This document forms part of the Insurance Contract entered into with the Estonian branch of UAB DK “PZU Lietuva” (hereinafter PZU*). In matters not regulated hereunder, the Parties to the Insurance Contract shall be governed by the Law of Obligations Act and other legislation.

1. General terms and conditions

1.1 Insurer

The Insurer is the Estonian branch of UAB DK “PZU Lietuva” (hereinafter referred to in these Terms and Conditions as PZU), with registered office at Pärnu mnt 141, 11314 Tallinn, Estonia, which has the right to engage in insurance activities pursuant to the procedure provided by law.

1.2 PZU's authorised assistance and service company

PZU's authorised assistance and service company Coris International (hereinafter Assistance and Service Company), (telephone +371 6733 4065, e-mail coris@corisriga.lv) is an international medical aid organisation that is authorised by PZU to organise medical care pursuant to the procedure prescribed by these Insurance Terms and Conditions.

1.3 Policyholder

The Policyholder is a legal or natural person, who enters into the Contract with PZU under these Terms and Conditions and who has the obligation to pay the insurance premium.

1.4 Insured

The Insured is the person stated in the Policy. The insured can be a person of up to 75 years of age whose permanent residence is in Estonia. A person belonging to the age group of 65 to 75 years of age is insured provided that the person has a valid medical certificate according to which travelling is not contraindicated. The Insured must be in the territory of Estonia at the moment of entering into the Insurance Contract except when it comes to the renewal of the Insurance Policy and the consent of PZU has been obtained thereto in advance.

1.5 Beneficiary The Beneficiary is: the Insured;

the medical facility where immediate medical care is provided to the Insured;

the successors or the persons specified by name in the Policy upon the death of the Insured. 1.6 Insurance Contract

Insurance Contract (hereinafter the Contract) is a written agreement entered into between PZU and the Policyholder under these Terms and Conditions and the current legislation, pursuant to which the Policyholder undertakes to pay the insurance premium stated in the Contract and PZU undertakes to provide the insurance cover prescribed by these Terms and Conditions and perform the obligations under the Contract in accordance with the provisions of the Contract.

The Contract shall be deemed to be entered into when the Policyholder accepts these Travel Insurance Terms and Conditions and confirms it by payment of the insurance premium.

1.7 Term of Insurance Contract

The insurance cover becomes effective at 00:00 on the day stated in the Policy, but not before payment of the insurance premium, and is effective continuously for the number of days stated in the Policy, and terminates on the last day at 24:00.

If returning to Estonia from a trip is delayed due to an insured event of travel failure, all the periods of insurance covers of the respective Contract automatically extend by 48 hours provided that the Contract includes travel failure insurance.

1.8 Geographical scope of insurance cover

The insurance cover is effective in Europe or in the whole world, except in the country of permanent residence of the Insured. As an exception, the country of residence is deemed to be included in the geographical scope of the insurance cover in the event of trip cancellation or if being late for a trip is caused due to an unexpected and unforeseeable event which has occurred in the country of residence and which is defined in the Insurance Terms and Conditions. The geographical scope of the insurance cover is stated in the Policy.

1.9 Insured event

Insured event is an unexpected and unforeseeable event which has occurred during the term of the Contract and is defined in the Insurance Terms and Conditions (loss event), as a result of which the Inured or the Policyholder becomes entitled under the Contract to receive the insurance indemnity and PZU becomes obliged to pay the insurance indemnity.

1.10 Sum insured

Sum insured is an agreed monetary amount stated in the Contract which is the upper limit of the insurance indemnity per one insured event.

1.11 Indemnity limit

Indemnity limit is the maximum amount of the insurance indemnity during the insurance period stated in the Policy. The indemnity limit applies to each Insured separately.

1.12 Multiple insurance

Multiple insurance is a situation where the risk related to the Insured Person is partly or fully insured with several insurers and the total amount of indemnities payable by the insurers exceeds the amount of damage. In the case of multiple insurance, the insurers shall be liable as joint and several obligors.

