GEN 1.2 ENTRY, TRANSIT AND DEPARTURE OF AIRCRAFT

1. General

1.1. All flights into, from or over the territory of the Republic of Kenya shall be carried out in accordance with valid regulations of Kenya regarding civil aviation.

1.2. Aircraft flying into or departing from the Republic of Kenya shall make their first landing at or final departure from, an international aerodrome/heliport or any other aerodrome notified for entry and exit (See AIP Kenya, GEN 1.3-4 para 2.7.)

2. Scheduled Flights

2.1 General

2.1.1 For regular international scheduled flights operated by foreign airlines into or in transit across the territory of Kenya, the following requirements must be met:

f) Date and place of origin of the flight. g) Complete route itinerary including

dates and times (UTC)

h) Number of passengers and/or freight details

i) Whether in conformity with IATA Resolution 045

j) Name of local agents (if any).

k) Full details of passengers and/or freight to be uplifted or dropped in Kenya.

Note 1: In case of air service licences required

for a period of validity of not more than seven days, applications should reach the Director General Kenya Civil Aviation Authority not less than 14 days prior to the required date of issue of the licence, except in most exceptional circumstances.

Note 2: Applications should not be made via

AFTN circuits. (Any application so received via such a circuit will not be actioned).

2.2 Documentary Requirements for Clearance of

Aircraft

2.2.1. It is necessary that the under mentioned aircraft documents be submitted by airline operators for clearance on entry and departure of their aircraft to and from the Republic of Kenya. The General declaration will be accepted when signed by either the authorized agent or the pilot-in-command. All documents listed below must follow the

ICAO standard format as set forth in the relevant appendices to ICAO Annex 9 and are applicable when furnished, in English and completed in legible handwriting. No

visas are required in connection with such documents.

2.2.2 Aircraft Documents Required (Arrival/ Departure) Required by: Customs/ Immigrations/KCAA General Declaration 2 2 - Passenger Manifest 2 2 1 Cargo Manifest 2 2 - Note:

a) One copy of the General Declaration is endorsed and returned by Customs signifying clearance.

b) If no passengers are embarking (disembarking) and no articles are loaded (unloaded), no aircraft documents except copies of the General Declaration need be submitted to the above authorities.

c) Operators shall submit a copy of Passenger manifest for flights departing within Kenya at KCAA Briefing office.

3. Non-Scheduled Flights

3.1 General

3.1.1. For Non-Scheduled, Non-Commercial flights, a clearance is required. Application should be made at least 72 hours prior to the date of intended flight to the address given below. Giving details as in Para 3.1.4 items (a) to (h)

3.1.2 For Non-scheduled-Commercial flights landing for commercial purposes, a clearance is required. Application should be made atleast 72 hours prior to the date of intended flight to:

3.1.3 Non-scheduled commercial flights overflying or landing purely for technical reasons, a clearance is required.

Application should be made at least 72 Hours prior to the date of intended flight to the address given above. Giving details as in para 3.1.4 items (a) to (h)

3.1.4 The application mentioned in 3.1.1, 3.1.2 and 3.1.3 above shall include the following details: a) Name and nationality of operating

company;

b) Type of aircraft and registration marks; c) Name of pilot and number of crew; d) Date and time of arrival at and departure

from Kenya aerodromes, or over-flying the Kenya territory;

e) Route of flight including an origin and final destination of flight, last airports before Kenya and next airports after Kenya;

f) Purpose of flight;

g) Number of passengers or nature and amount of freight; and

h) Name, address and business of chatterer. 3.1.5 In case the type of aircraft or registration mark

is changed by the operating company or aircraft owner due to technical or other reasons, a notification to that effect is required.

