NOTICE OF REQUIREMENTS

2. Contracts resulting from this RFP must be governed by and in accordance with the laws of the Commonwealth of Kentucky.
3. Any agreement or collusion among offerors or prospective offerors, which restrains, tends to restrain, or is reasonably calculated to restrain competition by agreement to bid at a fixed price or to refrain from offering, or otherwise, is prohibited.
4. Any person who violates any provisions of KRS 45A.325 shall be guilty of a felony and shall be punished by a fine of not less than five thousand dollars nor more than ten thousand dollars, or be imprisoned not less than one year nor more than five years, or both such fine and imprisonment. Any firm, corporation, or association who violates any of the provisions of KRS 45A.325 shall, upon conviction, be fined not less than ten thousand dollars or more than twenty thousand dollars.
AUTHENTICATION OF BID AND STATEMENT OF NON-COLLUSION AND NON-CONFLICT OF INTEREST I hereby swear (or affirm) under the penalty for false swearing as provided by KRS 523.040:
1. That I am the offeror (if the offeror is an individual), a partner, (if the offeror is a partnership), or an officer or employee of the bidding corporation having authority to sign on its behalf (if the offeror is a corporation);
2. That the attached proposal has been arrived at by the offeror independently and has been submitted without collusion with, and without any agreement, understanding or planned common course of action with, any other Contractor of materials, supplies, equipment or services described in the RFP, designed to limit independent bidding or competition;
3. That the contents of the proposal have not been communicated by the offeror or its employees or agents to any person not an employee or agent of the offeror or its surety on any bond furnished with the proposal and will not be communicated to any such person prior to the official closing of the RFP: 4. SWORN STATEMENT OF COMPLIANCE WITH CAMPAIGN FINANCE LAWS
In accordance with KRS45A.110 (2), the undersigned hereby swears under penalty of perjury that he/she has not knowingly violated any provision of the campaign finance laws of the Commonwealth of Kentucky and that the award of a contract to a bidder will not violate any provision of the campaign finance laws of the Commonwealth of Kentucky.
CONTRACTOR REPORT OF PRIOR VIOLATIONS OF KRS CHAPTERS 136, 139, 141, 337, 338, 341 & 342
The contractor by signing and submitting a proposal agrees as required by 45A.485 to submit final determinations of any violations of the provisions of KRS Chapters 136, 139, 141, 337, 338, 341 and 342 that have occurred in the previous five (5) years prior to the award of a contract and agrees to remain in continuous compliance with the provisions of the statutes during the duration of any contract that may be established. Final determinations of violations of these statutes must be provided to the University by the successful contractor prior to the award of a contract.

1.0 DEFINITIONS
The term "addenda" means written or graphic instructions issued by the University of Kentucky prior to the receipt of proposals that modify or interpret the RFP documents by additions, deletions, clarifications and/or corrections.
The term "competitive negotiations" means the method authorized in the Kentucky Revised Statutes, Chapter 45A.085.
The terms "offer" or “proposal” mean the offeror’s/offerors’ response to this RFP. The term "offeror" means the entity or contractor group submitting the proposal. The term "contractor" means the entity receiving a contract award.
The term "purchasing agency" means the University of Kentucky, Purchasing Division, Room 322 Peterson Service Building, Lexington, KY 40506-0005.
The term "purchasing official" means the University of Kentucky’s appointed contracting representative.
The term "responsible offeror" means a person, company or corporation that has the capability in all respects to perform fully the contract requirements and the integrity and reliability that will assure good faith performance. In determining whether an offeror is responsible, the University may evaluate various factors including (but not limited to): financial resources; experience; organization; technical qualifications; available resources; record of performance; integrity; judgment; ability to perform successfully under the terms and conditions of the contract; adversarial relationship between the offeror and the University that is so serious and compelling that it may negatively impact the work performed under this RFP; or any other cause determined to be so serious and compelling as to affect the responsibility of the offeror.
The term "solicitation" means RFP.
The term "University" means University of Kentucky.