1.13 Trip

A trip is deemed to mean the travelling of the Insured from Estonia to another country in order to stay there temporarily. Settling permanently in another country or living permanently in another country by the Insured shall not be deemed as a trip.

The starting point of a trip shall be in Estonia. A trip is deemed to begin when the Insured enters the means of transport of regular services (plane, train, bus, ship) by which the Insured intends to leave Estonia. If the Insured leaves Estonia by a means of transport, which is not a means of transport of regular services (car, bus, water craft, plane, etc.), on foot or by bike, the trip is deemed to begin upon crossing the Estonian border post on land or upon leaving the territorial waters or airspace of Estonia.

A trip is deemed to end upon arrival of the Insured in Estonia. 1.14 Baggage

Baggage is deemed to mean items taken along for the trip and bought during the trip. Baggage is covered as a whole, regardless of the number of baggage units.

1.15 Deductible

Deductible is an amount of money stated in the Contract which shall be covered by the Policyholder in the case of any insured event.

2. Medical insurance

2.1 An insured event of medical insurance is an unexpected and unforeseeable accident defined in the Insurance Terms and Conditions or an illness outside the country of permanent residence.

2.1.1 The following shall be regarded as an accident:

An unexpected and unforeseeable event occurring during the trip where an external and/or violent force against the will of the Insured causes damage to the health of the Insured as a result of which medical care is provided to the Insured no later than within 7 days after the injury or the Insured has died.

Infectious diseases if the Insured catches an infection through a wound resulted from an accident;

Random acute poisoning caused by exposure to poisonous plants, insects or animals, household chemicals, ingested tainted food products (with the exception of alcohol poisoning, narcotic substances, medications);

Heatstroke, sunstroke, freezing, drowning.

2.1.2 Unexpected deterioration of the health status of the Insured is deemed to be an unexpected illness if the

primary symptoms occur during the trip and the Insured needs emergency medical care outside the country of permanent residence for their treatment.

2.2 The following expenses are indemnified in the case of an insured event covered by medical insurance: Expenses on hospital care for up to 30 days if medical examination or treatment of illness or injury is prescribed by a physician who is licensed and registered in the respective country;

Necessary and reasonable examinations prescribed by a host country physician during the trip for making a diagnosis if these have been approved by PZU or the Assistance and Service Company in advance;

Unexpected complications related to pregnancy which occur for the first time before the 28th week of pregnancy; the one-time maximum indemnity limit is up to 1300 euros on the basis of a presented expense receipt;

Expenses on the purchase of prescription medications prescribed by a physician;

Emergency dental treatment to eliminate unexpected acute dental pain and/or local anaesthetics, up to 100 euros per insured event. Maximum two (2) insured events are indemnified during one insurance period on the basis of presented expense receipts;

If such a need is caused by an accident, the maximum indemnity limit for the cost of acquisition of medical aids (including a splint, support bandage, walking stick, crutches and glasses) is up to 100 euros per insured event. Maximum two (2) insured events are indemnified during one insurance period on the basis of presented expense receipts.

Unavoidable and reasonable transport and accommodation costs of the Insured for the return of the Insured to the country of residence, provided that these have been approved by PZU in advance.

If the health status of the Insured requires the return of the Insured to the country of permanent residence, PZU shall indemnify, if necessary, unavoidable and reasonable transport and accommodation costs of one person accompanying the Insured, provided that these have been approved by PZU in advance.

In the case of death of the Insured PZU organises and indemnifies the cost of transport of the deceased to the country of permanent residence with an indemnity limit of 5000 euros or indemnifies 2500 euros as burial or cremation costs of the deceased (excluding the costs of the funeral feast) abroad.

Only authorised physicians of the Assistance and Service Company and PZU have the right to decide whether return to the country of permanent residence is necessary or unavoidable and how it should be arranged. If authorised physicians of PZU or the Assistance and Service Company deem repatriation to be necessary or unavoidable and the Insured refuses to repatriate, PZU has the right to refuse to indemnify any subsequent damages.

