STATUTORY BASIS FOR CHARGES

THE AUTHORITY TO RAISE CHARGES

The authority to charge “ship, passenger, cargo and other dues” as considered “fit” is vested in the board of Saqr Port by the Ras Al Khaimah (RAK) Ports Act No. 9 of 2008.

THE POWER TO COLLECT CHARGES RAISED

By virtue of the RAK Ports Act No. (9) of 2008 the Saqr Port may recover rates payable to them in respect of a ship by distraint and sale of the ship and its tackle and in respect of any goods by distraint and sale either of those goods or any other goods held on harbour premises belonging to the persons liable for payment of the dues.

PAYMENT TERMS

Payment due within 45 days of the date of demand/invoice unless otherwise indicated. Thereafter interest will be charged at 2% per month PRO-RATA. The Port Authority reserves the right to demand full payment prior to departure.

CHANGES TO TARIFF

Saqr Port reserves the right to alter/modify the above tariff giving a notice period of 7 days only.

(a) On entry to the port, on shifting between berths within the port and on remaining within the port for more than five days

Rates are charged per TON/GROSS TONNAGE and apply to all commercial vessels. Rates increase when vessels remain within the Port for more than five days and port users should refer to the three separate tables below.

b) Vessels requesting a Port Authority berth for purposes other than working cargo (Lay-by Charges).

Subject to availability, a vessel lying alongside a Port Authority wharf, but not loading or discharging cargo, will be liable to pay a daily rate of AED 30.00 per metre of vessel length per day from the day of first entering the Port, in addition to the tonnage rate detailed in Table 1 and 3 on Page 2. Small Tug less than 999 GRT AED 1800.00 per day (subject to duration of stay).

Note: No lay-by/repair charges will be levied on vessels during cargo operations. These charges will only be applied prior to or post cargo operations, however a grace period of 11/

2 hours will be given post cargo operations for completion of

repairs and all other formalities.

c) Port Waste Reception Facilities

In respect of commercial vessels laying alongside at Port Authority wharves, a mandatory charge on entry of AED 250.00 per vessel per day will be levied for providing and administering port waste reception facilities plus a disposal charge of AED 300.00 per waste container. Supply vessels AED 1200.00 per month. Sludge / waste oil disposal at berth / anchorage – on request.

d) Service Rebates

At the discretion of the General Manager and on application by the service representative, rebates on vessel dues may be awarded. Application must be made at each quarterly end by the production of a report detailing:

 Name of service and its provider.

 Name of vessels.

 Dates of arrival.

 Port/s of loading.

 Total manifested cargo discharged at Saqr Port/Stevin Rock Harbour/ KGL/ RAKMCFZ.

Notes

1. A “commercial” vessel, for the purposes of applying the above rates and charges is defined as a vessel assessed as to Gross Tonnage (i.e. a vessel having an International Tonnage Certificate).

2. Payment terms: 45 days from date of demand. Thereafter interest will be charged at 2% per month PRO-RATA. The Port Authority however reserves the right to demand full payment prior to departure.

1) The General Manager will exercise discretion in determining whether articles and goods not specified in this list fall into the “general” category at 3. Unlisted cargoes not falling into category 3 will have rates determined at the discretion of and on application to the General Manager.

2) In charging the rates on goods, the gross weight or measurement of goods shall be taken. Fractional parts of any weight, measure, number or value shall be charged according to the nearest greater whole number.

3) A Cargo Declaration Form must be completed by the ship’s agent or the consignee of the cargo or agent thereof and submitted to the Port Authority no later than 24 hours after completion of discharge and/or loading.

4) Declarations of catch values for fish, shellfish and other sea-caught

foodstuffs should be accompanied by a landing certificate clearly detailing the market value.

5) Terms of payment: 45days from date of demand. Thereafter interest will be charged at 2% per month PRO-RATA.

When space is available goods may be stored for a period on Saqr Port’s wharves and within its transit sheds. Storage is at the discretion of the General Manager and dependent on traffic requirements.

Saqr Port does not accept any responsibility for any loss or damage, however caused to any goods placed on its wharves or within its transit sheds.

Ordinarily goods will not be allowed to remain in port for more than 60 days and the charges levied beyond this point in time will be determined at the discretion of and on application to the General Manager.

