AN AMENDED RESOLUTION BY FINANCE/EXECUTIVE COMMITTEE AUTHORIZING THE MAYOR, OR HER DESIGNEE, TO ENTER INTO AMENDMENT NO. 17 TO FC-9323, COOPERATIVE AGREEMENT FOR INDEFINITE QUANTITY CONSTRUCTION WITH EIGHT (8) CONTRACTORS FC-9323(A): ASTRA GROUP, INC.; FC-9323(F): GREEN & BURDETTE PROPERTY MANAGEMENT, LLC.; FC-9323(H): OSPREY MANAGEMENT, LLC. WHEREAS, the Department of Enterprise Assets Management has identified the need to make improvements to various City owned facilities; and

WHEREAS, on November 7, 2016 the Atlanta City Council approved Resolution 16-R-4518 authorizing the Mayor to enter into a Cooperative Agreement with fifteen (15) contractors to make necessary improvements to various City owned facilities; and

WHEREAS, resolution 17-R-3109, adopted by the Atlanta City Council on February 20, 2017 and approved as per City Charter Section 2-403 on March 1, 2017, corrected Resolution 16-R-4518 by listing the names of the fifteen (15) contractors and contract numbers as follows: FC-9323 (A): Astra Construction Services, LLC.; FC-9323 (B): Brown & Root; FC-9323 (C): Centennial Contractor Enterprises, Inc.; FC-9323 (D): Engineering Design Technologies, Inc.; FC-9323 (E): F.H. Paschen/ S.

N. Neilson & Associates; FC-9323 (F): Green & Burdette Property Management, LLC.; FC-9323 (G):

JOC Construction formerly known as Lesco Restoration, Inc.; FC-9323 (H): Osprey Management, LLC.; FC-9323 (I): Prime Contractors, Inc.; FC-9323 (J): Red Cloud Services, LLC.; FC-9323 (K):

WHEREAS, pursuant to 17-R-3230, adopted by the Atlanta City Council on March 6, 2017 and approved as per City Charter Section 2-403 on March 15, 2017, the City entered into Amendment No 1.

WHEREAS, pursuant to 17-R-3521, adopted by the Atlanta City Council on May 1, 2017 and approved as per City Charter Section 2-403 on May 10, 2017, the City entered into Amendment No. 2 to FC-9323, Cooperative Agreement with fifteen (15) contractors FC-9323 (A): Astra Construction Services, LLC.;

WHEREAS, pursuant to 17-R-3940, adopted by the Atlanta City Council on July 17, 2017 and approved as per City Charter Section 2-403 on July 26, 2017, the City entered into Amendment No. 3 to FC-9323 (L): HCR Construction, Inc. on behalf of the Department of City Planning to add funding and to issue task orders; and

WHEREAS, pursuant to 17-R-4020, adopted by the Atlanta City Council on August 21, 2017 and approved as per City Charter Section 2-403 on August 30, 2017, the City entered into Amendment No. 4 to FC-9323, Cooperative Agreement with fifteen (15) contractors FC-9323 (A): Astra Construction Services, LLC.; FC-9323 (B): Brown & Root; FC-9323 (C): Centennial Contractor Enterprises, Inc.;

FC-9323 (D): Engineering Design Technologies, Inc.; FC-9323 (E): F.H. Paschen/ S. N. Neilson &

HITT Construction, Inc., to add the Office of Enterprise Assets Management Real Estate Division, The Atlanta Fire Rescue Department, The Atlanta Police Department, and the Department of Aviation as authorized users and to add funding on behalf of the aforementioned departments and to issue a task order to FC-9323 (H): Osprey Management, LLC. for the renovation of the Georgia Hill Neighborhood Center; and

WHEREAS, pursuant to 17-R-4666, adopted by the Atlanta City Council on November 20, 2017 and approved as per City Charter Section 2-403 on November 29, 2017, the City entered into Amendment

No. 6 to FC-9323, Cooperative Agreement with eight (8) contractors FC-9323 (A): Astra Construction Services, LLC.; FC-9323 (F): Green & Burdette Property Management, LLC.; FC-9323 (H): Osprey Management, LLC.; FC-9323 (I): Prime Contractors, Inc.; FC-9323 (K): Rubio And Son Interiors, Inc.;

HITT Construction, Inc., to add additional Renew Atlanta bond program projects and add additional funds; and

WHEREAS, pursuant to 17-R-4756, adopted by the Atlanta City Council on December 13, 2017 and approved by Mayor Kasim Reed on December 15, 2017, the City entered into Amendment No. 7 to FC- 9323, Cooperative Agreement with FC-9323 (A): Astra Construction Services, LLC. on behalf of the Office of Enterprise Assets Management to add funding and issue a task order for the Trinity Lot Project; and

WHEREAS, pursuant to 18-R-3390, adopted by the Atlanta City Council on April 16, 2018 and approved as per City Charter Section 2-403 on April 25, 2018, the City entered into Amendment No. 8 to FC-9323, Cooperative agreement with eight (8) contractors FC-9323 (A): Astra Construction Services, LLC.; FC-9323 (F): Green & Burdette Property Management, LLC.; FC-9323 (H): Osprey Management, LLC.; FC-9323 (I): Prime Contractors, Inc.; FC-9323 (K): Rubio And Son Interiors, Inc.;

FC-9323 (L): HCR Construction, Inc.; FC-9323 (N): Johnson-Laux Construction, LLC.; FC-9323 (O):

