PROJECT: "Pilot Telemetering and Management System for the Electric Power Supply Demand by Residential and Small Commercial Consumers and Implementation of Smart Grids"

CALL FOR TENDERS WITH OPEN PROCEDURE

Hellenic Electricity Distribution Network operator SA (HEDNO), 20 Perevou & 5 Kalirois Street, 11743 Athens, hereby invites the Tenderers, in accordance with Directive 2004/17/EC of the European Parliament, Presidential Decree 59/Government Gazette No A63/16.03.2007, the provisions of Works, Procurements and Services Regulation of HEDNO (BoD Decision No 206/30.09.2008) and this Notice of Call for Tenders, to take part in an open Tender Procedureand criterion of the lowest price for the election of Project Contractor: "Pilot Telemetering and Management System for the Electric Power Supply Demand by Residential and Small Commercial Consumers and Implementation of Smart Grids", of a total Budget, according to the Corporation’s estimate, of EUR thirty six million (36,000,000.00) in one hand and the offer price for a five (5) years provision, of System operation, technical support and maintenance services, as well as failure restoration services for the total metering and communications equipment, with a possibility to provide such services for five (5) additional years, at the discretion of the Corporation, indicative budget during the study of the Corporation, of 1.2 million euros (1,200,000.00) Euros per year or six million for the five year services (6,000,000.00) Euros, the price which won’t join the EPAN - II (NSRF 2007-2013) funding.

The above budgeted prices do not include VAT. Said budget shall constitute the ceiling of bids. Bids that are higher than the budgeted value will be rejected.

The project is included in Operational Program Competitiveness and Entrepreneurship of the Fourth Community Support Framework for co-financing from the European Regional Development Fund (ERDF) and national resources. Assignment of the ERDF is to reduce disparities in development and living standards among different regions, minimize the delinquency at the least favored regions, to redress the main regional imbalances in the Community by participating in the development and structural adjustment of belated regions and as well as to social and economic reconstruction of regions.

The project is part of a wider action category "Energy for uninterrupted supply of electricity, security of supply and increase the stability of the system."

HEDN" and the positive opinion of RAE No. 10/2012, approved by Deputy EECC large-scale gradual replacement of existing measurement systems final electricity consumption in the HELLENIC ELECTRICITY DISTRIBUTION NETWORK (HEDN) respectively with intelligent metering systems in accordance with Article 59 of L. 4001/2011 (A 179). The replacement of metering systems with smart meters will begin no later than 01.07.2014 and until 30.06.2017 will have replaced 40% of all existing meters with smart meters and until 31.12.2020 at least 80% of the existing meters shall be replaced by smart meters.

The implementation of this project as described in Article 6 of GG B 297/13.2.2013, ie the Pilot Installation of new "smart" meters to Low Voltage consumers at the Distribution Network with simultaneous dismantling of the existing metering devices, whose basic design and co-financing is set with JMD Number FA / E 3.2/57/3/3.1.2011, will be completed in August 2015.

The HEDNO SA during implementation of the project will ensure that:

a) The composition of the sample application serves the required representativeness of the results of the pilot.

b) The project includes planning and actions to explore the potential use of metering systems in order to enable consumers on energy saving and demand management.

c) The metering systems cover the functions listed below:

• Ability to read metering data directly from the customer or any third party designated by the consumer.

• Updating meter readings frequently enough to enable the use of information to achieve energy savings.

• Possibility of remote meter reading by the administrator.

• Provision for bidirectional communication between the smart metering system and external networks for maintenance and control of the metering system.

• Frequent metering data capability so that the information is used for network programming. • Support advanced billing systems.

• Ability to remotely start / stop the connection and / or the provision or limitation of the power. • Providing secure communication for data.

• Prevention and detection of fraud.

ARTICLE 1

Name - Address of Competent Department for the Call for Tenders Place and time of the Call for Tenders

The Service of HEDNO SA in charge of the Call for Tenders, which is also responsible for all matters related to it, is the Network Department (Special Projects’ Contract Section), 22 Chalkokondili Street, Athens, tel 210 5292562, 210 5292563, 210 5292564.

