THE BOARD OF SUPERVISORS OF THE COUNTY OF ALAMEDA, STATE OF CALIFORNIA
RESOLUTION No. R- 2015-11
A RESOLUTION AUTHORIZING THE DESIGNATION OF CERTIFYING OFFICER FOR RESPONSIBLE ENTITY FOR ENVIRONMENT AL REVIEW PURPOSES.
WHEREAS, Under 24 CFR Part 58, the term "responsible entity" (RE) means the grantee (Alameda County) receiving HUD assistance. The responsible entity must complete the environmental review process. The RE is responsible for ensuring compliance with NEPA and the Federal laws and authorities has been achieved, for issuing the public notification, for submitting the request for release of funds and certification, when required, and for ensuring the Environmental Review Record (ERR) is complete.
WHEREAS, In order to fulfill its obligations under 24 CFR Part 58, the RE should designate a Certifying Officer:
Certifying Officer: The responsible entity must designate a Certifying Officer --the "responsible Federal official" -- to ensure compliance with --the National Environmental Policy Act (NEPA) and the Federal laws and authorities cited at section 58.5 has been achieved. This person is the chief elected official, chief executive official, or other official designated by formal resolution of the governing body. The certifying officer must have the authority to assume legal responsibility for certifying that all environmental requirements have been followed. This function may not be assumed by administering agencies or consultants.
WHEREAS, Under the terms of the certification required by §58.71, a responsible entity's certifying officer is the "responsible Federal official" as that term is used in section 102 ofNEPA and in statutory provisions cited in §58.l(b). The
Certifying Officer is therefore responsible for all the requirements of section 102 of NEPA and the related provisions in 40 CFR parts 1500 through 1508, and 24 CFR part 58, including the related Federal authorities listed in §58.5. The Certifying Officer must also:
(a) Represent the responsible entity and be subject to the jurisdiction of the Federal courts. The Certifying Officer will not be represented by the Department of Justice in court; and
(b) Ensure that the responsible entity reviews and comments on all EISs prepared for Federal projects that may have an impact on the recipient's program. WHEREAS, Programs and activities subject to this part include:

2. This resolution shall take effect immediately upon its adoption.

(3) The HOME Investment Partnerships Program (HOME); (4) Abatement oflead-based paint and lead dust hazards;
(5)(i) Public Housing Programs;
(ii) Grants for the revitalization of severely distressed public housing (HOPE VI); and
(iii) Assistance administered by a public housing agency under Section 8;
(6) Special Projects appropriated under an appropriation act for HUD; (7) The FHA Multifamily Housing Finance Agency Pilot Program;
(8) The Self-Help Homeownership Opportunity Program;
(9) Assistance provided under the Native American Housing Assistance and Self-Determination Act of 1996 (NAHASDA), in accordance with: (i) Section 105 for Indian Housing Block Grants and Federal Guarantees or
Financing for Tribal Housing Authorities; and
(ii) Section 806 for Native Hawaiian Housing Block Grants;
(10) Indian Housing Loan Guarantees; and
(11) Grants for Housing Opportunities for Persons with AIDS (HOPW A) under the AIDS Housing Opportunity Act for competitive grants.
NOW, THEREFORE, BE IT RESOLVED, BY THE COUNTY OF ALAMEDA,