2.0 GENERAL OVERVIEW
2.1 Intent and Scope
This Request for Proposal (RFP) is issued by the University of Kentucky to solicit proposals from qualified, experienced, financially sound and responsible firms to provide merchant payment services, which include credit card processing services, managed tuition payment services, alternative online payment solutions, and mobile payment solutions. The University reserves the right to award one or multiple contracts for merchant services described in this RFP.
The University of Kentucky is looking for business partners that are sensitive to customer service needs; creative in leveraging technology; and can propose creative alternative solutions for the University. With this as background, the specific goals of the RFP are to:
• Minimize the overall costs for accepting payment cards (credit, debit, FSA, purchasing cards)
• Minimize the administrative burden of merchant payment services • Provide excellent customer service and support to University merchants • Provide innovative electronic reporting capabilities
• Improve merchant payment options, utilizing technologically advanced processing equipment, internet payment gateways, and creative online and mobile payment solutions.
The scope of services is further defined in Section 7.0.
2.2 Background Information
The Office of the Treasurer has sole responsibility for contracting for treasury services at the University of Kentucky and for several of its affiliates. The University of Kentucky and its affiliates will be collectively referred to as “The University” in this RFP. The Treasury Services department within the Office of the Treasurer administers the merchant card processing functions of the University by coordinating merchant requests and receiving daily merchant card deposit
information. Any transaction service provider selected as part of this RFP will be expected to assist the Office of the Treasurer in enforcing this responsibility by not entering into any agreements with individual members or departments of the University community without the approval of the Office of the Treasurer.
All of the University merchant departments accept American Express, Discover, MasterCard, and Visa credit cards. UK merchants accept payments via several methods: face-to-face, mail-in, phone-in, fax-in, and internet-based. Additionally, payment cards are accepted for payment of tuition, continuing education and other academic expenses, as well as, payments relating to virtually all University-operated units with the need to accept payments for the sale of goods or services, such as UK HealthCare. Due to contractual obligations, the University of Kentucky Athletics department credit card transactions will not be included in this contract.
A University department that wants to accept credit card payments must submit a request to the Treasury Services department. The request is processed internally and then forwarded to the processor to establish a merchant account (MID) and create the associated terminal identification
numbers (TID). The processor will then either deploy any necessary equipment or distribute a VAR setup file for internet based TID’s. Once merchant accounts are established, University merchants daily upload transaction data to the processor via credit card swipe terminals, POS systems, or internet processing gateways for authorization and settlement. The processor then will initiate an automated clearing house (ACH) deposit transmitted to the University’s bank for each merchant’s gross batch settlement. Utilizing the MID and/or TID information included in the description fields of the ACH downloaded from the University’s bank, the UK Treasury Services department staff will then allocate the funds to the appropriate University accounts. At the beginning of each month, the processor will initiate an ACH debit for each individual merchant account for the cumulative fees accrued throughout the month. The Treasury Services department staff will then allocate those fees to the appropriate University accounts.
As of February 29th, 2016, the University has 202 individual active merchant accounts, utilizing 302 TID’s.
The following table (Table 1) is a summary of merchant card processing activity for Fiscal Year 2015. (The UK Athletics credit card processing activity is not included in the data below).

The following tables (Tables 4 and 5) show the merchant card processing activity in both the number of transactions processed and sales revenue, respectively, for our top ten merchant
departments during Fiscal Year 2015. For each University department listed in the tables below, all merchant accounts (MID’s) activity associated with that department have been combined. A
detailed listing of the University’s merchant locations and their associated processing activity during Fiscal Year 2015 is provided in Appendix A. The University incurred 53 chargebacks for a total amount of $6,428.82 during Fiscal Year 2015.

The University of Kentucky also utilizes a tuition payment management service provider to collect card-present in person and card-not-present online credit card payments for tuition and mandatory fees on the students’ accounts. The primary purpose of this arrangement is to process a
percentage based service fee in conjunction with the primary credit card payment for a student’s tuition and fees. This service fee covers the credit card processing fees incurred by the University for these high-dollar transactions. The managed tuition payments service provider keeps the service fee revenue and in return pays the credit card processing fees incurred for all tuition payments. The tuition payment management service provider’s system can integrate with the University’s ERP system, SAP, to process online payments. The service provider also supplies the credit card swipe terminals for in person, card-present transactions that also have the ability to charge the associated service fee. The table (Table 6) below shows the total activity for managed tuition payment services in Fiscal Year 2015, which is also included in the overall University processing activity listed in the tables above.