3.2 Documentary Requirements for Clearance of Aircraft

Same as for Scheduled Flights ref para 2.2.2

a) Wearing apparel

b) Personal household effects which have been in his personal use or household use but not including bicycles ,cine or steel projectors, record players, amplifiers, loud speakers, gramophones, gramophone records, refrigeration equipment, cookers, type writers, cassettes, tapes, sound recording machines, tuners ,radio and television record sets, radiogram of provisions.

c) Instruments and tools for his personal use in his profession or trade.

2. Immigration requirements

Passport

2.1 Immediately upon disembarkation, all passengers are requested to report to the immigration office.

2.2 Any person entering Kenya must hold a passport which is valid for a period of at least six months and an appropriate visa, the latter is applied and paid online through visa application portal on

http://www.ecitizen.go.ke/

2.3 A valid passport is required except for holders of;-

a) Expired passports issued to Nationals of Kenya;

b) Identity cards issued to Nationals of Kenya; c) Identity cards issued to Nationals of East Africa provided they are entering directly from East Africa;

d) Laissez-Passer issued by the Kenya Government, provided that the document is valid for onward and return travel. With a visa issued by the Consul of Kenya indicating approval by the Kenya Ministry of Foreign Affairs and based on the approval of the Kenya Immigration authorities or having a valid entry/exit visa to and from Kenya issued by the Kenya Immigration authorities;

e) Laissez-Passer issued by the United Nations provided that they must hold tickets and

other documents (including visa, if required) for onward or return travel; f) Military identity card (with movement or

leave order) issued to the Deterrent, Emergency, UN Interim (UNIFILL) and UN Security Forces;

g) Seaman’s Book (Travelling on duty) issued by any country. The Seaman must be a holder of a passport from the local Marine Navigation Company including details concerning the seaman (name, family name, nationality, etc.) indicating that the above mentioned company is sending him to his ship.

Note: This application should be sent to the Airport Immigration authority at least 48 hours before the time of arrival.

h) Travel document (Titre De Voyage) for refugees according to the London Convention of 1946 and the Geneva Convention of 1951, issued by any country. They must have prior permission from the immigration department and the travel document should have a valid return visa from the issuing country.

2.4 Validity of Passport.

The passport must be valid for a period of at least 6 months beyond the estimated duration of stay in Kenya.

2.5 Admission and Transit Restrictions.

2.5.1 The Government of Kenya refuses entry to holders of a Laissez-Passer unless it contains an entry visa issued by the Immigration authority prior to entry and the Laissez Passer should have a valid return visa from the issuing country. 2.5.2 The Government of Kenya refuses entry to

holders of any expired passport including the Laissez-Passer, even if issued by a Kenyan authority, with the exception of persons of Kenyan descent who are holding a Kenya identity card or expired Kenya passport. 2.5.3 Passengers arriving in Kenya with incorrect or

incomplete Entry/Transit documents will be refused Entry/Transit and deported at carrier's expense.

Commonwealth Countries and Eire (Republic of Ireland) excluding nationals of Nigeria, Australia and British passport holders.

b) Children under 15 years of age accompanied by their parents:

ii) Those whose father is a Kenyan national; or

iii) Those whose parents are residents of Kenya, who are business owners and/or company managers holding an entry visa.

c) Holders of Diplomatic Passports, provided they are accredited to Kenya;

d) Persons of Kenyan descent provided they are holding a Kenyan identity card or expired Kenya passport;

e) United Nations Staff, being Diplomats, holding Diplomatic Cards, issued by the Kenya Ministry of Foreign Affairs;

f) Alien residents in possession of a valid resident permit card;

g) Members of the Deterrent, Emergency, UN Interim forces in Kenya and UN Security forces, holding Military Identity Cards.

h) Nationals of the countries with which Kenya has a reciprocal visa abolition agreement. Denmark, Ethiopia, Federal Republic of Germany, Finland, Italy, Norway, San Marino, Spain, Sweden, Turkey and Uruguay.

i) Persons in transit through Kenya arriving and leaving by the same aircraft or transferring to another aircraft for a destination other than Tanzania and Uganda provided they hold confirmed onward bookings. Such persons must also have the appropriate entry facilities for the country of final destination and will not leave the transit lounge at Jomo Kenyatta International Airport, Nairobi, Moi International Airport, Mombasa and Eldoret International Airport, Eldoret.

