Listing Categories

Listings in these categories which are located within the NJMLS Market Area are required to be entered into the MLS within 24 hours.

Any 1 - 4 family property for sale (Residential, 2 - 4 Family, Condo/Co-op/ Townhouse categories). Other categories are optional.

Required Areas:

All of Bergen, Passaic and Essex Counties, and parts of Hudson County (i.e. E. Newark, Harrison and Kearny). Other areas are optional.

Change of Status Form

Used to change price, expiration date, commission, or to publish an Office Exclusive. When using this form, once the change is made fax a copy to NJMLS within 48 hours at 201-387-2535.

Required Procedure:

ALL paperwork must be signed by the Designated Realtor and ALL owners of the property before a listing can be entered or updated.

Listings MUST be entered into the MLS system within 24 hours of the

date on the listing agreement.

Once entered, write the MLS number on the paperwork and maintain the paperwork on file. It is no longer required to fax this paperwork unless requested by NJMLS.

A listing will be sent to the Internet (i.e. real estate web sites author-ized by the Board of Directors: njmls.com, Realtor. com, IDX participat-ing Broker web sites) unless the seller indicates otherwise by checkparticipat-ing the Internet decline box at the bottom of the listing agreement. Exempted Listings — Office Exclusives

Exempted Listings:

Having been explained the benefits of listing dissemination and broker cooperation, if the seller refuses to permit the property to be disseminated by the MLS, the listing may be taken as an “Office Exclusive with Broker Cooperation” or an “Office Exclusive without Broker Cooperation” and must be filed with the NJMLS.

Required Categories:

Any 1 - 4 family property for sale (Residential, 2 - 4 Family, Condo/Co-op/ Townhouse categories).

Required Areas:

Bergen, Passaic, Essex, and Hudson (E. Newark, Harrison and Kearny). Required Paperwork:

Office Exclusive (OE) form — either of 2 options: - Non-Dissemination — OE with Broker Cooperation

- Waiver of Broker Cooperation — OE without Broker Cooperation Required Procedure:

ALL paperwork must be signed by the Designated Realtor and ALL owners of the property.

ALL paperwork must be faxed to the NJMLS within 24 hours of the date on the listing agreement.

Office Exclusive Fax Number: 201-387-0241.

Status changes must be reported by calling the NJMLS.

Once an Office Exclusive has sold, closing information MUST be re-ported to the NJMLS, who will then enter the sold listing into the MLS. To Publish (Disseminate) an Office Exclusive Listing:

The original listing agreement must indicate a date the Office Exclusive is to be published; otherwise a Change of Status form must be signed by the Designated Realtor and ALL owners. Enter the listing into the MLS within 24 hours, and fax the Change of Status form (with MLS # of new listing noted) to the NJMLS so that you are not billed twice for the same listing.

Required short sale disclosure and policies on updates:

Per NJMLS Rules and Regulations, Listing Brokers/Agents are re-quired to disclose the potential for a short sale in the REMARKS sec-tion of a listing. Suggested language to use is “Potential short sale, subject to lender/bank approval.”

In addition, Listing Brokers/Agents need to report the ARIP status when an offer is signed by the buyer and seller and being reviewed by the attorneys/bank or lender. Listings not reported ARIP within 24 hours are subject to a fine. The UC status should be reported once the Attorney Review has been completed.

Disclosures and Status Changes on Short Sales

All listings are entered into the MLS with a status of Active (A). The following status changes must be reported as indicated:

ARIP — Attorney Review In Progress:

- ARIP must be reported within 24 hours once a contract has been signed by buyer and seller.

- Listings in ARIP are still active, and appear as A* or ACT*. If the deal falls through, change status to ARR (Attorney Review Removed) and the * will be deleted, returning it to active (A) status.

UC — Under Contract:

- When the attorney review has been completed, the status of the listing must be changed to Under Contract in the MLS system within 24 hours.

-The Under Contract date is the date it came out of attorney review. - DO NOT WAIT for escrowed down payment to report the listing as Under Contract.

SOLD:

- Listings must be reported SOLD within 7 days of the closing.