The University of Kentucky also partners with various companies who accept and process credit card transactions as part of the outsourced services they provide for the University. These service providers independently process transactions and remit funds directly to the University as part of the service agreement. Examples of such services, although this list is not totally inclusive, are conference and camp management services, ticketing services, learning management system services, and many more. The volume data provided does not include the transactions processed by these companies. At this time, the University has no intent to change these existing business processes. Existing and future outsourced services contracts are not included in this RFP and will not be subject to any payment processing exclusivity arrangements included in the contracts awarded.
The University of Kentucky is committed to maintaining Payment Card Industry Data Security Standards (PCI DSS) compliance. We are currently classified as a Merchant Level III and last validated our compliance in December 2015. We desire a merchant card processing partner that will provide us high quality tools, knowledge, and support with our PCI DSS compliance efforts.
2.3 University Information

Included in this portfolio is $153 million in federal awards from the National Institutes of Health, non-NIH grants from the Department Health and Human Services, the National Science Foundation, Department of Energy, Department of Agriculture and NASA, among others. The National Science Foundation ranks UK’s research enterprise 44th among public institutions.
With more than 50 research centers and institutes, UK researchers are discovering new knowledge, providing a rich training ground for current students and the next generation of researchers, and advancing the economic growth of the Commonwealth of Kentucky. Several centers excel in the services offered to the public. The Gluck Equine Research Center is one of only three facilities of its kind in the world, conducting research in equine diseases.
The Center for Applied Energy Research is pursuing groundbreaking discovery across the energy disciplines. CAER staff are pioneering new ways to sustainably utilize Kentucky natural resources through carbon-capture algae technology, biomass/coal to liquid products and the opening of UK’s first LEED-certified research lab to support the development of Kentucky’s growing alternative energy industry. Among the brightest examples of UK’s investment in transformative research is the Markey Cancer Center. As a center of excellence and distinction at UK, Markey’s robust research and clinical enterprise is the cornerstone of our commitment to Kentucky – fundamental to our success in uplifting lives through our endeavors and improving the general health and welfare of our state – burdened by the nation’s highest rate of cancer deaths per 100,000 people. In 2013, Markey earned the prestigious National Cancer Institute-designation (NCI) – one of 68 nationally and the only one in Kentucky.
The University of Kentucky was awarded a $20 million Clinical Translational Sciences Award (CTSA) from the National Institutes of Health (NIH). As one of only 60 institutions with this research distinction, UK was awarded the CTSA for its potential in moving research and discovery in the lab into practical field and community applications. The CTSA and NCI are part of a trifecta of federal research grants that includes an Alzheimer’s Disease Center. UK is one of only 22 universities in the country to hold all three premier grants from NIH.
Established in 1957, the medical center at UK is one of the nation's finest academic medical centers and includes the University's clinical enterprise, UK HealthCare. The 569-bed UK Albert B.
Chandler Hospital and Kentucky Children's Hospital, along with 256 beds at UK Good Samaritan Hospital, are supported by a growing faculty and staff providing the most advanced subspecialty care for the most critically injured and ill patients throughout the Commonwealth and beyond. Over the last several years, the number of patients served by the medical enterprise has increased from roughly 19,000 discharges to more than 36,000 discharges in 2014.
UK Chandler Hospital includes the only Level 1 Trauma Center for both adult and pediatric patients in Central and Eastern Kentucky. In addition, UK HealthCare recently opened one of the country's largest robotic hybrid operating rooms and the first of its kind in the region. While our new patient care pavilion is the leading healthcare facility for advanced medical procedures in the region, our talented physicians consult with and travel to our network of affiliate hospitals so Kentucky citizens can receive the best health care available close to their home and never need to leave the
Bluegrass for complex subspecialty care.

3.4 Offeror Presentations
All offerors whose proposals are judged acceptable for award may be required to make a presentation to the evaluation committee.
