Goods may only be returned to Ravensdown with Ravensdown’s prior written consent and any proposed return must be notified to Ravensdown within fourteen days of receipt of the goods. Should Ravensdown discover that there is no material defect in the goods supplied, Ravensdown will have the right to charge the customer all costs of delivery, return and a handling fee.

Fluorosis: Phosphate fertilisers contain fluoride. Avoid grazing topdressed pasture for 21 days after topdressing or until 25mm of rain has fallen, to minimise any risk of stock deaths due to fluoride toxicity.

Potassium and hypomagnesaemia: Applying potassium to pasture in late winter/spring, particularly around lambing or calving time, can contribute to grass tetany

(hypomagnesaemia) in pregnant and lactating stock. To avoid this risk, do not apply potassium during this period.

Risk

All prices exclude GST and charges for stores and freight. Prices are those applicable on the date of despatch. All quotes will be valid for the working day of the quote only. The direct debit price reflects a 1.5% discount for farmers paying by direct debit. Purchases less than 1/2 tonne which are not purchased on an account (eg cash sales) may be subject to a premium.

Prices of special mixtures, outside of the standard product range, are available on request (minimum order one tonne). The exact formulation of the mixture is to be expressed in terms of percentage (or kg per tonne) of each component per tonne of mixture; and the special mixture order must be signed by the purchaser or his/her agent prior to formulation and despatch.

Nitrogen products mixed with super-based products have the propensity to become lumpy even in relatively short periods of time. Applications should take place promptly. Segregation may occur when mixed with product with differences of particle size. This should be considered by the applicator when determining the appropriate bout width for spreading product blends of this nature and Ravensdown recommends the equipment and the operation thereof should at least meet the Spreadmark™ minimum performance.

Lime and hypocalcaemia: Applying lime to pasture in late autumn/winter, particularly in the last three months of pregnancy can contribute to milk fever (hypocalcaemia) in lactating stock. To avoid this risk, do not apply lime during this period.

Fluoride and cadmium levels: All Ravensdown products contain less than 270g fluoride and 280mg cadmium per kg phosphorus.

The following Terms of Trade apply to farmer customers only. These Terms of Trade shall apply to all supplies of goods and services by Ravensdown.

Changes to these Terms of Trade will be notified by Ravensdown giving one month’s written notice of the changes.

Returns Mixtures

Ownership of Goods / Security Interest

Supply

The property in any goods shall not pass to the customer (notwithstanding that the risk has passed on despatch as above) until the goods and any other goods supplied to the customer have been paid in full. The customer grants to Ravensdown a security interest in the goods as security for all amounts owing by the customer to Ravensdown and the performance of the customer’s obligations under these Terms of Trade. The customer shall ensure that the goods are always able to be identified from any other goods in the customer’s possession. If any such goods are sold prior to payment therefore (including if they become constituents of other goods) then the proceeds of the sale thereof shall remain Ravensdown’s property.

Ravensdown shall not be responsible for delays in delivery due to any events including problems with cartage or any other events beyond Ravensdown’s control. Ravensdown may, at its absolute discretion, deliver up to 3% more or less than the amount ordered subject to an appropriate adjustment to the price payable. Ravensdown also reserves the right to refuse or cancel any order by informing the customer in writing.

All technical advice provided by Ravensdown is given in good faith but without warranty. The customer must satisfy itself as to the suitability for the intended purpose and use of all goods supplied by Ravensdown. All warranties and representations including those expressed or implied by law are expressly excluded to the maximum extent permitted by law. Should liability be established, notwithstanding this exclusion, it shall be limited to the value of the goods or services supplied.

Risk passes from Ravensdown to the customer on dispatch of goods from which time the goods will be at the customer's risk notwithstanding that payment for such goods may be payable in whole or part at a later date.