Required Signatures

Listing Agreements, Change of Status Forms, and Withdrawal Forms are not valid unless they are signed by all owners and the listing broker. Until all signa-tures are secured, the listing or change should not be entered into the MLS. In addition, please write the MLS number on forms before faxing to the NJMLS. Members Only

If an agent is not an NJMLS member, their name and contact information cannot be included in listings. To avoid a fine, make sure you reference NJMLS mem-bers only in the Showing Instructions/Agent Remarks section of listings. Showing Instructions

Information that should be viewed by agents only and not appear in Customer Reports MUST BE ENTERED IN AGENT REMARKS/SHOWING INSTRUC-TIONS and not in the general Remarks section. This includes selling bonus infor-mation, all negotiations through LB, open house inforinfor-mation, property address, contact information including agent names, office names, phone and fax num-bers, e-mail and website addresses, etc.

Accurate Information

Listings must reflect current Property Taxes and accurate Flood Zone disclosure. It is the listing agent's responsibility to ensure that this information is accurate on his or her listings. Please review your inventory today and update this informa-tion.

Delayed Showings

If a listing cannot be shown when it is first listed, showing instructions must spec-ify the date when showings can begin. The listing office cannot show the property during this time period.

No Showings Until Further Notice

Properties which have been on the market and then cannot be shown must be Withdrawn Temporarily. While the listing is Withdrawn Temporarily, no one can show the property, including the listing office. This is also indicated on the With-drawal Form. Once showings can resume, the property would be put Back on the Market.

Listing Photo Captions

Addresses and contact information should not be included in the captions that appear under listing photos or in virtual tours. Since photos and captions appear on reports, the presence of addresses and contact information would defeat the purpose of the "Customer Report Without Address" that members use to send to their customers.

Exceptions

If there are exceptions to a listing, this must be disclosed by selecting Yes in the Exceptions field of the listing. Remarks must indicate how many exceptions there are and the duration of these exceptions. A letter must be faxed to the NJMLS which states the names and durations of these exceptions. The duration of the exceptions cannot be for the entire life of the listing.

Exclusive Agency

This means that the seller gives the listing broker the right to sell the property for a specified period, yet at the same time reserves the right to sell the property himself without paying a commission to the listing broker. You MUST select Yes in the Exclusive Agency field of the listing if an Exclusive Agency agreement ex-ists.

Unpublished Owner Name

If both the owner name and owner phone number are going to be left out of the listing, a letter must be sent to NJMLS, signed by the seller, stating the seller does not wish to publish their name and number in the NJMLS.

Unpublished Buyer Name

If the buyer does not want their name published through the NJMLS, the listing office must send something in writing stating the buyer does not want their name and number published through the NJMLS. This letter can be drawn up by the listing office, and would not need to be signed by the buyer.

More Than One Category

Listing a property in more than one category to increase exposure is allowed as long as one of those categories is the category for which the property is deeded. For example, a legal 2-family property must be entered into the 2-4 Family listing category and optionally, it can be entered into the Residential category. Note: If a property is listed in more than one category, each listing must reference the other (s) in the Remarks or Showing Instructions.

Exterior Photo

NJMLS rules require that listing content be complete, including an exterior photo on all sale listings. When entering a listing, if you select NO in the Take Photo field, you must upload your own exterior photo within seven days. A message is included to remind you to do so. If the photo is not uploaded within seven days, a fine will be issued.

Listing Fees:

$40 — Sale listings. In most cases, fee includes exterior photo.

$30 — Rental listings. No exterior photo taken.

All listing fees are billed monthly to the Broker. Office Exclusive Fee:

$60 — Sale listings. Price reflects special handling by NJMLS staff.

$50 — Rental listings. Price reflects special handling by NJMLS staff. No additional listing fee will be charged if the Office Exclusive is published.