3.5 Preparation of Offers
The offeror is expected to follow all specifications, terms, conditions and instructions in this RFP. The offeror will furnish all information required by this solicitation.
Proposals should be prepared simply and economically, providing a description of the offeror’s capabilities to satisfy the requirements of the solicitation. Emphasis should be on completeness and clarity of content. All documentation submitted with the proposal should be bound in the single volume except as otherwise specified.

3.6 Proposed Deviations from the RFP
The stated requirements appearing elsewhere in this RFP shall become a part of the terms and conditions of any resulting contract. Any deviations therefrom must be specifically defined in accordance with the transmittal letter, Section 4.3 (d). If accepted by the University, the deviations shall become part of the contract, but such deviations must not be in conflict with the basic nature of this RFP.
Note: Offerors shall not submit their standard terms and conditions as exceptions to the University’s General Terms and Conditions. Each exception to the University’s General Terms and Conditions shall be individually addressed.
3.7 Proposal Submission and Deadline
Offeror must provide the following materials prior to 3 p.m. (Lexington, KY time) on the date specified in Section 3.1 and addressed to the purchasing officer listed in Section 3.2:
• Ten (10) copies on an electronic storage device clearly marked with the proposal number and name, firm name and what is included (technical) and two (2) printed copies of each
technical proposal under a sealed cover
• Ten (10) copies on an electronic storage device clearly marked with the proposal number and name, firm name and what is included (financial) and two (2) printed copies of the financial proposal under separate sealed cover
Note: Proposals received after the closing date and time will not be considered. In addition, proposals received via fax or e-mail are not acceptable.
The University of Kentucky accepts deliveries of RFPs Monday through Friday from 8 a.m. to 5 p.m. Lexington, KY time. However, RFPs must be received by 3 p.m. Lexington, KY time on the date specified on the RFP in order to be considered.
Proposals shall be enclosed in sealed envelopes to the above referenced address and shall show on the face of the envelope: the closing time and date specified, the solicitation number and the name and address of the offeror. The technical proposal shall be submitted in a sealed envelope and the financial proposal shall be submitted in a sealed envelope under separate cover. Both sealed envelopes shall have identical information on the cover, with the addition that one will state “Technical Information,” and the other, “Financial Proposal.”
Note: In accordance with the Kentucky Revised Statute 45A.085, there will be no public opening.
3.8 Modification or Withdrawal of Offer
An offer and/or modification of offer received at the office designated in the solicitation after the exact hour and date specified for receipt will not be considered.
An offer may be modified or withdrawn by written notice before the exact hour and date specified for receipt of offers. An offer also may be withdrawn in person by an offeror or an authorized
representative, provided the identity of the person is made known and the person signs a receipt for the offer, but only if the withdrawal is made prior to the exact hour and date set for receipt of offers.
3.9 Acceptance or Rejection and Award of Proposal
The University reserves the right to accept or reject any or all proposals (or parts of proposals), to waive any informalities or technicalities, to clarify any ambiguities in proposals and (unless
otherwise specified) to accept any item in the proposal. In case of error in extension or prices or other errors in calculation, the unit price shall govern. Further, the University reserves the right to make a single award, split awards, multiple awards or no award, whichever is in the best interest of the University.
3.10 Rejection
Grounds for the rejection of proposals include (but shall not be limited to): • Failure of a proposal to conform to the essential requirements of the RFP.
• Imposition of conditions that would significantly modify the terms and conditions of the solicitation or limit the offeror’s liability to the University on the contract awarded on the basis of such solicitation.
• Failure of the offeror to sign the University RFP. This includes the Authentication of Proposal and Statement of Non-Collusion and Non-Conflict of Interest statements.
• Receipt of proposal after the closing date and time specified in the RFP.
3.11 Addenda
Any addenda or instructions issued by the purchasing agency prior to the time for receiving proposals shall become a part of this RFP. Such addenda shall be acknowledged in the proposal. No instructions or changes shall be binding unless documented by a proper and duly issued addendum.