2.3 When is medical cover not effective?

The events listed below and the costs related thereto are not subject to be indemnified: 1) trips undertaken for the purpose of medical treatment or medical examinations;

2) illnesses that have started before the trip and illnesses that have not been cured by the first day of the trip and from the medical point of view are a contraindication to travelling by the chosen means of transport;

3) illnesses, traumas and health disorders of the Insured which required in-patient hospital treatment during the last 6 months before the trip;

4) chronic diseases of the Insured and costs related to their treatment, excluding measures to save the life of the Insured;

5) oncologic diseases and costs related to their treatment, excluding costs incurred upon making the initial diagnosis;

6) mental disorders of the Insured, including diseases related to depression and costs for their treatment; 7) costs related to pregnancy or childbirth, their complications and consequences, excluding unexpected complications related to pregnancy that occur for the first time before the 28th week of pregnancy and are related to saving the health or life of the unborn child or the future mother;

8) costs related to the performance of abortion and consequences thereof unless such abortion was unavoidable due to an accident or unexpected illness in order to save the life of the Insured; 9) expenses related to in vitro fertilisation, treatment of infertility or prevention of pregnancy; 10) sexually transmitted diseases, including AIDS;

11) hydrotherapy, heliotherapy, cosmetic therapy and plastic surgery; 12) vaccination;

13) expenses on prosthetics, on acquisition of prostheses or orthopaedic appliances, as well as expenses on acquisition of hearing aids, etc.;

14) expenses on vision aids (glasses, frames of glasses, contact lenses, etc.) and medications (eye drops etc.), excluding aids and medications prescribed as a result of an accident;

15) stomatologic treatment, excluding unavoidable dental care;

16) expenses on medical treatment and care unless unavoidable and/or resulting from an unexpected and unforeseeable accident or loss event;

17) traumas occurring as a result of a disease (paralysis, convulsions, mental and memory disorders, etc.); 18) use of treatment methods not accepted by official medicine;

19) any impact of radiation sources; consequences of alcoholism or state of intoxication (alcohol content in blood exceeds the norms of the host country – ‰), and also the consequences of use of narcotic or toxic substances;

20) deliberate acts of the Insured and consequences thereof, including a suicide or an attempted suicide; 21) costs related to betting and consequences thereof;

22) costs related to violations of law, fights or consequences thereof, excluding cases of legitimate self-defence;

23) accidents caused by practising, trainings or competing in the following sports activities: motor sports (car, motorbike or any other mechanical vehicle), all fields of aerosports (including parachuting and bungee jumping, air racing, etc.), alpinism, mountaineering, speleology, scuba diving, diving deeper than 40m, triathlon, extreme sports, snowmobile riding, downhill skiing and snowboarding outside the marked trails of winter sports centres;

24) accidents and illnesses caused by practising, trainings or competing in the following sports activities: bicycle sport, handball, field hockey, horse riding, water sports activities, diving 10m to 40m, fencing, volleyball, basketball, baseball, diving, shooting, winter sports activities, downhill skiing and snowboarding outside the marked trails of winter sports centres, excluding amateur practising in these activities or provided that a special agreement is entered in the Contract (stated as sports A; sports B in the Policy) and additional premium has been paid; soccer, American football, heavy athletics, ice hockey, unless written consent has been obtained from PZU.

25) accidents related to professional practising of sports;

26) trips undertaken for the purpose of working, when performing physical work, unless a corresponding additional premium has been paid therefor;

27) accidents and illnesses caused by any kind of military exercises, games and participation in direct military action;

28) events that have occurred upon the violation of travel terms established by the travel agency; 29) war with a foreign country or civil war, riots, civil unrest, acts of terrorism, diversion, strikes or

explosions;

30) consequences of epidemics, environmental pollution and natural disasters that were know before going on a trip and in the countries against which the Ministry of Foreign Affairs of Estonia or the tour operator has warned;

31) non-compliance with the safety requirements in force in the country of destination or transit when the Insured with the normal baggage of knowledge understood or should have understood the consequences of arrival of, or either intentionally or unintentionally admitted the arrival of, the act, which led to the illness, health disorder or death of the Insured;

32) PZU shall not be liable for any damage due to defective or incompetent medical care caused by a service provider or a service provider’s partner.

3. Baggage insurance

3.1 The following are the insured events covered by baggage insurance: Theft and robbery of baggage;

Damage to or loss of baggage due to the fault of the transport company;

Damage to or destruction of baggage in connection with an accident or due to forces of nature; Delay of baggage due to the fault of the transport company.

3.1.1 Baggage loss is indemnified upon the arrival of an unexpected and unforeseen insured event. PZU shall

indemnify for the damage if:

1) proper supervision of the baggage was ensured during the theft or robbery of the baggage;

2) the baggage was stolen from a vehicle that was properly locked and alarm system activated and in which the items were not in a visible place;

3) the baggage was stolen from a properly locked room of a hotel or motel (accommodation room); 4) damage for the loss of baggage due to the fault of the air transport company shall be indemnified by

PZU to the extent not indemnified by the airline;

5) the indemnification obligation applies to photo, film and video cameras, mobile phones and travel documents only if these are under the direct supervision of the Insured or in a guarded baggage room or storage room. The above items are not covered by the insurance if they are in a room of a hotel or motel (accommodation rooms), in the cabin, sleeper, baggage or cargo room of a plane, bus, train or ship;

room;

7) when determining the sum insured, damage shall be assessed on the basis of the value of the baggage at the moment of occurrence of the insured event, but not in excess of the sum insured stated in the Contract;

8) PZU shall indemnify for the costs of obtaining new documents to replace the passport or identity card, driver's licence or technical passport stolen from the Insured or lost during a trip abroad if the costs are certified by an official report and the original invoice to the extent of reasonable expenses; this indemnity shall be paid under the baggage insurance cover;

9) if baggage is delayed, PZU shall indemnify for the costs of buying utility articles that are indispensable during the trip and are related to the intended purpose of the trip (including necessary clothes, footwear) on the basis of expense receipts to the extent of up to 35 euros per day if baggage is delayed to the destination in a foreign country due to the fault of the transport company for more than 2 hours, but not more than 200 euros per insured event; if baggage is delayed, deductible is not applied and the indemnity limit is not reduced;

10) the limit of indemnity payable for a single item is 50% of the sum insured of the baggage insurance and the value of each item is its value prior to the loss event taking account of the condition and wear and tear of each item;

11) the deductible for a damaged or broken suitcase, travel bag or such other carrying bag is 20 euros; 12) PZU shall choose the manner of indemnifying for the damage and PZU has the right to replace an

item with an equivalent item.

3.2 The following items are not covered by baggage insurance: 1) handicrafts;

2) musical instruments, pieces of art and antiquities;

3) animals, birds, fish and insects, and their grooming and walking equipment, animal products and furs, etc.;

4) land vehicles or means of transport, water craft and aircraft;

5) tickets, keys, cash or payment instruments substituting cash (bank debit or credit card, coupon for using a service, ski slope ticket, etc.), securities, precious stones and metals, jewellery, collections, seals, weapons and ammunition, software and hardware (programmes and technical equipment); 6) property dispatched as goods or dispatched before the beginning of the trip;

7) foodstuffs, beverages, tobacco products and intoxicants; 8) goods and samples of goods, advertising and training materials; 9) glasses, sun glasses and contact lenses;

10) hearing aids, dental prostheses, prosthetic hands and legs;

11) items which are insured according to other principles and by specially adapted insurance products (e.g. motor vehicle insurance, property insurance, liability insurance, electronic equipment insurance etc.);

12) items subject to rules restricting import or export or which are prohibited or protected by international agreements (e.g. protected species subject to conservation acquired during the trip: animals, birds and plants, and parts or organs thereof, archaeological fragments, pieces, rocks etc.).