2.7 Aircraft arriving from or departing for places outside Kenya must make immigration clearance at one of the airports mentioned hereunder during the stated hours (UTC).

i) Jomo Kenyatta Airport. (see HKJK AD 2.1 for more information).

ii) Wilson Airport, Nairobi.(see HKNW AD 2.1 for more information).

iii) Mombasa Airport. ( see HKMO AD 2.1 for more information)

iv) Kisumu Airport see HKKI AD 2.1 for more information)

v) Malindi Airport. (see HKML AD 2.1for more information)

vi) Eldoret Airport (see HKEL AD 2.1 for more information)

vii) Lokichoggio Airport (see HKLK AD 2.1 for more information)

viii) Wajir Airport (See HKWJ AD 2.1 for more information)

Where prior notice is required it should include particulars of date and time, the type of aircraft and nature of the load.

2.8 Visa Issuance.

2.8.1 An e-visa is issued prior to arrival to Kenya. 2.8.2 With effect from 1st September 2015 all visa

applicants will be required to apply and pay visas online through visa application portal on www.ecitizen.go.ke. prior to enter Kenya. The visa will be processed and sent online to the applicant. The applicant will then be required to print out the approved visa and present it to an immigration officer at the port of entry. 2.9 Additional Information.

Applications for extension of a visa or a residence permit should be made at the Immigration Department.

2.10 Re-Entry permit. 2.10.1 Re-Entry permit:

a) Returning Alien Residents must hold a re-entry permit which must be obtained before departure from Kenya. Otherwise they should obtain a new re- entry visa before returning to Kenya. b) Not required for Alien Residents in possession

of a valid residence permit.

Types of Services

4.1.1 Personal briefing and consultation for flight crew members are provided only at Nairobi Jomo Kenyatta Intl, Moi Intl. Mombasa, Eldoret Intl Nairobi Wilson, Kisumu, and Malindi. For all other aerodromes, consultation is available by telephone.

4.1.2 Limited flight documentation is normally provided for domestic flights. For international flights, the flight documentation comprises a significant weather chart, an upper wind and upper air temperature chart and the latest available aerodrome forecast for the destination and its alternate aerodromes.

4.1.3 For the planning of VFR flights departing from unmanned aerodromes, pilots can obtain weather reports and forecast from relevant aerodrome units by dialling one of the following telephone numbers:

4.1.4 Prior Notification on Flights

Whenever possible, requests for weather forecasts should be made at least 6 hours before the flight and should include:

(a) The route and/or Aerodrome(s) for which the forecasts are required.

(b) The period of flight for which the forecasts are required. Aerodromes at which there are no Meteorological and/or Civil Aviation personnel, pilots requiring forecasts must make telephone calls or despatch telegrams to Jomo Kenyatta Airport, Nairobi or Moi whose addresses are given in paragraph 4.1.3

4.2 Observing Systems and Operating Procedures.

The systems and procedures used for the provision of surface wind, visibility, and cloud base, temperature and pressure information are listed in AD 2 table 2.11 for each Aerodrome. 4.3 Meteorological Procedures for International

Air Navigation

The meteorological service for International Air Navigation is conducted in conformity with the procedures of ICAO as contained in the following ICAO documents as amended from time to time.

(a) Annex 3 Meteorological Service for

International Air Navigation.

(b) DOC7030 Regional Supplementary Procedures.