3.12 Disclosure of Offeror’s Response
The RFP specifies the format, required information and general content of proposals submitted in response to this RFP. The purchasing agency will not disclose any portions of the proposals prior to contract award to anyone outside the Purchasing Division, the University’s administrative staff, representatives of the state or federal government (if required) and the members of the committee evaluating the proposals. After a contract is awarded in whole or in part, the University shall have the right to duplicate, use or disclose all proposal data submitted by offerors in response to this RFP as a matter of public record.
Any submitted proposal shall remain valid six (6) months after the proposal due date.
The University shall have the right to use all system ideas, or adaptations of those ideas, contained in any proposal received in response to this RFP. Selection or rejection of the proposal will not affect this right.
3.13 Restrictions on Communications with University Staff
From the issue date of this RFP until a contractor is selected and a contract award is made, offerors are not allowed to communicate about the subject of the RFP with any University administrator, faculty, staff or members of the board of trustees except: the purchasing office representative, any University purchasing official representing the University administration, others authorized in writing by the purchasing office and University representatives during offeror presentations. If violation of this provision occurs, the University reserves the right to reject the offeror’s proposal.
3.14 Cost of Preparing Proposal
Costs for developing the proposals and any subsequent activities prior to contract award are solely the responsibility of the offerors. The University will provide no reimbursement for such costs.
3.15 Disposition of Proposals
All proposals become the property of the University. The successful proposal will be incorporated into the resulting contract by reference.
3.16 Alternate Proposals
Offerors may submit alternate proposals. If more than one proposal is submitted, all must be complete (separate) and comply with the instructions set forth within this document. Each proposal will be evaluated on its own merits.
3.17 Questions
All questions should be submitted by either fax or e-mail to the purchasing officer listed in Section 3.2 no later than the date listed in Section 3.1.
3.18 Section Titles in the RFP
Section titles used herein are for the purpose of facilitating ease of reference only and shall not be construed to infer the construction of contractual language.
3.19 No Contingent Fees
No person or selling agency shall be employed or retained or given anything of monetary value to solicit or secure this contract, except bona fide employees of the offeror or bona fide established commercial or selling agencies maintained by the offeror for the purpose of securing business. For breach or violation of this provision, the University shall have the right to reject the proposal, annul the contract without liability, or, at its discretion, deduct from the contract price or otherwise recover the full amount of such commission, percentage, brokerage or contingent fee or other benefit.
3.20 Proposal Addenda and Rules for Withdrawal
Prior to the date specified for receipt of offers, a submitted proposal may be withdrawn by submitting a written request for its withdrawal to the University purchasing office, signed by the offeror. Unless requested by the University, the University will not accept revisions or alterations to proposals after the proposal due date.
4.0 PROPOSAL FORMAT AND CONTENT
4.1 Proposal Information and Criteria
The following list specifies the items to be addressed in the proposal. Offerors should read it carefully and address it completely and in the order listed to facilitate the University’s review of the proposal.
Proposals shall be organized into the sections identified below. The content of each section is detailed in the following pages. It is strongly suggested that offerors use the same numbers for the following content that are used in the RFP.

4.2 Signed Authentication of Proposal and Statements of Non-Collusion and Non-Conflict of Interest Form
The Offeror will sign and return the proposal cover sheet and print or type their name, firm, address, telephone number and date. The person signing the offer must initial erasures or other changes. An offer signed by an agent is to be accompanied by evidence of their authority unless such evidence has been previously furnished to the purchasing agency. The signer shall further certify that the proposal is made without collusion with any other person, persons, company or parties submitting a proposal; that it is in all respects fair and in good faith without collusion or fraud; and that the signer is authorized to bind the principal offeror.
4.3 Transmittal Letter
The Transmittal Letter accompanying the RFP shall be in the form of a standard business letter and shall be signed by an individual authorized to legally bind the offeror. It shall include:
• A statement referencing all addenda and written questions, the answers and any clarifications to this RFP issued by the University and received by the offeror (If no addenda have been received, a statement to that effect should be included.).
• A statement that the offeror’s proposal shall remain valid for six (6) months after the closing date of the receipt of the proposals.
• A statement that the offeror will accept financial responsibility for all travel expenses incurred for oral presentations (if required) and candidate interviews.
• A statement that summarizes any deviations or exceptions to the RFP requirements and includes a detailed justification for the deviation or exception.
