KXPT VACATION TO THE DISNEYLAND RESORT HALLOWEEN 2021 No Purchase or obligation necessary to win
CONTEST DESCRIPTION:
Registration: Monday, September 20, 2021 – Friday, October 8, 2021
Requirements: To enter, you must be a resident of the Las Vegas Market Area , as defined by The Nielsen Company, 18 years of age or older and have a valid Nevada Driver’s License or Government Issued photo Identification Card, and a valid social security number.
Grand Prize: Grand Prize winner will win a Disneyland Resort vacation package including (4) 3-day, 1-park per day Disneyland Resort tickets and a 2-night stay for four at a Disneyland Resort Premises Hotel or Premises area Hotel. Hotel location chosen by Disney. The grand prize is valued at approximately $1740 and is provided by The Disneyland Resort for promotional purposes.
HOW TO ENTER/WIN:
To participate, listeners must do the following:
1. From Monday, September 20, 2021 through Friday, October 8, 2021, listeners will be instructed to be a specific numbered caller at 702 647 6468 to win a qualifying prize consisting of (4) four Disneyland Resort 2-day, 1-park per day tickets provided by Disneyland Resort for promotional purposes valued at approximately $940. Each winner will qualify for the random grand prize drawing to be held the week of October 10, 2021. All tickets must be used by September 15, 2022 and are subject to availability.
2. From Monday, September 20, 2021 through Friday, October 8, 2021, listeners will be instructed to go to POINT97.COM and click on the Halloween Time At Disneyland Resort banner. They will be redirected to a registration page and must provide the information requested. During the week of October 10, 2021, one winner will be randomly chosen to win (4) four Disneyland Resort 2-day, 1-park per day tickets provided by Disneyland Resort for promotional purposes valued at approximately $940. That winner will also be added to the random grand prize drawing. Contestants may enter one time per day online.
3. The grand prize winners name will be announced on the air and they will be notified by phone and/or email.
ELIGIBILITY RESTRICTIONS:
1. Employees of Lotus Broadcasting and its subsidiaries, affiliates, general sponsors, advertisers, competitors,
promotional partners, other radio stations in the Las Vegas, NV metropolitan area, and members of the immediate families or those living in the same households (whether related or not) of any of the above are NOT eligible to participate or win in this contest. For purposes of this contest, immediate family members mean spouses, parents, grandparents, children, and siblings and their respective spouses.
PRIZES:
1. To the extent that prize elements are provided by third-party providers, winner agrees to look solely to applicable prize providers with respect to any claims, losses, or disputes in connection therewith.
2. No substitution of prize is offered, no transfer of prize to a third party is permitted and non-cash prizes may not be redeemed for cash value.
3. Prizes will be awarded only upon winner verification and final approval by Lotus Broadcasting.
4 If for any reason a contest winner provides notice that they have decided not to accept an awarded prize, the winner may be required to sign a release form acknowledging forfeiture of the prize. It will be at the discretion of Lotus Broadcasting if another entrant is to be selected as the winner if time permits.
5. In the event any winner is found to be in violation of these Official Rules or is otherwise determined by Lotus Broadcasting, in its sole discretion to be ineligible, he/she may be required to forfeit the prize or to reimburse Lotus Broadcasting and / or any sponsor for the stated value of the prize if such a violation is found after the prize has been used by winner.
6. In the event the tickets are digital, the winning participant must have a valid email and smartphone. Digital tickets can only be claimed through email and used at the venue via smartphone. The process to claim and use the tickets is as follows:
The (station) promotions department will send ticket link(s) to the winner’s email/text. Upon opening email/text and clicking the link, you will be directed to the appropriate ticketing app on your smartphone, where you will see the digital barcode to be presented at the venue. If the winner does not have the app, it must be downloaded from the App Store where you first must create a profile. You cannot attempt to print the ticket link or ticket barcode because it will not be accepted at the venue.
ADDITIONAL RULES:
• 1-Park per day Disneyland® Resort tickets good for admission to Disneyland® Park or Disney California Adventure® Park, but not both Parks on the same day (the “Tickets”) (subject to restrictions) to be awarded in sets of four (4) by Promoter solely to the winner(s) of the Promotion Both a theme park ticket and separate theme park reservation for the same park on the same date are required for park entry for the winner and each Guest. Theme park reservations and tickets will be required for each day of the visit and must be obtained before visiting.
• Tickets must be used by September 15, 2022. Tickets are to be awarded as prizes to bona fide winners of the Sweepstakes only. No Tickets (or portions thereof) may be reassigned or transferred if any winner is unable to redeem such prize. Tickets issued will bear the date of issue and the date of expiration. Expiration date will not be extended, and Tickets will not be refundable or redeemable for cash or credit at any time, nor will they be replaced if lost or stolen. Tickets may not be sold or transferred to a third party including, without limitation, to any travel agents, tour operators or other persons engaged in the travel industry, except as allowed in this Agreement. No substitutions are allowed.
