RESOLVED that should the Health and Human Services Committee determine the need for other funding is appropriate, it may recommend action to the County Board by Resolution.

FI-R-0057-21 RESOLUTION -- Acceptance and Appropriation of Additional Funding and Extension of Time for the Emergency Solutions Grant - COVID-19 Response (ESG-CV), Agreement No. E-20-UW-17-002, Company 5000 - Accounting Unit 1470, from $1,031,548 to $3,515,152 (an increase of $2,483,604 to reflect a second allocation of grant funds received) (COVID ITEM).

WHEREAS, the County of DuPage, through the DuPage County Department of Community Services, heretofore accepted and appropriated the Emergency Solutions Grant-Covid-19 Response (ESG-CV), Company 5000 - Accounting Unit 1470, pursuant to Resolution FI-R-0404-20 for the period of March 1, 2020 through June 8, 2020; and

WHEREAS, the County of DuPage, through DuPage County Community Development, has been notified by the U.S. Department of Housing and Urban Development (HUD) that additional grant funds in the amount of $2,483,604 (TWO MILLION, FOUR HUNDRED EIGHTY-THREE THOUSAND, SIX HUNDRED FOUR AND NO/100 DOLLARS) in Emergency Solutions Grant Program-CARES Act Funding are available to continue to support local projects responding to the COVID-19 pandemic; and

WHEREAS, the DuPage County Board passed Resolution HHS-R-0349-20 on May 12, 2020 which adopted Substantial Amendment 2 to the 2019 Action Plan Element of the 2015-2019 DuPage County Consolidated Plan for Housing and Community Development; and

WHEREAS, the DuPage County Board passed Resolution HHS-R-0573-20 on October 27, 2020 which adopted Substantial Amendment 4 to the 2019 Action Plan Element of the 2015-2019 DuPage County Consolidated Plan for Housing and Community Development; and

WHEREAS, to receive said grant funds, the County of DuPage must enter into Amended Agreement No. E-20-UW-17-0002 with the U.S. Department of HUD, a copy of which is attached to and incorporated as a part of this resolution by reference (Attachment II); and

WHEREAS, the County of DuPage has been notified by the U.S. Department of HUD that the grant may be extended to December 9, 2022; and

WHEREAS, no additional County funds are required to receive the additional funding; and

WHEREAS, the DuPage County Board finds the need to appropriate said additional funds creates an emergency within the meaning of the Counties Act, Budget Division, (55 ILCS 5/6-1003).

NOW, THEREFORE, BE IT RESOLVED by the DuPage County Board that the Amendment to Agreement No. E-20-UW-17-0002 (Attachment II) between DuPage County and the U.S. Department of Housing and Urban Development is hereby accepted; and

BE IT FURTHER RESOLVED by the DuPage County Board that the additional appropriation on the attached sheet (Attachment I) in the amount of $2,483,604 (TWO MILLION, FOUR HUNDRED EIGHTY-THREE THOUSAND, SIX HUNDRED FOUR AND NO/100 DOLLARS) be added to the Emergency Solutions Grant - Covid-19 Response (ESG-CV), Company 5000 - Accounting Unit 1470 and the program continue as originally approved in all other respects; and

BE IT FURTHER RESOLVED by the DuPage County Board that the expiration date of this grant be extended until December 9, 2022; and

BE IT FURTHER RESOLVED by the DuPage County Board that the personnel budget for the Community Services Department Homeless Management Information System program be revised to reflect the addition of:

D. FI-R-0060-21 RESOLUTION -- Recommendation for the approval of a payment to the DuPage County Health Department for the reimbursement of COVID-19 eligible expenses from the CRF Fund for a total amount of $78,466.89. (COVID ITEM)

WHEREAS, the pandemic caused by the Coronavirus COVID-19 and the response thereto has adversely affected the financial condition of the County of DuPage, Illinois (the County) and DuPage County Health Department (the Department); and

WHEREAS, the County has received direct payment from the U.S. Department of the Treasury (U.S. Treasury) pursuant to section 601(b) of the Social Security Act, as amended by section 5001 of the CARES Act, Pub. L. No. 116-136, div. A, Title V (Mar. 27, 2020) and the County has deposited said payment into the Coronavirus Relief Fund (CRF Fund), Company 1100, Accounting Unit 1213; and

WHEREAS, the County of DuPage believes it is necessary to enter into an Agreement with the following townships to govern the reimbursement of COVID-19 related expenses; and

WHEREAS, the County of DuPage seeks to enter into agreements with: Addison Township, Bloomingdale Township, Downers Grove Township, Lisle Township, Milton Township, Naperville Township, York Township, Wayne Township, and Winfield Township; and