• A statement that identifies the confidential information as described in Section 6.22.
4.4 Executive Summary and Proposal Overview
The Executive Summary and Proposal Overview shall condense and highlight the contents of the technical proposal in such a way as to provide the evaluation committee with a broad understanding of the entire proposal.
4.5 Criteria 1 - Offeror Qualifications
The purpose of the Offeror Qualifications section is to determine the ability of the offeror to respond to this RFP. Offerors must describe and offer evidence of their ability to meet each of the
qualifications listed below.
Background and Experience
1. Provide a general overview and brief history of your organization, including parent and/or subsidiary companies and the number of employees.
2. Provide a general overview of the services you currently offer.
3. List any third-party providers who will provide any element of the service you propose and explain the services they provide.
4. Specify the number of customers for which you are providing payment services and categorize them by segment (e.g., retail, telephone, mail order).
5. What is the average number of transactions currently processed daily? What is the greatest number of transactions processed in an hour, and by each platform? How does that compare to your current capacity?
6. What would our volume ranking among your customers be, given our current number of transactions? What is the volume of your largest customer?
7. At what point would you need to extend your capacity and what resources would be required to do that?
Safety and Soundness
8. Indicate key measures of the Offeror’s financial strength (e.g. capital ratios, market capitalization, cash flow ratios, available credit lines).
9. Provide your ratings from two ratings agencies, such as Standard & Poor’s and Moody’s. 10. Provide a copy of your SAS 70, Type II report and a copy of your latest audited financial
statement.
11. Provide any additional information which demonstrates your financial strength.
12. Include samples of any proposed agreements that will be required if you provide this service. If a standard agreement(s) is provided, please indicate such and discuss which provisions you agree to modify based upon the service requirements outlined in this RFP.
Personnel
13. List names, titles, phone and fax numbers and e-mail addresses and provide brief biographies of relationship management contacts and senior management.
14. Describe the relationship management team that will service the account, as well as their functional responsibilities.
15. How many employees does the processor have in each functional area involved in providing this service to the University?
16. Describe any diversity initiatives in place at your firm, and highlight the number of women and minorities in senior positions.
Payment Card Industry Data Security Standards
17. Is your organization, including all subcontractors and third party processors, in compliance with all applicable current data security standards? Have you been certified as compliant by a third party assessor? Please provide the appropriate documentation for proof of your compliance.
4.6 Criteria 2 – Services Defined
4.6.1 Merchant Card Payment Processing Services Processing
Authorization
1. Provide a list of the credit and debit card brands that you process.
2. Describe the authorization method you recommend for the University of Kentucky. List and describe alternatives.
3. What are the procedures to reverse an authorization?
4. Describe your ability to process foreign/international credit cards. Describe if the process is different than a card issued domestically.
Settlement
5. Explain in detail the settlement, chargeback, and retrieval processes; include the proposed schedule, cut-off times, and availability of funds in University accounts. This should include the process for resolving any and all errors.
6. Provide a funds availability schedule by card type. Is it negotiable?
7. What is the settlement transmission time frame for Visa, MasterCard, Discover, and American Express?
8. Can you direct settle Visa/MasterCard/Discover? Are American Express transactions passed to American Express for authorization and settlement?
9. What is the latest time that sales transactions can be transmitted to meet these settlement times?
10. Do your swipe terminal setups include an automatic settlement option? If so, what time are the terminals programmed to auto-settle?
11. How do the settlement times affect our processing/discount expense? 12. Are settlement deposits made by ACH or Fedwire?
13. Do you allow for multiple settlement accounts?
14. Are settlement amounts listed separately for each TID or MID on the bank statement or will they appear as one lump sum? Will Saturday and Sunday activity be combined into Monday activity?
Transaction Data Retrieval and Chargebacks
15. Describe the ticket retrieval request process and turnaround time.
16. What response times do you require for ticket retrieval? How do these time frames compare to your Association rules?
17. What percentage of chargeback’s are handled without merchant involvement? 18. How often are chargeback’s reversed?
19. Will you provide a designated contact person or a department to help us manage chargeback’s?
20. The University of Kentucky requires that chargeback’s and other adjustments be debited separately, and not netted from daily proceeds. Describe your ability to honor this request. 21. Do you have the capability to store and retrieve transaction information, including signatures for
bank card transactions? If so, do you have a system that enables the merchant to retrieve and receive this information online?
