NOTICE OF PUBLIC HEARING

The New Braunfels Planning Commission will hold a public hearing at the request of

Carson Keller, agent, to consider a replat of the following property:

Description: Replat of Lot 51 Block M, Copper Ridge The Addition North. Additional

information can be found at the website: nbtexas.org/PublicNotice

Because your property is located within 200 feet of the request, State law requires that we

notify you of the public hearing. The public hearing process allows an opportunity to

comment on the request.

A replat does not change the allowed uses on the property.

A public hearing for this request is scheduled before the Planning Commission on

Tuesday,

April 6, 2021 in a virtual Zoom Meeting. Additional information is attached. All interested

persons are invited to attend.

SPECIAL NOTE ABOUT REPLATS

Pursuant to state law, the following section of the New Braunfels Code of Ordinances applies to this plat. Sec. 118-34. Replatting

b. Replatting without vacating preceding plat. A replat of a final plat or portion of a final plat may be recorded and is controlling over the preceding plat without vacation of that plat if the replat:

1. Is signed and acknowledged by only the owners of the property being replatted; and

2. Does not attempt to amend or remove any covenants or restrictions previously incorporated in the final plat.

c. Public Hearing. In addition to compliance with (b) above, a public hearing is required as follows:

1. During the preceding five years any of the area to be replatted was limited by an interim or permanent zoning district to residential use for not more than two residential units per lot; or

2. Any lot in the preceding plat was limited by deed restrictions to residential use for not more than two residential units per lot.

Notice of the public hearing required under (b) above shall be given before the 15th calendar day before the date

of the hearing by publication in an official newspaper or a newspaper of general circulation in the applicable county and the city web site. Notice of the public hearing shall also be given by written notice before the 15th

calendar day before the date of the hearing, with a copy or description of any requested waivers and a copy of V.T.C.A., Local Government Code § 212.015(c), sent to the property owners, as documented on the most recently approved ad valorem tax roll of the city of lots that are in the original subdivision and that are within 200 feet of the lot(s) to be replatted. In the case of a subdivision in the extraterritorial jurisdiction, the most recently approved county tax roll shall be used. The written notice may be delivered by depositing the notice, properly addressed with appropriate postage paid, in a post office or postal depository within the boundaries of the city.

d. If the proposed residential replat requires a waiver and the property owner(s) of 20 percent or more of the total land area of lots to whom notice is required to be given under subsection (b) file with the city a written protest of the replatting before or at the public hearing, then approval of the replat will require the affirmative vote of at least three-fourths (3/4) of the commission members present. For a legal protest, written instruments signed by the owners of at least 20% of the total land area of the lots or land immediately adjoining the area covered by the proposed replat and extending 200 fee from that area, but within the original subdivision, must be filed with the city prior to the close of the public hearing. In computing the percentage of land area subject to the “20 percent rule” described above, the area of streets and alleys shall be included.

As a safety measure to combat the COVID-19 pandemic in the United States, the City of New

Braunfels Planning Commission will hold its monthly meeting (to include public hearings) on

Tuesday, April 6, 2021 at 6:00 p.m. online via Zoom Webinar.

The public is welcome and encouraged to join the meeting by phone, computer, or any other internet

connected device.

This is a public meeting and normal meeting procedures and decorum are required.

presentation on the host screen. As a meeting attendee you will be able to view the host

screen.

Steps to speak during the meeting:

o During the public hearing and/or public comment time frame for the agenda item, if you

would like to speak, please raise your hand in one of the two following methods to be

recognized and given an opportunity to speak:

o If you are communicating through a device (computer, laptop, tablet, etc.), click the

“raise hand” icon at the bottom of the screen to request to speak.

o IF your device does not have a microphone and you are calling from a telephone,

dial *9 to request to speak.

o The host will identify participants in the order they are received. The host will identify you

by name if you used the “raise hand” icon. If you are on the phone, the host will identify

you by the last 4 digits of the phone number you are calling from.

o Participants will be muted, and the Host will unmute you when it is your turn to speak.

o Please state your full name and physical address for the official record and then proceed

to make your statement or ask a question.

o Please introduce yourself each time you begin speaking unless you have been introduced

by the chair or the host.

o Please restrict or minimize background noise while you are speaking to preserve the

quality of the meeting.
