Definition A non-professional/End User is a user who:

1. is one of the following: a) a natural person;

b) a company or close corporation incorporated and registered in accordance with the laws of the Republic of South Africa of which the shareholders or members are the natural person referred to in a) above and/or such natural person’s immediate family (ie the parents, grandparents, children, grandchildren and spouse of the natural person referred to in a) above) and whose management and daily operations are under the control of such natural person and/or the natural person’s immediate family; or

c) a trust registered with the Master of the High Court of any division of the High Court of South Africa the beneficiaries of which are the natural person referred to in a) above and/or his immediate family; or

d) an unincorporated entity operating an investment club for natural and not juristic persons on a non-professional basis, (each a “Qualifying Private User”); and

2. is not registered or required to be registered as, or qualified as, and does not act in any capacity (directly or indirectly) as, a securities trader, investment advisor or asset manager with any domestic or foreign financial exchange, regulatory authority, professional association or professional body recognised under any law; and

3. does not use the Data, directly or indirectly, for any business or professional purposes whatsoever (ie uses the Data solely for purposes of managing the personal funds of the natural person referred to in a) above and/or those of his or her immediate family and in circumstances in which the Qualifying Private User does not charge or receive a fee); and

4. does not distribute, publish or otherwise provide or make available any data to any third party in any manner whatsoever.

For the purposes of this Appendix 1, end users in respect of whom the User has reporting obligations to JSE Limited shall be referred to as “Reportable Users”.

If a Reportable User does not notify the User of his/her non-professional/private status, then such Reportable User will, for the purposes of this Price List, be construed as a professional/ corporate user (and notwithstanding their actual status may be non-professional/private user).

It is the responsibility of the User to ensure that

-(i) each Reportable User delivers to the User the Non-Professional Reportable User Confirmation where indicated above. The JSE shall not be obliged to make any enquiries in this regard;

(ii) the Reportable User notifies the User of any change in his/her status in accordance with the above definition;

(iii) the User notifies the JSE of any changes in a Reportable User’s status disclosed in the ENDF in accordance with the above definition; and (iv) the User retains all such Non-Professional Reportable User Confirmations for a minimum period of three years from the date of receipt.