22. Does the offeror have a system that has the ability of receiving and responding to all ticket retrievals and chargeback’s via an electronic process rather than a paper method?
23. Do you have the ability to redact (except the first six and last 4 digits) the cardholder PAN on all electronic systems (ticket retrievals, chargebacks, etc.)?
Debit Card Processing
24. Describe your pin-based debit card processing capabilities. Which networks can you use?
25. Currently the University does not accept pin-based debit transactions. Explain the pros and cons of accepting pin-based transactions and your recommended action for the University of Kentucky.
26. Given the Dodd Frank Act and Durbin Amendment, do you currently have infrastructure in place to conduct dynamic least cost routing for debit transactions?
27. Can you program a debit card transaction to the lowest cost network? Explain. 28. Can you process online debit transactions? Describe in detail each methodology for
processing debit cards for internet transactions and the pros and cons of each. What is your recommendation for the University of Kentucky?
General
29. Does your processing system identify and eliminate duplicate transactions and batches? 30. What transaction data fields are used to determine if a transaction is a duplicate?
31. What are the procedures to reinstate a transaction that was mistakenly identified and eliminated as a duplicate transaction?
32. Do you offer processing solutions that perform: a. Deferred billing?
b. Installment billing? c. Recurring billing?
33. Is data imaging (e.g., signature capture) available? If so, describe your capabilities and how you would recommend that the University take advantage of this service.
34. Discuss any training that you would offer to the University. Describe if training is conducted as ‘train the trainer’, if direct training to merchant location staff is offered, or if it can be
customizable to the UK merchant environment. Describe in detail the type of training that you offer. For example, do you provide training regarding PCI Compliance or
authorization/settlement process training, or training for online systems and reporting?
35. A listing of the University of Kentucky merchant locations and associated activity is provided in Appendix A. Based upon this listing as well as other details provided in this RFP, discuss any recommendations you would have for the University regarding its current merchant structure, equipment/software utilized, or products.
36. What MCC code(s) would be assigned to the University of Kentucky merchant locations? 37. Describe the initiatives you have under way to enhance and streamline the merchant acquirer
process and plans for utilizing new technology.

41. What specific feedback and suggestions do you regularly provide to the merchant to improve quality (e.g., recommendations on ways to reduce certain types of chargeback’s, system or process modifications)?
42. What is your approach and philosophy toward new and emerging payments (mobile payments, pay-by-phone, tokens, QR codes, etc.)? Please list any types of emerging payments that you are working with your customers to implement. What resources can you provide to merchants that are considering adopting new and emerging forms of payment?
Fraud Prevention and Detection
43. Please describe any fraud activity monitoring and prevention services that your company provides for merchant accounts.
44. Do you provide fraud-management training or awareness programs? 45. Are there limitations on the number of transactions:
a. Contained in a batch? b. Processed daily?
46. Can velocity thresholds be set for individual MID’s?
47. Are dollar thresholds put in place on each individual MID? If so, what are the procedures for a merchant to process a transaction that exceeds those thresholds?

Payment Card Industry Data Security Standards
1. Indicate what Merchant Level (1, 2, 3, 4) you might categorize the University of Kentucky for both Visa and MasterCard. Indicate whether you would apply the Level criteria to each merchant location or to UK as a single entity.
2. If you provide any online merchant portal services, please provide the PCI DSS compliance status of each portal service as well as any third party assessment of the portal.
3. Outline the security measures in place for the protection of data transmitted for processing, by method of transmission (dial, Internet, etc.).
4. Describe the security measures used to prevent unauthorized user access to either the system or the data.
5. Please describe if and how your organization can support merchants’ PCI DSS compliance efforts. Can you provide support based on the criteria below:
a. Access to Offeror compliance support staff.
b. Provide consultation regarding PCI DSS related issues, as needed.
c. Recommending and evaluating PCI DSS QSAs and ASVs, and providing a liaison between the University and the assessors, as needed.
d. Offer PCI DSS training to University representatives and merchants.