Transit Sheds

Rent on the use of transit sheds is charged according to current market rates and availability and will be quoted on application.

In order to avoid any dispute with regard to the calculation of storage charges for shipments within Saqr Port’s storage yards/transit sheds, a daily report is to be forwarded to Saqr Port by 0800 hrs every day identifying the previous 24 hours figures.

The report should include the volume of shipments transported from vessel to yard/yard to factories and vice versa.

Aggregate/Limestone

Storage of Aggregate and Limestone will be on a square metre basis determined at the discretion of and on application to the General Manager.

Crane/Cargo Delay: For whatever reason and at the discretion of the General Manager the following charges may be applied for crane delays and for delays in the removal of cargo from the quay after vessel completion.

a) Crane Delay – AED 1600.00 per hour (during cargo operations)

b) Cargo Removal Delay – Up to 4 hours foc thence AED 700.00 per hour until quay is clear of cargo.

Above rates are applicable to specialised bulk carriers only – General Cargo vessels with decks are subject to an additional charge of AED 3.00 per freight ton.

Abnormal bulk commodities which require special handling arrangements (large stones, pet coke, scrap etc) are subject to additional charges at the discretion of and on application to the General Manager.

MARINE SERVICES AND CHARGES

a) PILOTAGE

The Saqr Port as the Competent Harbour Authority (CHA) for pilotage in Saqr Port hereby makes the following list of pilotage charges and conditions of use of the pilotage service to take effect from the date above and replacing those previously applied.

AII charges are based on Gross Tonnage assessed in accordance with an International Tonnage Certificate.

Pilotage in the Port is compulsory.

The following pilotage charges are applicable only to acts of pilotage carried out between 0700hrs – 1900hrs Sunday to Thursday. Vessel movements carried out outside these normal hours will be subject to an additional charge of AED 1100.00 for vessels up to 5999 GT and AED 2200.00 for vessels over 6000 GT.

Pilotage payable on entry, on departure and on shifting: Up to – 9999 GT 10000 – 14999 GT 15000 – 24999 GT 25000 – 39999 GT 40000 GT + AED 650.00 AED 900.00 AED 1000.00 AED 1200.00 AED 1250.00 An additional charge will be levied for each of the following extra services: Internal movement at vessels convenience:

For the guidance of all vessels requiring the service of a Pilot the following procedure should be adopted:

BOARDING POINT: Pilots board incoming ships up to two miles off the Harbour Entrance.

ETAs AND AMENDMENTS: ETAs should be sent 24 hours before arrival through the Saqr Port Authority Control Tower or local agents with amendments at two hours' notice through Saqr Port Pilots on Channel 14 (VHF). ETAs should include the vessel's maximum draft.

CONTACT PROCEDURE: The Saqr Port Authority Control Tower maintains a listening watch on Channel 9/14/16 & RAKMCFZ Channel 69 throughout 24 hours.

WORKING FREQUENCIES: Having made initial contact on Channel 16, ships should communicate on the working frequencies - Channels 9 and 14 & 16 and for RAKMCFZ channels 69 & 16.

The Saqr Port reserves the right to plan the sequence of pilotage moves as directed by the Harbour Master, taking into account the size of ships, tidal circumstances and the availability of Pilots.

Payment for pilotage shall be made not later than 45 days from the date of demand. The Port Authority reserves the right to demand full payment prior to departure.

Towage Charges:

Harbour Tugs are available for hire at the following hourly rates. Their use is compulsory and the number to be deployed is at the discretion of the General Manager/Harbour Master.

Note: Hire of the Port Authority tugs is at all times subject to availability of the tugs and crews and to the UK Standard Conditions for Towage and Other Services (1983).

TRAFFIC VIOLATION TARIFF

Each person and or company violating such provisions below shall be subject to fine(s) imposed by the Port Authority. The amount shall be a fixed charge as noted below, dependent on the severity of the violation.

In all cases where the first offence exceeds a verbal warning, a AED 500.00 charge will be applied, increasing in AED 250.00 increments for subsequent offences.

In cases of risky driving being recorded, a AED 1,000.00 charge will be applied, increasing in AED 500.00 increments for subsequent offences.

In the case of dangerous driving being recorded, a AED 2,000.00 charge will be applied, increasing by a AED 3,000.00 increment for the subsequent offence.