WHEREAS, an Agreement has been prepared and attached hereto which outlines the financial arrangement between the County and the township and the process

WHEREAS, preventing severe influenza cases will decrease the risk of hospital resources being overwhelmed by influenza and COVID-19; and

WHEREAS, as a result of the economic impact of COVID-19, many residents have lost their employer-sponsored health coverage making cost a barrier to obtaining an influenza vaccine; and

WHEREAS, the DuPage County Board, using its reasonable judgment as the government officials responsible for the expenditure of these funds, finds that the County’s use of these funds to support expanded access to seasonal influenza vaccinations for uninsured residents is reasonably necessary; and

WHEREAS, the DuPage County Board did not budget for an influenza vaccination program its adopted budget for fiscal year 2020 approved by the County Board on November 26, 2019; and

WHEREAS, DuPage Health Coalition will contract for and coordinate the distribution of influenza vaccines through qualified vendors including Federally Qualified Healthcare Centers, retail pharmacies, and hospital systems; and

WHEREAS, the County agrees to extend the terms of the Agreement as approved under FI-R-0499-20 on September 8, 2020 to include expenses which were incurred no later than March 1, 2021; and

WHEREAS, the CARES Act’s requirement that expenses be incurred prior to December 30, 2020 was amended by the Consolidated Appropriations Act 2021 (PL 116-159, Division N, Title X, Section 1001), which provides that expenses must be incurred no later than December 31, 2021; and

Whereas, the County of DuPage agrees to extend the terms of the grant agreement to include expenses which were incurred no later than March 1, 2021; and

WHEREAS, the CARES Act provides that the County may disburse these funds in accordance with the terms set forth above; and

WHEREAS, the County of DuPage was eligible to receive payments under the CARES Act, as it is a unit of local government in excess of 500,000 residents; and

WHEREAS, the United States Department of Treasury has issued guidelines with regards to the authorized use of funds allocated to local governments under the CARES Act; and

WHEREAS, under the CARES Act, the County of DuPage is ultimately responsible for any expenditures from CARES Act funds; and

WHEREAS, under the CARES Act, should the Office of the Inspector General determine that the funds were used in a manner contrary to the intent of the legislature or contrary to the United States’ Department of Treasury guidelines, the CARES Act provides that the federal government will recoup the improperly spent funds from the County of DuPage; and

WHEREAS, the County of DuPage believes that Northern Illinois Food Bank is facing increased costs for the provision of food assistance to residents of DuPage County due to the conditions created by the COVID-19 emergency; and

WHEREAS, the County of DuPage believes that Northern Illinois Food Bank is providing food to over 50 food pantries and feeding sites in DuPage County during the COVID-19 emergency; and

WHEREAS, the County of DuPage, through the best judgment of its elected officials, believes that this expenditure is necessary to combat the negative secondary impacts of COVID-19 costs.

NOW, THEREFORE, BE IT RESOLVED, that the Director of the Department of Community Services is authorized to enter into agreements pursuant to this resolution; and

BE IT FURTHER RESOLVED that a copy of this resolution be distributed to the Auditor, Treasurer, Finance Department, Community Services Department, and one copy to the County Board.

N. FI-R-0079-21 RESOLUTION -- Approval of an extension to the Agreements between the County of DuPage and Various Not-For-Profits to Administer the Housing Assistance Program. (COVID ITEM)

WHEREAS, the pandemic caused by the Coronavirus COVID-19 and the response thereto has adversely affected the financial condition of the County of DuPage,

Illinois (“County”) and its residents; and

WHEREAS, the County has received direct payment from the U.S. Department of the Treasury (U.S. Treasury) pursuant to section 601(b) of the Social Security Act, as amended by section 5001 of the CARES Act, Pub. L. No. 116-136, div. A, Title V (Mar. 27, 2020) and the County has deposited said payment into the Coronavirus Relief Fund

(CRF Fund), Company 1100, Accounting Unit 1213; and

WHEREAS, the CARES Act provides that its funds should be used to mitigate the spread and effects of the Coronavirus/COVID-19 in DuPage County; and

WHEREAS, approximately twenty five percent (25%) of DuPage County

residents rent their housing; and

WHEREAS, the economic impact of the Coronavirus/COVID-19 has resulted in many DuPage County residents losing or substantially reducing their available income;

and

WHERAS, reducing housing insecurity and providing housing assistance prevents homelessness and mitigates the eviction “bubble” which may occur once evictions are

permitted in the State of Illinois; and

WHEREAS, the County of DuPage has approved an allocation of Coronavirus Relief Funds to provide housing assistance to DuPage County Residents who require

assistance; and

WHEREAS, the County of DuPage has approved the payment of the costs of administering the housing assistance grant program from the allocated Coronavirus Relief Funds.