The receipt and opening of bids will take place in the Hall "XENIA", at 22, Chalkokondili Street Athens, on ... day...at 10:00 am

(closing time for the submission of the tenders) before a Committee to be recommended by the Corporation.

Tenders may also be submitted by registered mail or courier service to the registration office of the NETWORK DEPARTMENT, 22, Chalkokondili Street, 8th Floor, Office 818, 104 32 Athens. Tenderers shall assume full responsibility for both the timely delivery of the tender and the tender’s contents. Such tenders shall be considered only if delivered sealed to the Registration Office of the above

Department not later than the above closing date and time for the submission of tenders.

The "TENDER ENVELOPE" must necessarily bear the trade name of the Economic Operator submitting the tender, its business address, the name and telephone number of its Attorney-in-Fact and be marked as follows:

ARTICLE 2

Location, description and essential characteristics of the Project

1. HEDNO SA is planning to implement a Pilot Project to install, test and operate about 160,000 meters in selected geographic areas of the distribution network through which it will be possible to document from a techno-economic point of view the selection of the appropriate combination of Meters, Telecommunications and Collection Centers, and Metering Data Processing technologies.

The Pilot Project will cover the engineering, preparation of required functional and structural designs, procurement of all necessary equipment, installation of equipment and, finally, acceptance of the operational central load management and telemetering system for low-voltage (LV) customers, installed on a property owned by HEDNO.

The Project also includes the supply, installation and integration into the system of state-of-the-art electronic LV power meters, which will be installed in selected geographic areas of the distribution network and will be communicating with the central system, and the existing metering devices of the distribution network’s LV customers will be dismantled. The equipment for installing metering devices (e.g. meter cabinets) shall be made available by HEDNO S.A. to the Project’s Contractor and is not included in the Project’s Price.

The geographical areas of the network which are selected for the implementation of the pilot project include urban and suburban centers of mainland Greece and island complexes in order to gain experience from the operation of an AMM system on a representative sample within the Greek territory. More specifically, the areas selected are:

The communication technologies that will be tested in the pilot project are:

1. PLC (Power Line Carrier) communication technology through power lines and appropriate concentrators installed at each substation 20/0,4KV.

2. Fixed line PSTN (Public Switched Telephony Network) or fiber optic technology (FTTx) for IP connections (Internet Protocol) through lines xDSL (Digital Subscriber Line)

3. GPRS (General Packet Radio Services) communication technology through mobile. 4. RF mesh (Radio Frequency Communication) technology over radio frequency.

Each of the above technologies will be applied to at least 10% of the total meters of the project. Specifically, the Project is expected to include the comprehensive design, supply and installation of the equipment, the execution of all necessary tests and configuration and the delivery to HEDNO SA, ready for commercial operation, ("Turn key solution") of the following: • Telemetering Centres (main & backup) for metering data and load management of

LV customers of the distribution network, capacity of at least 250,000 metering points.

• Approximately 130,000 single phase and 30,000 three phase electronic LV meters with simultaneous dismantling of the existing meters. The meters should come from at least two different manufacturers for each offered meter kind (with a minimum amount of meters / manufacturer 30%) and to ensure interoperability and the interchangeability between them. It is clarified that it is acceptable to offer the same meter type for the different tested communication technologies.

• Approximately 160,000 devices (In home displays) displaying energy data in real time.

• 4,300 measuring and remote monitoring devices of the distribution Substations at the selected areas. These devices may be part of concentrators if these concentrators are used in the project.

Implementation schedule - Phases of the project: The project will be executed in two phases:

• A Phase - Design, supply, installation and commissioning of the Telemetering Centre. Implementation time of Phase four (4) months.

• Phase B - Replacement of 160,000 meters in chosen areas and integration of the meters in the Telemetering Center.

Implementation time of Phase B starts at the end of Phase A and the duration is less than 16 months.

The project also includes:

• The operation of the system for at least 5 years after final acceptance.

• The maintenance of the system, the metering and communications equipment as well as

failure restoration for at least 5 years after final acceptance.

The telecommunication link between the meters and the Telemetering Center for the entire period of project, its delivery, and the 5th year system operation, in order to achieve communication, meter data retrieval and measured data management from all LV meters, as described in the Technical Description of the Project.