4.4 With regard to Meteorological Watch Office Requirements (Annex 3, Chapter 3, para 3.3.2), there are fewer actual weather reports available in Nairobi FIR by night than by day. 4.5 The following documents are provided to

aircraft commanders or their representatives before departure:

a) ICAO Model A1, Aerodrome Forecasts, Tabular form.

b) ICAO Models SWL, and SWH, significant weather charts, low and high level respectively.

c) ICAO Model TA, tabular forecasts en-route conditions.

c) d) ICAO Model TB, tabular upper winds and upper air temperatures,

example 1.

e) ICAO Model IS, example 3, chart for the standard isobaric surfaces 500 hpa, 300 hpa, 250 hpa and 200 hpa. f) ICAO Model CR, cross-section,

forecast en-route conditions. 4.6 Meteorological Information for Air Navigation.

Meteorological procedure for air navigation is similar to those of international air navigation. When forecasts are supplied from Jomo Kenyatta, Moi, Eldoret, or Wilson Airports, they are normally prepared on ICAO Model TA or TB and SWL. At other aerodromes, the forecasts are issued in message form as received from either Jomo Kenyatta or Moi airports, Meteorological offices.

4.7 In-flight Procedures.

For in-flight protection, the following services are provided:

a) Supply of current weather report from any Aerodrome on request.

b) Supply of route weather information, route forecasts, upper air data or terminal forecasts through appropriate channels on request. c) Notification to the Area Control Centre,

Nairobi for onward transmission to aircraft as necessary, of SIGMENT information on existing or forecast weather conditions over Nairobi FIR.

d) In addition, Aerodrome Meteorological offices pass local deterioration or improvement messages to the aerodrome ATCO within the limitation of the service provided by that office.

4.8 Aircraft Weather Reporting Procedures. 4.8.1 Captains in command of aircraft are required

under paragraph 5.2 of Annex 3 to make weather observations and pass weather reports over routine channels to the meteorological office. Aircraft weather reports should be made in accordance with item 6 GEN 3.5-6 and sent immediately to the Nairobi Area Control Centre.

4.8.2 ATS/MET reporting points designated in terms of Annex 3 para 5.3 in respect of routes crossing Nairobi Flight Information Region are indicated in ENR 3 passing weather reports whenever conditions prove different from those forecast or when deteriorations or improvements occur, is particularly emphasised as of benefit to the safety or operation of other aircraft.

4.9 Advance Operational Planning.

Requests for meteorological information required for planning new routes and schedules or other major questions effecting future Civil Aviation operations or policy should, in all cases, be addressed to the Director of Kenya Meteorological Department.

4.10: Complaints or Comments on the Meteorological Service.

All users of the Meteorological services for air navigation should submit, promptly, to the

Director Met Department any complaints or comments on the service. Aircrews should realise, however, that complaints can be investigated only if accompanied by full details of the flight, the forecast and/or other information issued and the respects in which the forecast and other information has proved inaccurate.

4.11: Applicable ICAO Documents

ICAO Standards, Recommended Practices and Procedures contained in the following documents are applied:

a) Annex 3 - Meteorological service for international air navigation.

b) DOC 7030 - Regional Supplementary Procedure.

6. Procedures and Signals Used

6.1. Dissemination of Distress Information 6.1.1 All reports of distressed or overdue aircraft

should be sent to any ATS Unit or direct to the RCC or Sub-Centre. In addition, reports may be communicated to any Provincial or District Office or Police Station.

6.1.2 The following information should always be given or asked for when reporting or receiving reports of distress incidents:

a) Name, Address and Telephone Number of person reporting.

b) Description of incident

c) Position of incident in relation to well-known landmarks.

d) Date and Time of incident. e) Action being taken.

f) Names of witnesses.

6.1.3 Telephone calls concerning distress incidents may be made from any telephone. They should be passed in the form “EMERGENCY To ...”

6.1.4 The operating agency of any aircraft reported to be in need of SAR assistance, will be advised as far as possible of the situation and developments by the ATS.