• The approximate retail value (“ARV”) of each Ticket is two hundred thirty-five dollars ($235.00).
• Travel and lodging for the Vacation Package awarded must be completed prior to September 15, 2022. (the “Prize Redemption Date”), subject to applicable residency restrictions for visitors to the Premises. If by the Prize Redemption Date, applicable residency restrictions prohibit the potential winner from visiting the Premises, the Prize Redemption Date will be extended to 180 days after the date that the potential winner becomes eligible to visit the Premises. The winner and up to three (3) guests (each a “Guest”; collectively “Guests” and together with the winner, the “Group”) must travel together on the same itinerary.
• Vacation Package fulfillment and travel are subject to certain restrictions and certain hotel/room availability at the Premises. The Vacation Package must be booked through a travel agent as designated by Disney at least forty-five (45) days prior to arrival. Block-out dates apply. No extensions will be granted (unless stated otherwise). Theme park tickets are subject to the terms and conditions set forth herein and included on the theme park tickets.
• Both a theme park ticket and separate theme park reservation for the same park on the same date are required for park entry for the winner and each Guest. Theme park reservations and tickets will be required for each day of the visit and must be obtained before visiting. Park reservations are limited and subject to availability. Park reservations do not guarantee park admission or access to any experience, attraction, or offering. Winner and Guests should visit Disneyland.com/updates for important details to know before traveling to the Disneyland Resort.
• Winners must be at least the age of majority pursuant to his/her applicable state of residence to enter and win. A Guest under the age of majority must be accompanied by his/her parent/legal guardian who must be at least the age of majority and both will be deemed Guests of the winner (unless the winner is the Guest’s parent or legal guardian). Once selected by winner, Guests cannot be changed without the express consent of Disney, which may be withheld for any reason.
• Vacation Package and its components (including, without limitation, theme park tickets) may not be used in conjunction with any other promotion or offer, separated, sold, exchanged or redeemed for cash, traded, transferred, substituted, assigned, or rescheduled to dates other than as set forth above, except in Disney’s sole and absolute discretion.
• The Vacation Package will not include the following: transportation to/from the Premises; insurance (health, travel, medical); parking fees (unless stated otherwise); room service, laundry service, spa treatments; food or beverages;
merchandise, souvenirs; incidental expenses; local or long distance telephone calls; tips, gratuities, service charges;
any taxes; or any other charges not explicitly included herein.
• All elements of the Vacation Package (including, without limitation, the theme park tickets) must be used by the Group on the same dates during the redemption of the Vacation Package. Any portion of the Vacation Package not accepted or used by winner will be forfeited.
• Certain theme parks, hotels, restaurants, attractions, experiences, services and other offerings may be modified, limited in availability and capacity, or be closed.
• A winner may not charge any Guest for participating in the prize. Prizes are awarded "as is" with no warranty or guarantee, expressed or implied, being provided by Promoter or Disney.
• The winner and his/her Guests are responsible for having valid travel documents including government-issued identification and/or passports, as applicable.
• The winner will not receive compensation for any element(s) of the Vacation Package (including, without limitation, theme park tickets) that any participant(s) is unable to use for any reason, and such unused portion(s) of the Vacation Package will be forfeited.
• If the winner chooses to bring less than the allotted number of Guests, the Vacation Package will be awarded in increments suitable for the actual number of participants with no substitute prize or compensation provided to the winner.
• The winner and his/her Guests will be required to execute a liability/publicity/COVID-19 release and waiver form prior to booking of any travel. Failure to return the executed release form within the specified time period will result in forfeiture of the Vacation Package. Winner acknowledges that he/she is solely responsible for any actions, claims or liabilities of the Group, related to any use or misuse of the prize or any prize-related activity or travel.
• Any damaged, lost or stolen theme park tickets, gift cards, or travel vouchers will not be replaced. Gift cards are not redeemable or exchangeable for cash (except as required by law) and are subject to all terms and conditions of use as established by issuer.
• There may be specific residency instructions, guidelines and requirements for all visitors to the Premises. The winner and his/her Guests are solely responsible, at their own cost, for staying updated on and complying with any of the latest restrictions and requirements that may be in place for travel to and visiting the Premises leading up to the planned stay. Such restrictions and requirements are subject to change.
• The actual value of the Vacation Package may vary depending on point of departure and fluctuations of hotel rates and airfares. Any difference between the approximate retail value and the actual cost of the/each Vacation Package will not be awarded.
• Theme park tickets must be used prior to September 15, 2022 (the “Prize Redemption Date”), subject to applicable residency restrictions for visitors to the Premises. If by the Prize Redemption Date, applicable residency restrictions prohibit the potential winner from visiting the Premises, the Prize Redemption Date will be extended to 180 days after the date that the potential winner becomes eligible to visit the Premises. Terms and conditions as set forth herein and on the theme park tickets shall apply. Theme park tickets may not be sold, transferred for commercial use, or redeemed for cash. No substitutions. An inability to use any tickets will result in forfeiture of such tickets. Block-out dates apply. No extensions will be granted.