The aim of the Pilot Project is:

• A full and detailed analysis of costs and benefits resulting from a national wide program to allow building a business and organizational plan for massive installation of "smart meters". • The collection and evaluation of information and experience on customer behavior towards the new technology and to determine to what extent the new system can influence customer behavior to improve energy efficiency and reduce peak demand.

• To test the technologies and automatic meter data collection and meter data management. • To highlight technical challenges in the installation process and data telemetering to obtain the necessary expertise for the optimal design of massive deployment of the system across the country.

• Examine the interoperability of supplied metering equipment by at least two different manufacturers and to verify compatibility with the existing grid.

• To gain experience in the design, installation and operation of an AMI (Advanced Metering Infrastructure) for the massive application of new technology across the country.

• To gather knowledge and experience concerning the appropriateness of the use of advanced metering functions such as prepayment, automation system etc. and whether this infrastructure can be used to create a smart grid.

The Pilot Program is not just an "experiment," but the main purpose is to simulate as closely as possible the conditions of full implementation of the new system, so that HEDNO will acquire relevant knowledge and experience to the next step, which is to implement "smart

metering systems" on a nationwide scale.

In addition, various types of technology that are expected to be tested during the project should not be in an "experimental stage" but should include equipment which technology is applied and reliable.

2. The individual works of the System shall be performed so as to ensure the delivery and operation of the Project without any delay and with minimum possible disruption to the functioning of the existing network, as well as with minimum possible intervention by technical support teams of the Corporation for data collection and failure restoration.

3. The suitability of the basic items of equipment used in the Project’s construction should be proven and certified, as further detailed in the Issues of the present Notice of Call for Tenders. 4. The Contractor shall carry out all necessary studies, obtain all necessary permits, see to the

procurement of all necessary equipment and necessary software, execute the necessary works, install, configure and test the equipment and, eventually, fully construct the System, in absolute compliance with those cited in the Issues of the present Notice of Call for Tenders.

5. The Contractor shall ensure at the implementation of the pilot project, the following:

• Distribution and statistical analysis of measurement data in accordance with the principle of transparency and the protection of consumer’s personal data. It is mentioned the quotation of the data that must, on 31.12.2014 and thereafter, the consumers have access, and also Article 10 of Directive 2012/27/EE of 25.10.2012.

• In addition to the above, extra care should be taken to the complete implementation by 09.03.2012 Commission Recommendation (2012/148EE) on preparations for the

commercial deployment of smart metering1 and the existing Union and national origin regulatory framework for the protection of personal data2.

2. Article 8 of the Chart of Fundamental Rights of the European Union, Directive 2006/24/EC, Directive 2002/58 and N 2472/1997)

The detailed features of the project and the required specifications are analyzed in the accompanying documents of the Declaration.

ARTICLE 3 1. Participation in the Call for Tenders

In the Tender may participate all interested Economic Operators (Natural or Legal Persons or Companies’/Persons’ Partnerships thereof), established in the Member States of European Union (EU) or in the countries of the European Economic Area (EEA or in countries having signed the Government Procurement Agreement (GPA) of the World Trade Organization (WTO), ratified in Greece by Law 2513/1997 (Government Gazette A 139/27.06.97), provided that the present Contract is covered by the GPA, or in third countries having signed association agreements with the EU, provided that the text of the said agreements expressly provides for the participation of the said countries to EU Request for Tenders, or Economic Operators incorporated under the law of an EU Member-State or of a country having signed the agreement for the European Economic Area (EEA) or of a country having signed the Government Procurement Agreement (GPA) of the World Trade Organization (WTO), provided that the present contract is covered by the GPA, and which have their central administration or principal place of business or registered office within the EU or the EEA or any country having signed the GPA of WTO, or, finally, in third countries which have entered into association agreements with the EU, with the following experience – capability. (It is noted that all participation issues shall relate to and come from the aforementioned countries for the respective Tenderers) :

Α) EXPERIENCE IN THE WHOLE PROJECT:

Tenderers shall be experienced in the design, construction and put into commercial operation of respective automated electricity meter reading and meter data management systems (AMR - MDM) through any kind of communication such as fixed telephony, wireless RF, PLC network lines, etc., including the installation and integration in the central automated meter reading and meter data management system (AMR - MDM) of the meters and the communication devices (mobile communication modems or similar communication device).

Minimum acceptable experience in design, Project Management and System Integration Projects, as well as in their roll-out and put into commercial operation shall be the realization, over the last decade, of similar projects, as described in the above paragraph, of which: • One (1) project that concern the integration of at least 250,000 metering points in a

Or

• Two (2) projects, that cumulatively concern the integration of at least 250,000 metering points in central system (AMR - MDM) of an Electric Utility or Network Operator

The above projects should be implemented over the last decade and should operate satisfactorily for at least one year.

The minimum required experience listed above should be evidenced by letters of recommendation from the owners of respective projects.

In the exceptional case with a declaration the above project principals deny in a written form the submission of recommendation letters (corporate policy), it is possible by the participants the submission of detailed information in order the Company (HEDNO SA) to be able to communicate to the project principals for verifying the information submitted by the participant in the contest. In that case the Tenderers in their offer should mention for every project that do not submit a reference letter at least the following details:

• The trade name of the Company which is the owner of the project

• The name(s) of the person(s) responsible for the project’s acceptance and operation on behalf of the Company which is the owner of the project

• Contact details (fixed telephone number(s), fax number(s) and email address(es) of the aforementioned persons.

• Detailed description of the project and the role of the participant during the implementation of the project.

Note that, if the staff of HEDNO S.A. fails to contact with the aforementioned owner of the project, the Tenderer is responsible for organizing and facilitating, in any way, the contact between the HEDNO S.A. staff and the respective staff of the Company for which the Tenderer has executed a similar project and which is invoked as evidence of its experience. For this reason, upon written notice by HEDNO S.A. and within five (5) working days from such notice, the Tenderer shall take all necessary steps to enable the staff of HEDNO S.A. to communicate with the staff of the respective Company.

The realization of the communication between HEDNO S.A. and the respective Company shall be confirmed by relevant correspondence following its completion.

In case that the Tenderer does not meet the obligation to verify the required experience, as provided for above, its tender shall be rejected.

B) EXPERIENCE IN THE SUPPLIED EQUIPMENT (METERS & COMMUNICATION DEVICES):

The manufacturer of each equipment (meter/equipment device) shall have the following necessary experience, evidenced upon submission of reference letters from Electric Utilities or Network Operators.

For the sales of the supplied meter types, reference letters from Electric Utilities or Network Operators shall be produced.

For each supply of the supplied meter types to the Electric Utilities or Network Operators, the respective reference letter shall include at least the following details:

• The trade name of the Company to which the said equipment have been supplied. • The quantity and the precise type of the meter for the referred supply.

• The name or names of those were responsible for the meter collection.

• Contact details (fixed phone and fax number(s) and email address(es)) of the above responsible.

1. Meters

1.1. Reference letters for every offered kind/type of the offered meter, proving sales of at least 30,000 units of the same type as to those supplied during the last six years which are integrated in a Central Telemetering System.

1.2. For the offered meters, the following shall be performed:

• Submission of certificate of compliance of the communication protocol in accordance which is approved by the European Standards Organization (CEN/CENELEC).

• Submission of certificate by an independent certification body for the interoperability and compatibility of the communication protocol for the offered meter types of the same kind.

• Submission of Type Test Certificates from an internationally recognized laboratory, certified as per EN ISO / IEC 17025:2005, according to the latest applicable version of EN/IEC 62052-11.

• Submission of Certificate of Conformance with Directive 2004/22/EC (measuring devices - MID) for class B, issued by the pertinent announced Body.

• Submission of CE certification of conformity for the supplied meter, in accordance with Directive EMC Directive 2004/108/EC.

• Every offered meter type shall to be successfully tested as regard its immunity against the impact of symmetrical currents at frequency range 2-150 kHz, as those produced by photovoltaic facilities’ inverters. The successfully tests of the offered meter shall be evidenced by submission of the relative Test Certification or Control Protocol

by a recognized and accredited according to EN ISO / IEC 17025: 2005 test

laboratory

.

• Submission of good performance guarantee for the hardware for at least five (5) years.