6.2 Distress Radio Organisation

Details of the Radio Services in Kenya are contained in GEN 3.4.1 of this AlP. An Aircraft making an emergency call should address its first call to the A TS Unit with which it has already established communication or to one which is known to be within range. Such a call will be made on the Air/Ground channel appropriate to the unit being called.

6.3 Assistance from other sources

6.3.1 Should an aircraft be unable to establish communication on the A/G Frequencies already listed, every effort should be made to make contact with an aircraft, land or ship station on either: a) 121.5 MHz or b) 243 MHz or c) 500 KHz or d) 406 MHz e) 2182 KHz or

f) Any other available frequency.

NOTE: There is more chance of signals being heard on 500 KHz during the International silence period at 15 to 18 minutes.

6.3.2 In the event of an aircraft having made a forced landing' in a remote area, and all efforts to establish communication by radio with a control or similar station having failed, attempts may be made to communicate with amateur stations which can, in turn, alert the rescue services. Amateur Radio Stations operate a number of frequencies but it is considered that 3650 Khz (night) 7075 Khz (day) or 14150 Khz (day and night) offer the best /all round chances of success and efforts should, therefore, be concentrated on these frequencies.

6.4 Aircraft in Distress or Emergency

6.4.1 Distress and urgency traffic shall comprise all radiotelephony messages relative to the distress and urgency conditions respectively. These conditions are deemed as:

a) Distress: A condition of being threatened by serious and/or imminent danger and requiring immediate assistance;

b) Urgency: A condition concerning the safety of an aircraft or a vehicle, or some people on board or within sight, but which does not require immediate assistance.

6.4.2 The radiotelephony distress signal MAYDAY and the radiotelephony urgency signal PANPAN shall be used at the commencement of the first distress and urgency communication respectively.

6.4.3 At the commencement of any subsequent communication in distress and urgency traffic, it shall be permissible to use the radiotelephony distress and urgency signals. 6.4.4 The originator of messages addressed to an

aircraft in distress or urgency condition shall restrict to the minimum number, volume and content of such messages as required by the condition.

GEN 4.2 AIR NAVIGATION SERVICE CHARGES 4.2.1 Definitions

In the details that follow unless the context requires otherwise, the following terms mean:

“Air Navigation Services” - includes Air Traffic Management (the aggregation of the airborne and ground based functions required to ensure the safe and efficient movement of aircraft during all phases of operations). Communication, Navigation and Surveillance (CNS); Search and Rescue (SAR) and Aeronautical Information Services (AIS). These services are provided to air traffic during all phases of operations (approach, aerodrome control and en route).

“Flight Information Region (FIR)”

the area allocated to the jurisdiction of Nairobi Area Control Centre by International Civil Aviation Organisation.

"Flight''

a) in case of an aircraft, from the moment when it first moves for the purposes of taking off until the moment when it comes to rest after landing;

b) in case of a free balloon, from the moment when it first becomes detached from the surface until the moment when it next becomes attached thereto or comes to rest thereon

"Maximum takes off mass"

Maximum takes off mass in relation to an aircraft, means the maximum total mass of the aircraft and its contents at which the aircraft may take off in accordance with the certificate of aircraft.

“Maximum permitted all-up Weight”

Maximum permitted all-up weight as set out in the aircraft Certificate of Airworthiness.

“Owner”

Registered owner or the person operating an aircraft whether it is for hire or reward.

“Maximum number of passengers”

As set out in the aircraft Certificate of Airworthiness.

In accordance with Civil Aviation (Regulatory fees and Charges for Air navigation services) Regulations, 2012, Gazetted on 5th October 2012 under Legal Notice No. 110 and in accordance with Section 6I of the Civil Aviation Amendment Act 2002, the following are applicable Charges for Air Navigation Services

4.2.2 Aerodrome and Approach Charges There shall be paid to the Authority an aerodrome and approach charge by the owner of an aircraft making a flight in the Flight Information Region and making a landings or a take off in the following aerodromes. The aerodrome and approach charges payable per take off only are as follows:
