A. GENERAL INFORMATION ON SPECIAL FEES, REFUNDS, EXTENSIONS AND CANCELLATIONS 1. DOUBLE FEES

A-001 Any person who commences building, structural, electrical, gas, mechanical or plumbing system work before obtaining the building official’s approval by means of a City-issued permit shall be subject to a penalty of 100 percent (100%) of the usual permit fee in addition to the required permit fees. When work (for which a permit is required) is commenced prior to obtaining a permit, the homeowner will be required to pay the specified fee twice (double permit fee) to the Building Department before it will issue the permit plus penalty fee. The payment of the required fee shall not relieve the applicant from being subject to any other penalties therein (code enforcement fines may apply). The double fee requirements shall be applicable to all trades of the Building Department as noted herein.

A-002 If a permit applicant is found doing work without a permit as stated above in A-001 a second time, the permit applicant shall be required to pay twice the double fees plus the following amount.

A-003 If a permit applicant is found doing work without a permit as stated above in A-001 a third time and any other time thereafter, the permit applicant shall be required to pay twice the double permit fee plus the following amount.

2. RE-INSPECTIONS OR ADDITIONAL INSPECTIONS

A-004 Upon receipt of a permit, the permit holder shall be entitled to one (1) initial inspection for each mandatory inspection. All work shall be inspected and if any deficiency is found it shall be noted by the

inspector for correction by the contractor. When the work described on the permit is partially completed, an inspection shall be performed on those portions of the work completed, provided that compliance with the Florida Building Code may be determined with respect to those portions. If an inspection is required to assure compliance with the Florida Building Code once the initial inspection has been done, the permit holder shall pay a fee for each additional inspection. All such re-inspection fees shall be paid prior to any re-inspection taking place and the final inspection being conducted. Payment should be in person at the City of Sunny Isles Beach Building Department. (This fee applies to all trades).

(a) LOST PLANS: When a field copy (job copy) is lost, a recertification fee shall be paid to the Building Department (before the office copy is sent out for duplication). The recertification shall bare a stamp indicating the Building Official’s certification. Such fee shall be based on thirty percent of the original permit fee. (b) REVISED PLANS PROCESSING FEE:

1. Major plan revision after permit is issued, including As-Built drawings shall be subjected to a fee of fifty percent of the original permit fee.

2. Minor plan revision shall be subject to a minimum $50.00 fee and $65.00 per ½ hour or fraction thereof for each submittal.

4. REFUNDS, TIME LIMITATIONS, AND CANCELLATIONS

A-009 The fees charged pursuant to this schedule, provided the same are for a permit required by Section the Florida Building Code, may be refunded by the Building Official with the following exceptions:

(a) No refunds shall be made on requests involving:

(1) Up-front processing fees collected at the time of application.

(2) permits fees of $125.00 or less; or

(3) permits revoked by the City Manager or the Building Official under authority granted by the Florida Building Code, or permits cancelled by Court Order, or conditional permits; or

(4) permits which have expired; or

(5) permits under which work has commenced as evidenced by recorded inspection having been made by the Building Department

(6) no refunds shall be made on a permit when a change of contractor is requested.

(b) A full refund less $125.00 or 50% of the permit fee, whichever is greater, rounded to the nearest dollar, shall be granted to a permit holder who requests a refund provided that:

(1) The Building Department receives an original and hardcopy written request from the permit holder prior to the permit expiration date;

(2) The permit holder submits with such

request the Applicant’s validated copy of such

permit; and

(3) That no work has commenced under such permit as supported by any recorded inspection and/or field inspection.

(c) Applications having a change of contractor, qualifier, architect, engineer, or owner shall pay a fee of $100.00 to cover the cost of transferring the data from the original permit to the second permit. When an original permit has expired under the Florida Building Code the original permit fee shall be paid.

(d) A fee of $100.00 shall be paid by the permit holder who submits a written request for a permit extension as authorized under the Florida Building Code.

(e) Where a permit has become null and void pursuant to the Florida Building Code, a credit of fifty percent (50%) of the original permit fee shall be applied to any re-application fee for permit covering the same project and involving the same plans, provided that the complete re- application is made within six (6) months of the expiration date of the original permit, and provided that no refund had been made as provided in this Section.

5. IMPACT FEES

A-010 Impact fees are assessed on certain building permits, including re-application on expired permits. (Chapter 174 of the Sunny Isles Beach Charter and Code)

A-011 Other agencies including, but not limited to, the

Department of Environmental Resources

Management (DERM), Miami-Dade Fire Rescue

Department, Building Code Compliance Office

and the Florida Department of Health may assess

fees on building permits, including re-application

on expired permits (contact the applicable

agencies for details).

6. SPECIAL PROJECTS A-012

A-012.a

A fee equal to actual staff time and related costs shall be assessed for special projects requiring research by the Building Department in order to answer questions proposed by developers, attorney’s, realtors, or municipalities, and others, in connection with the use, re-subdivision, and development of properties, or determination if any violations exist on the property through a review of departmental records. Such special fee will only be levied for requests outside the scope of normal departmental work.

A fee equal to $2.00 per page (letter size) shall be assessed for pre-programmed computer reports and on Building Department records copied or printed for the issuance of a permit.

9. INSPECTIONS REQUIRING OVERTIME:

A-022 Charges for inspections, which are requested in advance and which requires that an employee works overtime will be assessed at a rate of $75.00 per hour.

Two (2) hours, minimum, on weekdays or a minimum of four (4) hours on weekends and/or holidays.

Additional inspector’s travel time might be assessed.

10. FEES BASED ON ESTIMATED COST- DOCUMENTATION REQUIREMENTS

The Building Department may require the permit

applicant to submit appropriate documentation as

proof of estimated cost of construction, used to

compute the permit fees. This includes but is not

limited to an executed contract, invoices, receipts,

etc. The estimated cost of construction must

include the cost of labor and materials for the scope

of work applied for. If the estimated cost of

construction is deemed lower than the industry

standard, the Building Department will assess the

estimated value of work using their best judgment

according to comparable permitting files and/or industry information.

A-023 11. TRAINING AND EDUCATION FEES:

All permits will be assessed a training and educational fee of two percent (2%) of the permit fee cost. All fees collected pursuant hereto shall be set aside to offset the cost of training and education of personnel in the regulation, inspection, and enforcement of the Florida Building Code.

A-024 12. TECHNOLOGY FEES

All permits will be assessed a technology fee of 5.0%. All fees collected pursuant hereto shall be set aside to offset the cost of computer system purchases or technology expenditures within the building department.

13. PRE – SUBMITTAL REVIEW FEES:

A per hour fee will be assessed for every trade applicable for review when the customer elects to submit plans for pre – submittal review.

Minimum of 2 hours per trade.

A per hour fee will be assessed for Structural and Landscaping at the plan review rate set forth under A-026 and A-027.

A-026 14. STRUCTURAL ENGINEER PLAN REVIEW:

A per hour fee will be charged for plan review that

involves structural review. $160.00

A regular per hour fee will be charged for

B. BUILDING PERMIT FEES

Permit Fee is inclusive of plan review and

inspections for building, electrical mechanical and

plumbing trades, only if the scope of work for those

trades is included in the estimated value of work submitted at the time of permitting. A minimum processing fee of $25.00 will be charged on sub- permit applications issued. Other local, State, and County surcharges will be assessed on every permit in accordance to this fee schedule.

For new construction and additions, permit fee is inclusive of roofing, windows/doors, driveway (not including approach), only if the scope of work is included in the estimated value of work submitted at the time of permitting. Zoning plan review is also included.

F. RECERTIFICATIONS

F-001

1. 40- YEAR RE-CERTIFICATION FEES

For every application for 40 – year re-certification under Chapter 8 of the Miami Dade County Code, and every ten (10) years, thereafter, there shall be paid to the Building Department, for the processing of each application, a fee of $500.00.

F-002 For the initial application for structural glazing re- certification and each subsequent application under Chapter 8 of the Miami Dade County Code, there shall be paid to the Building Department, for the processing of each application, a fee of $500.00.
