Employee Responsibility

It is your responsibility to read, understand, and review this COVID-19 Policy, RLM’s Emergency Paid Sick Leave Policy, and Emergency Family and Medical Leave Policy.

Please address any questions or concerns regarding the adherence to this policy with your supervisor prior to signing. All staff should feel comfortable informing their supervisor or HR if they feel conditions at work and/or the actions of a coworker are not safe or putting them at risk.

This is a commitment to your personal safety, the safety of your fellow co-workers, and the safety of our guests

regarding the prevention and mitigation of COVID-19. By signing this form and/or providing electronic confirmation, you are agreeing to follow the rules below to keep yourself and others safe.

Information regarding COVID-19

COVID-19 is thought to spread mainly through close contact from person to person, including between people who are physically near each other (within about 6 feet). People who are infected but do not show symptoms can also spread the virus to others. We are still learning about how the virus spreads and the severity of illness it causes.

COVID-19 spreads very easily from person to person

How easily a virus spreads from person to person can vary. The virus that causes COVID-19 appears to spread more efficiently than influenza but not as efficiently as measles, which is among the most contagious viruses known to affect people.

COVID-19 most commonly spreads during close contact

• People who are physically near (within 6 feet) a person with COVID-19 or have direct contact with that person are at greatest risk of infection.

• When people with COVID-19 cough, sneeze, sing, talk, or breathe they produce respiratory droplets. These droplets can range in size from larger droplets (some of which are visible) to smaller droplets. Small droplets can also form particles when they dry very quickly in the airstream.

• Infections occur mainly through exposure to respiratory droplets when a person is in close contact with someone who has COVID-19.

• Respiratory droplets cause infection when they are inhaled or deposited on mucous membranes, such as those that line the inside of the nose and mouth.

• As the respiratory droplets travel further from the person with COVID-19, the concentration of these droplets decreases. Larger droplets fall out of the air due to gravity. Smaller droplets and particles spread apart in the air.

• With passing time, the amount of infectious virus in respiratory droplets also decreases.

COVID-19 can sometimes be spread by airborne transmission

• Some infections can be spread by exposure to virus in small droplets and particles that can linger in the air for minutes to hours. These viruses may be able to infect people who are further than 6 feet away from the person who is infected or after that person has left the space.

• This kind of spread is referred to as airborne transmission and is an important way that infections like tuberculosis, measles, and chicken pox are spread.

• There is evidence that under certain conditions, people with COVID-19 seem to have infected others who were more than 6 feet away. These transmissions occurred within enclosed spaces that had inadequate ventilation.

Sometimes the infected person was breathing heavily, for example while singing or exercising.

• Under these circumstances, scientists believe that the amount of infectious smaller droplet and particles produced by the people with COVID-19 became concentrated enough to spread the virus to other people. The people who were infected were in the same space during the same time or shortly after the person with COVID- 19 had left.

• Available data indicate that it is much more common for the virus that causes COVID-19 to spread through close contact with a person who has COVID-19 than through airborne transmission.

COVID-19 spreads less commonly through contact with contaminated surfaces

• Respiratory droplets can also land on surfaces and objects. It is possible that a person could get COVID-19 by touching a surface or object that has the virus on it and then touching their own mouth, nose, or eyes.

• Spread from touching surfaces is not thought to be a common way that COVID-19 spreads.

Watch for symptoms

People with COVID-19 have had a wide range of symptoms reported – ranging from mild symptoms to severe illness.

Symptoms may appear 2-14 days after exposure to the virus. People with these symptoms may have COVID-19**:

• Fever or chills

• Cough

• Shortness of breath or difficulty breathing

• Fatigue

• Muscle or body aches

• Headache

• New loss of taste or smell

• Sore throat

• Congestion or runny nose

• Nausea or vomiting

• Diarrhea

**Please inform your supervisor and call your health care provider for direction as soon as possible if you have any of the above symptoms before coming to work. Once you have talked to your healthcare provider, contact HR.

COVID-19 Prevention Standards Social (or Physical) Distancing

Social distancing means keeping space between yourself and other people outside of your home. To practice social or physical distancing:

Stay at least 6 feet (2 meters) from other people at all times, when practical

Avoid gathering in groups more than 10 people

Stay out of crowded places and avoid mass gatherings

We highly recommend direct deposit for future checks and verifying your mailing address is accurate.

Employees are expected to work in isolation as much as practical at this time. If you do need to talk to fellow employees, please keep at least 6-8 feet of distance in all directions. If you cannot meet this expectation, we require that you use a cloth face covering for your safety, but also for the safety of others.

Employee common areas are not to be used for gathering. If you are using a common space to access supplies or kitchen appliances, you should disinfect any touched surfaces before and after use and then wash your hands. There is hand sanitizer available in all common workspaces. When possible, employees should be assigned their own tools, equipment, vehicle, etc. Limiting shared spaces, tools, and equipment is essential during this time.

Personal Hygiene

Wash your hands with soap and water for at least 20 seconds OFTEN. Use a single use paper towel to dry your hands and throw in the trash. Use of re-usable towels is discouraged during this time. Avoid touching your eyes, nose, and mouth with unwashed hands.

You should wash/sanitize your hands after the following (including but not limited to):

• Before and after opening/closing the gate

• Once you arrive to work

• After blowing your nose, coughing, or sneezing

• After using the restroom

• Before and after entering a company vehicle

• After removing face mask/covering

• After accepting product, paper, or materials from someone

• Before and after using any shared spaces (vehicles, tool use, copiers, kitchen spaces, etc.)

• After you throw used tissues in the trash

If soap and water are not readily available, use a hand sanitizer that contains at least 60% alcohol. Cover all surfaces of your hands and rub them together until they feel dry for at least 20 seconds.

Cleaning and Disinfecting

Cleaning refers to the removal of germs, dirt, and impurities from surfaces. It does not kill germs, but by removing them, it lowers their numbers and the risk of spreading infection. Disinfecting refers to using chemicals, for example, EPA- registered disinfectants, to kill germs on surfaces. This process does not necessarily clean dirty surfaces or remove germs, but by killing germs on a surface after cleaning, it can further lower the risk of spreading infection.

Employees should practice routine cleaning and disinfecting of frequently touched surfaces. Times to clean and disinfect surfaces include, but are not limited to, before and after using:

• any shared spaces (bathrooms, kitchen, break rooms, vehicles)

• any shared tools, gas handles, computers, phones, radios etc.

• frequently touched shared surfaces (tables, doorknobs, light switches, handles, desks, toilets, faucets, and sinks)

To disinfect:

1. Spray on surface – wait cure time – 5 minutes

2. Spray on surface, wipe down with paper towel, throw single use paper towel away

Use a single use paper towel for cleaning and disinfecting. If you use a common spray disinfectant bottle, you need to wash your hands after use. RLM will provide cleaning and disinfecting products. Please contact Facilities for product and refer to the Safety Data Sheet provided to understands hazards of this chemical.

Face Covering

Face coverings are used to slow the spread of the virus and help people who may have the virus and do not know it from transmitting it to others. Face covering is required indoors or if you must get closer than 6 feet to people or have

frequent interactions with guests. Read the CDC recommendations for cloth face covering use:

Face coverings will be provided by RLM. Employees are also permitted to provide their own if they meet the

specifications provided by the CDC. Face coverings must be washed by an employee using a washing machine or hand washed with bleach regularly.

Employee Transportation

Red Lodge Mountain recommends employees do not ride with other individuals outside their family/housing unit. This is defined as coming/going from work and within the workday. Where possible, vehicles should be assigned to an

individual. If you are using a company vehicle, please read and follow COVID-19 JHA for transportation. Ask your supervisor for a copy if you do not have one to date. If employees are sharing a vehicle, they should clean and disinfect prior to use. Employees riding together in a company vehicle for 15 minutes or more are required to wear face coverings during the entire duration of the transport. After arriving at the destination, employees should clean and disinfect touched vehicle surfaces and then wash their hands.

Manager/Supervisor Requirements

Additionally, mangers/supervisors are responsible for the following:

1. Check in with direct reports daily at the beginning of the shift to ensure they are not experiencing COVID-19 symptoms.

2. Notify HR immediately if employee is showing or has notified you that they are experiencing COVID-19 symptoms.

3. Update JHA’s to include specific Department COVID-19 preventative and mitigative measures.

4. Ensure employees have proper cleaning and disinfecting equipment for their hands and for frequently touched items. Ensure employees have personal paper towel rolls available.

5. Ensure employees understand the hazards and first aid measures of the disinfectant product.

6. Provide employees with face covers and other PPE as needed.

7. Provide the space, tools, and resources for employees to abide by this policy.

8. Notify HR immediately if employee is eligible for paid leave as it relates to the FFCRA.

9. Provide contact information to your employees, so they can reach you regarding COVID-19 issues.

COVID-19 Reporting Standards

Employee – Child Care Reporting

If you need to care for your child whose school or childcare provider is closed or unavailable for reasons related to COVID-19, you are eligible for E-FMLA (10 weeks at 2/3 of your regular rate). You must notify your supervisor/HR if this is the case. Please complete the E-FMLA form.

Weeks/days do not need to be consecutive. There are options to move salaried employees to hourly, for those who need to take less than a full week at a time. Employees are discouraged from bringing their children to work for a prolonged period of time during their work day.

Employee – Symptoms or Confirmed Cases Reporting

Employees must ensure to the greatest possible extent that they are healthy before entering the workplace. If you feel unwell or you experience a fever, chills, cough, or any signs of illness, please stay home. If you feel sick at work, go home, notify your supervisor immediately, and call your doctor or local health authority.

• Employees are required to notify their supervisor/HR immediately if they are experiencing symptoms of COVID-19.

• Employees are required to notify their supervisor/HR if they have been in close contact with another person (i.e. a family member, friend, co-worker) who has tested positive for COVID-19.