3.3 No indemnity shall be paid if damage is caused by the following:

1) baggage or personal belongings are unsupervised, lost or left behind;

2) ordinary use, wear and tear, scratching, tearing and natural qualities of baggage or personal belongings;

3) in consequence of deliberate action or state of intoxication of the Insured; 4) contact of items with smearing or corrosive substances in the baggage; 5) breakage of fragile items (items of ceramics, glass, porcelain, etc.); 6) activities of authorities;

7) theft from unlocked or unsupervised room or other room, tent, balcony;

8) theft of baggage from the passenger compartment (vehicle cabin) of a vehicle which was properly locked and alarm system activated if the items were in a visible place.

4. Travel failure

4.1 The insured events of travel failure insurance are trip cancellation and trip interruption.

Upon the cancellation of trip, PZU shall indemnify the Insured for the direct material damage caused by the cancellation of the trip to the extent of the sum insured.

Upon the interruption of trip, PZU shall indemnify the Insured for unavoidable travel and accommodation costs to the extent of the sum insured.

4.2 Reasons for cancellation, interruption of trip:

Unexpected and unforeseeable accident, illness or death of the Insured's spouse, cohabitee, close relatives, children or persons under the legal care of the Insured or the direct travel companion with whom they have a

common travel package.

A serious illness or bodily injury is deemed to mean medically certified damage to health due to which the Insured could not go on the trip.

Delayed arrival at the starting point of the trip or for a transit flight:

1) a delay in or cancellation of regular means of transport (aircraft, ship, bus or train connection) due to weather conditions or technical malfunction (except for hydrofoils);

2) serious damage unexpectedly caused to the property of the Insured before the beginning of the trip due to which personal presence of the Insured is indispensable (burglary in the place of residence, fire, water accident, natural disaster, etc.);

3) the vehicle that is used for driving to the starting or transit point of the trip becomes involved in a traffic accident;

4) the cheapest option to reach the destination was used upon changing tickets;

5) if the Insured misses the trip due to delayed arrival at the starting point of the trip, PZU shall pay for the actual cost of the missed trip (subject to the limit per each Insured specified in the Insurance Policy).

4.3 The insurance cover for travel failure is not effective in the following cases:

1) travel failure was foreseeable and the Policyholder or the Insured would have been able to avoid the event or reduce the damage;

2) circumstances, of which the Policyholder or the Insured was aware before the occurrence of the loss event, but of which they failed to notify the tour operator and PZU;

3) illnesses, traumas and health disorders of the Insured which required in-patient hospital treatment during the last 6 months before the trip;

4) in the case of chronic illnesses of the Insured or the Insured's family member or travel companion which was previously known;

5) mental disorders, including depression and related diseases, stress, phobias of the Insured or the Insured's family member or travel companion;

6) pregnancy of the Insured or the Insured's family member or travel companion and events related to pregnancy. This condition does not apply to family members of a pregnant woman should there appear pregnancy-related complications or a life-threatening condition which requires the presence of family members;

7) loss caused when using air transport if the period of time between the time of arriving at the starting or transit point of the trip and the time of departure therefrom by plane did not correspond to the minimum period of time prescribed by the tour operator;

8) travel failure damage which occurred less than 72 hours after payment of the insurance premium.

5. General exclusions

1) illnesses, traumas and health disorders of the Insured which required in-patient hospital treatment during the last 6 months before the trip;

2) chronic diseases of the Insured and costs related to their treatment, excluding measures to save the life of the Insured;

3) mental disorders of the Insured, including diseases related to depression and costs for their treatment; 4) costs related to pregnancy or childbirth, their complications and consequences, excluding unexpected complications related to pregnancy that occur for the first time before the 28th week of pregnancy and are related to saving the health or life of the unborn child or the future mother;

5) intangible damage, moral damage, loss of profit, time spent, indirect expenses;

6) damage caused due to deficient travel documentation or deficient execution thereof or lack of a visa for the country of destination or transit;

7) expenses compensated for by the transport company responsible for the delay in or cancellation of the trip;