• Software for mass parameterization for each kind/type of meter, according to the technical specification shall be offered.

1.3.As regards the manufacturing and inspection plant of the types of meters under supply, evidence should be produced that its production capacity meets the requirements of the project.

1.4. The meters’ manufacturing plant should have been granted the following certifications: • Quality management system in accordance with EN/ISO 9001:2008

• Environmental Management System according to EN ISO 14001:2004

• Compliance with Directive 2004/22/EC (measuring devices) and in accordance with the Ministerial Decision (Government Gazette 521 / Issue B / 12.04.2007, No F2 - 1393) for the manufacture of electronic meters.

• Certificate of conformance according to EN ISO / IEC 17025:2005, for the control laboratories of the plants and for the inspection site, if different from the meters’ production plants.

Tenderers shall state in their tender the manufacturing plant and the inspection site of the types of meters under supply.

2. Communication devices

2.1. Reference letters for every offered communication device type, which are integrated to a Central Telemetering system and operate satisfactorily the last five years at quantities as follows:

• GSM/GPRS modems 20,000 pieces • ETHERNET (ADSL) 1,000 pieces • PLC 20,000 pieces

• RF 20,000 pieces

If any of the above communication devices are modular into corresponding meters, then it is valid what is referred in the preceding paragraph about meter sales.

2.2. The manufacturing plants of the communication devices must have the following certification: • Quality management system according to EN/IS0 9001:2008.

2.3. For the sales of the offered communication device types, reference letters from Electric Utilities or Network Operators shall be submitted, that include at least the following details:

• The trade name of the Company to which the said equipment have been supplied. • The quantity and the type of the communication device for the referred supply. • The name or names of those were responsible for the communication device

collection.

• Contact details (fixed phone and fax number(s) and email address(es)) of the above responsible.

C) EXPERIENCE FOR THE OFFERED SYSTEM (AMM APPLICATION)

The minimum experience is considered as the execution of projects relating to the supply and installation of at least two (2) AMM applications of the same type as the offered, with capability (cumulative) of at least 250,000 metering points and are in commercial operation in the last six years.

The minimum experience required, as cited above, shall be evidenced upon submission of reference letters from the owners of the respective applications or projects.

For that reason, the Tenderers shall state in the reference letters submitted with their tender at least the following details:

• The trade name of the Corporation which is the owner of the project

• The name(s) of the person(s) responsible for the project’s acceptance and operation on behalf of the Corporation which is the owner of the project

• Fixed phone and fax number(s) and email address(es) of the above persons.

1. It shall be proved that the WEB application required in the technical description of the system is already in operation.

2. Considering that the AMR application should collect data in accordance with the technical specification of the meters, the manufacturer of the application under supply shall include the appropriate software for the processing of power quality data and the extraction of statistics.

D) EXPERIENCE IN WORKS FOR THE INSTALLATION OF METERS AND COMMUNICATIONS DEVICES:

The Tenderer shall have available in Greece the appropriate staff and infrastructure for the installation and support of the meters and telecommunication devices and shall have already executed works for their installation. In case the Tenderer does not have the above infrastructure in Greece, will have to declare a specialized company, as a subcontractor for this work, which has experience in the installation of electricity meters, having installed at least 10,000 electricity meters in the last six years.

The subcontractor shall have to be granted:

• Quality Management System according to EN ISO9001:2008 Besides the above should:

• Submit a declaration stating that he will provide technical support, maintenance and failure restoration services of the system and the metering and communication devices for at least five (5) years after the final acceptance of the project.

• Submit the organizational structure in which is presented the operation mode and the manpower to be employed for system and measuring equipment support.

Note that tenderers not proving their experience in the above mentioned requirements of paragraphs A, B, C and D, according to those provided for above, shall be excluded from further participation in the tender procedure.

Tenderers should submit all the above items at the date of submission of tenders. 2. Tests for the supplied equipment for the Technical Evaluation of Tenders. 2.1. Tests performed during the Technical Evaluation of Tenders.

For HEDNO S.A. to certify the compatibility and successful operation of the offered Telemetering System and the communication devices with the L.V. meters, the test described below shall be carried out during the technical evaluation of the tenders and, specifically, within ten (10) working days from the date that the technical tenderers are opened:

• The tenderers shall install in their own computer the software of the AMR-MDM System (trial version).