WHEREAS, pursuant to 18-R-3391, adopted by the Atlanta City Council on April 16, 2018 and approved as per City Charter Section 2-403 on April 25, 2018, the City entered into Amendment No. 9 to FC-9323, Cooperative Agreement with eight (8) contractors FC-9323 (A): Astra Construction Services, LLC.; FC-9323 (F): Green & Burdette Property Management, LLC.; FC-9323 (H): Osprey Management, LLC.; FC-9323 (I): Prime Contractors, Inc.; FC-9323 (K): Rubio And Son Interiors, Inc.;

HITT Construction, Inc., on behalf of the Department of Enterprise Assets Management for the renovation of the ground and fourth (4th) floor restrooms and the ground floor locker rooms at City Hall South; and

WHEREAS, pursuant to 18-R-3378, adopted by the Atlanta City Council on April 16, 2018 and approved as per City Charter Section 2-403 on April 25, 2018, the City entered into Amendment No. 10 to FC-9323, Cooperative Agreement with eight (8) contractors FC-9323 (A): Astra Construction Services, LLC.; FC-9323 (F): Green & Burdette Property Management, LLC.; FC-9323 (H): Osprey Management, LLC.; FC-9323 (I): Prime Contractors, Inc.; FC-9323 (K): Rubio And Son Interiors, Inc.;

FC-9323 (L): HCR Construction, Inc.; FC-9323 (N): Johnson-Laux Construction, LLC.; FC-9323 (O):

HITT Construction, Inc., on behalf of the Department of Enterprise Assets Management for City Hall Interior Renovations; and

WHEREAS, pursuant to 18-R-3763, adopted by the Atlanta City Council on June 18, 2018 and approved as per City Charter Section 2-403 on June 27, 2018, the City entered into Amendment No. 11 to FC-9323 (A), a Cooperative Purchasing Agreement for Indefinite Quantity Construction with Astra

Construction Services, LLC., on behalf of the Department of Enterprise Assets Management, to issue a task order for the renovation of the Public Safety Annex parking lot; and

WHEREAS, pursuant to 18-R-3730, adopted by the Atlanta City Council on June 18, 2018 and approved as per City Charter Section 2-403 on June 27, 2018, entered into Amendment No. 12 to the Agreement to add funds to the Renew Atlanta Bond Task Order Fund; and

WHEREAS, pursuant to Resolution 18-R-4359, adopted by the Atlanta City Council on November 19, 2018 and approved as per City Charter Section 2-403 on November 20, 2018, entered into Amendment No. 14 to add funding on behalf of the Department of Watershed Management, Department of City Planning, Atlanta Police Department, and the Renew Atlanta Renew Atlanta Bond Program to renovate City owned facilities, in an amount of $6,726,178.71; and

WHEREAS, pursuant to Resolution 19-R-3278, adopted by the Atlanta City Council on March 4, 2019 and approved per City Charter Section 2-403 on March 13, 2019 entered into Renewal No. 1 and Amendment No. 15 to add funding on behalf of Renew Atlanta in an amount of $410, 000.00; and

WHEREAS, pursuant to Resolution 19-R-3277, adopted by the Atlanta City Council on May 6, 2019 and approved per City Charter Section 2-403 on May 15, 2019 corrected Resolution 17-R-4020 on behalf of Renew Atlanta to correct the funding sources from task level to district roll up level; and

WHEREAS, pursuant to Resolution 19-R-3533, adopted by the Atlanta City Council on March 4, 2019 and approved per City Charter Section 2-403 on March 13, 2019 corrected Resolution 18-R-3278 to include an additional contractor that was omitted; and

WHEREAS, pursuant to Resolution 19-R-3860, approved in Full Council on July 1, 2019, entered into Amendment No. 16 on behalf of the Department of City Planning for the Electronic Document Review (EDR) Pilot Space construction in an amount not to exceed $41,933.67; and

WHEREAS, the Director of Facilities has identified a need for additional funding in an amount of

$20,171.20 to continue City Hall Annex 5th Floor HVAC system replacement; and

WHEREAS, Renew Atlanta has identified a need for additional funding in an amount of $420,000.00 for projects in various districts; and

WHEREAS, the Department of Finance will renovate 14th and 15th floors of City Hall Tower side in an amount of $ 1,315,441.65; and

WHEREAS, the Atlanta Municipal Court will renovation of the assembly room in an amount of

$50,000.00; and

WHEREAS, Renew Atlanta has identified artwork for the MLK Mural Wall build-out in the amount of

$250,000.00; and

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ATLANTA, GEORGIA, that the Mayor, or her designee, is authorized to enter into Amendment No. 17 to FC-9323, Cooperative Agreement with eight (8) contractors FC-9323 (A): Astra Construction Services, LLC.; FC- 9323 (F): Green & Burdette Property Management, LLC.; FC-9323 (H): Osprey Management, LLC.;

FC-9323 (I): Prime Contractors, Inc.; FC-9323 (K): Rubio And Son Interiors, Inc.; FC-9323 (L): HCR Construction, Inc.; FC-9323 (N): Johnson-Laux Construction, LLC.; FC-9323 (O): HITT Construction, Inc., on behalf of the Department of Enterprise Assets Management, Renew Atlanta, Department of Finance and Municipal Court in an Amount Not To Exceed Two Million Fifty-Five Thousand Six Hundred Twelve Dollars and Eighty-Five Cents ($2,055,612.85).