6. Identify your PCI DSS support structure, including the compliance team, their backgrounds and professional certifications.
7. How do you monitor the PCI Compliance of your clients?
8. What will be required from the University of Kentucky to validate its PCI DSS compliance? Will a single Self-Assessment Questionnaire (SAQ) suffice to cover all UK MID’s? Or, will you require an SAQ from each individual merchant account?
9. Does the Offeror offer any online tools to assist in the organization and collection of merchant SAQ’s for validation purposes?
10. Does the Offeror offer any vulnerability scanning services as part of the PCI DSS compliance validation process?
11. Does the Offeror offer any penetration scanning services to assist in meeting the requirements of PCI DSS?
12. Provide a copy of your incident response procedures. Describe in detail how incidents are handled.
13. How do you support clients who have experienced a PCI DSS violation? Provide examples.
Technical Capabilities System Capabilities
1. Describe the processing platforms supported by your institution, including location. Describe in detail the platform pertinent to your recommended solution and how you arrived at your
recommended platform for UK. Provide system specifications, if appropriate.
2. Does your processing software support Purchasing Card Levels II? Card Level III?
3. What is your process for handling test transactions? Do you provide test cards and if so, what types?
4. Can your company authorize and settle card transactions utilizing EMV technology for card-present transactions? Please provide details regarding this type of processing activity.
Equipment and E-commerce solutions
5. The equipment currently utilized by the University appears in Table 3 shown earlier in this request for proposal. List the type of equipment that you support or recommend to the
University for usage in our diverse merchant environment, and why. Are the terminals being recommended EMV capable?
6. Explain how this equipment is obtained. Does the University purchase on our own? Does the University purchase through you? What is your maintenance, replacement and disposition policy for this equipment?
7. Describe your procedure for replacing malfunctioning equipment. How quickly will the equipment be replaced and at what cost to the University?
8. State your willingness to provide equipment and supplies, such as credit card terminals and processing equipment, signage, decals and terminal paper, at no cost or reduced pricing to the University. What other supplies might be offered with this type of arrangement?
9. Do you offer transaction processing via cellular swipe terminal? If so, please describe the setup process of a cellular device, including the establishment of the associated cellular account for that device.
10. Can your company offer or recommend any Point-to-Point Encryption (P2PE) solutions that are certified PCI DSS compliant and listed on the PCI Council website as a certified compliant P2PE solution? Please provide details for any recommended solution.
11. Please list all internet gateway service providers currently integrated with your processing system.
12. Do you offer an internet payment gateway solution? Please list any internet payment gateway service providers for which you are a reseller of their services? Do you have a preferred internet gateway service provider?
13. Can you offer or recommend any shopping cart and/or payment form solutions along with your recommended internet payment gateway solutions?
14. Please describe any alternative online payment solutions your company can offer or recommend.
15. Does your company currently offer a mobile payment solution that gives a merchant the ability to process transactions generated through the use of smart phones/tablet PCs, etc., that is PCI DSS compliant certified and included on the PCI DSS Council website?
Disaster Recovery
16. Describe your local back up and/or redundant systems.
17. Describe your “hot-site” back up capabilities in case of a complete site failure. How often are they tested?
18. Describe the last time that use of your back up system was required, the circumstances and the length of time the backup system was in use.

1. Describe your customer service philosophy. Describe your customer service organizational structure. Is the customer service function performed in-house, or is it outsourced?
2. Describe the promotional support you provide (e.g., signs, supplies, funds for specific purposes, advertising allowance). Is there any additional cost for this support?
3. Will a specific customer service representative be assigned to handle this business? Describe the responsibilities of the customer service personnel, including the chain of command for problem resolution. Identify the support staff and percentage of their time to be dedicated to the University of Kentucky. Describe where these people are located and their availability.
4. Do you hold regular meetings with customers to review the service? If so, describe the frequency and topics of discussion.
5. Explain the process for adding new locations and closing existing locations (e.g., assignment of merchant IDs, toll-free phone numbers, communications, turnaround time to add/delete