• They shall perform metering data extraction using the proposed communication devices from the supplied meter types and concentrators.

• They shall perform installation of proper software for on sight metering data readout through a laptop or an equivalent portable registrar (HHU), and test data extraction from the meters / concentrators, as well as transfer and entering of the data collected in the computer with the AMR-MDM System software.

• They shall perform a data transfer test between any meter kind/type and the offered display device (In Home Display).

• They shall perform a data transfer test between the metering devices and remote monitoring devices of distribution substations and the central system and also

communication between concentrators and the central system.

The tests shall be carried out in the facilities of the Network Department/ Laboratories and Radios Section (70 Ag. Annis Str., Rouf) and shall be regarded as successful if, within three (3) days from their commencement, full communication between the supplied equipment is systematically achieved.

In case of failure of the aforementioned tests, the tender shall not be further technically evaluated and shall be rejected.

2.2. Evaluation of the Experience for the supplied Central System (AMR + MDM)

HEDNO S.A. in order to confirm the satisfactory operation of the Telemetering System (AMR-MDM) under supply is possible during the Technical Evaluation three members of the Technical Evaluation Committee to perform a visit as described below:

The Tenderer shall indicate, in consultation with the Evaluation Committee, the place, the time for a three-day visit, to be carried out by the Three-Member Committee to an Electric Utility or Network Operator, where the offered Central AMR + MDM System is already installed and in commercial operation, in order to assess its satisfactory operation.

The cost of the three members of the Technical Evaluation Committee’s Visit is to be borne by the Tenderer (accommodation and air tickets costs).

3. If the Tenderer is a Joint Venture or Consortium

3.1. If the Tenderer is a Joint Venture or Consortium, a statement should be submitted by each Company participating in the Joint Venture or Consortium, that such companies established a Joint Venture or Consortium in order to jointly undertake the project and that they shall be liable towards HEDNO SA in relation to their participation in the tendering procedure and the performance of the project, unified, indivisible and in whole.

In case of a Joint Venture, the above statement shall also include the percentages of each member, while in case of a Consortium the relevant consortium agreement indicating the percentages of each member, shall also be submitted.

3.2. Moreover, in case of a Joint Venture and to the extent that the tender of the successful Contractor does not specify the execution of a separate part of the project and the separate price for it by each member of the Joint Venture, and therefore the separate invoicing of the members of the Partnership according to the Greek tax law is not possible, then the Contractor shall be obliged prior to the signing of the contract to adopt a legal status that allows joint invoicing.

3.3. The awarding of the contract shall be in the name of all member of the Joint Venture or Consortium and the Contract shall contain a term according to which each members of the Joint Venture or Consortium involved shall be liable towards HEDNO S.A. uniformly, indivisibly, jointly and in whole, shall have a common representative and the participation of all members of the Joint Venture or Consortium shall be verified by HEDNO S.A.

If the case of the previous paragraph applies then for the signing of the contract it shall be obligatory to submit a certified copy of the document evidencing its compliance with the above requirement.

3.3.1. The experience requirements shall be met collectively by the parties to the Joint Venture or Consortium; i.e. they need to be met by a single member of the J/V or Consortium.

3.3.2. Companies submitting a tender, either independently or as members of a Consortium or J/V, may not participate as members to another Consortium or J/V participating in the same Call for Tenders.

It is also prohibited a Representative to represent two or more Tenderers.

3.3.3. It is acceptable the participation in the contest of affiliate companies or companies of the same Group of companies, by providing a letter for complete and exclusive support of their parent companies or companies in the same Group of companies in all matters relating to the planning, design and project implementation.

In case of non-compliance of the Tenderers with the said requirements, the Tenders submitted by those Tenderers shall be excluded from further tendering procedure.

4. Loan experience

If the Tenders would like to invoke the financial, technical and professional capability of third parties in order to meet the participation requirements set out in previous paragraphs and the requirements regarding the financial standing of the Tenderer, which are defined in the “Tendering Terms and Guidelines", they must submit evidence of the aforementioned capacity and declare that they are bound to provide all guarantees required by the Notice of the Call for Tenders.

