EXECUTIVE SUMMARY

BACKGROUND

This is a request for approval of a zoning change for 100.29 acres of land from the interim Suburban Development District (SD) to a zoning classification of Suburban Residential-15 District (SR-15). The subject land is owned by the City of Pearland (approximately 93 acres) and the Gulf Coast Water Authority (approximately 7.2 acres). The properties were recently annexed by the City (Ordinances 1574 & 1575) in July 2019. This property will be developed for a surface water treatment plant which has been an approved and bonded project through Capital Improvement Projects.

The Unified Development Code (UDC) establishes the following criteria of approval for the Planning and Zoning Commission and the City Council when considering a requested zoning change:

1. Whether the proposed zoning map amendment implements the policies of the adopted Comprehensive Plan, including the land use classification of the property on the Future Land Use Map and any

incorporated sector plan maps;

2. Whether the uses permitted by the proposed change in zoning district classification and the standards applicable to such uses will be appropriate in the immediate area of the land to be reclassified;

3. Whether the proposed change is in accord with any existing or proposed plans for providing public schools, streets, water supply, sanitary sewers, and other public services and utilities to the area; and 4. Any other factors which will substantially affect the public health, safety, morals, or general welfare.

In staff’s opinion, the proposed zoning classification of SR-15 provides the best fit for this municipal use and consistent with the Comprehensive Plan and the 2015 Future Land Use Plan; therefore, staff recommends approval.

Site History

The 100.29-acre site is currently undeveloped. The subject property is surrounded by the following land uses and zoning districts:

Conformance with the Comprehensive Plan

The subject property is designated as “low density residential” in the Future Land Use Plan. This land use category is intended to allow for residential with low density. The proposed zone change is compatible with future land use designation.

Conformance with the Thoroughfare Plan The subject site has access to County Road 48.

Conformance with the Unified Development Code

The lot dimensions meet the area regulations of the SR-15 zoning district.

Platting Status

The subject property is currently unplatted.

Impact on Existing and Future Development

The proposed zone change will have no negative impacts on the existing and future development.

Public Notification

Staff sent public notices, comment forms and a vicinity map to the applicant, the owner of the property and to property owners within 200 feet of the subject property under consideration for the zone change. Additionally, a legal notice of the public hearing was published in the local newspaper, and a notification sign was placed on the property by the applicant.

Public Input

Staff has not received any public feedback in support or opposition of the proposed zone change request at the time of this report.