• Any damaged, lost or stolen theme park tickets will not be replaced.
• Federal, state and local taxes relating to the prize are the responsibility of the winner and Promoter will issue all tax forms including a 1099 form to the winner.
• Promoter is the sponsor of the Sweepstakes.
• Disney, its parent, related, affiliated and subsidiary entities and their respective officers, directors, agents, employees and assigns will be released and discharged from any and all legal claims, losses, injuries, demands, damages, actions, and/or causes of actions that arise out of and/or are in any way related to the prize, the receipt, use and/or enjoyment of the prize, or prize-related activity including travel, the Promotion or the Sweepstakes.
• All disputes arising out of or relating to any prize provided by Disney shall be resolved by applying the laws of California, without regard to conflict of law rules, and shall be solely and exclusively brought in state or federal courts within Orange County, California. Such claims shall be resolved individually, without resort to any form of class action, and all such claims shall be limited to actual out-of-pocket costs incurred, but in no event to include attorneys’ fees.
• In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes promotional materials and the terms and conditions of the Official Rules, the Official Rules shall prevail and govern.
GENERAL CONDITIONS:
1. Winners are responsible for all applicable taxes associated with the receipt of the prize and any person winning over
$600.00 in prizes in the aggregate will receive an IRS form 1099 at the end of the calendar year for tax purposes and a copy of such form will be filed with the IRS as required by law.
2. No purchase necessary. Contest is void where prohibited. Contest is subject to all applicable federal, state and local laws and regulations
3. Odds of winning depend upon the number of eligible contestants participating during the Contest Period.
4. By participating in the contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest, in any media now known or hereafter devised for advertising or promotional purposes without additional compensation. By entering this contest, each participant agrees to comply with the Official Rules and the decisions of the contest sponsor which shall be final and binding in all aspects relating to the contest.
5. Winners must provide valid identification (i.e. via driver’s license, passport or other government-issued photo I.D.) to claim their prize.
6. Lotus Broadcasting retains the right to disqualify any contestant if all contest rules are not followed. Contest void if prohibited by law.
7. So long as no participant is materially adversely affected, Lotus Broadcasting reserves the right to make changes in the contest rules, which will become effective upon being announced on the air and / or posted online.
8. WARNING: Online listeners to streamed broadcasts may experience a lag in transmissions due to buffering limitations.
Contest participants should not rely on streamed broadcasts to participate in contests.
9. Lotus Broadcasting, participating sponsors and their respective parent companies, subsidiaries, affiliates or their representatives, agents and employees are not responsible for the inability of any contestant to complete or continue a telephone call, facsimile transmission or internet registration due to equipment malfunction, busy lines, inadvertent
disconnections, unavailable network, server, Internet Service Provider (ISP) or other connections, communication failures or human error that may occur in the transmission, receipt or processing of entries. In addition, Lotus Broadcasting,
participating sponsors and their respective parent companies, subsidiaries, affiliates or their representatives, agents and employees are not responsible for lost, misdirected, mutilated, illegible or incomplete contest entries. Once submitted, entries become the property of Lotus Broadcasting and will not be returned.
10. By accepting the prize, the winner acknowledges that Lotus Broadcasting has neither made, nor is in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize or to any portion thereof, including but not limited to its quality, mechanical condition or fitness for a particular purpose.
11. Lotus Broadcasting. its subsidiaries, its affiliates, participating sponsors and any other promotional parties will not assume any responsibility for any changes in the execution of the contest, including; cancellation of the contest as a result of the occurrence of events not within the control of Lotus Broadcasting, its subsidiaries, affiliates, participating sponsors, promotional partners and other radio stations, such as acts of God, strikes, terrorists acts or criminal acts of third parties. In the event, such an act should occur, Lotus Broadcasting may in its sole discretion, offer the winner comparable prize(s) currently being offered by Lotus Broadcasting in lieu of the Prize originally awarded.
12. If for any reason, a contest is not capable of running as planned, including without limitation, any suspected evidence of tampering or technological corruption or if any portion of a contest is compromised by virus, bugs, worms or
unauthorized human intervention, fraud, an insufficient number of qualified Contest entries, or any other causes beyond the control which corrupts, threatens or impairs the administration, security, fairness, integrity, or proper conduct of the Contest, Lotus Broadcasting reserve the right to cancel, terminate, modify or suspend the contest at their sole discretion.
13. Any attempt by an entrant to deliberately undermine the legitimate operation of the contest may be in violation of criminal and civil laws and should such an attempt be made, Lotus Broadcasting reserves the right to seek remedies and damages (including attorney’s fees) from any such entrant to the fullest extent of the law, including criminal prosecution.