In this specific case, the Tenderer is required to demonstrate, in any expedient way, that it shall have at its disposal, throughout the term of the Contract, all necessary means to execute it. Such evidence might be, for example, a valid private agreement between the Tenderer and the third parties referred to, a binding statement signed by a legal representative of such third party, production of guarantees of other forms, so that the aforementioned capacity is adequately proven to the satisfaction of HEDNO S.A. Such evidence should be included in Envelope B of the Tender.

The scope of cooperation between the Contractor and the said third party, as well the guarantees provided by such third party to the Contractor, shall be included in the Contract.

ARTICLE 4

Requirements for the contents of the Tender 1. Deviations

1.1. No deviations from the Commercial and Financial Terms of the Notice of the Call for Tenders shall be acceptable. The tenders shall fully comply with the respective terms and requirements cited therein.

of the Call for Tenders shall be treated as Commercial deviations. Tenders containing such deviations shall be rejected.

As regards the Technical terms of the Notice of the Call for Tenders (technical description of the Project and individual technical specifications of the equipment), it is specified that Tenderers may propose technical solutions that, in their opinion, meet, in an equivalent manner, the requirements of technical terms of the Notice of the Call for Tenders. In such case, Tenderers shall be required to properly fill in the Table of Equivalent Technical Solutions, in the format provided in the Notice of the Call for Tenders, and include in their tender all necessary evidence to document the proposed equivalence (complete and detailed technical description of the object, documented justification of the equivalence, suitability of the proposed solution, references to its international application to date, submission of the international regulations on which it is based, etc.). Moreover, the technical solutions proposed shall, in no way, affect the functionality, security, availability, ease of maintenance, operation and protection philosophy, reliability and life cycle of the equipment.

As long as the above documentation is deemed to be satisfactory by the Corporation, the proposed equivalent technical object shall be incorporated in the Project without any further cost to the price.

Otherwise, the Tenderer’s tender shall be rejected, unless the tenderer has submitted a statement that in case of award of the Project he will comply with the technical terms of the Declaration, unconditional and without any financial or time burden for HEDNO SA for all of the suggested as equivalent techniques solutions were not accepted by the Company. It is clarified that apart from the above statement, the submitted evidence should prove that it is possible to comply with the requirements of the technical specifications of the Company. 1.2. Deviations from the Technical Specifications of the Notice of the Call for Tenders due to

technical and manufacturing specificities of the offered equipment and/or systems shall not be acceptable.

1.3. In case that the Tenderer has not submitted the Equivalent Technical Solutions Table, he shall submit a Declaration stating that the supplied project is in full compliance with the Technical Specifications of the Notice of the Call for Tenders.

1.4. Note that any different approach by the Tenderer of the above mentioned procedures shall entail rejection of its tender.

1.5. For the basic items of Project’s software and equipment and specifically: For:

• The Automated Meter Reading Application and the Meter Data Management Application, Tenderers shall be called to offer one (1) manufacturing type for the system, otherwise their tender shall be rejected.

For:

manufacturing types for each kind.

• The Communication devices (mobile communication modems, PLC, ETHERNET etc.) there is no restriction, with the precondition that every type covers complete the experience requirements for the supplied equipment.

Article 5

Receipt of issues of the Notice of the Call for Tenders

The Issues of the Notice of the Call for Tenders, as mentioned in Article 1 of the “Tendering Terms and Guidelines”, are posted on the Corporation’s website www.deddie.gr

Alternatively, the said issues are made available in electronic form (CD) by HEDNO S.A.- NETWORK DEPARTMENT (Special Projects’ Contracts Section), 22 Chalkokondyli Str., Athens, 6th Floor, Office 609, tel. 210 5292562, upon payment of € 20 and the respective VAT applicable.

Those interested may receive these issues, by signing a relevant receipt, not later than five (5) days before the tendering date, namely by ………on working days, from 9.00 to 13.00. They may also receive knowledge of all the other issues of the Notice of the Call for Tenders at the offices of the aforementioned NETWORK DEPARTMENT (Special Projects’ Contracts Section), on working days, from 09.00 to 13.00.