8) damage caused due to wrongful behaviour of the Insured, including delay in arrival, which the Insured could have avoided, considering the circumstances which the Insured knew or should have known (travel itinerary, weather conditions, traffic conditions, etc.);

9) violation of traffic rules, unauthorised intervention in the driver's activity;

10) property damage or personal injury caused intentionally to the Insured himself or herself, their family members or travel companions;

11) damage caused by the Insured to a third person: liability damage, property damage or personal injury;

12) events due to violation of travel conditions of the transport company;

13) dangerous sports activities (including parachuting and bungee jumping, mountain and cave trips, rock climbing, auto racing, motorcycle sports and diving deeper than 40 m) and events caused by participation in training related thereto;

14) baggage delay upon return of the Insured to the place of residence;

15) events caused by radiation classified directly or indirectly as ionizing pursuant to law or by nuclear energy;

16) events directly or indirectly related to war, civil war, combating, rebellion, riot, civil unrest or strike; 17) damages indemnified by another insurance, e.g. insurance of the transport company;

18) items removed from baggage during the security check (technical equipment and electronic devices, manicuring tools, fragrances and lotions and other such items) which removal was related to security considerations in order to ensure the safety of passengers, regardless of whether the person knew or became aware of it during the security check;

19) items subject to rules restricting import or export or which are prohibited or protected by international agreements (e.g. protected species subject to conservation acquired during the trip: animals, birds and plants, and parts or organs thereof, archaeological fragments, pieces, rocks etc.);

20) damage to items precluded for storage in a guarded baggage room;

21) loss due to bankruptcy, strike or interruption of work of travel company or transport company; 22) if the Insured gives false statements and provides incorrect information in the event of an insured

event;

23) PZU has no obligation to indemnify for the contractual penalties under the contract entered into between the traveller and the tour operator.

6. Claims for damages

6.1 The Insured is obliged to notify PZU of a possible insured event at the first opportunity in person or through a representative at the following contacts:

Contact the nearest medical facility for assistance in the case of an unexpected health disorder. Pay the primary medical expenses if possible. In a situation where a hospital or medical facility requires a guarantee of insurance, the Insured must immediately contact PZU or the Assistance and Service Company.

The Insured shall ensure that the authorised physicians of PZU and the Assistance and Service Company have access to the necessary medical information and medical history concerning the Insured.

Present the following documents when applying for an indemnity: 1) duly completed statement of loss or claim for damages; 2) identity document;

3) invoices for costs certifying the expenses of the Insured;

4) medical certificate or an extract from the medical history if necessary;

5) depending on the nature of the case, a statement of the state law enforcement agency or a registered report (police etc.) confirming the occurrence of the event and initiation of procedural acts; death certificate in the event of death.

6.3 In the case of baggage insurance loss event

Present the following documents when applying for an indemnity: 1) duly completed statement of loss or claim for damages; 2) identity document;

3) invoices for costs certifying the expenses of the Insured;

4) statement of the law enforcement agency or registered report (police statement, court judgment etc.) of the state where the loss event occurred confirming the occurrence of the event and initiation of procedural acts in connection with theft or robbery of baggage (in English, German, Spanish, French, Finnish, Russian or Estonian, if possible);

5) invoice received on purchase of the item (in the absence thereof PZU determines the damages on the basis of the average market price of the item or the lowest price for its acquisition);

6) written report of the transport company in the event of breakage or delay of baggage;

7) depending on the nature of the case, a statement of the state law enforcement agency or a registered report (police etc.) confirming the occurrence of the event and initiation of procedural acts;

8) other documents certifying the basis and extent of the claim for damages;

9) import and export licences confirmed by the customs authority in the case of items which import and export are not restricted by laws of the countries of origin or location (except if the trip took place in the European Union countries and it is not contrary to the legislation of the countries of origin and transit and Europe).