• Employees are required to notify their supervisor/HR if they have been in close contact with another person (i.e. a family member, friend, co-worker) who has been told by a medical professional to quarantine due to COVID-19.

If you qualify for any of the leave reasons related to COVID-19 under Families First Coronavirus Response Act (FFCRA) listed below, you are required to notify your supervisor/HR and complete an E-FMLA Request Form.

Employee is scheduled to work and employee:

1. Is subject to a Federal, State, or local quarantine or isolation order related to COVID-19 (this does not apply to the general shelter in place recommendation from the state)

2. Has been advised by a health care provider to self-quarantine related to COVID-19;

3. Is experiencing COVID-19 Symptoms and is seeking a medical diagnosis;

4. Is caring for an individual subject to an order described in (1) or self-quarantine as described in (2);

FFCRA Emergency Paid Sick Leave Policy (effective April 1, 2021)

The Company provides employees with emergency paid sick leave under certain conditions.

Eligibility

All employees are eligible for emergency paid sick leave.

Reason for Leave

You may take emergency paid sick leave if you are unable to work (or work from home) because:

1. You are subject to a federal, state, or local quarantine or isolation order related to COVID-19.

2. You have been told to self-quarantine because you have COVID-19, may have COVID-19, or are particularly vulnerable to COVID-19.

3. You are experiencing symptoms of COVID-19 and are seeking a medical diagnosis; you are seeking or awaiting the results of a diagnostic test for, or a medical diagnosis of, COVID-19 because you have been exposed or because the Company has requested the test or diagnosis.

4. You are obtaining a COVID-19 vaccination or recovering from any injury, disability, illness, or condition related to the vaccination.

5. You are caring for an individual who has been ordered or advised to quarantine by a government agency or health care provider.

6. You are caring for a child whose school or place of care is closed, or whose childcare provider is unavailable, due to COVID-19 precautions.

Duration

Full time employees are eligible for 80 hours of leave.

Part-time employees are eligible for the number of hours they work, on average, over a two-week period.

Compensation

Leave will be paid at your regular rate of pay, subject to a limit of $511 per day when leave is taken for reasons 1, 2, or 3.

Leave will be paid at 2/3 of your regular rate of pay, subject to a limit of $200 per day when leave is taken for reasons 4 or 5.

Leave Rules

You may elect to use emergency paid sick leave before using any other accrued paid leave.

This bank of emergency paid sick leave is available for use between April 1, 2021, and September 30, 2021.

Leave provided by the Company prior to April 1, 2021, will not count against the EPSL leave available to you between April 1, 2021 and September 30, 2021.

Employees will receive only one bank of hours, though it can be used on more than one occasion.

The Company, as a small business with fewer than 50 employees, may need to deny otherwise qualifying leave for reason #5 under this policy if granting such leave would jeopardize the viability of the Company’s business as an ongoing concern. The Company may deny leave when:

Such leave would cause the Company’s expenses and financial obligations to exceed available business revenue and cause the Company to cease operating at a minimal capacity;

The absence of the employee or employees requesting such leave would pose a substantial risk to the financial health or operational capacity of the Company because of their specialized skills, knowledge of the business, or responsibilities; or

The Company cannot find enough other workers who are able, willing, and qualified and who will be available at the time and place needed, to perform the labor or services the employee or employees requesting leave provide, and these labor and services are needed for the small employer to operate at a minimum capacity.

Expiration

This policy expires on September 30, 2021.

FFCRA Emergency Family and Medical Leave Policy (effective April 1, 2021)

Eligibility

All employees who have worked for the company for 30 days are eligible for EFMLA.

Reason for Leave

You may take EFMLA if you are unable to work (or work from home) because:

1. You are subject to a federal, state, or local quarantine or isolation order related to COVID-19.

2. You have been told to self-quarantine because you have COVID-19, may have COVID-19, or are particularly vulnerable to COVID-19.

3. You are experiencing symptoms of COVID-19 and are seeking a medical diagnosis; you are seeking or awaiting the results of a diagnostic test for, or a medical diagnosis of, COVID-19 because you have been exposed or because the Company has requested the test or diagnosis.

4. You are obtaining a COVID-19 vaccination or recovering from any injury, disability, illness, or condition related to the vaccination.

5. You are caring for an individual who has been ordered or advised to quarantine by a government agency or health care provider.

6. You are caring for a child whose school or place of care is closed, or whose childcare provider is unavailable, due to COVID-19 precautions.

Duration

You are eligible for up to 12 weeks of EFMLA at your usual number of hours per week.

Compensation

Leave will be paid at 2/3 of your regular rate of pay, subject to a limit of $200 per day, regardless of the reason for leave.

Leave Rules

This bank of emergency family and medical leave is available for use between April 1, 2021, and September 30, 2021.

Leave provided by the Company prior to April 1, 2021—including previous EPSL and EFMLA—will not count against the EFMLA leave available to you between April 1, 2021 and September 30, 2021.

Employees will receive only one bank of EFMLA hours, though it can be used on more than one occasion.