NJMLS By-Laws and Rules & Regulations — Fines:

Please make yourself familiar with the By-Laws and Rules & Regulations of the NJMLS. Failure to comply will result in fines, including:

Compensation to be paid to a cooperating buyers agent. Comp TA

All compensations should be displayed as a percentage of the gross selling price less any specific dollar value. (ex: 2.5% - 100)

DCA — Dual Commission Arrangement:

This means that the commission paid by seller is variable and dependent on who brings in the buyer. For example, if the seller sells the property through his own efforts, he may pay a lesser commission to the listing bro-ker. Another example would be a listing in which the commission offered by the seller may be less should the property be sold by the listing broker, and higher if the listing is sold by a cooperating broker. You MUST enter a “Y” in the Dual Commission Arrangement field of your listing if a DCA agreement exists.

EA — Exclusive Agency:

(Not to be confused with “Office Exclusive”. ) This means that the seller gives the listing broker the right to sell the property for a specified period, yet at the same time reserves the right to sell the property himself without paying a commission to the listing broker. You MUST enter a “Y” in the Exclusive Agency field of your listing if an EA agreement exists. Exceptions:

This means that the seller reserves the right to sell the property to a spe-cific person or persons without owing compensation to the listing broker. Exceptions must be for a specific duration (example: first two weeks of listing agreement). You MUST enter a “Y” in the Exceptions field of your listing and indicate in Remarks how many Exceptions there are and the duration of the Exceptions. You must also fax the names and durations of

Return Keys to Keybox Immediately After Showing

NJMLS Rules and Regulations state: It is the obligation of the Member/ Subscriber when showing a property to return the owner's key to the keybox im-mediately after the showing. This rule must be observed as a safety precaution and a courtesy to the owner as well as other members.

DisplayKEYS & eKEYS

NJMLS Rules and Regulations state: DisplayKEYS and eKEYS are only to be used by the leaseholder and cannot be shared with or transferred to another member.

"Unauthorized use of a keypad is a violation of the lease agreement and the authorized key holder must bring the key to the NJMLS within twenty four (24) hours and have the authorized code changed. Keypad will be turned off after twenty four (24) hours. The cost for the reprogramming of the code is eighty (80) dollars."

Keybox on Property

NJMLS Rules and Regulations state: "If a keybox is used for showings, the Par-ticipant must place the latest NJMLS keybox on the property so that all registered members of the Service are able to gain access to the property." In addition, when accessing a property through a NJMLS keybox, it is your obligation to re-turn the key to the keybox immediately after the showing.

Purchasing Keyboxes

Keyboxes can only be purchased with a broker's check, or with a broker's written authorization to bill the office and are registered to the Designated Realtor of the office.

Shackle Codes

Shackle codes can only be given out to the Designated Realtor of the office to which the keybox is registered. NJMLS can provide or modify shackle codes for an agent if the broker has provided written authorization for that agent to receive/ modify the shackle codes.

Withdrawing a Listing

The listing broker must make arrangements to present all written offers to the seller as soon as possible and without undue delay.

Right of Cooperating Broker in Presentation of Offer:

The cooperating broker has the right to participate in the presentation to the seller or lessor of any offer he/she secures to purchase or lease. He/ she does not have the right to be present at any discussion or evaluation of that offer by the seller or lessor and the listing broker. However, if the seller or lessor gives written instructions to the listing broker that the coop-erating broker not be present, the coopcoop-erating broker has the right to a copy of the seller’s written instructions. A copy of seller’s written instruc-tions must be sent to the NJMLS to be kept on file. None of the foregoing diminishes the listing broker’s right to control the establishment of ap-pointments for such presentations.

Presentation of Offers

To withdraw a listing, a Withdrawal Form, indicating the type of withdrawal, MUST be signed by the Designated Realtor and ALL owners and faxed to the NJMLS within 24 hours. The 3 types of withdrawals are as follows: WT — Temporary:

Used to remove a listing from active showing for a brief period due to ill-ness, vacation, repair work, etc. When the property can be shown again the status should be changed to BOM (Back on Market).

WC — Conditional:

Used to withdraw a listing BUT with a signed release agreement outlining the conditions. No other office can list the property until the listing expires, at which time the conditions are null and void.

WU — Unconditional:

Used to withdraw a listing unconditionally. The listing agreement is com-pletely terminated without conditions.