6.4 In the case of travel failure loss event

1) duly completed statement of loss or claim for damages; 2) identity document;

3) invoices for costs certifying the expenses of the Insured; 4) copy of the payment order or bank account statement;

5) medical certificate about the illness of the Insured or his or her family member;

6) a certificate of the transport company upon a delay in or cancellation of a means of transport; 7) depending on the nature of the case, a statement of the state law enforcement agency or a registered

report (police etc.) confirming the occurrence of the event and initiation of procedural acts; 8) other documents certifying the basis and extent of the claim for damages.

6.5 Procedure for disbursement of PZU's insurance indemnity

PZU shall indemnify for the damage within up to 30 days after the receipt of all the required documents to the extent of the identified damage and within the maximum limit of the sum insured.

PZU shall indemnify the Insured for the costs reasoned by the insured event for which the Insured is not entitled to receive compensation from other persons (e.g. the airline, health insurance fund). In the event of double insurance the insurance companies shall indemnify for the damage jointly and severally.

PZU shall not be liable if the performance of its obligations under the Contract is delayed or hindered due to strikes, explosions, mutinies, public disturbance, uprisings, restriction of freedom of movement, sabotage, terrorist acts, consequences of a war with a foreign country or civil war, radioactive contamination or due to any other unforeseen and extraordinary circumstances.

7. Other terms and conditions

7.1 Cancellation of Insurance Contract

7.1.1 Upon cancellation of the Insurance Contract the Policyholder shall be returned the insurance premium paid

thereby less a fee for the covered risk in conformity with the procedure established by the Insurer and 25% to cover handling costs of the Insurer.

7.1.2 The insurance premium shall not be returned if an indemnity has been paid or a claim for indemnification

for damages has been submitted to the Insurer under the Insurance Contract.

7.1.3 No insurance premium shall be returned in the event of cancellation of contracts entered into for multiple

trips or on discounted or campaign terms (e.g. packages for the youth of up to 30 years of age) if the request for cancellation is submitted after the insurance cover has become effective.

7.2 Recourse

7.2.1 All the rights of the Insured to claim indemnification for the caused damage from third persons shall

transfer to PZU to the extent of the indemnity paid and services provided to the Insured.

7.2.2 PZU shall retain the right to claim the return of the paid indemnity if circumstances appear which under

these Terms and Conditions release PZU from the obligation to provide medical care to the Insured and indemnify the Insured for the expenses incurred. In such case the Insured is obliged, within 14 days after the appearance of such circumstance, to return to PZU the expenses already incurred by PZU and the indemnity already paid by PZU as well as the expenses incurred for the establishment of the circumstances of the insured event. If the Insured or the Beneficiary delays with repayment, they must pay a penalty for late payment at the rate of 0.1% per day, but not in excess of 50% of the repayable amount.

7.2.3 If PZU is unable to use the right specified in clause 7.2.1 due to the fault of the Insured, PZU may, in part

or in full, waive its obligations in respect of providing services and paying indemnity.

7.2.4 If the Insured hides facts or submits false statements, omits information or is inaccurate when reporting

on the insured event, deceives or hides anything in relation to the reasons, circumstances or consequences of the insured event, fails to report an insured event pursuant to these Terms and Conditions, the Insured shall be deprived of the right to the services provided and the insurance indemnity paid by PZU.

7.3 Settlement of disputes

7.3.1 The Policyholder is entitled to refer any disputes with PZU for resolution to the insurance conciliation body

at the Estonian Association of Insurance Undertakings. The insurance conciliation body can be addressed and any dispute is resolved thereby pursuant to the procedural rules of the insurance conciliation body (see the website of the Estonian Association of Insurance Undertakings at www.eksl.ee).

7.3.2 Any disputes under the Insurance Contract, including such disputes which the insurance conciliation body

failed to resolve, shall be referred to Harju County Court. 7.4 Confidentiality requirement

7.4.1 PZU is obliged to maintain the confidentiality of information received about the financial situation and

business activity of the Policyholder and the Insured.

7.4.2 PZU may communicate information received about the Policyholder and the Insured only to reinsurance

undertakings and to the people and organisations who assist PZU in resolving insured events as well as to authorised law enforcement agencies in the cases prescribed by the legislation if law imposes the notification obligation on PZU.
