Purpose:

Approve Resolution 93-20 approving Application No. V-1435 by Northland Farm Systems, a request to allow a freestanding sign that is 233 square feet in size where only a 100 square foot freestanding sign is permitted in the B-2, Community Commercial District.

Staff recommends approval of this variance request by resolution as recommended by the Planning Commission by your approval of Resolution 93-20.

RESOLUTION NO. 93-20

A RESOLUTION APPROVING VARIANCE V-1435

WHEREAS, Northland Farm Systems, a request to allow a freestanding sign that is 233 square feet in size where only a 100 square foot freestanding sign is permitted in the B-2, Community Commercial District and legally described as follows;

and

WHEREAS, The Planning Commission held a public hearing on July 14, 2020 and recommended approval of V-1435; and

WHEREAS, on July 21, 2020, the City Council accepted and approved Variance V-1435, as the same was approved and recommended by the Planning Commission of the City; and

WHEREAS, the City Council concurs with all of the findings of the Planning Commission and hereby makes the identical findings as referenced in the V-1435 Staff Report.

NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Owatonna, Minnesota:

1. That said variance is in accordance with and conformity to the plans and regulations established by the City and the comprehensive plan for the development of the City.

2. That said variance be and the same hereby is approved with the following provisions:

a) A building permit shall be approved prior to construction of the sign.

b) The applicant will verify the property line during the footing inspection by exposing all property pins showing the entire property line.

c) All portions of the freestanding sign will meet the 5’ setback from the property line and be at least 400’ from a residential property.

d) The digital sign shall only advertise products sold on the property or through the dealership. No offsite advertising shall be permitted.

3. That the Clerk cause a certified copy of this resolution to be filed in the office of the County Recorder of Steele County, Minnesota.

Application Review:

Applicant/Owner: Northland Farm Systems

Location of Property: 2250 Austin Road

Zoning Map: B-2, Community Business District

Zoning Ordinance: Section 153.28 (A)(1)(c) states that a freestanding sign shall not exceed 100 square feet on the property.

Proposed Development:

♦ Application No. V-1435 by Northland Farm Systems, a request to allow a freestanding sign that is 233 square feet in size where only a 100 square foot freestanding sign is permitted in the B-2, Community Commercial District.

♦ The applicant would install a 35’ tall freestanding sign with two panels. The sign will have two cabinets. The Northland cabinet is 3’ x 20’ for 60 square feet. The digital display is 9’ x 19’ approximately for the 233 square foot total.

♦ The applicant is requesting to construct a larger freestanding sign due to the high speed along Highway 14.

♦ The property has frontage along 3 different streets. Code would permit them to have a freestanding sign on each one of these streets.

♦ As of this time the applicant only has two wall signs on the property. Both signs are the same and measure 6’ x 17’ or 102 square feet a piece. They are permitted within the wall sign ordinance.

♦ The applicant would like this sign to be considered similar to the Highway Business Sign Overlay district. In that district they would be permitted to 50’ in height and up to 500 square feet. This sign would then be permitted, however that district is only along I-35.

♦ The sign will need to be located a minimum of 5’ from any property line and over 400’ from any residential property.

♦ State Statute requires that the applicant show a practical difficulty in order to be granted a variance. You also need to show that the variance requested is the minimum amount necessary to accomplish what is needed.

♦ A variance must stand on its own merits and may not be compared to other situations in which variances were granted.

♦ The applicant has provided existing conditions photos that have been included in the report.

♦ According to the ordinance, the Planning Commission shall make findings of fact base on the following.

 That particular physical surroundings, shape, or topographical conditions of the specified parcel of land involved.

 That the condition involved is unique to the particular parcel of land involved.  That the alleged difficulty or hardship is caused by this Ordinance and has not

been created by any persons presently having an interest in the parcel.

 That the granting of the variation will not be detrimental to the public welfare or injurious to other land or improvements to the neighborhood.

 That the proposed variation will not impair an adequate supply of light and air to

adjacent property, or substantially increase the congestion of the public streets, or interfere with the function of the Police and Fire Departments of the City.

Staff Review:

Staff is recommending approval of the variance to allow a freestanding sign that is 233 square feet in size where only a 100 square foot freestanding sign is permitted with the following provisions:

Planning Commission:

Application No. V-1435, which is a request by Northland Farm Systems to allow a freestanding sign that is 233 square feet in size where only a 100 square foot freestanding sign is permitted in a B-2 Community Business District, was presented by Community Development Manager Greg Kruschke. (Refer to report on file.) Public hearing opened at 5:37 pm. Kelly Katzung, owner of Northland Farm Systems, was present, as well as the sign installer, to answer any questions the Commissioners may have. Public hearing closed at 5:38 pm. Eickhoff asked if there had been any feedback from neighbors. Kruschke said that he hasn’t heard anything on this request. Boeke clarified that they could put up three separate signs. Kruschke said yes, because of the property’s frontage on three streets. A motion was made by Boeke and seconded by Wilson to recommend
