Important information about this form – please read

Use of this form

This form is for use where you are applying for Countryside Stewardship (CS) and you do not have

management control over part/all of the land included within your application for the entire length of any

agreement (and any durability requirement) which would result from the application, should the

application be successful. You therefore need to make a countersigned application with the individual(s)

who will take over your responsibilities under any resulting Countryside Stewardship agreement on the

relevant land.

You must complete a separate form for each counter signatory required for the land in your application.

How to fill in this form

You must complete Part 1 and read and sign the Declaration in Part 3. Your counter signatory must

complete Part 2 and read and sign the Declarations and Undertakings in Part 2, Section 4.

Please use black ink and CAPITAL LETTERS. Do not use pencil or felt-tip pen.

Do not cross through whole pages or remove pages.

If a mistake is made,

do not use correction fluid. Make your alterations in block capitals and black

ink and initial and date them. For boxes with a ‘

or ‘x’, completely fill in the square box containing

the mistake and add your initials and the date. Put a ‘

’ in the correct box.

Please check that you have filled in all sections, answered all questions that apply to you and

attached all supporting documents.

Counter signatory’s undertakings

In countersigning this Countryside Stewardship application I confirm that:

I undertake that if the applicant(s) named in Part 1 ceases to have management control over the land declared in Part 2, Section 3 at any time before the completion of the full term of any agreement (and any durability

requirement) resulting from this application, including, but not limited to, where I/we terminate the applicant’s possessory interest in or control over the relevant land, I will from the date of such cessation ensure that all of the obligations under the agreement will be properly fulfilled for the full term of such agreement (and any durability requirement).

Where I have failed to fulfil the obligations identified in the previous paragraph (such as non-compliance with the agreement) or where Natural England reasonably believes that false or misleading information has been given by me in this application form or in subsequent correspondence relating to this scheme, the agreement may be terminated by Natural England, and I agree to repay on demand, with penalties and interest, any payments received by me or the applicant(s) under the agreement.

In addition, I undertake to:

• allow access to any land and any relevant records to which the application relates for the carrying out of an inspection or audit in order to verify the accuracy of any information provided to Natural England and to ensure compliance with these undertakings;

• provide any additional information as may be required by Natural England or inspectors or auditors and co-operate with or take part in any economic environmental or other monitoring and evaluation of the scheme (including any research and development studies) conducted by Natural England or their appointees for that purpose.

This declaration and undertaking must be signed by a party/parties having full capacity and authority to bind the counter signatory named at Part 2 of this form or by an agent who has written authority from the counter signatory.

Using and sharing your information

The data controller is Natural England, 4th Floor, Foss House, Kings Pool, 1-2 Peasholme Green, York, YO1 7PX.

Your information will be stored and processed in accordance with the Data Protection Act 1998. This Act gives you, as an individual, the right to know what data we hold on you, how we use it, with whom we share it and to ensure that it is accurate.

We will use the data for administering and analysing applications, agreements and claims under Countryside Stewardship. We will circulate and discuss it, in confidence, with those persons or organisations helping us to assess and monitor applications, agreements and claims. Some information will be shared with other grant distribution bodies and government departments, to enable them to detect fraudulent applications, agreements and claims and to co-ordinate the processing of complementary applications, agreements and claims. To do this, we may have to discuss applications, agreements and claims with third parties or disclose information about funding decisions.

Participation in Countryside Stewardship involves expenditure of public money and is therefore a matter of public interest. We make information about Countryside Stewardship applications, agreements and claims publicly available, in line with European Regulations, for example on a website such as www.magic.gov.uk. Details disclosed may include, but are not limited to, your name, the name and address of your farm or business, postal town/parish, first part of your postcode, grid references, the total area under agreement, the payments you receive, the location of parcels, details of the environmental features and management options they contain and details of inspections by Defra or its agents. On request, copies of individual applications and agreements will be made available.

We, or our appointed agents, may use the name, address and other details on your application form to contact you in connection with customer research aimed at improving the services that we provide to you.

We will respect personal privacy while complying with access to information requests to the extent necessary to enable Natural England to comply with its statutory obligations under the Environmental Information Regulations
